COPIES OF TAPES ARE AVAILABLE BY CONTACTING CENTRAL PUBLICATIONS, AT (213) The meeting was called to order by Commission Vice President, Curtis Fralin, at 4:30 p.m. Commissioners present: Tisha Greene and James Silcott. ZA (CUB)-A1 APPEAL of the entire determination of an Associate Zoning Administrator s denial pursuant to Los Angeles Municipal Code Section W,1 of a conditional use permit to allow the sale and dispensing for consideration and on-site consumption of a full line of alcoholic beverages in an existing restaurant and nightclub on Lot 382 (which currently sells beer and wine) with proposed hours of operation between 10:30 a.m. to 2:00 a.m. seven days a week. Staff recommends denial of the appeal. Staff conducted an overview of the project. The request, written and verbal by the applicant is to attract more patrons and provide a larger service. This will also attract more patrons. Staff corrected Finding #4 to read On-sight not Off sight #5 should be Not an undo concentration. The Finding is accurate, there was a typographical error Staff testified that the findings could not be made. At the public hearing a lot of information provided by the applicant was his contribution to the community and charity work. This is great and commendable when a business person could participate in the community but not germane to the case, it does not address the land use issues. Applicant testified that he lived in the area for 7 years. APPELLANTS REPRESENTATIVE testified the reason for the application is to upgrade the business and improve the property value in the area. There will be nice dining and a musical club. The owner has done charitable things for the community. Request the Commission to grant the appeal with some self imposed conditions presented at today s meeting. Several spoke in support of the appeal, those that worked at the establishment. One that upgrading the liquor license will give the club an upscale clientele. stated Council Representative stated if the appeal was approved the Commission could add the following conditions; 1) The business does not open before 6:00 p.m.; 2) No parking for film crews on the South side of Adams; 3) Management to maintained cleaning around the building South end to the West end; 4) No loud music. Several spoke in opposition stating, they were not invited to the proposed meeting by the owner, the noise is unbearable. A speaker stated she contact the police on several occasions and spoke with the area Watch Commander, due to the noise and private parties in the alley.

Parking is an issue during the filming at the location, which leaves no parking for the residence. Several stated they were opposed to the granting of a full liquor license. CLOSE PUBLIC HEARING DELIBERATION: Commissioner Silcott made a motion to Grant the Appeal. There was no second the motion failed. Commissioner Fralin made a motion to Deny the Appeal and Sustain the action of the Zoning Administrator. There was no second, the motion failed. Commissioner Green made a motion to Grant the Appeal and impose conditions. There was no second, the motion failed. Commission Silcott reintroduced his motion to Grant the Appeal. No second the motion failed. Commissioner Fralin reintroduced his motion to Deny the Appeal, Commissioner Green seconded. Vote 2-1 Failure to Act. The decision of the Zoning Administrator stands, Denial of the request. Page 3
