1 Minutes of the 48 th SEIAA Meeting held on 5 th February, 2011 The 48 th meeting of the State Level Environment Impact Assessment Authority was convened on 5 th February, 2011 at A. M. at the Authority's office in M.P. Pollution Control Building, Paryavaran Parisar, Bhopal chaired by Shri Amar Singh, Chairman SEIAA. The following members attended the meeting:- 1. Shri M. Hashim, Member 2. Shri Praveen Garg, Member Secretary (A) Cases received from MoEF for Prior Environmental Clearance 1. M/s Twenty first century Developers Pvt Ltd, 6 th Floor, Treasure Island - II, Tukoganj, Main Road, Indore M.P. Residential Township project at village Bijalpur, Indore- M.P. Case no 229/2008 The case was considered in the 43 rd SEIAA meeting and following decision was taken. It was observed by the Authority that the project is proposed in Indore city, on the basis of the building permission issued by Indore Municipal Corporation. Since Indore city is a critically polluted area having CEPI more than 70. The Ministry of Environment and Forests, Vide its Office Memorandum dt 26/10/2010 had imposed a moratorium up to 31 st March 2011 in such type of cases. It was decided to put up the case before the Authority after further instructions from the Ministry. The Project Proponent on the basis of the 43 rd SEIAA meeting minutes submitted his reply which was considered by the Authority in today s meeting. It was agreed by the Authority that the moratorium which is extended up to 31 st March, 2011 vide MoEF office memorandum dt 26/10/2010 is for industrial clusters. Hence it was decided by the Authority to grant Prior Environmental Clearance to the above project. Page no 1 of 7

Shri Shantilal Singhvi, Director, M/s Vinayak Natural Stone Pvt Ltd, Udaypur, Marble mine hact. at near village- Dinarikhamaria, Teh- Majholi, Distt- Jabalpur M,P, Case no 241/2008 The above case was considered in the 64 th SEAC meeting and recommended for Prior The Authority while scrutinizing the document observed that the mine is located within 250 m from Forest boundary. The Proponent has submitted the notarized copy of the NOC issued by the Competent Authority as per Govt. of M.P., Forest Deptt Order no F-5/16/81/10-3.dt Hence the Authority accepted the recommendation of SEAC and decided to accord Prior Environmental Clearance to the above project. 3. Shri Jagdish Dhaneria, 119/1 Kumawatpura, Juni-Indore M.P., Bauxite laterite & clay deposit, 9.71 hact. at village Chitti, Jagir, Teh-Sirmour, Distt-Rewa-M.P. Case no 255/09 The above case was considered in the 61 st SEAC meeting and recommended for Prior mining lease area from inter-state boundary has not been submitted. Hence it was decided to write to the Distt.Collector asking the above information up to 31 st March, M/s Pacific Exports 11, Dunne market, JBP Road Bargawan, Katni- M.P., Jhiiti Iron ore, Blue dust and laterite mine ha at village Jhiiti, Teh- Sihora, Jabalpur-M.P. Case no 265/2009 While scrutinizing the documents related to the above case the Authority came to know that a W.P. No. 1072/2011 was filed by Santu S/o Vishram and Sukhlal S/o Faguram Vs Union of India and others. In this writ petition the Authority has also been made the respondent. The Hon ble High Court of Madhya Pradesh has passed an order on 19/01/2011 and directed Counsel Shri Shroti to inform whether any Prior permission under the law has been obtained by the proponent. 3 Hence it was decided by the Authority to ask Advocate Shri Shroti about the latest development in the W.P. no 1072/2011. He may also be asked whether any stay has been granted by the Hon ble High Court as prayed by the petitioner in their writ petition. It was also decided that the Member Secretary shall examine all the documents related to the case in the meantime. The case may be put up before the Authority after getting a reply from the Advocate. 5. Naginchand Bansal Om Niwas, Ramkrishnaganj, Behind Mandi gate, Khandwa- M.P., Basalt (Metal stone) mine cum/annum hact. at Bhavsinghpura, Teh-Khandwa, Distt East Nimar M.P. Case no 273/2009 Mining Lease Area from the Forest boundary and the protected areas under Wildlife Protection Act, 1972 has not been submitted. Hence it was decided to write to the concerned DFO asking him the above information up to 31 st March, Rowell mining corporation, Rawal Building, plot no- 18, 190, Ramdaspath, Nagpur- (M.H), Ranpeth Damani manganese ore mines ha. 600 tonnes per annum at village Ranpeth Damani Teh- Sausar, Chhindwara -M.P. Case no 287/2009 The above case was considered in the 61 st SEAC meeting and recommended for Prior The Authority while scrutinizing the documents observed that the distance of the mining lease area from interstate boundary is not submitted. Hence it was decided to write to the Distt.Collector asking the above information up to 31 st March It was also observed by the Authority that the Proponent has not submitted an attested/notarized copy of the valid Mining lease. Hence it was decided to write to the Project Proponent asking him to submit the above information up to 31 st March A copy of the letter shall be endorsed to the Minerals Resources Deptt. and the Distt.Collector. 4 7. M/s Murlidhar minerals, Malegaon, Sausar Chhindwara-M.P., Malegaon dolomite mine hect TPA at village- Malegaon, Teh-Sousar, Distt-Chhindwara- M.P. Case no 299/2009 The above case was considered in the 63rd SEAC meeting and recommended for Prior It was observed by the Authority that the Proponent has submitted a copy of the Mining Lease signed in the year 1994 for 10 years. It was decided to ask the Project Proponent to submit an attested/notarised copy of the valid mining lease by 31/03/2011. A copy of the letter shall be endorsed to the Mineral Resources Deptt. and the Distt.Collector. 8. M/s S.B. Granites Ltd., 614, Apex Mall, Lalkothi, Tonk Road, Jaipur, Silpatpura Granite mine 5.0 ha. at Village Silpatpura, Teh- Laundi, Distt-Chhatarpur-M.P. Case no 422/2009 mining lease area from interstate boundary is not submitted. Hence it was decided to write to the Distt.Collector asking the above information up to 31 st March It was also observed by the Authority that the Proponent has not submitted an attested/notarized copy of the valid Mining lease. Hence it was decided to write to the Project Proponent asking him to submit the above information up to 31 st March A copy of the letter shall be endorsed to the Minerals Resources Deptt. and the Distt.Collector. 9. M/s S.B. Granites Ltd., 614, Apex Mall, Lalkothi, Tonk Road, Jaipur, Silpatpura Granite mine 7.0 ha. at Village Silpatpura, Teh- Laundi, Distt-Chhatarpur-M.P. Case no 423/2009 mining lease area from interstate boundary is not submitted. Hence it was decided to write to the Distt.Collector asking the above information up to 31 st March Page no 4 of 7

5 It was also observed by the Authority that the Proponent has not submitted an attested/notarized copy of the valid Mining lease. Hence it was decided to write to the Project Proponent asking him to submit the above information up to 31 st March A copy of the letter shall be endorsed to the Minerals Resources Deptt. and the Distt.Collector 10. Jujawal Marble Deposit, 993, Badi Omti, Distt- Jabalpur-M.P., Jujawal Marble depost 8.19 ha. at Village- Jujawal, Teh- Bahoriband, Distt- Katni- M.P. Case no 438/2009 The above case was considered in the 61st SEAC meeting and recommended for Prior The Authority while scrutinizing the docuemnts observed that the Proponent has not submitted the distance of mining lease area from the forest boundary and the protected area under Wildlife Protection Act Hence it was decided to write to the concerend DFO asking him the above information up to 31st March It is also observed by the Authority that the mining lease area mentioned in Form-I and the mining lease document are different. Hence it was decided to write to the Proponent to submit the clarification along with the attested/notarised copy of the relevent documents. The copy of the letter written to the Proponent should be endorsed to the Mineral Resources Deptt. and the Distt.Collector. 11. Granite India, Gupta complex, Near Bus stand, Distt- Chattarpur-M.P, Production of Granite for proposed quarry C 10.0 ha. at village Silpatpura, Distt- Chhatarpur- M.P. Case no 456/2009. mining lease area from inter-state boundary has not been submitted. Hence it was decided to write to the Distt.Collector asking the above information up to 31 st March, Page no 5 of 7

6 12. Shri Mordhawaj Mishra, Yadav Gas Agency, Kolgawan, Distt-Stana M.P, Devra Laterite mine ha. at Village Devra, Teh- Rampur, Baghelan, Distt-Satna M.P. Case no 460/2009 The Authority accepted the recommnedation of SEAC and decided to grant Prior Environmental Clearance to the above project. 13. M/s Kisan Minerals Pvt Ltd, P.O Bijuri, Distt- Anuppur, Silpatpura Granite mine ha. at village Silpatpura Talluka, Laundi, Distt- Chhatarpur-M.P. Case no 464/2009 The above case was considered in the 61 st SEAC meeting and recommended for Prior mining lease area from inter-state boundary has not been submitted. Hence it was decided to write to the Distt. Collector asking the above information up to 31 st March, Collage group Khaneja Properties Pvt. Ltd, 56-58, Community centre, East of Kailash, New Delhi, Propose residential development of Khasra no. 552/2, 527/2, 553/1 at village Bairagarh, Chichli, Kolar road, Bhopal-M.P. Case no 491/09 The Authority while scrutinizing the documents observed that SEAC has not given the detail recommendations. While as per the EIA notification, the project should be appraised on the basis of the manuals of MoEF and a detail recommendation should be forwarded to SEIAA covering all the environmental aspects. Hence it was decided to send the case back to SEAC for reconsideration. SEAC should send back the case within 45 days from its reconstitution. Page no 6 of 7

7 15. M/s Samdriya Builders Pvt Ltd, Samdariya House, Russel Chowk, Distt-Jabalpur- M.P, Shopping mall with multiplex, civic centre at Jai Prakash, Narayan ward scheme no-18, Distt-Jabalpur-M.P. Case no 516/2010 The above case was recommended by SEAC for Prior It was considered in the 43 rd SEIAA meeting and following decision was taken After the constitution of SEIAA on 12 th November 2010 this case was sent back to SEIAA for consideration by MoEF and was received on 04/12/2010. As per the provisions of EIA notification the SEIAA has to take a final decision and communicate to the proponent accordingly within 45 days from the date of receipt of recommendations from SEAC. As the prescribed period is over, it was decided to get a clarification from MoEF in light of the provision of EIA notification dated of Ministry of Environment and Forests.. As per the policy decision taken in the 47 th SEIAA meeting the above case was again considered in this meeting. The Authority accepted the recommendation of SEAC and decided to accord Prior Environmental Clearance to the above project. 16. Western coalfields Ltd, Coal estate, Civil Lines, Nagpur, Harrado under ground coal mines ha. at Teh- Junerdeo, Chhindwara M.P.Case no 119/2008 The above case was recommended by SEAC for Prior It was considered in the 47 th SEIAA meeting and was deferred for today s meeting. While scrutinizing the documents submitted by the Proponent it was noticed that the mine is located within Forest Area. As per the Principal Chief Conservator of Forests (Wildlife) letter no 946 dt 18/02/2010 the mine is located between Satpura and Pench Tiger Reserves. As per the EIA notification of 2006, General consideration, if a project is located within 10 KMS from the protected area under Wildlife Protection Act, 1972, it will not be in the jurisdiction of SEIAA but shall be considered by the Ministry of Environment and Forests Govt.of India. Hence it was decided to get the exact distance of the mine from the above protected areas from the Principal Chief Conservator of Forests (Wildlife) by 15 th March, Meeting ended with a vote of thanks to the chair Page no 7 of 7
