1 CITY OF BOISE TO: FROM: Mayor and Council Department of Finance and Administration RESOLUTION NUMBER: R DATE: August 21, 2009 SUBJECT: Approval of Contract; SS ; Animal Control Services, to Idaho Humane Society for FY 2010 in a total annual amount not to exceed $737,106 and for FY 2011 in a total annual amount not to exceed $760,800. ACTION REQUIRED: Contract Approval by Resolution. RECOMMENDATION: Department of Finance and Administration recommend that a Sole Source contract be awarded to Idaho Humane Society for FY 2010 in a total annual amount not to exceed $737,106 for FY 2011 in a total annual amount not to exceed $760,800. FISCAL IMPACT/BUDGET IMPLICATIONS: Financial Services has confirmed sufficient funding is available for this obligation. BACKGROUND: Requesting approval for Animal Control Enforcement and Shelter Services 7 days per week. Also included is Educational and Community Outreach Services. Animal Control s top priority is to attempt to reduce animal related violations and achieve an increase in voluntary compliance with Code-stipulated regulations. This goal will be achieved by vigorous and prompt enforcement, public education and positive reinforcement for responsible pet owners who abide by the law. Mutually we seek to reduce the number of animals relinquished to shelters and expand the spay and neuter program. The expected outcome of these goals is the increased licensing rate for the City of Boise. This is a sole source request due to the fact that The Idaho Humane Society is the only agency providing comprehensive animal control services in the City of Boise s defined area of local preference. SOLE SOURCE PURCHASE: Department of Finance and Administration staff recommends that this purchase be declared a Sole Source Purchase. Idaho Code authorizes the Mayor and City Council to approve a Sole Source purchase when it is determined that there is no functional equivalent, and where competitive solicitation is impractical, disadvantageous, or unreasonable under the circumstances. BY THE COUNCIL: BISTERFELDT, CLEGG, EBERLE, JORDAN, SHEALY AND TIBBS A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY OF BOISE CITY, AN AGREEMENT FOR SS ANIMAL CONTROL SERVICES, DEPARTMENT OF FINANCE AND ADMINISTRATION, BETWEEN THE CITY OF BOISE CITY AND THE IDAHO HUMANE SOCIETY, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Department of Finance and Administration recommended approval of SS Animal Control Services, to the Idaho Humane Society; and, WHEREAS, during their meeting of 10/24/06, the City Council followed staff recommendation and awarded Resolution No , SS Animal Control Services, Department of Finance and Administration to the Idaho Humane Society; and, WHEREAS, Department of Finance and Administration staff believes and Idaho Humane Society has agreed to continue the contract for FY 2010 and 2011 under the terms and conditions as specified in the attached contract. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the Contract by and between the City of Boise City and the Idaho Humane Society, for SS Animal Control Services, which is attached hereto and incorporated herein by reference, be, and the same hereby is, approved both as to form and content. Section 2. That the Mayor and City Clerk be, and they hereby are, authorized to respectively execute and attest said Agreement for and on behalf of the City of Boise City. Section 3. That this Resolution shall be in full force and effect immediately upon its adoption and approval ADOPTED by the Council of the City of Boise, Idaho, this day of September, R
