OLD BUSINESS None. V. COUNSEL REPORTS Lawsikia Hodges & Bob Sugarman 1. Brotherhood Settlement Lawsikia Hodges said Timothy Johnson had asked her to provide an update on this settlement. Rita Mairs and other OGC litigators are handling the case. City Council needs to agree to the settlement document as introduced on April 24. It will be up for discussion and public comment in May. The case must go through the courts as a consent decree. The bill number is Rita Mairs and other OGC litigators plan to meet with the PFPF Board of Trustees. Any Board action would not be necessary any earlier than by the end of the year. Bob Sugarman updated the Advisory Committee on a number of issues his office is working on A deceased member s family has asked the PFPF to pay them directly. Bob Sugarman sent them a letter informing them that the PFPF cannot do that by law. The PFPF must pay the estate directly. The PFPF cannot designate beneficiaries. A member s Chapter 13 bankruptcy case Creditors asked the PFPF to make payments to the trustee, but research shows this cannot be done. A member is in prison and the Court ordered the member to pay restitution to his victim through his pension. The Court Order was not properly addressed to the PFPF; once the order is rewritten, the PFPF will start the deduction. Jason Mann s pension is not forfeitable because he pleaded to a misdemeanor, not a felony. Bob Sugarman s office will issue a final letter stating that his pension is not forfeitable. DROP & COLA Opinion Bob Sugarman s office has continued to discuss with Lawsikia Hodges and Steve Lundy. Steve Lundy has done an amazing job thinking of variations of members who may have a right to make this election. Lawsikia Hodges and Bob Sugarman have discussed practical advice to the PFPF. Bob Sugarman recommends members talk to the PFPF office before they settle their divorce, bankruptcy, and other legal cases. This will save them lots of money in lawyers fees resulting from incorrect court orders. Bob Sugarman encouraged the Advisory Committee to attend the Division of Retirement Trustees School in Tallahassee in June. VI. EXECUTIVE DIRECTOR S REPORT Timothy Johnson
12 P O L I C E A N D F I R E P E N S I O N F U N D A D V I S O R Y C O M M I T T E E M E E T I N G S U M M A R Y M A Y 9, Page 7 Timothy Johnson discussed the Beaches Time Service Connections (TSCs) issue. He had an important meeting with Lawsikia Hodges and Steve Durden at the end of last month. Members are asking the PFPF how this error started. Two opinions were received in June 2016 that answered different questions. Those opinions and following conversations were misinterpreted to mean all Beaches TSCs should cost less than the usual, correct rate. Richard Reichard asked what the correct rate is 8% or 20%. Timothy Johnson answered 20%. There were no questions asked concerning what Beaches TSCs should cost. Conclusions were drawn from other answers to unrelated questions. James Holderfield said members would be notified of their due process to appear before the Board of Trustees or Unions. Usually issues like these that come before the Advisory Committee relate to disability applications. 1. DROP & COLA Plan Election Sessions Timothy Johnson said that the DROP & COLA Benefit Plan Elections are ready to go public. The Actuary translated the DROP & COLA Benefits Opinion into an actuarial definition of affected members. That language was sent to ITD to generate a list of all affected members, which is now complete. The PFPF will notify these affected members later today of upcoming educational workshops on May 30-31, and June 4-5. They may make their election at the workshops or at the PFPF office starting May 30. Timothy Johnson added that these members benefit plan elections would be retroactive to the date they retired or entered the DROP, if applicable. 2. Bailiff Time Service Connection Update Timothy Johnson said that out of about 90 applicants who wish to purchase bailiff time, only two are close to retirement eligibility. One member has 20 years of service, and the other will accrue 20 years within 4 months. He said he is confident that the PFPF will go through the list quickly once the data file is received from JSO. He does not expect all 90 applicants will be eligible to connect the time, as the threshold of requirements to purchase time is high. The complete data file is expected by May 25. James Holderfield asked if the quarterly DROP statements have been suspended. Timothy Johnson said only the DROP statements for the members affected by the DROP & COLA Benefits opinion have been suspended. He does not want to send members incorrect data. He said statements would resume once all adjustments are made relative to members elections. This might not be complete until the end of the calendar year. James Holderfield asked if a member could enter the DROP after they start purchasing time through payroll deduction over 5 years.
