3 REQUES FOR BIDS DEPARMEN OF PUBLIC UILIIES HARNE COUNY, NORH CAROLINA WORKS MAERIALS & SUPPLIES Pursuant to Section of the General Statutes of North Carolina, sealed bids addressed to Kimberly Honeycutt, Finance & Budget Analyst, Department of Finance, Post Office Box 760, Lillington, NC 27546, and marked Waterworks Materials & Supplies PUWW will be received until 11:00 AM, September 9, 2010, at which time they will be publicly opened and read. Instructions and specifications for submitting bids (bid packages) may be obtained from Kimberly Honeycutt, Finance & Budget Analyst, Finance, 102 East Front Street, Lillington, NC 27546, (910) ext 6093, from 8:00AM to 5:00PM, Monday through Friday. A pre-bid conference will be held on Friday, September 3, 2010 at 9:00 AM in Room 101 located at Public Utilities, 700 McKinney Pkwy in Lillington, NC. It is suggested that interested bidders attend to insure the items bid on meet the County s specifications and requirements. he County reserves the right to reject any or all bids. does not discriminate on the basis of race, sex, color, age, national origin, religion or disability in its employment opportunities, programs, services, or activities. GENERAL SPECIFICAIONS & INSRUCIONS O BIDDERS Scope It is the intent of this request for bids to obtain proposals for supplying the materials, supplies and/or equipment listed in the Bid Proposal Sheets. Every part and accessory of a standard unit shall automatically be included and become a part of these minimum specifications. References to brand or trade names are normally included to more accurately describe the requirements of the County or approved equals may be bid. However, specific brands only may be requested within the bid if deemed in the best interest of the County. You are requested to submit your bid(s) on the enclosed Proposal Sheet(s) and return the entire package to Kimberly Honeycutt, Finance & Budget Analyst, Finance, Post Office Box 760, Lillington, North Carolina no later than the time specified in the bid advertisement. Marking of Bid Envelopes Bids must be contained in a sealed envelope, with the Bid Document Mailing Label affixed, showing the bid name, date, time for opening bids and the bidder's name. Late Bids Not Considered Bids received after the stipulated bid opening date and time will not be considered. Compliance with Specifications Your bid must be in strict compliance with the specifications and offer the same or equal materials. (HCDPU) reserves the right to allow or disallow minor deviations from the specifications in order to purchase what is best for the County from a standpoint of quality, price and service to be rendered. 4 Warranty In submitting a bid, the bidder warrants that all goods furnished shall be free from all defects and shall conform in all respects to the technical specifications established herein. he bidder expressly warrants that all items bid are fit and sufficient for their intended purpose. If the specifications contain a statement of the particular purpose for which the goods will be used, the goods offered by Bidder shall be fit for this purpose. Shipping All prices are to be quoted F.O.B. delivered, unless otherwise specified. Risk of loss and/or damage shall be upon the seller until such time as the goods have been physically delivered and accepted by the buyer. Unit Prices to Prevail Prices shall be submitted on per unit basis by line item. In the event of a disparity between the unit price and the extended price, the unit price shall prevail. Quantities he bid quantities shown on the Maintenance & Supplies Quote Form are estimates of use for the Fiscal Year and include line item quantities which could be more or less. Line item quantities may be adjusted from time to time depending on the needs of the County. Bid Price Corrections All prices and notations shall be written in ink or typed. Changes or corrections made on the bid form must be initialed by the individual signing the bid. No corrections will be permitted after bid opening. Withdrawal of Bids Bids may be withdrawn at any time prior to the time specified for the bid opening upon written request of the bidder. No bid may be withdrawn for a period of thirty (30) days after the scheduled bid opening date and time. Negligence on the part of the bidder shall not constitute a right to withdraw the bid subsequent to such bid opening. Use of Brand Names And References Unless otherwise stated, the use of manufacturer's names and product numbers are for descriptive purposes and establishing general quality levels only. hey are not intended to be restrictive. Bidders are required to state exactly what they intend to furnish otherwise it is fully understood that they shall furnish all items as stated. Alternate Bids Bids submitted as alternate which do not meet or exceed the minimum specifications shall be rejected except that minor deviations may be acceptable. he County shall be the sole judge of what is considered a minor deviation. Rejection of Bids he County reserves the right to reject any and all bids. Award Award shall be made to the lowest responsible bidder taking into consideration quality, performance and time specified in the proposal for the performance of the contract. ime of delivery and prompt payment discounts will be considered in breaking tie bids. 5 Addendums shall not be responsible for any oral instructions made by its employees or officers of the County in regards to the bidding instructions, specifications or contract documents. Any changes to the specifications will be in the form of an Addendum which will be mailed to all bidders who are listed with the Assistant Director as having received the invitation or any other bidder who requests an Addendum. Responsibility of Compliance With Legal Requirements he bidder's products, service and facilities shall be in full compliance with any and all applicable state, federal, local, environmental and safety laws, regulations, ordinances and standards or any standards adopted by nationally recognized testing facilities regardless of whether or not they are referred to in this invitation. Collusion By offering a submission to this Request for Bids, the bidder certifies the bidder has not divulged, discussed, or compared his bid with other bidders and has not colluded with any other bidder or parties to this RFP whatsoever. Also, the bidder certifies, and in the case of a joint bid, each party thereto certifies as to his own organization, that in connection with this RFP: a. any prices and/or cost data submitted have been arrived at independently, without consultation, communication, or agreement for the purpose of restricting competition, as to any matter relating to such prices and or cost data, with any other bidder or with any competitor; b. any prices and/or cost data bid for this bid have not knowingly been disclosed by the bidder and will not knowingly be disclosed by the bidder prior to the scheduled opening directly or indirectly to any other bidder or to any competitor; c. no attempt has been made or will be made by the bidder to induce any other person or firm to submit or not to submit a bid for the purpose of restricting competition; d. the only person or persons interested in this bid, principal or principals is/are named therein and that no person other than therein mentioned has any interest in this bid or in the contract to be entered into and; e. no person or agency has been employed or retained to solicit or secure this contract upon an agreement or understanding for a commission, percentage, brokerage, or contingent fee. axes is exempt from and will not pay federal taxes. An exemption certificate will be furnished upon request. North Carolina and local sales tax shall be shown as a separate item. Sales tax will not be a consideration in the award. erms and Conditions Provision for the payment of all amounts to become due, has been made by appropriations duly made, or by bonds or notes duly authorized, as required by the Local Government Finance Act. Upon award of the contract, the County will issue a blanket purchase order for the total or a specified amount of the total bid. Items will be ordered monthly or as often as stocks need to be replenished. he Vendor will submit an invoice for all materials purchased and payment will be made by in full for all materials delivered as soon after complete delivery and receipt of a correct invoice as can be processed in accordance with these specifications. erms and Conditions included herein are an integral part of the bid document and shall prevail unless changes or attachments are agreed to and initialed by prior to the bid opening. erms and Conditions attached to the bid by the bidder and made a condition of purchase may render the Page 5 of 11

6 bid non-responsive and may be rejected by. Requests for Shipment Deliveries must be made in accordance with the delivery date specified by the County on the purchase order, not to exceed twenty (20) days from receipt of order, or the vendor will be required to pay a fifty dollar ($50.00) per day per item liquidating damages. Any inability to meet the County s delivery schedule must be made known to the HCDPU Distribution & Collection System Supervisor within eight (8) working hours of the County s placement of the order. he quantities and point of delivery shall be shown on the purchase order or specified at the time the order is placed. Deliveries under this contract will require verification to the person placing the order of delivery time and date and must be completed between the hours of 8:00 am and 4:00 PM, Monday through Friday on normal business days. Suppliers/transporters shall be equipped with suitable unloading devices to transfer the materials and supplies from the truck to the County s warehouse. ie Bids In the event of identical bids, the County will base its award recommendation on the following basis: (1) prior service and delivery records; (2) quality of materials and supplies provided to the County; (3) and frequency of in-stock materials. In the event that all things are equal, the County will recommend award to the contractor who presently holds the contract if the said contractor is among the low bidders. In the event of several low bidders and the previous year's contractor is not among them, all other things being equal, the award will be based on a random drawing. Contract Period he terms of this contract shall be for one (1) year from the date of award. he County reserves the right to renew this contract at mutually acceptable prices for a twelve (12) month period. he bid prices shall remain firm throughout the contract period. he County reserves the right to discontinue the contract for specific materials and supplies. Any deviations from these specified price and delivery terms, or in the event the bidder ships the wrong materials or ships non-specified materials, or in the event of any other deviation from the terms hereof, the County, at its option, may cancel the remaining term of the bid contract with no further obligation. Minority Business Participation he County of Harnett has adopted a Minority Business Plan to encourage participation by minority business in the award of contracts. Bidders are hereby notified that this bid is subject to the provisions of that Plan. It is the policy of the County to (1) provide minorities an equal opportunity to participate in all aspect of its contracting and procurement programs and (2) prohibit any and all discrimination against persons or businesses in pursuit of these opportunities. Minority participation goals for procurement contracts are ten percent (10%) for. Indemnity & Insurance Bidder will indemnify and hold harmless the County, its officers, agents, and employees from and against all loss, cost, damages, expense and liability caused by accident or other occurrence resulting in bodily injury, including death and disease to any person, or damage or destruction to property, real or personal, Page 6 of 11

7 arising directly or indirectly from operations, products, or services rendered or purchased under the contract. Bidder, at its sole expense, will purchase and maintain the insurance listed below as A, B, & C. A. Automobile Automobile bodily injury and property damage liability insurance. B. Commercial General Liability-Bodily injury and property damage liability as will protect bidder from claims of bodily injury or property damages which arise from operations of this contract. he amounts of such insurance shall not be less than $1,000, bodily injury and property damage combined single limit each occurrence/aggregate. his insurance shall include coverage for products/completed operations, personal injury liability and contractual liability. C. Workers Compensation and employers liability meeting the statutory requirements of the State of North Carolina. Bidder shall provide the County with a certificate of such insurance and shall contain the provision that the County will be given thirty (30) days written notice of any intent to amend or terminate by either the insured or the insuring company.
