3 SECURITY CHECKPOINT INFORMATION Stop by the information booth near the tram station on the Tram Level. At the information booth, you will be asked to complete a security checkpoint access form and show valid, government-issued photo identification, such as a driver s license. Take your completed access form with you up two floors, to the Ticketing Level security checkpoints. Show your approved access form to security checkpoint personnel. You will then be screened just as if you were traveling. Access forms are only valid for the purpose of attending a public MAC meeting at a particular date and time. Commission Chambers are located on the Mezzanine Level overlooking the airport s central shopping area (above Chili s Restaurant), past the main security checkpoints. Allow yourself at least 30 minutes to park, complete the access form and get through the security checkpoint prior to the meeting. 7 METROPOLITAN AIRPORTS COMMISSION HEARING OFFICER S REPORT July 30, 2009 Public Hearing on Petition for Emergency Relief, dated July 6, 2009 Received from Taxicab Owners and/or Operators Hearing Officer s Report July 30, 2009 Public Hearing Petition for Emergency Relief I. PURPOSE OF HEARING On July 7, 2009, the Metropolitan Airports Commission ( MAC ) received a Petition for Emergency Relief ( Petition ). Guled M. Mohamud submitted the Petition on behalf of taxicab owners and operators. Approximately 223 owners and operators appear to have signed the Petition. The Petition asks for MAC to assist the operators and owners in dealing with the problems that they are facing in the current business climate. The Petition states that the prevailing economic conditions are negatively and seriously affecting the airline industry. These conditions have tremendously decreased the number of air travelers, thus the number of people requesting taxicab service from the airport has decreased. The Petition had four specific requests: (i) a decrease in the yearly taxicab permit fee; (ii) a two (2) year increase in the age of the taxicab vehicle; (iii) a cap on the number of taxicab permits issued; and, (iv) a yearly meeting with Commissioners. Because of the potential impacts that the Petition could have on MAC s governing taxicab ordinance, MAC Ordinance No. 102, a public hearing was held to conform with Minnesota Statute , subd. 17. II. PUBLIC HEARING A. Time and Place A public hearing was conducted at 1:30 p.m. on July 30, 2009 in the Commission Chambers, Room 3048A located in the Lindbergh Terminal at the Minneapolis-St. Paul International Airport, Hennepin County, Minnesota to receive verbal and written comments on the Petition. Commissioner Michael Landy was appointed as the Hearing Officer. The hearing was held pursuant to Minnesota Statutes Chapter 473, with public notice of the hearing provided. B. Attendance Present at the hearing was MAC Commissioner Michael Landy, who served as the Hearing Officer. MAC staff who spoke at the hearing included: Steve Wareham, Director of MSP Operations, Arlie Johnson, Assistant Director Landside Operations; and John Kedrowski, Attorney. Other MAC staff present included: Tim Anderson, Deputy Executive Director Operations; Eric Hudak; Steve Holes; Robert Mundahl; Tammy Rader, Stephanie Gassert, and David Singleton. Thirteen (13) members of the public signed in on the attendance sheets. 3

Presentations After an introduction by Commissioner Landy, John Kedrowski introduced procedural exhibits into the record. Next, Arlie Johnson, Assistant Director Landside Operations, and Steve Wareham, Director of MSP Operations, gave a brief overview and background of events and issues regarding the Petition s specific requests. Mr. Johnson described the two taxicab subcommittee meetings that were held with members of the taxicab community after the Petition was submitted and prior to the public hearing. D. Public Testimony All persons wishing to do so were given the opportunity to testify and to introduce evidence regarding the issues set forth in the Notice of Public Hearing. TESTIMONY AND COMMENTS RECEIVED Verbal testimony and written comments were received from MAC staff and the public in this public hearing process. For efficiency in format, the testimony and comments are listed under the four specific requests from the Petition. A. Decrease in the Yearly Taxicab Permit Fee MAC Staff explained that the purpose of the yearly taxicab permit fee is to recover MAC s attributable costs related to taxicab operations. The cost includes, among other things, staff time, computer programs, GPS purchase costs and depreciation of the roadways used by taxicabs. For the permit period starting Nov. 11, 2009, the yearly permit fee being proposed would increase the permit fee by $ to $3, or under the hybrid payment method to $1, plus $1.85 per trip fee. Historically, the permit fee has increased by 3% each year for the past six years. Public testimony described the difficult economic circumstances that the taxicab community is facing. Taxicabs are taking fewer passengers, waiting longer to receive loads and, possibly, receiving shorter fare trips. Some testimony related the number of taxicabs to part of the economic problems. Overall, the testimony stated that taxicab operators are receiving less money which is affecting their profitability. A specific suggestion received from a few comments was for MAC to share in the potential risk that the number of taxi riders would decrease further than projected. In this suggestion, the hybrid approach would have a lower initial fee with a higher per trip fee. 5
10 Hearing Officer s Report July 30, 2009 Public Hearing Petition for Emergency Relief B. Increase in the Age of Taxicabs MAC Staff testified that taxicabs must be no more than six years older than the year starting the annual permit. Staff explained that this allows a brand new vehicle to operate as a taxicab for up to seven years. It is estimated that an increase in the allowable age of a taxicab vehicle would affect about 180 taxicabs. Staff also reported that of the 2003 model year vehicles, approximately 82% failed the first time through their last mechanical inspection. When comparing the vehicle age to other municipalities, MAC was found to have one of the longest periods. In Minneapolis, the oldest vehicles are six years old. In St. Paul, the vehicles can be no older than five years. Public testimony indicated that in New York City, the age limit is three years. Most of the public testimony on age limits was tied to economic reasons. By extending the vehicle s age, taxi owners would not have to incur additional cost in replacing the vehicle this year. As to concerns about the condition of an older vehicle, the testimony offered that any mechanical problems would be found and corrected in the inspection process. C. Cap the Number of Taxicab Permits Staff gave a history regarding the previous implemented cap from 1999 to During that cap, only 1% of the 608 taxicabs left the system per year. Without the cap, the number of vehicles has fluctuated each year. Staff feels that allowing participants to voluntarily enter and exit the permit system has alleviated participants fear about being shut out of the market; thus reducing the effect of holding a taxicab permit(s) in anticipation of some perceived value. Staff also described a secondary consequence that the previous cap created. With the lack of ability to actually transfer a taxicab permit to someone, taxicab owners used the power of attorney process to achieve their intended transfer. In using a power of attorney, the taxicab owner was able to give control of their vehicle and permit to someone else. Staff stated that during the previous cap, up to 80% of the owners were using the power of attorney process. This led to customer service and accountability problems within the taxicab business. In addition, the cap allowed owners to charge taxi drivers a significant amount of money to operate the taxicab with a power of attorney approval. Currently, very few taxi owners use a power of attorney process. Public testimony indicated that a cap is being proposed so that competition for the taxicab business would be frozen. With no increase in the number of permits, it is believed by the industry that the competition would at least not get worse. Some public testimony also suggested that MAC should do more than just cap the number. It was suggested that MAC should reduce the numbers of taxicabs operating at the airport. By reducing the number, it was stated that taxicabs might not have to wait as long for a fare. In addition, reducing the number of permits could help with control in the taxicab queuing lots where there is competition for the limited queuing space. However, testimony was not consistent on a particular number for reduction. 6
11 Hearing Officer s Report July 30, 2009 Public Hearing Petition for Emergency Relief D. Yearly Meeting with Commissioners Staff reported that, currently, the taxicab community has the most exposure to a Commissioner than any other user group at the airport. Eleven times per year the taxicab community has a standing meeting with Commissioner Landy. In addition, the permit fee is discussed yearly by the Commission. Other opportunities are also available to talk with Commissioners. The public testimony indicated that this specific request could be dropped. IV. CONCLUSION After careful consideration of the public testimony, written comments and knowledge of the taxicab operations at the Minneapolis-St. Paul International Airport, it is the recommendation of the undersigned Hearing Officer that: 1. The proposed yearly taxicab permit cost continue to recover the applicable amount needed for total cost recovery; however, the hybrid method of payment should be evaluated so that the initial permit amount may be lowered with a corresponding increase in the per trip fee; 2. The age of the taxicab should not be extended beyond the current age limit. The Commission currently allows vehicles to be operated for one of the longest age periods and any increase would be further away from the industry s standards, and may add potential safety risks for the traveling public; 3. A cap on the number of taxicab permits would not be in the best interests of the Commission. Any cap would likely lead to problems similar to the previous time period when the Commission capped the number of permits; however, further study on the number of taxicab permits to issue should continue; and, 4. The yearly meeting with MAC Commissioners has been addressed satisfactorily. Attached as Attachment 4 are proposed Findings, Conclusions, and Order regarding the Petition for Emergency Relief. 12 METROPOLITAN AIRPORTS COMMISSION HEARING OFFICER S REPORT July 30, 2009 Public Hearing on Petition for Emergency Relief, dated July 6, 2009 Received from Taxicab Owners and/or Operators FINDINGS, CONCLUSIONS AND ORDER Pursuant to notice duly given, a public hearing was held at 1:30 p.m. on Thursday, July 30, 2009 in the Commission Chambers, Room 3048A located in the Lindbergh Terminal at the Minneapolis-St. Paul International Airport, Hennepin County, Minnesota in which testimony was taken and other evidence introduced on the Petition for Emergency Relief, dated July 6, 2009 received from Taxicab Owners and/or Operators. The public hearing was commenced at the time and place designated in the notice and was conducted by the appointed Hearing Officer, Commissioner Michael Landy. The Commission was represented at the hearing by Steve Wareham, Director of MSP Operations, Arlie Johnson, Assistant Director Landside Operations and John Kedrowski, Attorney. Following presentations by staff, there was an opportunity for questions and comments by members of the Committee and members of the public. Exhibits 1 through 5 presented at the hearing were received and attached to the record. The hearing record was kept open until noon on Friday, July 31, Four written comments were received. NOW, THEREFORE, having given due consideration to the testimony, exhibits and other evidence submitted and made part of the record, the Metropolitan Airports Commission makes the following Findings, Conclusions and Order: FINDINGS AND CONCLUSIONS 1. That the Metropolitan Airports Commission (MAC) is a public corporation operating under Minnesota Statutes Chapter 473 to serve the public s best interests of aviation for the state; and has broad discretion and authority to regulate ground transportation within its jurisdiction. 2. That Taxicab Owners and Operators submitted a Petition for Emergency Relief, dated July 6, 2009 ( Petition ) and in response to that Petition a public hearing was conducted under Minnesota Statute , subd That the Petition had four specific requests: (i) a decrease in the yearly taxicab permit fee; (ii) a two (2) year increase in the age of the taxicab vehicle; (iii) a cap on the number of taxicab permits issued; and, (iv) a yearly meeting with Commissioners.

That the Commission s yearly taxicab permit fee is established so as to reasonably recover the total projected costs of the Commission for taxicab operations at the Minneapolis-St. Paul International Airport. 5. That the maximum age of taxicab vehicle(s) at the Minneapolis-St. Paul International Airport is one of the oldest in the Twin Cities metropolitan area; and, that an extension of the age of vehicle(s) is not beneficial to the public. 6. That the Commission s experience with a cap on the number of taxicab permits is that a cap does not achieve the Commission s intended purposes; and, that the ability of taxicab operators to freely enter and exit the system does result in some of those purposes. 7. That notice and opportunity for public review and comment on the Petition was provided to interested parties. 8. 14 MEMORANDUM ITEM 2 To: Management and Operations Committee From: Arlie Johnson, Asst. Airport Director, Landside Operations ( ) Re: RECOMMENDATION RE: ADJUSTMENT TO COMMERCIAL VEHICLE PER- TRIP FEE AND TAXICAB ANNUAL PERMIT FEE Date: August 11, 2009 MAC Ordinances 102 and 106 govern the operation of taxicabs at Minneapolis-St. Paul International Airport (MSP). MAC Ordinance 93 governs the operation of commercial vehicles at MSP. These ordinances require the Commission to recover associated budgeted costs by annually adjusting fees for commercial vehicle operators picking up passengers at the airport. Fees are determined by applying the cost recovery formula for commercial roadway and automated system use against budgeted costs for operations, administration, depreciation and interest, and historical roadway usage data. Taxicabs and commercial vehicles comprise 16.8% and 11.7% respectively of the overall traffic at MSP as determined by a 2004 traffic study. Because there are differences between the ordinances and cost recovery fee setting, this memo addresses commercial vehicle and taxicab permit fee adjustments separately. Commercial Vehicle Per Trip Fee Adjustment Staff recommends the current commercial vehicle per trip fee of $2.50 be decreased 7.7% to $2.31 for the period November 11, 2009 through November 10, This per trip fee recovers the budgeted cost associated with operations of commercial vehicles other than taxicabs as required in Ordinance 93. The commercial vehicle per trip fee is determined by dividing the associated budgeted cost to be recovered by the number of trips taken during the most recently completed annual permit period. See Attachment 1 for calculation details. Transit Center Per Trip Fee The Lindbergh Transit Center will be equipped with Automated Vehicle Identification (AVI) equipment later this year. This equipment will, in part, provide the automated monitoring of trips and collection of fees associated with Bus operations. All commercial operators, except bus operators, are assigned separated areas of operation one for passenger pick-up, where the per trip fee is applied, and another for passenger drop-off where no fee is charged. Bus operations at the Lindbergh terminal are unique in that operators are required to perform both passenger pick-up and drop-off within the Transit Center. Due to this arrangement, and the fact that AVI equipment cannot distinguish whether an operator is performing passenger pickup or drop-off, a new Transit Center per trip fee is needed to ensure the equitable distribution of recoverable costs. Because it is reasonable to assume that a Bus operator who initially provides service to or from the Transit Center will provide return service to the same group to or from the Transit Center at a later date, staff recommends that a Transit Center per trip fee be approved that equals one-half of the established Per trip fee or $1.16. This amount recovers the budgeted cost associated with the operation of commercial vehicles at the Lindbergh Transit Center as required in Ordinance 93. Off-Airport Parking Per Trip Fee Staff is currently in the process of identifying a new fee structure for Off-Airport Parking operations that will be recommended to the Commission later this year. In the interim, staff recommends the current fee charged to Off-Airport Parking operators at a rate $2.50 per trip remain unchanged.
15 Taxicab Annual Permit Fee Adjustment Staff recommends the current annual taxicab permit fee of $3650 remain unchanged for the period November 11, 2009 through November 10, As a measure of economic relief, this recommendation includes the deferment of $66,400 ($100 per taxicab) that will be recovered through addition to next year s fee calculation. This recommended annual permit fee, plus the deferment, recovers the budgeted costs associated with the operations of taxicabs as required by Ordinance 102. The annual taxicab permit fee is determined by dividing the cost to be recovered by the number of permits issued during the most recent annual permit period. This fee allows the taxicab to be operated through the airport s automated dispatch system. See Attachment 1 for calculation details. Taxicab Annual Permit Fee Hybrid Payment Adjustment The Commission established per trip fees as an optional payment method for annual taxicab permits. This hybrid option allows operators to pay a portion of the annual fee up front and the remainder throughout the permit period via per-trip fees. Historically the up front portion has been calculated as approximately one-half of the recommended annual permit fee. As an additional measure of economic relief, this year s up front portion has been calculated to be approximately one-third of the recommended annual permit fee. Staff recommends that operators opting to pay using the hybrid method be charged $1200 plus $2.42 per trip for the period November 11, 2009 through November 10, See Attachment 1 for calculation details. Taxicab Airport Use Fee The airport use fee enables taxicab operators to recover the approximate cost of the annual taxicab permit fee. Taxicab operators are the only commercial vehicle operators allowed by ordinance to add an airport use fee to the fare charged to a customer. The use fee is calculated by dividing the associated budgeted cost to be recovered by the number of trips taken during the most recently completed annual permit period, then rounding to the nearest $0.25. Based upon this formula, staff recommends the airport use fee of $3.00 be increased to $3.50 per trip for the period November 11, 2009 through November 10, See Attachment 1 for calculation details. COMMITTEE ACTION REQUESTED THAT THE MANAGEMENT AND OPERATIONS COMMITTEE RECOMMEND TO THE FULL COMMISSION: 1. APPROVAL OF A COMMERCIAL VEHICLE PER TRIP FEE ADJUSTMENT FROM THE CURRENT RATE OF $2.50 TO A RATE OF $2.31 FOR THE PERIOD NOVEMBER 11, 2009 THROUGH NOVEMBER 10, 2010; 2.
