4 IBA Legal Practice Division The Legal Practice Division brings to life the global voice of the legal profession in a number of ways: specialist conferences throughout the world, an abundance of publications aimed at specific practice areas, projects aimed at sharing best practices and streamlining crossjurisdictional practice, and working groups submitting comments to shape international legislation creation and reform. Members of the Legal Practice Division have a unique opportunity to join the dialogue and to have a direct effect on the state of the profession in their particular area of practice, while keeping up to date on the latest developments and participating in a powerful network of over 35,000 members across the globe. The Antitrust Committee has been the leader of the Division in this regard, and its working groups continue their very high level of activity. In the last year, they have submitted comments on the following: Public Consultation Paper issued by the Hong Kong Commerce and Economic Development Bureau in May 2008 in relation to the detailed proposals for a Competition Law in Hong Kong. The Canadian Competition Bureau on the Draft Information Bulletin on Sentencing and Leniency in Cartel Cases. The United Kingdom Office of Fair Trading (OFT) Draft Guidance Consultation document, Mergers: Jurisdictional and Procedural Guidance, of March The Competition Commission of South Africa on Corporate Leniency Policy Review The Australian Treasury on the proposed criminalization of certain cartel conduct, following the release of the Exposure Draft of the Trade Practices Amendment (Cartel Conduct and Other Measures) Bill The European Commission s Draft Notice on the conduct of direct settlement proceedings. The Consumer Litigation Committee Class Action Task Force, comprising leading international lawyers, academics, judges, and in-house counsel, has addressed the issue of enforcing class action judgments and settlements outside the jurisdiction in which the judgment was granted or the settlement agreed. The Task Force presented its findings at the 2007 IBA Annual Conference, and have subsequently consulted with other relevant committees in the Legal Practice Division, to develop recommendations and guidelines for international procedures and protocols for enforcement. The Arbitration Committee has translated its Guidelines on Conflicts of Interest in International Arbitration and its Rules on the Taking of Evidence in International Commercial Arbitration, into multiple languages. The translations are freely available on the IBA website. In addition, the Committee is conducting a review of implementation of the New York Convention in conjunction with UNCITRAL, and it produced a video interview with Pieter Sanders, the father of international arbitration, on his experience during the drafting of the New York Convention. The Litigation Committee has published a collection of key relevant international litigation instruments, for distribution at its specialist conference in Toronto in June 2008 as well as at the 2008 IBA Annual Conference. Additionally, it has begun drafting a Conflict Management Guide, intended to help practitioners choose the most appropriate method for the resolution of a particular dispute in a particular jurisdiction. The Legal Practice Division Task Force on the Extraterritorial Application of the Law, a Divisionwide project, has analysed the problems caused when states impose their law beyond their borders, and has proposed solutions that may alleviate the problems. The Task Force has established six subcommittees: antitrust, securities, bribery and corruption, international civil jurisdiction and torts, international criminal jurisdiction, and insolvency. A draft report was discussed publicly at the 2007 IBA Annual Conference, each subcommittee updated its report based on comments received, and the final report will be presented and distributed in hard copy at the 2008 Annual Conference. 4 Contact the IBA Tel: +44 (0) member@int-bar.org Website:

5 Public and Professional Interest Division The objectives of the Public and Professional Interest Division are to promote an interchange of information and views among Member Organisations of the Association and its individual Members about the public and professional interests of the legal profession throughout the world; to support and promote those activities, the rule of law and the defence of human rights; to facilitate communication among Member Organisations and their members; to provide the opportunity to Member Organisations and all members to be active in the Division through its Bar Issues Commission ( BIC ), constituents, fora and other groupings; and to undertake such related projects as may be approved from time to time by the Division s Council. These are our key successes this last year. Anti-Money Laundering Legislation Implementation Group In June, the IBA launched a new Anti-Money Laundering Forum website to replace the existing site. The new site contains information on the status of the transposition of the Third EU Money Laundering Directive in all EU member states. The new site can be accessed via the homepage of the main IBA website The Anti-Money Laundering Legislation Implementation Group (AMLLIG) participated in a panel discussion on money laundering, which was organised by the ABA s Section of International Law as part of the ABA International Fall Meeting held in London on 4 October The discussion focused on the role of lawyers as gate-keepers in the fight against moneylaundering. The AMLLIG, represented by Stephen Revell, was accompanied on the panel by representatives from the ABA, the UK Law Society, the UK Serious Organised Crime Agency (SOCA) and experts in the field of white collar crime. Because the ABA meeting was held in London, the discussion naturally focused on the impact of anti-money laundering legislation on UK lawyers and how the US bar is reacting to the Financial Action Task Force (FATF) Recommendations (applicable in the United States), which require anti-money laundering legislation to apply to lawyers. Representatives of the AMLLIG also attended a meeting in Bern, Switzerland on 11 December 2007 with FATF and other representatives of the private sector. FATF is an inter-governmental organisation that sets the agenda for anti-money laundering legislation worldwide. For instance, the European Union followed its guidelines and recommendations when issuing the Third EU Money Laundering Directive, which came into force on 15 December The 11 December meeting was the second meeting (the first was held in London in September 2007), in a series of meetings, that FATF is conducting with designated nonfinancial businesses and professions (DNFBPs), including lawyers, accountants, casino operators, real estate agents and dealers in precious metals and stones. In a unique public/private partnership, FATF is seeking the involvement of these DNFBPs in drafting guidance relevant to each respective group on the riskbased approach to money laundering legislation, particularly in the context of customer due diligence. The IBA s AMLLIG was appointed by the lawyers, notaries, and trust and company service providers present at the 11 December FATF meeting to coordinate the drafting efforts on behalf of the global legal community. This effort is being led by AMLLIG Coordinator Stephen Revell and Chris McNeil, both of Freshfields Bruckhaus Deringer. Pro bono and Access to Justice The new IBA website helps expand and support information sharing within a growing international network of legal professionals engaged in innovative transnational pro bono initiatives. It is a userfriendly and versatile site with multiple features to maximise communication between site users. This strategic use of technology will allow those engaged in international pro bono work to spread information and share experiences 24 hours a day across the globe. The site has a unique and exclusive focus on international and cross-border pro bono work. The library compiles important resources, including relevant materials from IBA conference sessions and from other organisations engaged in pro bono. A training calendar alerts international pro bono practitioners to events that offer information to aid their work. A news archive collects relevant developments in the field of international pro bono, and stores them for later reference as needed. The site s aim is to foster and encourage dialogue and informationsharing among users via listservs, discussion fora, alerts, and the ability of site users to contribute to all of the resources linked on the site. The Charitable Trust has a broadened scope, covering amongst other things education, human rights projects, and the provision of relief for lawyers experiencing hardship (such as those affected by the Asian Tsunami in 2004). Objects of the Trust from the Trust Deed a) To advance education in the law throughout the world for the benefit of the public; b) to promote research into commonly encountered legal problems and to disseminate the useful results of such research for the benefit of the public; c) to promote human rights (as set out in the universal declaration of human rights and subsequent united nations conventions and declarations) throughout the world by all or any of the following means: d) to promote the relief of financial hardship or distress either generally or individually of lawyers, their widows, widowers and other dependents and employees. IBA Foundation Inc Foundation President: Philip F Zeidman The Foundation is a US-based charitable foundation, created in 1986 to engage in a wide variety of educational and charitable activities related to advancing the rule of law. While the Foundation was created by members of the International Bar Association, and works closely with the IBA and other organisations affiliated with the IBA, it is an independent entity whose mandate permits it to support a broad range of law related undertakings. In carrying out its mission, the Foundation interacts with the IBA, the Charitable Trust and supports other legally-related projects not associated with IBA programmes. The Foundation provides financial support for approved charitable projects, typically coupling it with the contribution of time and expertise by the Foundation and by individual IBA members.

Business Law International (BLI) Published three times a year, BLI comprises articles that break new ground on issues of relevance to the international commercial, legal and academic community, particularly those with a cross-border or multijurisdictional focus. Competition Law International (CLI) Published three times a year, CLI provides an insight into international competition law issues with articles that are of practical interest. Construction Law International (CLInt) Published quarterly, CLInt contains a balance of substantive and practical articles and news that anyone involved in the international construction industry will wish to receive. Convergence Published twice a year, Convergence provides current and incisive analysis of developments in the areas of information technology, intellectual property, media, the law relating to arts and culture, communications and outer space law. Dispute Resolution International (DRI) Launched in June 2007 and published twice a year, DRI consists of in-depth discussions of current developments and topical issues in all areas of dispute resolution. The In-House Perspective (IHP) Published quarterly, IHP provides in-depth articles on subjects of particular interest to corporate counsel and in-house lawyers. In addition it features profiles of leading counsel, advice on managing external counsel and internal clients and a round-up of in-house developments from around the world. Insolvency and Restructuring International (IRI) Launched in June 2007 and published twice a year, IRI provides a practical analysis of current developments and timely issues in the area of insolvency and creditors rights. International Bar News (IBN) Published six times a year and featuring articles by accomplished legal journalists, IBN covers topical legal and business issues of international interest, as well as highlighting IBA initiatives, activities and member benefits. Journal of Energy and Natural Resources Law (JERL) Published quarterly, JERL contains unsurpassed expertise in all areas of energy and natural resources law. 10 The IBA s Human Rights Institute The work of the Human Rights Institute of the IBA is a source of pride, empowerment and inspiration for lawyers in Southern Africa. It is a visible demonstration of the power and value of international cooperation among lawyers of the world. Sternford Moyo President, SADC Lawyers Association, Zimbabwe The IBA s Human Rights Institute (IBAHRI), established in 1995 under the Honorary Presidency of Nelson Mandela, has become a leading force in setting governments agendas in human rights and promoting respect for the rule of law worldwide. Over the past few years, the IBAHRI has experienced remarkable growth and achievement. Key activities include: training lawyers, judges and prosecutors in human rights law and international humanitarian law; pioneering training programmes to strengthen the judiciary in post-conflict countries or countries where basic state infrastructure may have been eroded; undertaking fact-finding missions and sending trial observers to countries where the rule of law may have deteriorated; making representations to authorities worldwide where individuals or the independence of the judiciary have been threatened; analysing draft legislation to ensure compliance with international and regional standards; providing long-term technical assistance to under-resourced Bar Associations and Law Societies; and galvanising international support to lobby for change through media and advocacy campaigns. The IBAHRI is recognised and sought out for partnership by organisations such as the United Nations, as well as governments and independent funding bodies across the world. However the basic infrastructure required to maintain the Institute (such as staff, premises, travel and office equipment) must be paid for out of our own resources. If activities expand, so must this infrastructure. Without the increased support of its members the IBAHRI would be unable to maintain its current level of work and this is a funding gap only the legal profession is likely to fill.
