1 INVITATION TO BID PEST CONTROL SERVICES The Ware County Board of Commissioners is seeking bids from contractors to provide Pest Control services for all the county buildings listed in the bid package. Scope of work shall include Provide labor, materials, and equipment necessary to treat the buildings specified for the pest(s) specified on a monthly basis and as otherwise required. Contract Time The contact shall be for the period beginning July 01, 2016, through June 30, 2017, known as FY 2017, and shall be renewable for an additional two years (FY 2018 & FY 2019) at owner s discretion. Terms and Time of Payment The contractor shall present the owner with an invoice each month, per the specifications, for approval by the owner s representative. Upon approval invoices shall be paid within a maximum of 30 calendar days of receipt of invoice. Ware County prefers to pay by Procurement (Visa Credit) Card. Bonds and Insurance 1. Bid Bond is not required. 2. Payment & Performance Bonds are not required. 3. Contractor must provide General Liability insurance in the amount of $1,000, and Vehicle Insurance in the amount of $500, per vehicle. 2 INSTRUCTIONS TO BIDDERS Bids will be opened and read as stated in the Invitation to Bid. All bids must be submitted on the same form as the specimen shown on pages with BID FORM as a header of this document and must be signed. All blanks on the Bid Form must be filled in. The completed form shall be without interlineations, alteration or erasure. Failure to submit a bid in the form requested will render the bid irregular and shall be considered sufficient cause for rejection of a bid. Bids shall be received until Tuesday, May 10, 2016, 10:30am at the address: Ware County Commission Office, Attn. Mrs. Elizabeth Hope, 800 Church Street, Suite 223, Waycross GA 31501, and shall be opened after that time. No bids received after this date and time shall be opened or considered. Bids are to reach the address designated in the Invitation to Bid no later than the time and date named in the Invitation to Bid. After time has been called, no proposal may be withdrawn for a period of thirty (30) calendar days. Negligence or error on the part of any bidder in preparing his proposal confers no right of withdrawal or modification of his proposal after time has been called. BONDS & INSURANCE No Bonds are required, because the owner is paying by approved invoices, for work completed in place and approved by the owner only. Contractor must provide proof of General Liability Insurance in the amount of $1,000, and insurance for vehicles in the amount of $500, per vehicle. Contractor must provide proof of Worker s Compensation coverage, as required by law, or a Worker s Compensation Exemption Affidavit. (Included in this bid package) AWARD OF CONTRACT The owner reserves the right to reject any or all bids and to waive all minor technicalities, informalities and irregularities. Owner reserves the right to accept the bid, which in the judgment of the Owner is in his best interest. CONTRACT RENEWAL If the contractor has provided acceptable service during the contract term, Ware County may at its discretion offer to renew the contract under the same terms and conditions for an additional two (2) one (1) year terms for a total contract length of 3 years. The contact shall be for the period beginning July 01, 2016 through June 30, 2017 known as FYE Ware County reserves the right to renew the contract for an additional two contract periods as follow: July 01, 2017 through June 30, 2018 known as FYE 2018 FY 2107 PEST CONTROL BID Page 2 of 17

3 July 01, 2018 through June 30, 2019 known as FYE 2019 Ware County reserves the right to negotiate the contract pricing as may be reflected by economic changes, only at the time of contract renewal for the next contract period. NEGOTIATION Ware County reserves the right to negotiate with the lowest and/or best bidder for value engineering changes, after bid opening and establishment of the lowest and/or best bid, before the contract is awarded and/or after contract award. Negotiations will not be made to increase the contract price except in the instance of additional and/or changes in the scope of work added to the contract. TERMITE CONTRACTS Termite Control is not part of the Pest Control Contract. The contractor shall immediately notify the Facilities Coordinator of any detected termite activity or infestations. Ware County has some buildings under termite contracts and on these buildings such activity will be reported to the responsible party for reconcillation. The contractor shall give recommendations and quotes for spot or total treatment of facilities not covered by a termite contract. Ware County shall not be obligated to use the Pest Control Contractor and may contact other providers for price quotes comparisons and enter into termite contracts with them as they choose. Ware County will decide upon the best course of action on their behalf and may request that the Pest Control Contractor provide a quote to treat the facility for termites. Ware County reserves the right to get quotes from other Pest Control Contractors as well and to award to the lowest and/or the best treatment plan presented. SUBMITTALS Before proceeding to work, the contractor must provide the following information to the owner s representative, Clarke Lee, Facilities Coordinator, 800 Church Street, Suite 218, Waycross GA Copy of current valid business license. 2. Proof the company has been in the Pest Control Business for at least five (5) consecutive years under the same business name. 3. A copy of the company s "Commercial Applicator s License" issued by the State of Georgia, stating the areas in which your company is licensed by the State to work. 4. A copy of each applicator s current certification, "Structural Pest Control Employee Registration Card" 5. Executed W 9 Form 6. Certificates of insurance meeting or exceeding requirements, by companies that are authorized by the State of Georgia to do business in Georgia. 7. Executed E Verify Form or E Verify Exemption Form (Included in this document) 8. Proof of Worker s Compensation Insurance or a Worker s Compensation Exemption Affidavit (Included in this document) 9. Schedule of Values for Unit Cost of work to be done. The objective is to have a unit cost for addition or deletion of work units and material units. 4 10. Provide 24 hour, seven day a week, contact information in case of an emergency need to alleviate a pest control need. NOTE: THE OWNER MUST APPROVE ALL SUBMITTAL DATA BEFORE PROCEEDING TO WORK. NOTICE TO PROCEED Upon receiving and approving all the submittal data required, the owner shall issue (in writing by letter, fax or ) a Notice to Proceed and the contractor may then begin work in accordance with an approved work schedule being established. SCHEDULING OF WORK, SITE VISITS & HOURS OF ACCESS Contractor shall render service once a month for all facilities under contract, on or about the same calendar day. Schedule site visits through the Facilities Maintenance Department. In many facilities the technician will be escorted by maintenance personnel to provide access to otherwise inaccessible areas to be treated. The contractor shall schedule work, with the owner, to not interfere, or minimize interference, with normal operations of the buildings and to insure the safety of staff and visitors. Access to secure areas must be coordinated through the appropriate contact in each building. Ware County expects work to be performed during normal hours of operation in areas that normal operations of the facility can continue. For work required that cannot be accomplished safely during normal hours of operation the contractor must coordinate and schedule this work to be done at a time when it will be safe to proceed. APPLICATIONS FOR PAYMENT The Contractor shall submit to the Owner an invoice for the total monthly billing per the contract pricing and "Schedul of Values" for approval and payment. Invoices shall be accompanied by signed Service Orders for each individual facility treated. The Service Order shall list the: Date of Service, Time of Service, treatment method, Chemicals and quantities used and any other pertinent information required by law. Payment for each invoice will be made within 30 calendar days of approval. Items in conflict will be researched and the contractor shall supply the needed information to approve them or remove them from the invoice. If the invoice amount has changed the contractor shall submit a revised invoice reflecting the corrected amount for payment. Ware County prefers to make payments via Procurement (Visa Credit) Card, utilizing online payment services if available. If contractor does not offer these services, invoices will be paid by check. ADDING & DELETING BUILDINGS Buildings may be added or deleted from the list, as determined by Ware County, and the monthly billing shall be adjusted to reflect the changes. It is the intent that there be an established per square foot (SF) value by the total building SF of treated area. This established value will be utilized in adding and/or deleting facilties from the "Schedule of Values". For the addition of new buildings to, or the removal of buildings from, the "Schedule of Values" the rates shall be adjusted per the SF rate of the contract unless there are extenuating circumstanaces. In the event of extenuating circumstanaces, the contractor and Ware County shall agree upon a monthly cost and amend the building list and Schedule of Values to reflect the change. 5 QUALIFICATION OF BIDDERS Bids shall be considered only from Contractors who are financially responsible, able to show evidence of satisfactory past performance, and ready, willing and able to render prompt and satisfactory services, able to give proof that his/her company has been in the Pest Control Business for at least five (5) years under the same business name, proof he/she has available under his/her direct employment and supervision the necessary personnel, organization and facilities to properly fulfill all the services and conditions required under these specifications. The Ware County Board of Commissioners is the sole determiner of a qualified bidder and may request other information sufficient to determine bidder's ability to meet these minimum standards listed above. Request for information contained in this section may also occur at any time during the effective period of this Contract, or any extension/renewal thereof. GENERAL BIDDING REQUIREMENTS FOR PEST CONTROL SERVICES The Contractor must have a current legal license, for all the work in the contract, from the State of Georgia and a current city and/or county business license, if required, and is expected to perform all work with competent licensed/certified personnel. All work is to be coordinated with the county s representative, Ware County Facilities Coordinator, Clarke Lee, or his designee. The contractor must provide and keep in effect the entire contract period a current license, issued by the State of Georgia, stating the areas in which your company is licensed by the State to work. The contractor must provide and keep on file with the owner a current " Permit", issued by the State of Georgia, showing the particular certification for the person performing the specific work in reference to this contract. Contractor must provide General Liability insurance in the amount of $1,000, and Vehicle Insurance in the amount of $500, per vehicle, through a company that is licensed and authorized by the State of Georgia to do business in Georgia. The Contractor must be capable and willing to provide all the services contained in this contract. All work performed and decisions made concerning this work will be in the best interest of the owner either by; longevity of equipment or services, or by monetary means, or monetary savings. GENERAL REQUIREMENTS Pest Control: The contractor shall be required to furnish and install all labor, equipment, parts, chemicals, and materials necessary, and all other items necessary, to do a complete and professional job, of monthly Pest Control Services treatment for the Ware County buildings listed, or added to the list, throughout the contract period. Wasp & Bees Contractor shall treat the inside of all buildings and outdoor populations of potentially indoor infesting species that are within the property boundaries of the specified buildings. Contractor shall treat the exterior of all buildings, including sidewalks and entrances, and around the air conditioning equipment, with granular treatments, or other treatment, as may be needed to keep pest from entering the buildings and/or causing damage to equipment. Notices and Postings: All notices and etc. required by law shall be furnished by the contractor and posted as required by law. Billing: Each monthly invoice shall be accompanied by: A "CHECK LIST" sheet (a sample is provided in this document) that list the Facility Name, Facility Address, Date of Treatment, and Signature by Ware County Representative present at time of treatment Followed by, Individual field reports that: Identify each facility individually, Date & time of treatment, Technicians Name Type of pest treated for Chemicals used and if applicable systems or devices used Chemical strengths/mixtures, application rate, and total amount used Equipment used Type of service (Monthly, Bi Monthly, Quarterly, Annual, Call Back and etc.) List all areas treated Note any untreated areas and why they were not treated. Signed by the technician/applicator, Signed by a Ware County representative in that facility that can verify that the treatment has been done. All paperwork shall be turned in to the Facilities Coordinator or his designee. RECALL FOR SERVICES Contractor may be recalled for pest treatment at any time deemed necessary, and shall respond in a timely manner at no additional cost to Ware County. RULES AND REGULATIONS The Contractor must perform Pest Control Services per the current rules, regulations and standards of the Georgia Structural Pest Control Act, the Structural Pest Section (SPS) and all other current Federal, State or Local codes, laws, regulations, manufacturer's recommendations, and trade standards. SAFETY STANDARDS The contractor must comply with all current rules and regualtions for safety as required by Federal, State, or Local laws, regulations, ordinanaces and standards. 7 The Contractor will furnish 24 hour, 7 days a week, contact information to the owner such as office phone numbers, cell phone numbers, text messaging if available, and , if available, for after hours methods of making contact. YEARS OF SERVICE The contractor is required to have operated an established business that was continually licensed to perform Pest Control Services for a minimum of 5 years. UNSATISFACTORY OR UNACCEPTABLE WORK OR MATERIALS Any work or materials found to be unacceptable or unsatisfactory shall be removed and replaced in conformance with the contract documents, rules, laws, and regulations. Should the Contractor fail to make, unacceptable or unsatisfactory work or materials, satisfactory or acceptable, Ware County may use any means necessary to make the work acceptable and charge all cost to the Contractor, who agrees to pay all such cost. DAMAGE The contractor shall be fully responsible for the safety and good condition of all work and materials until work is completed and accepted by the owner. The contractor shall take care to not damage existing items to remain, new items installed, or other portions of the building or grounds, and all persons (employees or visitors) and personnel in the fulfillment of the contract. DAMAGE COST All restoration of damages shall be done without any cost to the owner. If Ware County has to expend any funds to make restoration repairs, for council or law suit to collect the monies due, the contractor agrees to reimburse Ware County all restoration and legal cost. HOLD HARMLESS AGREEMENT The Contractor agrees to indemnify, defend and hold harmless Ware County, and all its affiliated parties, from and against all claims arising out of or resulting from the activities performed on the Property. "Claim" as used in this agreement means any financial loss, claim, suit, action, damage, or expense, including but not limited to attorney's fees, attributable to bodily injury, sickness, disease or death, or injury to or destruction of tangible property including loss of use resulting therefrom. TERMINATION OF CONTRACT The Ware County Board of Commissioners may, at any time they deem necessary, terminate this agreement with written notice, for any justifiable reason, such as incompetence in performing the contract requirements. Payment shall be made for all approved and accepted work. No payment shall be made for unapproved or unacceptable work. Some, but not all, reasons for termination of contract are: Ware County having to call the contractor to retreat a facility. Failure of the contractor to keep facilities free of pest. Failure of the contractor ot maintain a regular treatment schedule. Failure of contractor to respond in a timely manner to call backs Failure to correct deficiencies in pest control that are pointed out Acts of irresponsibility, neglect, or lack of professionalism. 10 BID FORM PEST CONTROL BID It is the intent of these specifications to describe the items needed and requirements to be met to provide Ware County with Pest Control Services for county buildings. Please complete the following bid documents and include all charges for this contract. Ware County will not be responsible for any charges not shown on this contract, without prior approval from the Facilities Coordinator or his designee.
