2 1 We have been appointed under the Hospital Labour Disputes Arbitration Act to adjudicate all the issues in disputes in respect of a renewal collective agreement to the collective agreement between the parties that expired December 31, There is no dispute with respect to our authority in this regard. Hotel Dieu Hospital is the ambulatory care teaching and research hospital for Kingston and Southeastern Ontario and is affiliated with Queen s University. Hotel Dieu Hospital is one of three hospitals in Kingston with the other two hospitals being Kingston General Hospital and Providence Care. Hotel Dieu Hospital operates the Kingston Central Ambulance Communications Centre (Kingston CACC). There are 19 full-time and 14 part-time Ambulance Communications Officers (ACOs) in this bargaining unit. The Hospital has a total of eight bargaining units. The Hospital has seven OPSEU bargaining units and one ONA bargaining unit. Local 442 is the hospital professionals bargaining unit, which represents primarily Laboratory and Diagnostic Imaging Technologists and Technicians that bargain centrally. The collective agreement expires on March 31, Local 442 also includes health care professionals such as Social Workers, Behavioral Therapists, Physiotherapists, and Speech Pathologists that do not bargain centrally, and have a separate collective agreement. The collective agreement had expired on March 31, This unit went to arbitration on January 13, 2012 and the Board s award was received by the parties on May 17, The hospital and ONA bargain at the ONA central hospital bargaining table. Their collective agreement expires on March 31, 2014.

3 2 There is a service bargaining unit representing Weeneebayko Patient Services (also in Local 442). The collective agreement expired on March 31, The Information Services Employees were certified in August 2011 and the Hospital and the Union have not commenced bargaining. CENTRAL AMBULANCE COMMUNICATIONS CENTRES Central Ambulance Communications Centres (CACCs) are often the initial access point to Ontario s emergency health services system for many victims of illness or injury. CACCs prioritize the urgency of emergency requests, and provide callers with prearrival first aid instructions if required. CACCs determine the appropriate destination hospital and dispatch ambulances to meet patient needs. The Centres deploy, coordinate and direct the movement of all ambulances and emergency response vehicles within geographic catchment areas to ensure an integrated healthcare system. Computer-aided technology, such as automatic vehicle location using global positioning systems, helps the dispatcher to determine and assign the closest available and most appropriate ambulance to each emergency. There are 22 land ambulance CACCs located throughout the Province. Eleven CACCs are operated directly by the Ministry of Health and Long-Term Care and these eleven CACCs are covered by the collective agreement between OPSEU and the Management Board of Cabinet (the OPS Central Collective agreement). 391 OPS Ambulance Communications Officers (ACOs) work at these 11 CACCs across the Province. The eleven CACCs are located in the following cities: Barrie Cambridge Hamilton

4 3 Lindsay London Mississauga Renfrew Sudbury Thunder Bay Whitby Windsor There are close to 400 ACO1s employed by the 11 CACCs operated directly by the Ministry of Health and Long-Term Care and covered by the OPS Central Agreement. There are close to 60 ACO2s employed by the Province-run CACCs. ACO2s are supervisors. Five CACCs are operated by hospitals (including Hotel Dieu Hospital). Lake of the Woods Hospital operates the CACC in Kenora. North Bay Regional Hospital operates the CACC in North Bay. The Sault Area Hospital operates the CACC in Sault Ste. Marie. Chatham-Kent Health Alliance operates the CACC in Wallaceburg. Three CACCs are operated by municipalities. and the City of Timmins operate their respective CACC. The City of Ottawa, the City of Toronto Ontario also has three locally-based Ambulance Communications Services (ACS), serving the respective communities of Muskoka, Niagara Region and Parry Sound. These Centres dispatch one ambulance service, rather than multiple ambulance services that the CACCs deal with in their respective catchment area. KINGSTON CACC The Kingston CACC provides emergency medical communications and dispatching services twenty four hours a day, seven days a week for an area of approximately 35,000 square kilometers. The area extends from Brighton in the west to Iroquois in the east and to the Smiths Falls area in the north over to the eastern edge of Algonquin

5 4 Park. This area includes the Counties of Frontenac, Lanark, Leeds & Grenville, Lennox & Addington, Hastings and Prince Edward. There are 5 ambulance services in the catchment area. This catchment area has a population of 500,000. The Kingston CACC is not located on the premises of Hotel Dieu Hospital, but rather is located on 1473 John Counter Blvd, which is at the intersection of Sir John A McDonald Blvd and John Counter Blvd. Notice to bargain was served on October 2, The parties met to bargain on March 1 and 2, 2010 and April 9, Conciliation took place on September 13, 2010 and a no board report was issued. A hearing in this matter was convened on June 7, The parties have made full submission with respect to the issues in disputes. Having regard to these submissions and to the statutory criteria we award as follows: A W A R D The parties are hereby directed to enter into a renewal collective agreement to the collective agreement between them that expired December 31, 2009 that contains all of the terms and conditions in the predecessor collective agreement save and except as amended below: 1. All matters agreed between the parties prior to the date hereof 2. ARTICLE 17 BEREAVEMENT LEAVE (effective date of the award)

6 (a) A employee who suffers the loss of a spouse (which will include a partner of the same sex), son or daughter, shall be granted seven (7) consecutive calendar days leave of absence without loss of wages or benefits to make arrangements and attend the funeral. (b) A employee who suffers the loss of an immediate relative, other than one set out in Article (a) above, shall be granted five (5) consecutive calendar days leave of absence without loss of wages or benefits to make arrangements and attend the funeral. An immediate relative shall mean: mother, father, sister, brother, mother-in-law, fatherin-law, employee s grandparents, grandparent of spouse, grandchildren, or such other person as may have been a member of the employee s household at the time of death, i.e., guardian or ward. NEW (c) An employee shall be granted one (1) day bereavement leave without loss of regular earnings to attend the funeral of/or memorial (or equivalent) for his/her Aunt, Uncle, Niece or Nephew. 3. ARTICLE 26 BENEFITS AND INSURANCE (effective date of the award) The Employer agrees to pay one hundred percent (100%) of the Empire Life equivalent to Blue Cross semi-private coverage for each full-time employee. The Employer agrees to pay one hundred percent (100%) of the cost of the billed premium for Long Term Disability Insurance Benefits for each full-time employee who is eligible for the plan. The Employer agrees to pay one hundred percent (100%) of the monthly premium of the present Group Life Insurance Plan and eighty percent (80%) of the monthly premium for Extended Health Care Plan for all full-time employees. Effective January 1, 1987, the E.H.C. Plan will include a Vision Care plan which shall provide coverage of three hundred dollars ($300.00) per person within a two (2) year period to cover the cost of required eyeglasses, contact lenses or laser surgery. The Employer agrees to provide the Hospital of Ontario Disability Income Plan subject to the regulations pertaining to that plan. The Employer agrees to provide coverage of hearing aids, in the amount of three amount of three hundred dollars ($300.00) per person per five year (5) period. The Employer agrees to provide Registered Massage Therapy (medical referral required) up to $ per calendar year. The Employer agrees to provide chiropractic services up to $ per calendar year The Employer shall continue the existing dental plan (which is similar to Blue Cross NO. 9), with claims being reimbursed at the current O.D.A. fee schedule rate(s). The Employer agrees to pay seventy-five percent (75%) of the premium cost of the plan.

7 6 In addition to the existing dental plan the coverage shall include major restorative, crowns orthodontics at 50% co-insurance with maximum limits of $2, lifetime per insured person. 4. NEW LETTER OF UNDERSTANDING MENTORING NEW EMPLOYEES (effective date of the award) The Employer agrees to pay one dollar ($1.00) per hour for any shift spent mentoring. A mentoring shift is defined as anytime an employee is approved by the Employer to tutor or teach a new employee as part of his/her formalised training process. 5.
