1 Specifications for the Application Of Silane Penetrating Sealer to Various Bridge Decks in Otsego County It is the intent of these specifications to solicit a unit price bid per square foot for the furnishing of all labor, equipment, and material necessary to satisfactorily apply Silane Penetrating Sealer to various bridge decks in Otsego County. It is the purpose of this bid to provide for in-place application of an industrial grade Penetrating Silane Sealer for concrete and masonry to various bridge decks located in Otsego County as per all the product manufacturer s specifications without thinning or alteration. This includes but, is not limited to tools required, application rates, coverage rates, protective equipment, label precautions, material and weather limitations, and a thorough understanding of the MSDS. The sealer shall be applied to achieve uniform coverage, by brushing, spraying, or rolling, as recommended by the manufacturer. Care shall be taken when applying the sealer, so that running or puddling does not occur. Prior to any use the Silane Penetrating Sealer must be approved by Otsego County Highway Department s Superintendent or Deputy Superintendent. All materials shall be in new condition with purchase invoices maintained by the successful bidder and provided to the County upon request. The equipment used for sealer application must be clean of foreign materials and approved by Otsego County Highway department before use. The Contractor shall complete the bridge deck surface, and concrete fascia beam preparation (cleaning) before any sealer application can commence. Cost for this measure will be included in the bid price per square foot. The successful Bidder will coordinate with Otsego County Highway Department for scheduling of the penetrating sealer application. Sealer materials will not be applied during wet weather conditions or when adverse weather conditions are forecasted within twelve (12) hours of the completion of the sealer application. Application of sealant by spray methods will not be permitted during windy conditions, if in the opinion of the County, unsatisfactory results will be obtained. Other application methods or rescheduling will be required. The bridges to be sealed are currently open to traffic, but will reduced to one lane during the application of the penetrating sealant. The successful Bidder will be responsible for supplying and maintaining all necessary signs, cones and barricades at the bridge site during the application of the sealant as per the July 1,1983 New York State Manual of Uniform Traffic Devices. The payment for this work will be treated as part of the unit price per square foot bid. The bride will reopen for traffic only when the penetrating sealant has been allowed to sufficiently dry for a minimum of one (1) hour. The successful Bidder is required to clean up, dispose of any surplus material, and restore any disturbed areas unless otherwise directed. Leave all areas clean! The successful Bidder s attention is directed to the fact that all applicable State Laws, Federal Laws, Municipal Ordinances, and rules and regulations of all authorities having jurisdiction over the project shall apply to the successful bidder throughout. They will be deemed to be included in the Bid Specifications the same as though herein written out in full. All operators, laborers, mechanics and workman employed by the successful Bidder in the execution of the work described herein, shall be paid in accordance with the NYS Department of Labor; Schedule of Wages and Supplements included with this specification. When, in the opinion of the Otsego County Highway Department Superintendent or Deputy Superintnedent, the successful Bidder has satisfactorily completed the work at the given bridge sites, and acceptance of the work approved, a

2 letter of such acceptance will notify the successful Bidder, and the successful Bidder s Request for Payment will then be approved and submitted for payment. Payment will be made at the unit price bid per square foot for the number of square feet of concrete to be sealed. The amount of concrete bridge deck to be sealed is based on the annual Concrete Bridge Deck Sealing Program established by the Otsego County Highway Department. There are a total of fourteen (14) bridges requiring the application of concrete penetrating sealant for the program, with a total concrete deck area of 52,221 +/- square feet. The County reserves the right to change the number of bridges and square footage to be sealed at any time without prior written or verbal notice. NON-DISCRIMINATION IN EMPLOYMENT The undersigned assures the County of Otsego that it will comply with all applicable laws and regulations prohibiting discrimination in employment on the grounds of race, religion, creed, color, natural origin, sex, disability, marital status, and other non-merit factors. The undersigned understands and agrees that the contract, understanding, or agreement to which this assurance relates can be terminated upon a finding by any governmental agency that the undersigned is in violation of applicable discrimination laws, and that such finding will also disqualify the undersigned for future contracts with the County. The undersigned certifies to the County of Otsego that there is no pending or outstanding decision, ruling, or order against it finding the undersigned in violation of the laws against discrimination. Dated:, 2015 By: Signature Title INSURANCE REQUIREMENTS The successful Bidder shall procure and maintain, at its own expense and without expense to the County, until final acceptance by the County, of the work covered by the agreement, liability insurance for damages imposed by law, as hereinafter specified, with insurance companies authorized to do such business in the State covering all operations under the contract performed by the successful Bidder. The types of insurance are as follows: a) COMPREHENSIVE GENERAL LIABILITY Comprehensive General Liability shall be written on an occurrence form of policy, with limits of: General Aggregate... $2,000,000 Products and Comp/ops... $1,000,000 Personal Liability... $1,000,000 Fire Damage... $50,000 Medical Payments... $5,000 The Comprehensive General Liability shall be written to include: [1] Bidder's Liability with limits not less than those specified above, to protect the successful Bidder against claims arising from the operations performed by the Contractor under the agreement. [2] Protective Liability with limits not less than those specified above, insuring the provision in the Contract for indemnification of the Owner, the County Superintendent of Highways and all employees of the County Highway Department both officially and personally, any town or village in which the work is performed, and/or any public benefit corporation, railroad, or public utility whose property or facilities are affected by the work or any Consultant Engineer or

3 inspector working for or on the project, and their agents or employees, with respect to all operations under the agreement by the successful Bidder, including omissions and supervisory acts of the Owner, town or village, public benefit corporation, public utility, or any Consultant Engineer. [3] Liability The successful Bidder shall assume all liability for, and indemnify and save the Owner, and its representative agents and employees and its successors or assigns, harmless from any and all claims, demands, and suits arising out of state or federal statutes, or at common law in connection with an injury to persons including death resulting therefrom or loss of any damage to property, sustained by the Owner or any of its officers, agents, or employees, or by third parties, arising out of, or occurring in connection with, or in any way relation to, the work hereby undertaken by successful Bidder. The Comprehensive General Liability shall name as insureds the Contractor, the Owner, and the Engineer. b) AUTOMOTIVE LIABILITY The successful Bidder shall take out and maintain, during the life of this contract, Business Automobile Liability insurance (covering all owned, non-owned, and hired vehicles) with limits not less than the following: Coverage Limit Bodily Injury and Combined Single Limit per Property Damage Accident - $1,000,000 No Fault Uninsured Motorists Statutory Benefits Statutory Limits WORKERS COMPENSATION & EMPLOYERS LIABILITY The successful Bidder shall procure and maintain (and assume the expense of) during the Contract time - in accordance with the provisions of the laws of the State in which the work is performed - Workers Compensation insurance (including occupational disease provisions) for all of the latter's employees, unless such employees are covered by the protection afforded by the successful Bidder. In case any class of employees (engaged in hazardous work under this contract at the site of the project) is not protected under Workers Compensation statute, the successful Bidder shall provide adequate and suitable insurance for the protection of those employees not otherwise protected. STATUTORY DISABILITY BENEFITS - NEW YORK STATE The successful Bidder shall procure and maintain (and assume the expense of) coverage which will pay the benefits to employees required under the Worker's Compensation Law of the State of New York, for off-the-job injury and for nonoccupational disease. CERTIFICATES Certificates of insurance (acceptable to the County) shall be filed with the County prior to the commencement of the work. These certificates shall contain information sufficient to confirm compliance with the requirements in the Specifications. The certificates shall contain a provision that coverage afforded under the policy will not be canceled or reduced, nor will the policy be allowed to lapse at expiration, unless at least thirty (30) days prior written notice by Certified Mail has been given to the County.
