A discussion of old business was led by Harry Capwell with participation from the board. Old Business: A motion was made by Debbie Walker, because the prior minutes did not list the approved signers by name, for the Secretary to draft a resolution documenting the authorized check signers for The resolution will be given to the bank to allow the authorized people be included on the HOA account signature cards. All members of the 2013 Board shall be authorized check signers. First: Harry Capwell, Second: Danny Jones, the Board unanimously approved. Authorized signers, effective January 1 December 31, 2013, shall be as follows: Harry Capwell, current signer; David Scroggs, current signer; Tom Newburn, current signer; Ava Bailey; Christine McGlynn; Danny Jones; and Hugh Summers. Video surveillance signs for the entrances are on order per Dave Scroggs. Qty. 2 bicycle racks will be ordered by Dave Scroggs. Budgeted in 2012, to be realized in A change in the type of repair at the St. Andrews Rd. playground was decided. Instead of PVC pipe, landscape ties shall be used as a border to stop golf carts from entering play area. Playground border material pricing to be obtained by Harry Capwell and submitted to the Board for approval. Work to be performed when material purchase is approved.
2 Dressler Rd. playground work, scheduled for November 2012 has not yet been completed. Rare Earth has been approved to do the work, and needs to schedule a completion date. Treatment for ants will be scheduled with the landscape company monthly; additional treatments shall be applied by Tom Newburn as needed. Irrigation at both entrances was damaged during the Fort Howard Road construction in The City of Rincon has been notified of the damage and the City needs to schedule repairs. Harry Capwell is pursuing remedial action. Poles for traffic and street signs within Lost Plantation are to be reviewed for maintenance and/or replacement with architectural poles by Tom Newburn. Maintenance activities are also to include installation of top finials where missing, and replacement of misspelled or worn street signs. Yard of the Month committee to be chaired by Ava Bailey with Christine McGlynn. Flags and poles to be installed at entrances. Lost Plantation entrances and both sides of fencing along Fort Howard Road to be pressure washed to remove staining, mold and algae. Common areas and lots need to have trees trimmed and debris removed. Earthmark was solicited to quote this work and has not yet done so. Danny Jones to obtain quotes for both projects and present for Board approval. The need for a second dumpster during neighborhood cleanup events was discussed to address the problem of overflow that occurred during December Thank you to Harry Capwell for volunteering his services to compact the dumpster contents and remove overflow refuse that was not collected with the dumpster! Tennis court repairs are on hold pending action by the City of Rincon to repair or replace/relocate the underlying sewer pipe responsible for the subject damage. Harry Capwell has discussed need for the repair with the City throughout 2012 with no result. The City Manager had accepted the responsibility for the repair, but in recent conversations has been less specific. The board approved engaging Mickey Kicklighter to send a letter of notice to the City demanding that the City schedule work necessary to repair the underground pipe; Harry Capwell has been assigned this task. The City Manager discussed with Harry Capwell moving the drainage pipe, now located under the tennis court, to the area under the cart path bordering the pool and tennis court. Concern was expressed regarding timing of the repairs in conjunction with pool season. It was also decided to assign a Board member, volunteer not currently identified, to be responsible to pursue the City s scheduling and completion of the work pool inspection and licenses paperwork to be completed by Weed Pools and submitted to the City of Rincon by the deadline January 31. Harry Capwell will schedule in concert with pool committee members Jason Pridgen and Don Fletcher. A detailed statement of work needs to be written and included in the 2013 landscape contract for maintenance of common area grounds. The currently proposed Earthmark contract does not outline the updated scope of work for Earthmark s contract proposed an increase in the annual cost, which
3 the 2012 Board had no objection to; however, because of the lack of response by Earthmark to update the current proposed contract and provide quotes for additional work needed in the neighborhood, the Board approved seeking competitive bids for the 2013 landscape contract, to be solicited by Danny Jones. The Williamsburg amenity cost share program was discussed. Debbie Walker provided a historical account and legal/financial perspective. The original 30 Williamsburg homeowners were offered the opportunity to use the Lost Plantation amenities under a cost share program. For participating homeowners, an impact fee of $1500 was paid to Lamar Smith. In 2009, Lost Plantation assumed individual invoicing of participant homeowners. Homeowners that did not pay the annual assessment were permanently dropped from participating in the program. Lost Plantation does not currently have any collection remedies for the Williamsburg homeowners who do not pay the cost share, with the exception of assessing a late fee and dropping their participation. Changes in ownership of homes in Williamsburg have generated new interest in joining/rejoining the cost share program. A local real estate agent told a 2012 home purchaser that they would be allowed to participate in the cost share program when the prior homeowner had notified Lost Plantation a few years earlier of their desire to be dropped from the program (they were dropped and they discontinued paying the cost share). The current policy is that once a homeowner fails to pay the annual assessment, the home is permanently dropped from the program and is not allowed to rejoin at a later date. The 2012 Board approved allowing Williamsburg homeowners the opportunity to join the cost share program and use Lost Plantation amenities by signing a contract with Lost Plantation that requires them to continue participation or be subject to collection remedies consistent with remedies used for collection of fees from Lost Plantation homeowners. Because Lost Plantation does not have access to the original records of addresses that participated in the program and paid the $1500 impact fee, the current proposal does not include a catch up clause to recoup any prior non-payment of cost share assessments or new impact fees for homes that originally did not have the fee assessed. There was some confusion concerning the specific handling of this new offering, which resulted in a new discussion of the topic, which included the following questions: Is there an impact from the increased volume of people using the pool with respect to the size of the current pools? Harry Capwell indicated that if volume requires it Lost Plantation would have to build another pool. Should current homeowners that originally participated for some period of time and then dropped out of the program be allowed to participate? Harry Capwell indicated that records from prior years are not complete and it would not be possible to identify these homeowners, therefor they should not be excluded from rejoining the program. Harry Capwell also indicated that the contract is valid for the current homeowner and any transfer in property would require the following homeowner to sign a contract to participate; the agreement is not transferrable.
4 A motion was made to continue the amenity cost share program with original homeowners currently in good standing, grandfathering their original terms of agreement; and also to allow current nonparticipating Williamsburg homeowners the opportunity to join the Lost Plantation amenity cost share program ONLY under a signed, non-transferable contract with right of collection, as described in the Lost Plantation collection policies and covenants, and the payment of assessed annual dues and fees. The new participating homeowner does not have the option to drop out of the program. First: Harry Capwell, Second: Dave Scroggs; the Board unanimously passed the proposed program. Harry Capwell will contact Mickey Kicklighter to draft the contract and then present it to the Board for approval. New Business: Debbie Walker, Bookeeper Debbie Walker distributed a copy of the current financial statement to the Board. The 2012 ending cash balance is $93,016. The ending balance was greater than the estimated $82,000 because work scheduled to be completed before year end was not completed and has been moved to Net proceeds exceeded budget by $28,406 due to estimated costs exceeding actual costs and increased revenue over budget; and the repair of the tennis courts was moved to Debbie Walker noted that there has been no change to the collection list naming those homeowners with outstanding balances due. Debbie will meet with the HOA attorney regarding collections and report back to the Board. A homeowner on St. Andrews Road has inquired to the possibility of purchasing the common open space located next to their property in connection with an offer for the sale of their home. The property is small and is currently zoned as open space (not allowed any improvement on the property). The Board unanimously agreed to consider selling the property, but needs additional information. Dave Scroggs is going to contact the real estate agent and have the buyer s attorney review Lost Plantation Covenants and Bylaws to determine if the Board has authority over the sale of the property. In addition, selling property is a non-related business activity for the HOA. The attorney will be asked to determine what the tax effect of a sale of property would have on the non-profit status of the HOA, and any taxes due as a result of the sale. All articles and items to be put in the next newsletter need to be submitted to Debbie Walker on or before 19 February The newsletter is scheduled to be mailed in early March Dave Scroggs, Vice President Dave Scroggs requested assistance in coordinating neighborhood security patrols under agreement with the Rincon Police Department. This program has not started yet. Harry Capwell will assume scheduling and control of the program with the Rincon Police.
5 Several complaints have been made by residents regarding safety on Merion, Walthour and St. Andrews roads. The new Rincon Police Chief told Harry Capwell the police cannot issue tickets for speeding, with the exception of St. Andrews Road. Tickets can be issued for running stop signs within the neighborhood. The state conducts a survey to list streets that are allowed to be monitored by the Rincon police; the remaining streets in Lost Plantation have been submitted for approval (this process only occurs every 3 years). The City installed the required signage to allow the police to enforce stop signs and speed limit; however, they are unable to enforce the speed limits at the current time. Further discussion with the Chief of Police is required. Mitigation of speeding in the neighborhood was discussed, including increased patrols in problem areas, installation of additional stop signs at several intersections, and speed tables. Further discussion shall be conducted at the February board meeting. Tom Newburn, Board Member and Architectural Review Chairperson Tom received several ARC requests including gutter installation, fences and sheds. All of these were approved. Three violations were noted and residents will be receiving notification/violation letters.
