2 WHAT S NEW? Creation of Kansas Trucking Connection The Kansas Corporation Commission Motor Carriers Section, the Kansas Department of Transportation Oversize/Overweight Special Permits Section, and the Kansas Department of Revenue Motor Carrier Services Bureau are in the process of relocating all their respective staff and offices into one site at 1500 SW Arrowhead Rd., Topeka, KS. This new office is designed to progressively improve and simplify the services currently provided to our customers with the creation of a One-Stop-Service. There will be one main phone line and one main fax line at the Kansas Trucking Connection. At the current time, these departments will act independently to meet existing statutory requirements and collaboratively to meet customer needs. The Kansas Department of Revenue IFTA Bureau will not be included in this move. However, the MCSB staff will continue to provide the same IFTA assistance as they have in the past. Future developments include: creation of one carrier application form to obtain registration, IFTA, and KCC compliance; improving documentation processing by scanning and imaging systems; cross-training staff of the various duties performed by these departments so that a customer may be helped on first contact by one staff associate to obtain Oversize/Overweight Permits, IRP registration, IFTA, and KCC compliance; and offering training to increase usage of Internet processing to meet customer needs at their convenience. TOTAL REISSUE OF ALL IRP PLATES IN 2005 During the 2005 IRP Renewal all IRP accounts will be issued new license plates for their trailers and power units. Please renew early to get your new your tags and new cab cards on and in your vehicles by the March 1, 2005 deadline. Watch for the development of obtaining IFTA decals on-line in January Apportioned Registration Refunds on Sold Leased Vehicles Effective 04/02/2004 the MCSB will process refunds on vehicles leased on to Kansas IRP accounts when the vehicle has been sold, repossessed, foreclosed by mechanic s lien, title transferred by operation of law, or the owner is deceased and the deleted vehicle is not going to be replaced by another vehicle. The required documentation is outlined in this book under refunds. For example, a copy of the bill of sale is required to be provided with the properly completed and notarized Application for Refund of Kansas Apportioned Fleet Registration form (MCS-105) for sold vehicles that are being deleted from the account. The MCS-105 application is designed to be completed by an authorized representative of the IRP account and the Federal Tax Identification Number required and provided on the MCS-105 will be for the IRP Registrant since the refund will be sent to the IRP registrant. 1

Any motor carrier, permit company or individual with an escrow account from Central Permit and a Motor Carrier INK subscription may purchase permits. Getting Access You need an Escrow account, a user name, and a password. To get an escrow account, fill out the escrow form or contact Central Permit at (785) To get a user name and password, fill out the Motor Carrier Subscription form and download the terms and agreement or contact the Information Network of Kansas at KANSAS or (785) These forms are available in this book. There is a $50 minimum deposit to open Escrow account if you only plan to do IRP transactions. You will receive a letter advising you to deposit funds when your Escrow account balance drops below $25. There are no other charges involved in getting your access set up. What is the Information Network of Kansas (INK)? Is the primary Internet provider for many state agencies, you may visit them at Some services provided by INK require a subscription, for subscription information logon to: Why Would I Want To File On-line? Internet supplement processing It is easy to do and it allows you to add vehicles, transfer vehicle fees, add jurisdictions, increase vehicle weights, and replace lost credentials (cab cards and license plates) at your convenience. After you have submitted the information you will be able to print off the necessary documentation to get your vehicle on the road. The next day (unless it is a holiday, weekend, or your entry occurred after 6 PM) your billing invoice will be available for you to printout for submission to our office with the required documents and payment. You enter the information prompted one time and the system will create the Schedule C and Title Application forms for you to print off. You will continue to have 30 days to complete the process and receive your credentials. There is no charge for replacement cab cards. INK charges a $1.00 transaction fee. The replacement license tag fee of $6.50 plus the $1.00 INK processing fee includes the cab card and plate and is deducted immediately from your Escrow account, which allows us to promptly mail your replacement tag to you. Payments of IRP Internet Supplements and Renewal Invoices The next business day after you have completed your on-line transaction you will be able to pay your invoice with an E-check. This means you provide your personal checking account routing number and the fees will be automatically drafted out of your account. 2

4 IRP Renewal Processing As of December 2002 we encouraged all of our IRP accounts to file their renewal on-line. You do not need an Escrow account to process your renewal on-line. You will need your IRP account number and your PIN annually assigned by MCSB off the forms we mail to you. It is designed to allow you to return to the session and complete your processing if you get interrupted. After your renewal has been created you can resume processing supplements on-line. When Would I Not Be Allowed To File On-line? If your IRP account balance exceeds $ due you will not be able to process renewals on-line. Letter size Cab Cards Effective August 28, 2002, Kansas began producing our cab cards printed on standard letter size 8 ½ x 11 white paper. Law enforcement and IRP was informed of this change. The 2004 renewal cab cards displayed the Kansas State Seal watermark in the background as a security enhancement. 7 IMPORTANT INFORMATION When you call us to verify or search information to assist you, please have your IRP Account Number and your license plate number, or vehicle identification number ready. SCHEDULE C SUPPLEMENT APPLICATION The schedule C form is used to add vehicles, transfer vehicles, and delete vehicles. Use this Checklist to know what items should be sent with SCHEDULE C Form: ADDITIONS 1. Provide the proof of ownership via: original title if assigned on the back to new purchaser OR Manufacturer Statement of Origin OR provide a front and back copy of the clear title with the owner s name printed on the front side of the title. 2. Provide a VIN (Vehicle Identification Number) Inspection that has been completed by the Kansas Highway Patrol or another state s law enforcement for an out of state title. 3. Notarization is needed if the vehicle is purchased from a notary state. (AZ,KY,LA,MT,NC,OH,OK,PA,WY) 4. All liens must be released and notarized if required by a notary state. (KS,WV,WY) 5. If the vehicle you are adding has just been purchased (it does not have a clear title), you will need to provide a Sales Tax Exemption Number or the Sales Tax Payment, and surrender the current title. If you need to apply for exemption of Sales Tax Payment, you will also need to provide a completed Business Tax Application and a copy of the current Lease Agreement between both parties. NOTE: the name on the lease agreement, the business tax application form and the title must match exactly. In order to apply for exemption, our office must receive these forms within 30 days of the date the vehicle was purchased. Once your Business Tax Application has been processed, you will receive your Sales Tax Number. Leasing to a Private Carrier you will need to pay Kansas Sales Tax. Leasing to a For Hire Carrier you will need to provide a Kansas Sales Tax number, or completed business tax application form. Company owned will pay sales tax if a Private Carrier. Company owned with current For Hire Authority may use their KCC authority number or MCID Number to apply for exemption of sales tax. 6. Provide a completed and signed title application form if adding a newly purchased vehicle with an assigned outstanding negotiable title or adding a vehicle with an MSO (Manufacturer s Statement of Origin form). 7. Heavy Vehicle Use Tax needs to be provided if the vehicle was purchased 60 days or more days ago. TRANSFERS Fees transfer on vehicles not the tags. 1. Return the license plate and cab card of the deleted vehicle. 2. List date of deletion and the reason it is being deleted. 3. Complete the addition section with the new vehicle information. 8 INTRODUCTION IRP INTERNATIONAL REGISTRATION PLAN Kansas is a member of the International Registration Plan referred to as the IRP. Members of the IRP include all of the United States as well as Canadian jurisdictions. Under the IRP an owner of a Kansas based vehicle or fleet shall make application for apportioned registration only to Kansas. Kansas will provide each IRP jurisdiction information contained in the application. Vehicles registered under the IRP shall be deemed fully registered in all jurisdictions for both inter-jurisdiction or intra-jurisdiction movement. Kansas shall determine the percentage of miles operated in Kansas and each IRP jurisdiction to the total miles operated in all jurisdictions. The percentages applicable to the registration fee of each jurisdiction will be calculated and a billing notice covering registration will be issued. An optional breakdown of registration fees by vehicle is available on more than one vehicle. The enclosed original application is to be completed according to the instructions on the back of the form. If you had a fleet with Kansas apportioned registration for the previous registration year; the renewal application is a printout based on that information. If any changes have occurred they must be noted on this application. IMPORTANT DATES The registration year for Kansas apportioned vehicles is January 1 through December 31 each year. Kansas apportioned registration renewal applications are sent out of our office Mid December each year. Please review the renewals for accuracy and make required changes and return them to our office as soon as possible or process your renewal on-line. We process renewals by date of receipt. Please remember these dates so that if you do not receive your next renewal packet in the mail you will need to contact us. We encourage renewal payment prior to February 15. Waiting to pay fees until the expiration of the grace period, March 1 does not allow adequate time to receive new cab cards and license plates. 7 Quarterly payment may be an option if received and paid in our office on or before March 1. Full fees are assessed March 2. The enforcement deadline for each renewal will begin March 2 of each year. Any vehicle that has not registered, which is required to be registered prior to that date, shall be subject to a penalty of $2 for each vehicle. Vehicles in the possession of the owner on and after January 1 of a registration year are subject to registration for that year. CREDENTIALS Kansas shall issue a cab card describing each vehicle in the owner's fleet and a license plate. The cab card shall also indicate the name of each IRP jurisdiction with which the fleet owner is apportioning the registration of a fleet. The base IRP jurisdiction shall be the only jurisdiction to issue credentials. When you receive your credentials from us, check your cab cards for correct information. Your cab card describes your vehicle, where you go and the maximum weight in each apportioned jurisdiction. If the information is not accurate you may be ticketed and fined. Keep your IRP cab card in your vehicle. A photocopy of your IRP cab card is not valid. Display your apportioned plates on: The front of tractors. The back of straight trucks The back of all trailers. Keep the original cab cards with the vehicle assigned. Permits Carriers who have Internet service will now have the option to receive their IRP temporary registration permits sent electronically to their service. Also, the Central Permits Section offers the option of sending the permits they issue electronically. Customers will need to provide their address and it will be their responsibility to provide updates regarding address changes.

You can use a permit service, establish an escrow account, use Western Union Quick Collect, or use VitalChek credit card processing with MasterCard, Visa, Discover Card, or American Express. New accounts must be in the office by 4:00 PM. 8

10 PAYMENT SERVICES WESTERN UNION QUICK COLLECT Carriers who prefer to pay accounts quickly can use the Western Union Quick Collect. This service is less expensive than any of the express companies. Your payment is usually received within the hour of your visit to a Western Union location. Take cash to the Western Union Agent nearest you and the transaction will cost $12.95 for up to $5,000. They also accept credit cards for Quick Collect and you may call Western Union however fees are more expensive and vary in price. For up to $2,000 fees are $95. CASH OPTION: Call for nearest agent. Take cash. Identify as a quick collect customer. VITALCHEK VitalChek is a credit card servicing company that enables our office to process your credit card for a fee that is charged on your account. You may use your credit card in our office or provide us your credit card number by phone to pay your IRP bill or to order a permit from our Permit Section. You may use MasterCard, Visa, Discover, or American Express through VitalChek. VitalChek will add a processing fee on your credit card bill at the time the transaction is processed in our office. VitalChek Fee: 2.5% of the total amount billed or a minimum $7 fee, which ever is greater. E-Check Payments IRP Supplements and Renewals that are created on the Internet are eligible for e-check payments. The next business day after you have completed your on-line transaction you will be able to pay your invoice with an E-check. This means you provide your personal checking account routing number and the fees will be automatically drafted out of your account. 11 REGISTRATION INFORMATION Kansas based apportioned registration includes the following types: REGISTRATION To be an apportioned IRP registrant, you must have a vehicle(s) that will operate in Kansas and one or more member jurisdictions. You may register a power or trailer fleet in Kansas if you have an established place of business in Kansas. (a) "Established Place of Business" means a physical structure owned, leased or rented by the fleet registrant. (b) The physical structure shall be designated by a street number or road location, be open during normal business hours, and have located within it: (1) a telephone or telephones publicly listed in the name of the fleet registrant, (2) a person or persons conducting the fleet registrant's business, and (3) the operational records of the fleet (unless such records can be made available in accordance with the provisions of Section of the Plan). Your fleet must accumulate mileage in Kansas and the operational records for your vehicles must be kept or made available for audit in Kansas. (a) "Apportionable Vehicle" means any vehicle, except recreational vehicles, vehicles displaying restricted plates, city pick up and delivery vehicles, buses used in transportation of chartered parties, and Government-owned vehicles, used or intended for use in two or more member jurisdictions that allocate or proportionally register vehicles and is used for the transportation of persons for hire or designed, used or maintained primarily for the transportation of property and: 1. Is a power unit having two axles and a gross vehicle weight or registered gross vehicle weight in excess of 26,000 pounds or 11, kilograms; or 2. Is a power unit having three or more axles, regardless of weight; or 3. Is used in combination, when the weight of such combination exceeds 26,000 pounds or 11, kilograms gross vehicle weight. Trucks and truck tractors, and combinations of vehicles having a gross vehicle weight of 26,000 pounds or 11, kilograms or less and buses used in transportation of chartered parties may be proportionally registered at the option of the registrant. Optional Registration Kansas shall accept at the option of the carrier. Two axle commercial trucks operated intrastate in other jurisdictions in excess of 12,000 lbs. PERMANENT TRAILER PLATES Carriers that have a power unit fleet may register their trailers with this office. Trailers will receive a permanent registration plate and cab card. Unless trailers are deleted from the fleet at renewal, Kansas s fees will be billed. Trailer registration can not be transferred. When a trailer is sold or deleted from the fleet the license plate and cab card must be returned to Motor Carrier Services Bureau. When a newly purchased trailer is registered via this office, then a new vehicle license plate and cab card is issued. 10

12 PERMANENT POWER PLATES All power units, except Custom Harvesters, will be issued permanent power plates. Cab cards will be re-issued each year at renewal and if you have quarterly payments, again each quarter. Fees will be billed on all power units at the time of renewal unless you delete the vehicle and return the plates and cab cards to Motor Carrier Services Bureau. If a leased vehicle operates after January 1 fees will be assessed until credentials are returned to this office. RENTAL VEHICLES Rental Vehicle: Base Jurisdiction: The base jurisdiction must be met by the rental company as registrant of the fleet. Rental companies may now register vehicles in their name and long term lease them (over 30 days) provided they lease them without drivers. FARM CUSTOM HARVESTERS Kansas based custom harvesters can register vehicles bearing apportioned registration. This type of registration will be allowed if the following criteria are met: Transport farm machinery, supplies, or both to and from a farm, for custom harvesting operations on a farm. Transport custom harvested crops only from a harvested field to initial storage or to initial market locations. Transport agricultural products produced by such owner or commodities purchased by such owner for use on the farm owned or rented by the owner of such vehicle. The issuance of these account numbers and license plates will be distinguished by using the 800,000 series. ONE WAY RENTAL FLEETS The IRP provides for the allocation registrations of a one way rental fleet consisting of trucks that are rented or offered for rental without drivers on a short-term rental. These trucks have a combined gross weight of less than 26,000 pounds. A one-way rental fleet owner shall complete applications MCS-1A and 1B. List only the trucks that have been allocated to Kansas for registration. The trucks listed shall be a mix of trucks by combined gross weight in proportion to the Kansas mileage percentage applicable. In conjunction with completing and filing the application, the applicant shall include a list of the total vehicles in the fleet including the combined gross weight. All trucks of such one-way fleet so qualified will be allowed to perform both inter-jurisdictional and intra-jurisdictional movements in all jurisdictions. HOUSEHOLD GOODS CARRIERS Household Goods Carriers using equipment leased from Service Representatives may elect to base such equipment in the base jurisdiction of the Service Representative or that of the Carrier. If the base jurisdiction of the service representative is selected, the equipment shall be registered in the service representative's name and the household goods carrier shall be indicated as lessee. The apportionment of fees shall be according to the combined mileage records of the service representative and those of the carrier. Such records must be kept or made available in the service representative's base jurisdiction. If the base jurisdiction of the household goods carrier is selected, the carrier shall register the equipment and the service representative shall be designated as lessor. The apportionment of fees shall be according to the mileage records of the carrier and the service representative, which must include intrastate miles, operated by those vehicles. The records must be kept or made available in the base jurisdiction of the carrier. Service representatives properly registered under this selection shall be fully registered for operations under their own authority as well as under the authority of the carrier. 11

13 BUSES Common carriers of passengers must file and apportion unless the bus is used exclusively for charter. The bus must be marked as "Chartered" and have an itinerary. At the option of the registrant, total miles may be the sum of all actual miles in a jurisdiction or it may be a sum equal to the scheduled route miles per jurisdiction from the farthest point of origination to the farthest point of destination of the scheduled pool. APPORTIONED REGISTRATION EXEMPTIONS Buses transporting chartered parties. Vehicles with restricted registration plates, i.e., "Local," "Farm," "6,000 mile." Charitable vehicles, i.e. not for profit fraternal or religious organizations or an accredited school. Recreational vehicles (personal pleasure). Drive away, Transporter or Dealers. If you did a name change with IFTA during the year you will need to submit this form. We are able to electronically obtain the mileage filed on your Kansas IFTA returns in hopes of saving you the time of writing down this information on our renewal applications. Kansas based carriers must meet the following criteria if applying for Kansas Apportioned farm custom harvesting type of registration: (1) Transport farm machinery, supplies, or both,to or from a farm, for custom harvesting operations on a farm; (2) Transport custom harvested crops only from a harvested field to initial storage or to initial market locations; or (3) Transport agricultural products produced by such owner or commodities purchased by such owner for use on the farm owned or rented by the owner of such vehicle. 14

16 APPORTIONED APPLICATIONS New IRP Registrant The original application consists of completion and verification (by this office) of the following items: Schedule B (MCS-1B) Our office will assign an account number, please retain for future use and identification with our office. Federal Employer Identification Number or Social Security Number. Kansas established place of business (a physical location address is required). Proof of prior registration is required. Type of operating authority issued by the Kansas Corporation Commission. MC authority type and number. OR Owner Operator Registration Requirements: 1. KCC Authority is not required. 2. Provide proof of Insurance. 3. Provide proof of HVUT payment for vehicles registered over 54,000 lbs. 4. Provide proof of payment of personal property tax (obtain from carrier if you were leased on, or from your local county treasurer s office). 5. Provide your valid Kansas driver s license with current Kansas address. 6. Provide proof of business or home address via copy of a current utility bill. 7. Agree to maintain mileage records for their vehicle and report the miles for IRP registration and IFTA (if applicable). 8. Provide actual miles if applicable when account is opened. 9. Must register in at least one other jurisdiction (multiple jurisdictions are anticipated). U. S. DOT number. If you operate a commercial vehicle that crosses state lines you are required to have a US DOT number. Total number of power units to be registered. Total number of trailers to be registered. Quarterly Payment Option of Kansas fees (available each year before March 1). The privilege of paying quarterly installments is voided for 2 years if any payment is delinquent. Optional Registration Fees. Optional Billing Option: a separate listing of costs per vehicle (this is not a billing statement). Estimated miles are used only in the initial year of operation when no prior mileage history exists. The estimate must be an accurate estimate of the future 12-month operation. An explanation is required supporting the estimated mileage figures. Motor Carrier Services will estimate your mileage based on mileage other carriers reported the previous year unless you have documentation to show a proposed method of operation. Schedule A & C Combined (MCS-66). The blank boxes are used to raise the weight in other jurisdictions for more than the registered weight in Kansas and equivalent weight in other jurisdictions, see page 31 for Maximum Allowable Weight table. 18 RENEWAL IRP REGISTRATION Preprinted renewal applications are mailed during December prior to the new registration year in a packet with extra forms and the MCSB Instruction Manual. You should correct and return the Schedule A and B forms. The documents you return will be processed in order of date of receipt and your Renewal Invoice will be mailed to you for payment. Your payment must be received no later than March 1 each year. Schedule B (MCS-1B) Verify the Registrant information for accuracy. If information is missing, i.e., telephone, fax numbers, U.S.DOT number, or needs corrections please provide. Record actual miles driven during the reporting period of July 1, through June 30, of the previous registration year. Place an X in the box of each jurisdiction that you have actual miles for and want to continue apportioned registration. Record actual miles. When you don't have actual miles and you want to add the jurisdiction on your cab card, place an X in the ADD JUR column. 20 INSTRUCTIONS FOR MCS-1B Section 1 -- Mileage Schedule List the actual miles operated, include all miles traveled, in each and all jurisdictions by the motor vehicles of the fleet that are proportionally registered with Kansas during the period of July 1 through June 30 of the fiscal year immediately preceding the new registration year. E.G., the mileage-reporting period for the registration year 2003 is July 1, 2001 through June 30, Mark an "X" in the square of all IRP jurisdictions that you have actual miles AND want to continue the apportioned registration. If you do not put a "X" in the box, that jurisdiction will not be included. If you wish to add a jurisdiction (and do not have actual miles) mark an "X" in the "ADD JUR" column. Our office will enter miles based on mileag that current fleets operate into these jurisdictions. When a new account is established, and there is not a history of mileage, estimated mileage will be used. If the account is established during the period of January 1 through April 30 actual mileage will be required on the next renewal. If the account is established during the period of May 1 through December 31 the estimated mileage used on the initial application, and any added jurisdictions during that period, will be used for the next renewal. 22 REGISTRATION REQUIREMENTS There are qualifications and compliance requirements that must be met in Kansas before an application for apportioned registration may be accepted or any registration issued. Some of the requirements may have already been met depending on the type of authority registered with the Kansas Corporation Commission and the Federal Highway Administration (FHWA). An example of when authority may not be needed: In Kansas if you haul sand, rock and gravel you would be exempt from KCC. If you haul sand, rock and gravel across a state line, you would not be exempt from FHWA authority. It is the individual s responsibilities to contact the state you are working in to verify if you would be exempt in that state. not been assigned over to a different owner than the one on the front of the title). Proof of prior registration must be provided whether Kansas registered or previously registered in another jurisdiction. A lease agreement is required, if the name on the title is different from the registrant name. If the title has been assigned to another owner, a completed Kansas Title application form shall be provided. (Refer to Application for Kansas title section). INSURANCE OWNERSHIP Effective Kansas s statutes changed to allow Kansas to register a vehicle in the name of a lessor or owner-operator. An owner-operator, who meets the required criteria, may obtain Kansas registration by opening an account with our office and operate under the lessee's authority. This allows the owner-operator to purchase his own Kansas registration and receive credentials as the Registrant. For purposes of registration in Kansas, the Owner is the person or company who has the right to control the operation of a vehicle. If the vehicle title is in a different name than the Registrant name the vehicle is considered a leased vehicle. The lessee is responsible for the operation of the vehicle and shall be considered the owner and not the owner of the legal title. TITLE Proof of ownership is required for each fleet vehicle. Proof of ownership may be satisfied by providing a Kansas Title, a Kansas County Receipt, a Kansas E-title, a title issued by a jurisdiction other than Kansas, a Manufacturer Statement of Origin, or a copy of the front and back sides of the title (if the back of the title has Financial security (liability insurance) as required by Kansas s law must be maintained continuously throughout a registration year on the vehicles that constitute a fleet. If you are NOT registered with the KCC we must have a CERTIFICATE OF INSURANCE or a copy of your current insurance card. PROPERTY TAX Vehicles of a fleet shall be currently assessed for property taxes or the property taxes paid for the preceding calendar year. INTERSTATE FOR HIRE CARRIER shall be subject for the assessment by and payment of ad valorem or property taxes to the Division of Property Valuation, Kansas Department of Revenue. PRIVATE CARRIERS or CARRIERS WHO HOLD NO KCC AUTHORITY will be subject to assessment of personal property tax by the County. The County in which the fleet vehicles have a tax base is the County where the taxes are to be paid. Private carriers and carriers who hold no KCC authority will be required to show proof of personal property tax payment each renewal registration year. 21

23 Owner-Operators will be required to show evidence of payment of personal property tax when they establish their registrant account and at each renewal registration year. If the Owner- Operator is not leased onto an Interstate For Hire Carrier the Owner-Operator shall be subject to assessment of personal property tax by their Local County Appraiser's Office. When the Owner-Operator is leased onto an Interstate For Hire Carrier, it the Owner- Operator s responsibility to obtain a copy of the personal property tax assessed rendition form from the lessee. If the Owner-Operator cannot provide this form he shall be subject to assessment of personal property tax by the County. Motor vehicles acquired, purchased, traded or sold after January 1 and prior to September 1 will need to show proof of personal property tax paid. Trailers are classified as commercial and industrial machinery and equipment and as such are to be valued annually as of January 1, of each taxing year. HEAVY VEHICLE USE TAX A registrant of any vehicle that is to be registered for a gross weight of 55,000 lbs. or more must show proof of payment of the Federal Heavy Vehicle Use Tax (HVUT) as required by the Internal Revenue Service (IRS). The proof of payment requirement is imposed by the Internal Revenue Service regulations. The Motor Carrier Services Bureau in Topeka does not have the authority to change these requirements. Use Form 2290 to figure and pay the tax due. This form may also be used to claim suspension from the tax when the vehicles will be used on public highways 5,000 miles or less. You must show proof of payment of this tax to register your vehicle in any state. Use the Schedule 1 for this purpose. If you do not have a Federal Identification Number you will need to complete a Form SS-4, Application for Employer Identification Number. SALES TAX Sales tax is required upon the purchase of a fleet vehicle, unless the carrier is exempt from sales tax. (See KCC Authority Types to determine Sales Tax Exemption). If the purchaser of a vehicle obtains a lease from a registrant with ICCR or ICCE Authority (issued by KCC), the lessee may make application for a retailer's sales tax registration number, or business tax number to apply for sales tax exemption. When a business tax number is issued to the name printed on the sales tax application form that individual, partnership, or corporate name would be exempt from paying sales tax. WHO MUST FILE? You must file Form 2290 and Schedule 1, if a taxable highway motor vehicle is registered, or required to be registered in your name at the time of it s first taxable use or when you claim suspension. You must also file a return when the taxable gross weight of a vehicle increases over 54,000 lbs. during the tax period. If the person liable for the tax at the time of the first taxable use paid the tax and later sold the vehicle, the new registrant does not have to pay the tax for the same tax period. However, if the former registrant did not pay the tax, the new registrant is liable for the total tax for the entire taxable period. Please refer to Sales Tax Requirements section for additional procedural information. 22

24 HUVT PROOF OF PAYMENT NEW OR USED VEHICLE PURCHASED. If a vehicle is registered within 60 days of purchase, the "bill of sale" may be used as proof of payment in lieu of a Form If a used vehicle is being registered past the 60-day period, a copy of the previous registrants paid Schedule 1, form 2290 must be presented as proof. Returns with payment are sent to the Internal Revenue Service, P.O. Box , Atlanta, GA PAYMENT OF THE HVUT AT MCSB OFFICE: If your heavy vehicle use tax has not been paid you may send us your check (must be made out to the Treasury Department) along with a stamped envelope (addressed to the IRS) and the 2290 form. This will enable us to verify payment and then we can forward the payment on to the IRS for you. Your renewal application will be processed without the HVUT but plates and cab cards will not be issued until proof of payment has been established. 25 HOW TO MAKE CHANGES After the Original Application has been submitted the Schedule C (MCS-66) is used to make most registration changes. December - March 1 December through March 1 is considered the renewal season. Preprinted renewals must be requested each year if you cannot complete the renewal On-line at our Website. If a vehicle is purchased after December 15 and before January 1 but will not be used before January 1, the vehicle may be registered at the unladen weight for December and the declared combined gross weight effective January 1. SCHEDULE C ADDITIONS via Schedule C Complete the header information using the same information as listed on your original application. For the vehicle being added to your fleet for the first time, complete columns 2 through 16. If the added vehicle has a weight variance write the jurisdiction and weight desired for each jurisdiction in the header. TRANSFERS via Schedule C Registration fees for power units may be transferred only if the deleted vehicle was disposed of by cancellation or expiration of a lease agreement, sold by the applicant, obtained nonhighway title, repossessed, or foreclosed on or before the date the added vehicle was in the possession of the registrant. The registration plate and cab card must be returned to Motor Carrier Services Bureau. A Kansas transfer fee of $5 is required. Please do not send money prior to receiving a billing. Not all jurisdictions allow fee transfers. Several jurisdictions will charge fees on transfers for other reasons, i.e., model, year, unladen weight, and type of vehicle. Complete the header information using the same information as listed on your original application. For the vehicle being deleted from your fleet, complete columns 1 through 10 under DELETIONS and column 1 through 16 under ADDITIONS for the vehicle being added to transfer the fees. DELETIONS via Schedule C License plates may be made inactive by completing just the Deletions portion of the Schedule C. The permanent plate and cab card must be returned to Motor Carrier Services Bureau and you may then transfer fees when ready to add a new vehicle to your fleet. A deletion does not release the Registrant from the obligation to pay the quarterly fees. SCHEDULE C REQUIRED DOCUMENTATION If a new title is to be issued, an assignment has been made on the back of the title, see Title Requirements. When the title name is correct on the face of the title the documentation to be included: Proof of ownership (a copy of the title front and back). A copy of the paid receipt from the IRS, Form 2290, heavy vehicle use tax. (A new or used vehicle may be registered within 60 days of purchase without the paid receipt, if you provide a copy of the bill of sale). Sales tax receipt, sale tax number, completed business tax application, or sales tax payment must be satisfied when applicable. Accounts in good standing may fax the documents for processing. 24

26 If all required documents are faxed and if there is no title work to be completed: MCSB can issue a 30-day temporary registration. No-Title work to be completed means that it is a clear title with the individual or carrier s name printed on the face of it and there is no new assignment on the back of it. If a 30-day temporary registration is issued, any requested documents and the Supplement Billing Invoice payment must be received by MCSB and the registrant must receive the credentials before the 30- day temporary registration expires. It is the Registrant s responsibility to identify documents that are being provided by mail to complete a Schedule C that has been processed by fax in order to avoid duplicate billings on the account. If a temporary registration is issued, all of the required documentation must be provided and the billing invoice must be paid within the grace period, or a letter of Warning of Suspension of the Fleet will be issued. Failure to satisfy the Warning of Suspension of the Fleet will result in the issuance of Suspension of the Fleet and all the vehicles on the fleet shall not operate. If all required documents are faxed and if there is title work to be completed: The MCSB may issue a 10-day temporary registration. Title work to be completed means the face of the title is not in the individual or carrier s name and there is a new title assignment on the back of the title. The title that is to be completed and any other required documents must be received by MCSB before the 10-day registration expires. Receipt of these documents allows MCSB to extend the temporary registration 20 more days (maximum 30-day temporary permit). A 30-day temporary registration may only be extended if the delay in issuing the credentials was the fault of the MCSB NAME CHANGE ONLY This applies to a vehicle currently registered with our office and the vehicle is staying on that same IRP account but ownership on the vehicle has changed. Failure to provide the required documentation before the 10-day registration expires will result in the issuance of a letter Warning of Suspension of the Fleet. 25

To increase your Kansas weight identify the vehicle by your IRP account number, the VIN, give current registered weight, license plate number, and weight increase on company letterhead. Please sign and date. We will accept a fax or a faxed copy of your cab card with indicated changes. Payment of HVUT must be made if the new weight is for over 54,000 lbs. and the tax has not been previously paid on this vehicle. In addition to the cost of the weight increase there is a $1 cab card fee. There is no registration fee refund or credit allowed decreasing a weight. WEIGHT VARIANCES A SCHEDULE C FORM MAY BE USED For example, if your vehicle is registered at 85,500 lbs. in Kansas the equivalent weight for Oklahoma is 86,000. You can register for 90,000 lbs. in Oklahoma by recording {OK 90,000} in one of the boxes for a weight variance. See the Maximum Allowable Weight chart. In addition to the added weight fee, a replacement fee of $1 shall be charged for the issuance of a Kansas cab card reflecting the new registered weights. A 30-day temporary may be faxed upon request. 37 Adding A Jurisdiction If a Kansas based registrant finds that there will be operation in an additional IRP jurisdiction after the initial application, or renewal application is filed, the registrant shall complete form MCS-71, Certification for an Added Jurisdiction. The Certification for an Added Jurisdiction can be faxed to our office. A 30-day temporary registration can be faxed upon request. If a temporary registration is issued, the billing must be paid within a 30-day period or a warning of suspension of the fleet will be sent out. The estimated miles are determined for the entire calendar year for which registration is being sought. The registration fees are calculated on the computer and a billing notice shall be provided. Upon payment, a new Cab Card will be issued listing the new jurisdiction(s) for all vehicles on the fleet. In addition to the registration fees for each jurisdiction added, a cab card fee of $1 for each vehicle will be included in the billing notice. (FORM ON FOLLOWING PAGE) 36
