ADOPT the Staff Report. 2. DETERMINE that this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Article Ill Class (8)(c) of the Los Angeles City CEQA Guidelines. 3. FIND that the work can be performed more economically or feasibly by the Los Angeles County Metropolitan Transportation Authority than by City employees. 4. APPROVE the Cost Reimbursement Agreement with the Los Angeles County Metropolitan Transportation Authority for an amount not to exceed $ APPROPRIATE capital funds in an amount not to exceed $ for this project. 2 6. AUTHORIZE the Chief Executive Officer to execute the Cost Reimbursement Agreement after approval as to form by the City Attorney. DISCUSSION:. Purpose Provide continued water service for the fire suppression system and for potable water purposes to Los Angeles World Airports Imperial Cargo Complex (ICC). 2. Prior Related Actions None 3. Current Action Background Los Angeles World Airports (LAWA) currently owns and operates two eight -inch waterlines that are located within Los Angeles County Metropolitan Transportation Authority (MTA) right -of -way property for the Crenshaw LAX Light Rail Project (Project). In order to expeditiously remove and relocate the waterlines that are obstructing the Project without construction schedule delays or increased costs to this important transportation project staff proposes entering into a Cost Reimbursement Agreement (Agreement) with the MTA. The Agreement scope of work includes engineering design removal and relocation of the two eight -inch waterlines and replacement with one 0 -inch waterline to serve the ICC. The total amount of the Agreement is not to exceed $ All work will be performed and guaranteed by MTAs contractor for the Project Walsh /Shea Corridor Constructors a company that was originally selected through MTAs public bidding process. The work is expected to commence during April 206 and to be completed within 6- months. The January 2003 City -wide Master Cooperative Agreement between the City of Los Angeles and the MTA provides for the waterline relocation work to be performed by the MTA and requires reimbursement for all costs to be paid by LAWA. Action Requested Staff requests the Board to approve the Agreement with MTA and authorize the Executive Director to execute the Agreement after approval as to form by the City Attorney. Staff also requests the Board to appropriate capital funds in an amount not to exceed $ to cover the Agreement. Fiscal Impact The costs incurred for this Agreement will be recovered through user fees rates and charges. Page 2

3 4. Alternatives Considered Take No Action Taking no action is not recommended. The waterlines are owned by LAWA and are critical to fire suppression system and the general cargo operations of the ICC. These lines have to be relocated to accommodate the Project. LAWA Performs the Work LAWA could perform the waterline relocation work but this would greatly delay the construction schedule of the Project. The work cannot be performed in a timely manner by LAWA to meet the MTA schedule as it would require the execution of a separate contract and would present serious challenges associated with having two contractors working in the same area. APPROPRIATIONS: Staff requests that funds in an amount not to exceed $ be appropriated and allocated from the LAX Revenue Fund to WBS Element (ICC Waterline Relocation - MTA Reimbursement). STANDARD PROVISIONS:. The issuance of permits leases agreements gate and space assignments and renewals amendments or extensions thereof or other entitlements granting use of existing airport facilities or its operations is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article Ill Class (8)(c) of the Los Angeles City CEQA Guidelines. 2. This item is subject to approval as to form by the City Attorney. 3. Actions taken on this item by the Board of Airport Commissioners will become final pursuant to the provisions of Los Angeles City Charter Section This action is not subject to the provisions of the Service Contractor Worker Retention and Living Wage Ordinances. 5.
