Be it enacted by the General Assembly of the State of Colorado: Act". SECTION 1. Short title. The short title of this act is the "Energy Storage Procurement SECTION 2. 9 EVRAZ Statutory Contract (pursuant to , C.R.S.) PSCo, through an unregulated affiliate, will enter into a PPA for a 240 MW solar facility and make those PPA payments The solar facility will be interconnected as a net-metered resource for EVRAZ EVRAZ will pay PSCo the statutory contract rate (cents/kwh) for all electricity use PSCo will calculate a shadow bill for EVRAZ equal to the current applicable tariff (Demand/Energy) rate for EVRAZ, as a net-metered customer The Clearinghouse function will assure that the fully-allocated system costs for EVRAZ are covered (and assigned as appropriate in any rate case) To the extent that revenues from the Statutory contact exceed the PPA cost plus the fully allocated system costs for EVRAZ, shareholders benefit. To the extent that they do not, shareholders will pay to make up the difference. 9
