1 70 YEARS OF FLUKE ANNIVERSARY PROMOTION TERMS AND CONDITIONS 1. Eligibility: Fluke s 70 Years of Fluke Anniversary ( the Promotion ) is available for all purchases of a Qualifying Fluke Industrial and Fluke Calibration Product excluding Fluke Biomedical, Fluke Networks and Amprobe (as defined in Section 5 below) made from an authorised Fluke reseller in Australia, New Zealand and Pacific Island regions between Monday 16 th July 2018 and Friday 7 th September See the list of authorised distributors at Customer purchases made via an Electrical Wholesaler/Reseller must ensure the Fluke product has been purchased via a Fluke Australia authorised distributor. Wholesaler/Reseller branch product purchases not made from a Fluke Australia authorised distributor will be void. Void where prohibited by law. A receipt may only be submitted once; receipts submitted more than once are considered invalid. Only one bonus gift per receipt received. This offer cannot be combined with any other discounts, credits, rebates or other special offers from the Sponsor. Redemption requests postmarked after 14 days of purchase will be invalid and will not be returned and redemption will be denied. Redemption forms must be filled out accurately to qualify. This offer is not available through Fluke sales staff, Fluke Service Centres or Fluke Corporate offices. Employees, directors and officers of Fluke Corporation in Australia, New Zealand and the Pacific Island regions ( Sponsor ), its parent companies, affiliated companies, subsidiaries, distributors, wholesalers, representatives, and their immediate families (parents, siblings, children and spouse) and persons living in the same household (whether related or not) are not eligible to receive a bonus gift with purchase. Employees or representatives of government entities, including government owned or controlled companies are not eligible to participate in the Promotion. 2. Disclaimer: Sponsor and any of its parent companies, subsidiaries, affiliates, directors, officers, professional advisors, distributors, representatives, employees and agencies (collectively, the Released Parties ) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or redemption requests; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communicationsrelated malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events

2 beyond the control of Sponsor or by nonauthorised human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion. 3. Promotion Period: The Promotion starts at 8:00 AM Australia Eastern Standard Time ( AEST ) on Monday 16 th July 2018 and ends at 6:00 PM AEST on Friday 7 th September 2018 (the Promotion Period ). Australian Eastern Standard Time shall control for all purposes of this Promotion. Sponsor s computer shall be the official timekeeping device for the Promotion. 4. How to redeem your bonus gift: For all redemption requests. All requested contact information must be provided for your redemption request to be valid. A copy of the purchase receipt/sales invoice must be included that clearly shows each Fluke product purchased. The Sponsor has the right to substantiate all sales receipts. Redemption forms will not be returned. All participants and redemption forms are subject to verification by the Sponsor, in its discretion. Any redemption form that does not comply with any aspect of these Terms & Conditions may be rejected by the Sponsor and the participant disqualified. Purchase levels exclude GST (where applicable), shipping costs and other fees. The amount spent on Qualifying Fluke Products described below entitles a participant to select one gift from one of the five (5) gift levels, based on the amount spent on Qualifying Fluke Products. Amounts spent for taxes, shipping cost, and other fees are excluded for these purposes. All costs associated with shipping and handling of a gift made in connection with the Promotion within the Australia and New Zealand will be paid by the Sponsor. The customer is responsible for all taxes, customs duties and other similar fees payable in connection with receiving the gift.

However, participants should note that deliveries may be delayed beyond such standard periods. Bonus gifts only available until stocks last. If the bonus gift is unavailable, the Sponsor, in its sole discretion, reserves the right to dismiss the submission or substitute the reward with another of equal or greater value. If the Fluke purchases listed on your redemption form were purchased by you for your employer, then you agree to promptly deliver any bonus gifts given under the Promotion to your employer, and to provide the Sponsor evidence of such delivery upon request. You must comply with your company s policy regarding acceptance of gifts. Qualifying Fluke Calibration Products highlighted above. A receipt for a Qualifying Fluke Product may only be submitted once to participate in the Promotion. Receipts submitted more than once are invalid. Only one gift will be awarded for each receipt received. Multiple Qualifying Fluke Product purchases evidenced by one receipt qualify for only one gift. Customers are limited to three (3) redemption requests during the promotion period. The amount spent on Qualifying Fluke Products determines the gift from one of the five (5) gift levels. Taxes, shipping, and any other associated fees are excluded from this promotion. Gifts must be shipped to a customer s physical address. Gifts cannot be shipped to post office boxes, reshipping companies, distributors or wholesalers. Gift requests are subject to further audit at Sponsor s sole discretion. Sponsor in its sole discretion may render that gift request void, in which case it will not be honored. Sponsor may require customers to provide additional proof of purchase, including, without limitation, physical UPC codes from packaging, product serial numbers, or proof of delivery.

Release of Liability: Except where otherwise prohibited by law, by participating in the Promotion, participants release and agree to hold harmless Fluke Australia Pty Ltd, its parent companies, subsidiaries, affiliated companies and the directors, officers, employees and agencies of any of the above entities from any liability whatsoever for any injury, loss or damage of any kind, including any tax liability or loss of opportunity, whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the company s control); (b) any theft, unauthorised access or third party interference; (c) any redemption request that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Sponsor) beyond the reasonable control of Sponsor; (d) any damages due to the operation of the postal service; (e) any variation in reward with purchase value to that stated in these Terms & Conditions; (f) any tax liability incurred by participant; or (g) use or misuse of the bonus gift. 7. Miscellaneous: Participants agree to be bound by these Terms & Conditions and by the decisions of the Sponsor, which are final and binding in all respects. The Sponsor reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Promotion or any person s participation in the Promotion should viruses, bugs, unauthorised human intervention or other causes beyond the Sponsor s control affect the administration, security or conduct of the Promotion, or the Sponsor otherwise becomes (as determined in its sole discretion) incapable of conducting the Promotion as planned. Participants who violate these Terms & Conditions, violate any law, rule or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or engage in any conduct that is detrimental or unfair to the Sponsor, the Promotion or any other participant (in each case as determined in the Sponsor s sole discretion) are subject to disqualification from participation in the Promotion.
