1 OFFICIAL ELECTION INFORMATION April 18, 2012 TO: County Election Officials and County Registrars FROM: Linda Ford, Director of Elections RE: T-SPLOST, Election Supplies and Ballot Information Thank you for a successful phase one (the PPP) of the 2012 Election Cycle. Call for Transportation Investment Act of 2010 As a reminder, the Transportation Investment Act of 2010 requires an election for submitting the question on the imposition of a special district transportation sales and use tax to be held in conjunction with the 2012 statewide general primary. Pursuant to O.C.G.A , each election superintendent shall issue the call for an election submitting such question to the voters within each multi-county special district and shall conduct the election in the same manner authorized under O.C.G.A Furthermore, the election superintendents shall cause the date and purpose of the election to be published once a week for four weeks immediately preceding the date of the election in the official organs of their respective counties. 4,4 Department of Transportation has provided a sample template for the "call" that is available for your review on elearn through the T-Splost Course Page on elearn. Please note that the template is provided as a sample for your review. You may make any necessary amendment. Pursuant O.C.G.A , the call for this election must be published prior to May 03, Please review O.C.G.A and before finalizing the call for publication. Please submit your inventory report using the Mandatory Election Inventory on the County
2 Reporting Page of elearn ( by close of business on Monday, April 30, The Inventory provides links to the most current version of the form in the elearn Forms Library. Please submit only one Inventory per county (see submittal instructions on the form). We will not process your etraker order until we receive an inventory response from your county. Our office will accept and process absentee orders for those counties who completed their survey by the deadline beginning on Monday, May 14, All absentee supplies should be ordered no later than Friday, May 25, Election Day supplies can be ordered Monday, June 18, 2012 Friday, June, 29, Please allow 2-3 weeks for your orders to be processed and shipped. Ballot Information Please answer the What's on the Ballot for the July Primary Survey to share what for offices and issues will be on your July Primary Ballot in addition to the state wide races. We know that all counties will have their state races as well as the non-partisan judicial offices. Please include the other races at the county level. Also, on the What's on the Ballot for the July Primary please include a copy of your call for any special elections (other than the TSPLOST) that will be on your ballot. Please be mindful that one of the duties of an election superintendent (as outlined in O.C.G.A (3)) is "...to transmit immediately to the Secretary of State a copy of any publication in which a call for a special primary, election, or runoff is issued." 3 CALL FOR SPECIAL ELECTION GEORGIA, Ben Hill COUNTY: THAT:, SUPERINTENDENT OF ELECTIONS for the above State and County, DO HEREBY CERTIFY WHEREAS, in the 2010 Georgia General Assembly, the House and Senate passed House Bill 277, known as the Transportation Investment Act of 2010, to provide 12 special tax districts across the State and to provide for a special district transportation sales and use tax in such special districts; and WHEREAS, in accordance with Code Section of the Transportation Investment Act of 2010, the Southern Georgia special district Roundtable, of which Ben Hill County is a part, officially approved a Final Investment List to be funded through the special district transportation sales and use tax; and WHEREAS, the special one percent (1%) sales and use tax will not exceed a projected revenue generation amount of $670,985,361 for the Southern Georgia special district, and shall not exceed ten (10) years in duration commencing January 1, 2013; and WHEREAS, Seventy-Five percent (75%) of the projected revenue generation amount will fund the approved Final Investment List of the Southern Georgia special tax district and Twenty-Five percent (25%) of the projected revenue generation amount will be directly distributed to the cities and counties of the Southern Georgia special tax district by formula for local transportation uses; and WHEREAS, the Southern Georgia Roundtable has made a resolution to the Superintendents of Election of the Southern Georgia special tax district, as specified in the Official Code of Georgia Annotated , to notify the election superintendent to issue the call for election for the purpose of submitting to the electors of the county the question of whether such sales and use tax shall be granted for approval or rejection; and WHEREAS, in accordance with Code Section , the election results will be tabulated per district and if more than one-half of the votes cast throughout the special district are in favor of levying the tax, then the tax will be levied in said special district as specified; and WHEREAS, the Final Investment List to be undertaken and completed utilizing 75% of the projected revenue generation amount in the Southern Georgia special tax district are as follows: Project ID Project Name County RC City of Willacoochee New Access Road to Industrial Park Atkinson County RC Widen SR 89/US 441 from CR 101/Clinch to SR 520 in Atkinson County Pearson/Atkinson RC Bacon County Airport Terminal Bacon County RC CR 327 Big Satilla Creek Bridge Replacement Bacon County RC SR 4 Alt/SR 4/Floyd Street Intersection Realignment Bacon County

(2) That said Special Election shall be held on July 31, 2012, between the hours of 7:00 a.m. and 7:00 p.m.; that all persons who are not registered to vote and who desire to register to vote in the special election may register to vote through the close of business on July 2, (3) That the question to be put before the voters of Ben Hill County, as part of the Southern Georgia special tax district, shall be placed on the ballot and read as follows:
