INTERNATIONAL DISPUTES Selected matters include: Co-arbitrator, complex IT licensing dispute between Canadian and Taiwanese parties Advised on multi million dollar manufacturing dispute between Korean and US parties relating to the manufacture of buoyancy devices. Sole arbitrator in a complex ICDR international arbitration between Swiss and Florida parties in healthcare licensing dispute. Co-lead Counsel in multi million dollar NAFTA arbitration for a major international oil company against Canada under the ICSID Arbitration Rules involving the application of regulatory guidelines. Successful application before an ICC Emergency Arbitrator under English law on behalf of an energy company. ICC arbitration arising under a Joint Operating Agreement for a petroleum block in Peru involving issues of environmental remediation. ICDR arbitration between Mexican and US companies in relation to the supply of materials for fracking, over US$20 million in dispute, joint first chair before a distinguished panel of arbitrators. Advised a major international oil company on questions of international law in relation to a gas fields in the Middle East and possible claims under bilateral investment treaties. UNCITRAL arbitration in relation to a petroleum block off shore Cote D Ivoire. 1

2 ICDR arbitration involving a Texas-based international music and a European company regarding issues of breaches of intellectual property rights. Advised a major Canadian energy producer in a complex arbitration brought under the Canada-Venezuela Bilateral Investment Treaty and conducted under the UNCITRAL rules and subsequently ICSID Additional Facility Rules. Advised a major energy producer on an ad hoc arbitration seated in Halifax, Canada, under Nova Scotia law. Ad hoc arbitration under the Arbitration Act 1996 for a US energy company against a Bermudan re-insurer, seat in London, New York substantive law. ICDR arbitration against a Georgian oil producer, seat in Texas, with Texas substantive law. The matter involved an application for ICDR emergency measures to secure the release of the client s oil rig from the rig-site in Georgia. LCIA arbitration in relation to a contractual dispute over a joint venture in Estonia, involving complex questions of English law. Represented an investment group as the claimants counsel in arbitration proceedings under the UNCITRAL Rules in London and the litigation initiated by the respondent in Russia. Simultaneous proceedings in the UK and Russia, as well as criminal proceedings initiated against the former Governor of the Kaliningrad Oblast. Successfully defending a challenge to an ICC arbitration award before the English Commercial Court under section 68 of the Arbitration Act The award was made in London and involved questions of bribery. (Cameroon Airlines v Transnet Ltd). Acted for an international media group in relation to an ICC arbitration under Hungarian law. UNCITRAL arbitration conducted under Trinidadian law between a major Texan oil producer and a Trinidadian state entity involving exploitation of oil and gas interests off the coast of Trinidad. ICC arbitration under Indian law between a French company and a State entity involving the collapse of a coal mine in India. There was over US$45 million in dispute. ICC arbitration conducted under Swiss law in relation to a contractual dispute. The sum in dispute was in the region of US$60 million. Ad hoc shipping arbitration under the LMAA Rules and the Arbitration Act 1996 for a Japanese client, work involved drafting pleadings, reviewing documents and advising on disclosure issues. UNCITRAL arbitration under English law between an independent contractor and a major oil and gas producer in relation to disputes arising out of the hire of an oil rig for drilling off the coast of India. ICC arbitration under English law for a Romanian state entity against an aircraft manufacturer. ICC arbitration under Chilean law against a Chilean distributor involving the alleged breach of a distributorship agreement. Member of a team who obtained a freezing order of over GBP 1 billion in support of an arbitration in Switzerland brought by the Qatari royal family. Multi-million dollar dispute between Brazil company and Spanish company arising out of a floating production and storage facility involving free standing hybrid risers in the Gulf of Mexico, representing the Spanish company in this US$400 million dispute in the United States District Court for the Southern District and on appeal to the Fifth Circuit Court of Appeals. 2

3 Acted for a major investment bank in relation to the long-running disputes arising out of the collapse of Parmalat, the Italian company. The bank was the subject of extended civil and criminal proceedings in Italy to clawback 290 million and to recover 2.2 billion. Acted for the underwriters in relation to the US$10 billion IPO of the Russian oil company, Rosneft, which floated shares on the London, Moscow and New York Stock Exchanges in July Successfully resisted Yukos emergency application to the English court for judicial review of the FSA s decision to admit the Rosneft shares to the Official List and for an injunction to suspend the listing. Acted for a major investment bank in relation to civil and criminal proceedings in Turkey involving allegations of corporate manslaughter arising out of an accident involving a faulty fire extinguisher which killed one child and injured a number of others during a re-fit of the client s offices in Istanbul. Represented a major gas producer in relation to a dispute arising out of an IT contract to replace its billing systems, where the IT provider was claiming over 30 million. Acted for a major bank in relation to the long-running dispute involving issues of fraud and conspiracy arising out of the attempted hostile takeover. Advised a major US investment bank in relation to whether a 500,000,000 insurance contract had been affirmed by the underlying insurers, who were seeking to avoid the policy on the basis of alleged non-disclosure. Advised a major company in relation to claims by individuals of cancer caused by working in its Hull tin factories. Conducted a detailed investigation into the trading practices of a major mutual fund following allegations of market timing, this involved interviewing personnel and reviewing documentary evidence, culminating in a detailed report and notification to the FSA. Advised a major international bank in relation to investigations by the Financial Reporting Review Panel into accounting practices, this involved producing detailed submissions to the Panel on the accounting practices, and resulted in a decision by the Panel that no further action was required.
