No. A 99/2000) to be an approved township. The conditions, subject to which the application for permission to establish the township concerned has been granted, are set out in the Schedule below in terms of the said Section 13. Conditions of title (1) The following conditions are registered in favour of the Local Authority against the title deeds of all erven except the erven referred to in paragraph 3: The erf is subject to the reservation for the Local Authority of the right of access and use without compensation of the area three metres parallel with any boundary of such erf, for the construction and maintenance of municipal services in respect of water, sewerage, drainage, electricity and gas, which right includes the right to place on such erf temporarily any material that may be excavated during such operations on the erf or any adjacent erf. (2) The following conditions shall, in addition to those enumerated in paragraph 4( 1 ), be registered in favour of the Local Authority against the title deeds of erven 3105 to 3123,3125 to 3159,3166 to The erf shall be used for residential purposes only. The building value of the main building, including the outbuildings to be erected on the erf shall be at least equal to the valuation of the erf. (3) The following conditions shall in addition to those enumerated in paragraph 4( 1 ), be registered in favour of the Local Authority against the title deeds of erven 3124,3161 to The erf shall be used for flats and business purposes, other than a factory as defined in regulation 14 of the Regulations to the Health and Safety of Employees at Work promulgated under Government Notice No. 156 of 1 August 1997: Provided that where a building is erected for business purposes the ground floor of the main building shall not contain flats and no flats shall be constructed on the same floor as any business or offices. The building value of the main building, including the outbuildings to be erected on the erf shall be at least two times the valuation of the erf.

7 No Government Gazette 2 September Regulation 1 is amended by the substitution for the definition of"levy year" of the following definition- "'levy year' means the period of 12 months ending on 31 March each year.". 2. Regulation 2 is amended by the substitution for the phrase "which ended on 31 March 2002" of the phrase "commencing on 1 April2002". 3. Regulation 2.4 is amended by the substitution for paragraph of the following paragraph: " Every registered insurer under the Short-term Insurance Act, 1998 (Act No. 4 of 1998) must pay- (i) for the levy year running from 1 April2002 to 31 March 2003 for the period- (aa) 1 April2002 to 30 August 2002 a levy equal to 0,05%; and (bb) 1 September 2002 to 31 March 2003 a levy equal to 1%, of the insurer's gross premium income for the last financial year preceding the levy year, subject to adjustment after the end of the financial year in accordance with its actual gross premium income as reflected in its audited financial statement; and (ii) for each levy year thereafter, with effect from 1 April2003 an annual levy equal to a percentage not exceeding 1,5% determined annually by the Registrar: Short-term Insurance of the insurer's gross premium income for the last financial year preceding the levy year, subject to adjustment after the end of the financial year in accordance with its actual gross premium income as reflected in its audited financial statement.". 4. Regulation 2.5 is substituted for the following regulation: "2.5 Every registered insurer under the Long-term Insurance Act, 1998 (Act No. 5 of 1998) must pay- (i) for the levy year running from 1 April 2002 to 31 March 2003 for the period - (aa) 1 April2002 to 30 August 2002 a levy equal to 0,05%; (bb) 1 September 2002 to 31 March 2003 a levy "equal to 0,15%, of the aggregate of the insurer's liabilities under un-matured long-term policies; and (ii) for each levy year thereafter, with effect from 1 April 2003 an annual levy equal to a percentage not exceeding 0,2% determined annually by the Registrar: Long-term Insurance of the aggregate of the insurer's liabilities under un-matured longterm policies. The expression "liabilities under un-matured long-term policies" means the liabilities as determined at the end of the long-term insurer's financial year which ended in the calendar year preceding the levy

8 8 Government Gazette 2 September 2002 No.2804 year, and the value of such liabilities are the net liabilities under unmatured policies as reflected in the long-term insurer's financial statements.". 5. Regulation 2.6 is substituted for the following regulation: "2.6 Every person registered as an insurance agent, insurance broker or re-insurance broker in terms of section 53 of the Short-term Insurance Act, 1998 (Act No. 4 of 1998) or in terms of section 55 of the Long-term Insurance Act, 1998 (Act No. 5 of 1998) must pay- for the levy year running from 1 April2002 to 31 March (i) (ii) for the period 1 April 2002 to 30 August 2002 a levy equal to 0,01 %; for the period 1 September 2002 to 31 March 2003 a levy equal to 0,15%, of the gross income received by the person during the most recent financial year of the person or the amount ofn$2000, 00, whichever is the greater; and for each levy year thereafter, with effect from 1 April 2003 an annual levy equal to a percentage not exceeding 0,2% determined annually by the Registrar: Short-term Insurance and the Registrar: Long-term Insurance of the gross income received by the person during the most recent financial year of the person, or the amount of N$2000, 00, whichever is the greater. In this regulation "gross income" means the amounts received from any insurer and underwriter at Lloyds as reported by an auditor or accounting officer.". 6. Regulation 2.7 is substituted for the following regulation- "2.7 Every management company of a unit trust scheme in securities other than property shares, registered in terms of the Unit Trusts Control Act 1981 (Act No. 54 of 1981) must pay, in respect of the unit trust scheme controlled by the management company - Basic annual levy: N$5000, 00; For the levy year running from 1 April2002 to 31 March 2003 for the period 1 September 2002 to 31 March 2003, an additional monthly levy equal to 0,055% x 117 of the total value of all assets under management as at the end of every month from the 1 September 2002 to the 31 March 2003; and for each levy year thereafter, with effect from 1 April 2003 an annual levy equal to a percentage not exceeding 0,1% determined annually by the Registrar: Unit Trusts of the total value of the assets under management as at the end of every month during the aforesaid period.". 7. Regulation 2.10 is substituted for the following regulation: "2.10 Every person, and every person falling within the category referred to as investment manager, who have been approved by the Registrar of Stock Exchanges under section 4(1 )(f) of the Stock Exchanges Control Act, 1985 (Act No. 1 of 1985), must pay the following annual levies: Basic annual levy: N$5000,00

9 No Government Gazette 2 September For the levy year running from 1 April2002 to 31 March 2003 for the period 1 September 2002 to 31 March 2003, an additional monthly levy equal to 0,022% x 1/7 of the total value of the assets under management as at the end of every month from the 1 September to the 31 March 2003; and For each levy year thereafter, with effect from 1 April2003 an annual levy equal to a percentage not exceeding 0,1% determined annually by the Registrar: Stock Exchanges of the total value of the assets under management as at the end of every month during the aforesaid period.". 8. Regulation 3 is amended by the substitution for sub-regulation ( 1) of the following: "( 1) Levies payable in terms of this notice must be paid in two equal installments, the first installment to be paid not later than 31 October falling in the levy year, and the second installment not later than 30 April falling in the next levy year, the first installment in respect of the first levy year that commenced on 1 April 2002 to be paid not later than 31 October 2002.".
