1 HIGHLIGHTS OF THE COLLECTIVE AGREEMENT BETWEEN JUBILANT HOLLISTER STIER KIRKLAND, QUEBEC AND UNITED FOOD AND COMMERCIAL WORKERS INTERNATIONAL UNION LOCAL 291P, AFL-CIO Effective until April 30, 2018
2 MANAGEMENT RIGHTS Cannot terminate you without just cause (these members are NOT at-will employees). Grievance procedure for contract violations (conflict resolution). VACATION Years of Service Weeks Accumulated % Payable* Less than one (1) year One (1) day a month maximum of 10 days 4% One (1) year but less than three 2 weeks 4% (3) years Three (3) years but less than 3 weeks 6% nine (9) years Nine (9) years but less than 4 weeks 8% sixteen (16) years Sixteen (16) years but less than twenty-four (24) years 5 weeks 10% Twenty-four (24) years or more 6 weeks 12% *Vacation pay represents, for each week of vacation two percent (2%) of the total salary of the employee during the year preceding the one during which the one vacation is taken. Nevertheless, the vacation pay will never be inferior to the standard rate of the employee at the time where he/she takes vacation. HOLIDAYS (12 fixed) New Year s Day Second day of the New Year Holy Friday Queen s Day St-Jean-Baptiste Day Canada Day Labor Day Thanksgiving Day Christmas Eve Christmas Day Boxing Day December 31 Two additional holidays which are not fixed (if unable to take these two holidays, they will be paid out). Holiday overtime: An employee that, of his/her own free will, works during one of the mentioned holidays will receive two (2) times his/her standard rate of pay for this day. When an employee works more than the daily basic schedule of work during an agreed holiday, his/her total pay for the holiday is three (3) times his/her standard rate of pay for all the worked hours.
3 HOURS OF WORK Basic work week is 37 hours and thirty minutes. Day shift meal period is 45 minutes (unpaid). Swing shift meal period is 30 minutes but can be increased to 45. Work Schedule changes. Assigned to only one work schedule for the week. Before making any change, which have to be done the first week of the month, employer will have to fill its operational needs by soliciting overtime. If the schedule must still be modified, the following will apply: If the time between the shifts is bigger than 8 hours, the first day is paid at time and one half (1.5). If the time between the shifts is smaller or equal to 8 hours, the first day is paid at double time. If the time between shifts is zero, mandatory overtime cannot be forced, only voluntary overtime and the first day will be paid at double time. Overtime highlights: Employees are paid at time and a half (1.5) standard rate for the time worked over that scheduled for the day or the basic week of work. If an employee has an appointment and for which one that the employer was notified in advance (before the request for overtime), the employee will be paid for their worked hours, outside of their standard schedule, to the applicable rate upon providing the employer with proof of their appointment. No employee is called in for less than 4 hours of work or 4 hours of pay if being called in without performing work. Premiums: If called to collaborate by telephone to assist with a problem linked to work will receive $25 for this collaboration. The call must be previously authorized by a supervisor. Employees qualified as Lead in their specialty will receive a premium amount of $150/week ($4.00/hr). Swing shift premium of $.95/hour for all hours worked Night shift premium of $1.20/hour for all hours worked Machine mechanics premium of $1.36 for all hours worked Weekend shift premium of $1.00/hour for every hour worked SENIORITY For a promotion, transfer or reduction of personnel and re-employment of an employee, the seniority principle surpasses all while taking into account skills and aptitudes of the employee.
4 LEAVES Jury Duty: an employee called to fill the functions of a juror or assigned as a witness receives the difference between what they would have received at their salary rate and the pay provided by the court. (There is no limit to days served as a juror/witness). Maternity/Parental Leave/Adoption Leave: total of these 3 leaves combined is 18 months (unpaid). Employee is resettled in their functions with all rights to the moment of their return to work (includes salary and seniority). Bereavement Leave: In the event of a death of a spouse, child of the employee or spouse, father or mother of the employee, paid leave of 5 days with documentation. (One additional paid day could be approved with documentation if funeral takes place at more than two hundred km (124 miles) from the residence of the employee.) In the event of a death of a brother, sister, father of the spouse, mother of the spouse, or grandparent of the employee, paid vacation of 3 days is granted with documentation. In the event of a death of a brother-in-law, sister-in-law, spouse of a sister-in-law or spouse of a brother-in-law, of a grandparent of the spouse, the employee has a right to take 1 vacation day with documentation. GROUP INSURANCE Company pays 80% of the premiums of group insurance except for the cost of premiums for long-term disability insurance which the employee paid at 100%. Note: Company-provided insurance in Canada provides what are known as extended medical benefits. These include dental, drug coverage, vision and physical therapy since the major medical coverage is provided by the province of residence. SICK LEAVE 37.5 hours of paid sick time per year for illness, medical appointment or family obligations Unused sick leave will be paid out: 1-2 days 100% of present salary 3 days 140% of present salary 4 days 150% of present salary 5 days 160% of present salary Short term disability takes effect after missing 3 days of work with documentation for illness, surgery, hospitalization. RETIREMENT Employer contributes 3.5% of the employee s salary to a registered profit sharing plan if the employer is able to use this means. If the employer cannot use that means it will
5 place the contribution in a group defined contribution plan account of the employee. The employee does not have to contribute in order to obtain the contribution of the employer.
