1 Report To: From: Development Services Committee Item: Date of Report: DS July 4, 2007 Commissioner, Development File: Date of Meeting: Services Department B July 9, 2007 Subject: Harmony Creek, Branch 1, from Olive Avenue to Ward(s): 3 Approximately 350m North PUBLIC REPORT 1.0 PURPOSE The purpose of this report is to advise Council that certain residents of Florell Drive, Walnut Court and Lorindale Drive have petitioned the City to undertake remedial creek bank stabilization work along the portion of Harmony Creek abutting their properties. Exhibit No. 1 to this report illustrates the general location of the subject reach and the residents who have petitioned for the work. The subject reach has a length of approximately 350m extending north from Olive Avenue to the confluence of Harmony Creek Branches 1 and 5. Exhibit No. 2 is a photograph showing the interim works that the City has carried out along a portion of Harmony Creek at Harmony Village Park. Exhibit No. 3 contains photographs taken recently along the subject creek reach. Attachment No. 1 is an example of the petition form letter used by the area residents. Attachment No. 2 is a list of the property owners along the subject reach who have petitioned for the work. Attachment No. 3 is a copy of the City s Cost-Sharing Policy for Bank Erosion Control Works on Private Property. 2.0 RECOMMENDATION That the Development Services Committee recommend to City Council: 1. That, based on Report DS dated July 4, 2007, the petition from the area residents of Florell Drive, Walnut Court and Lorindale Drive requesting the City to undertake remedial Creek bank stabilization work be received and filed. 2. That City staff be authorized to undertake a preliminary design and budget for bank stabilization works on Harmony Creek, Branch 1, between Olive Avenue and Harmony Village Park

That the remedial creek bank stabilization project be referred to the City s 2008 Capital Budget for consideration. 5. That a copy of this report be forwarded to the impacted residents on Florell Drive, Walnut Court and Lorindale Drive. 3.0 EXECUTIVE SUMMARY Over the last 10 years, the City has periodically received complaints regarding erosion problems along Harmony Creek Branch 1 from Olive Avenue to approximately 350m north. If left uncorrected, continued erosion will result in the loss of valuable lands and mature trees. A petition signed by the majority of the area residents requesting that the City undertake remedial creek bank stabilization work along the subject reach has now been received. It is recommended that the required creek bank protection works be considered as part of the City s 2008 Capital Budget. 4.0 INPUT FROM OTHER SOURCES On October 25, 2006, staff attended a meeting at the Donevan Community Centre organized by the residents of Florell Drive, Walnut Court and Lorindale Drive to discuss erosion along Harmony Creek and the possibility of the City undertaking erosion protection works. Messrs. John Vester and Doug Ackerblade organized the meeting and advised that 31 property owners were invited to the meeting. Over twenty property owners attended the meeting. On December 14, 2006, Mr. John Vester submitted a petition signed by 24 property owners requesting that the City undertake a remedial creek bank stabilization project to stop the active bank erosion at the back of their properties. Central Lake Ontario Conservation Authority staff have been consulted on various alternative methods to address the ongoing erosion problems and support an erosion protection project.

3 Report to the Development Item: DS Services Committee (Continued) Meeting Date: July 9, ANALYSIS Active erosion problems along this particular reach of Harmony Creek, Branch 1 (from Olive Avenue to approximately 350m north) have been identified and catalogued in the City s Watercourses Erosion Inventory. The reach has been rated as a medium priority site. There have been numerous complaints about erosion from area residents on this portion of Harmony Creek since In early 2001, in an attempt to slow down the erosion process, the City undertook an interim erosion protection project utilizing wood posts (Exhibit No. 2) along the east bank of the subject reach within the City s Harmony Village Park. The interim works have been effective in arresting erosion activities in the park, but do not address the erosion which is occurring on the balance of the subject reach. In this regard, the creek bank for this reach has deteriorated to a stage where, if left uncorrected, ongoing erosion will result in the loss of more useable private property, potential damage to existing erosion protection measures installed by property owners and the loss of mature trees (Exhibit No 3). A petition signed by the majority of the area residents (24 out of 31 properties) abutting this reach of Harmony Creek has been received requesting that the City undertake erosion protection works and agreeing to cost sharing. While the petition does not represent unanimous consent from the affected property owners as required by City policy (Article 6, Attachment No. 3), there are sufficient signatures to warrant proceeding with a preliminary design and budget to present to all property owners for their consideration. Funding for the project should therefore be referred to the 2008 budget. 6.0 FINANCIAL IMPLICATIONS The project, if approved by Council as part of the 2008 Budget, will be subject to the City s current cost-sharing policy for bank erosion control works on private property, which requires a cost sharing of 85% (City) and 15% (property owners). The majority of the City s share is expected to be funded through development charges. An estimate has not yet been developed for this project but will be prepared as part of the preliminary design and included in the 2008 Capital Budget submission.
