3 Page 3 of 9 1. Bidder shall specify QUOTED or NOT QUOTED as the case may be in un-priced bid in all FORMS of Schedule of Prices. 2. Bidder shall quote prices in US Dollars/ Euro/ Indian Rupees only. Currency once quoted shall not be permitted to be changed. 3. For services and materials to be procured from India, bidder shall quote prices in Indian Rupees only. 4. Bidder must clearly specify the name of currency as applicable in the various FORMS. 5. In case of any difference in the prices quoted in figures and words, the rates quoted in words shall be considered as correct. 6. All Prices quoted in all FORMS shall be gross of all non-indian taxes. 7. The Prices quoted should be inclusive of Indian Income Tax. In the un-priced part bidder shall indicate the withholding tax included in his price in percentage only. Withholding tax shall be deducted and TDS certificated issued to the Catalyst supplier/agency so that he can claim tax credit in his country. However, in case, the Catalyst supplier does not include (or partially includes) the provisions of Indian income tax in his prices and withholding tax as applicable is payable by Owner (BPCL), the income tax liability shall be added to the Catalyst supplier s prices for evaluation. In such a case, Catalyst supplier/agency explicitly confirms that the TDS certificate would not be issued to the Catalyst supplier/agency for the tax paid by Owner (BPCL) and the same shall not be claimed as credit by Catalyst supplier.

Bidder to furnish the item description and lumpsum charges for providing the equipment for the loading operation at site. The charges shall include : a. In the case of direct import of equipment from outside India : Sea/Air Freight charges from dispatch port to port of import, Customs Duty and Incidental expenses for clearance at Port of Import, transportation from port of import to refinery and transportation back from refinery to port and freight charges to next destination / catalyst supplier s office ; b. In the case of equipment brought to refinery from another location within India: To & Fro transportation up to refinery site & back.

Un-priced copy of the same blanking out the prices column to be submitted in the un-priced bid.. 4. Item is to be delivered at refinery site one week prior to starting of loading operations, schedule for which will be intimated one month in advance. 5. Rates/ prices quoted shall remain firm till Port of receipt for all imported items shall be considered as Kochi.

7 Page 7 of 9 Cost of base Catalyst shall exclude the cost of precious metals but shall be inclusive of all elements associated with Catalyst processing, all conversion charges, processing cost, service charges for procurement of precious metals etc. Precious metals and their quantity shall be mentioned in column 6 and 7 of above Table. 2. Bidder shall quote Lump-sum prices for supply of proprietary Catalyst on FOB Port of Shipment (i.e. excluding cost of freight & insurance) for foreign component (Inco terms 2010) and FOT dispatch point basis for Indian component. 3. The cost of precious metals is the cost of metals listed at Clause No 6 above in the Catalyst formulation and is equal to metal content (in Kg) X cost of precious metals in USD (per Kg) as per Ryan s Notes. Catalyst supplier to indicate the metal quantity which should include any handling losses anticipated by the Catalyst supplier during formulation / impregnation of Catalyst and should take care of rounding of requirement. 4. Previous week average prices of respective precious metal on the day of opening of the price bid shall be the basis for NVA analysis and also for ordering. 5. After ordering of Catalyst, the final precious metal prices will be based on three months average prices ending the month prior to shipment. 6. Vendors are requested to submit the relevant pages of Ryan s Notes publication, in support of the price of the relevant metal to be adopted for price bid evaluation (at the time of opening of price bid) and for Invoice Payment (at the time of shipping) 7. The rates/ prices quoted for base Catalyst shall remain firm till Bidder to list proprietary Catalyst in accordance with provisions of Bidding Document, furnishing item description, quantity, unit rate/price and firm delivery schedule in the Price Part. Bidder shall submit the Un-Priced copy of the same blanking out the prices in the Un-Priced part for evaluation. 9. Port of receipt for all imported items shall be considered as Kochi. 10. Bidder to specify quantities in kilograms. Contingency towards loss/ spillage to be furnished separately. 11. Order would be placed with value of precious metal considered at the time of price bid opening; Invoice value/payment for the shipped consignment would be regulated with reference to precious metal price applicable for the shipment (as mentioned against item 4 above).
