1 At a Town Board meeting and Public Hearing of the Waterford Town Board held on Wednesday, November 4, 2015 at Waterford Town Hall, 65 Broad Street, Waterford NY at 7 P.M. the following transpired: There were present: Councilman Ball Councilman Boudreau Councilman Marble Councilman McClement Supervisor Lawler The Public Hearing on the 2016 budget was opened and the Town Clerk read the Public Hearing Notice as published by law in the Schenectady Gazette newspaper. There were no comments or questions. The hearing was closed at 7:10 P.M. The VFW Post 5800 presented the colors and the Supervisor thanked all the men for their service to our country. The Toys for Tots Coordinator, Lenny Roman, gave a presentation to the Board to kick off the Toys for Tots Drive in Waterford. He explained that last year the program served 114,000 children. You can bring an unwrapped toy to the Town Hall; there will be a box in the Police Department. Toys for Tots is 100% volunteer, 97 cents out of every one dollar goes directly to the children and the other 3 cents is for fuel. Toys will be collected until December 18 th. Rock for Tots will be held in Waterford at Chrome Restaurant on November 21 st with the children s party at 12 P.M. with the adult bands etc to follow. There are 860 drop off sites and you can contact them at Albanytoysfortots.org for more information. COMMUNICATIONS AND PETITIONS Town Clerk Dziarcak read a letter of resignation from Dakotah Horan. ACTION ON MINUTES OF PREVIOUS MEETINGS AS FOLLOWS: Town Board minutes of the meetings of October 6 and October 27, 2015 were submitted to the Board. A motion was made by Councilman Boudreau and seconded by Councilman McClement to accept the minutes. All in favor. COMMITTEE REPORTS FINANCIAL REPORT AND SUBMISSION OF BILLS AND PETTY CASH

2 Supervisor Lawler read the Supervisor s monthly cash report for the month of October. The payments in advance of audit totaled $144, and the audited abstracts totaled $351, The petty cash report for the month totaled $ A motion was made by Councilman Ball and seconded by Councilman Marble to accept the report, reimburse the petty cash funds and pay the bills. All in favor. COMMITTEE ON HIGHWAY, WASTE WATERTREATMENT, WATER AUTHORITY AND CEMETERY Councilman Boudreau read the Wastewater Treatment plant report as submitted by Richard Thyrring, Chief Operator. He further read the Highway Department report for the month of October. The trash drop off program has ended for the year and the Department is continuing with the leaf pick up program. The Parks Department replaced all the lights on the Christmas tree with new lights at Soldier and Sailors Park. The Town Parks and canteens are closed for the season. COMMITTEE ON PUBLIC SAFETY, EMERGENCY SERVICES, VETERANS AFFAIRS Councilman Ball distributed the Uniform Traffic Ticket report for the month of October. There were 15 domestic incidents, 63 EMS calls and 18 animal control reports with 20 arrests. There were a total of 419 calls. VFW Post 5800 will hold its annual chicken and biscuit dinner on Veterans Day at the VFW. COMMITTEE ON CANAL DEVELOPMENT, GRANTS AND PROGRAM FUNDING, COMMUNITY GROUPS AND VILLAGE GOVERNMENT LIAISON Councilman McClement gave the Harbor/Visitor s center report. There were 2337 total volunteer hours with 635 boats going though our center this year. They came from 30 states and 6 foreign countries. The Farmer s Market is closed for the year. A big thank you to all of our volunteers and to Dick Hurst, Harbormaster for another very successful season. The Museum will hold a wine and cheese night on December 4 with an unveiling of a new book entitled Images of Waterford, Richard Herzog author. The library is working with the Rescue Squad again on the annual Holiday Food Drive. Classic Movie Mondays to begin again.

3 COMMITTEE ON YOUTH, SENIORS, PARKS AND PLAYGROUNDS, POOL AND FESTIVALS On Saturday Nov 28 th from 2 4 we will be having cookies and hot chocolate with Santa. The children will also have the opportunity to have a picture with Santa and bring home some crafts that they will make that day. This will take place in the community room in the rescue squad building. Please make sure to join us for Waterford s Annual Christmas Parade on Sat Nov 28 th at 6 pm. Lineup will be between 5 and 5:30 for a 6 pm step off. Walkers and groups will line up at Brendese Parking lot and vehicles will line up at the 8 th st park. Parade will proceed down Broad St to Soldiers and Sailors park where Santa will light the tree and sing Christmas Carols. All the information will be on the town website if there are any questions. Plans for next year s bicentennial celebration are shaping up and all of the dates and information will also be on the town website. We are very excited about the events we are planning. The bicentennial calendar will be ready in time for the holidays and will make a great gift. The locations of where they can be purchased will be on the website. Coats for the community: This was the second year for this coat drive. Over 50 coats were distributed here in Waterford. Debbie Saxby once again did a wonderful job organizing and making this a success. She had many helpers including Town Clerk Darlene Dziarcak. Thanks to all who volunteered. Senior Van Hours worked: 106 Miles driven: 1907 Daily avg: 76 Persons transported: 95 Daily avg: 4 Senior citizen center On Tues Oct 20 th the seniors held their monthly meeting. Plans for upcoming events were discussed.

4 St. Mary s youth group will be hosting a senior citizens dinner on Saturday Nov 14 th at 5pm at St. Mary s hall. The WHHS will hold the annual appreciation day Thanksgiving dinner and concert for seniors at the high school on Friday Nov 20. The concert will be in the auditorium at 11:45 am and dinner at 12; 15 in the high school dining room. Any senior interested please call the center or Julie Caulkins at the school. The senior Christmas party will be held at the Van Schaick country club on Sunday Dec 6 th at noon. The cost is $25 for members and $30 for guests. Call the center for reservations On Thursday Oct 29 th the seniors went to the racino in Saratoga. On Friday Oct 30 th over 20 seniors attended a Halloween lunch at the Grace church sponsored by the Saratoga county office of the aging meals on wheels. On Tuesday Nov 17 th Saratoga County will conduct a health clinic from 10:30 am to 11:30 am at the center prior to monthly mtg. please sign up at the center. GENERAL ORDERS RESOLUTION # 102 OF THE TOWN BOARD OF THE TOWN OF WATERFORD A RESOLUTION ELECTING RETIREMENT PLAN OFFICER CRAIG FIFIELD At a regular meeting of the Town Board of the Town of Waterford, New York (the Town Board ) held at Town Hall, 65 Broad Street, Waterford, New York on Nov 4, WHEREAS, when Town of Waterford Police Officer Craig Fifield (hereinafter PO Fifield ) was first hired by the Town of Waterford, he was inadvertently enrolled in the wrong New York State Pension Plan; and WHEREAS, PO Fifield was incorrectly enrolled in the New York State Pension Plan 375(i) when he should have been enrolled in the correct New York State Pension Plan, which is Pension Plan 384(d) and (e); and

5 WHEREAS, the errors in enrolling PO Fifield have a profound impact on his ability to retire after twenty (20) years of service and also diminishes the pension benefits PO Fifield is entitled to receive; and WHEREAS, New York State Senator Kathy Marchione and Assembly Person John McDonald sponsored and introduced State legislation (Senate Bill S05778 and Assembly Bill A07978) to correct the error, as stated above, in the enrollment of PO Fifield in the incorrect New York State Pension Plan so as to elect to reopen the provisions of Section 384-d together with Section 384-e of the Retirement and Social Security law for PO Fifield; and WHEREAS, said legislation has been signed into law by Governor Andrew Cuomo; NOW, THEREFORE, BE IT RESOLVED 1. That the Town Board of the Town of Waterford elects to make 384-d and 384-e of the retirement and social security law available to PO Fifield. 2. The Town Board via this resolution certifies that PO Fifield did not bar himself from participation in such retirement plan as a result of his negligence and the signature of this resolution by any officer of the Town and any other documents/certifications thereof shall constitute any necessary further certification thereof and any Town officer is hereby authorized to execute same. 3. 8 RESOLVED, that the Town Board hereby reappoints Mandy McFarland as BAR member through September 30, Offered by Councilman Marble Seconded by Councilman Boudreau RESOLUTION # 105 RESOLVED, that all eligible employees be and they are hereby authorized to attend the Association of Towns Annual Training School and meeting in New York City from February 13-17, 2016 and they are hereby afforded a cash advance of $ Offered by Councilman Boudreau Seconded by Councilman McClement RESOLUTION # 106 WHEREAS, the Town Board has previously adopted a local law regulating and limiting the parking of vehicle on certain streets with the Town from the time period of November 1 through March 31 of each year;

9 WHEREAS, the Town Board desires to amend said law to add additional streets; NOW THEREFORE, BE IT RESOLVED that the Town Board hereby calls for a public hearing to be held on December 1, 2015 at 7:00 p.m. at Town Hall, 65 Broad Street, Waterford, New York, at which time the public may comment on the text of said law as annexed hereto. Offered by Councilman Boudreau Seconded by Councilman Ball RESOLUTION # 107 WHEREAS, the Town is currently involved in various tax certiorari litigation proceedings entitled Erie Boulevard Hydropower L.P. v. Town of Waterford, et al; WHEREAS, the parties have engaged in settlement negotiations; THEREFORE, NOW BE IT RESOLVED that the Town Board hereby authorizes the execution of the settlement agreement which provides for the settlement of all pending tax certioraris commenced by Erie Boulevard via a settlement agreement the form of which shall be approved by the attorneys for the Town and which shall include at a minimum the following terms encompassing all years in suit: no refunds, the assessment shall be set now to correspond to a full value of $4 million which shall therefore result in an assessed value of $1,392,000 being fixed going forward for the same number of years going forward as are currently in suit.

10 Offered by Councilman Boudreau Seconded by Councilman McClement RESOLUTION # 108 RESOLVED, that the Town Board hereby chooses to receive the Town of Waterford s share of the 2016 Saratoga County Sales Tax Revenue s in cash. Offered by Councilman Boudreau Seconded by Councilman Marble Supervisor Lawler expressed his appreciation to all of the Veterans who were here tonight and all of our Veterans in general for all they continue to do and have done.
