3 The above rates are not inclusive of travel. The family can decide to include a travel allowance into the monthly salary, but due to fluctuating petrol prices, we suggest you reimburse at AA rates. The salary is entirely at your discretion. Au pairs generally earn between R40-R70 per hour but many factors need to be taken into account when making your decision, namely age, experience, qualifications, number of children being taken care of, duties required etc. Over time work should be reimbursed at 1.5 x the hourly rate. Sundays and Public Holidays should be reimbursed at double the hourly rate. GENERAL: DAY MAMAS AGREEMENT This agreement is hereby entered into between Day Mamas ( the agent ) And. ( the client ). The agreement serves as a contract between the Agent and the Client. The Agent agrees to provide Au Pair placement services to the Client under the terms in this agreement. This document contains the whole agreement between the parties. No party will have any right or remedy arising from any undertaking, warranty or representation that is not included in this document. This agreement, or any part of it, can only be waived, varied, added to, or cancelled by a further written agreement between the parties signed by the parties. For purposes of this agreement, unless the context clearly requires otherwise: The CLIENT shall mean the Au Pair Host Family The AU PAIR shall mean the individual who was introduced to the Client through Day Mamas; The AGENT and/or DAY MAMAS shall mean the au pair placement agency Whilst the Agent will take all reasonable care to ensure the suitability of the au pair, it is the Client s responsibility to satisfy him or herself before offering the position - the final decision to accept the candidate remains with the Client. The Agent offers the service of background/criminal checks on a proposed Au Pair if requested by the Client. PLACEMENT FEE:
4 Once both the Client and the Au Pair have accepted and agreed upon employment terms, a Placement Fee Invoice will be sent to the Client. Agency fees are calculated from a percentage of the gross income to be paid to the Au Pair over the expected period of employment. These are as follows: PERIOD AGENCY FEE 12 months or more 10% of total gross annual income 6 to 12 months 12% of total gross income 3 to 6 months 15% of total gross income 1 to 3 months 20% of total gross income The placement fee is due before the Au Pair can begin her employment with the Client, and is non-refundable. The Client must pay the placement fee to the Agency within 5 days from date of invoice. A fee is not charged unless an Au Pair is placed with the Client s family. TERMINATION OF EMPLOYMENT BY CLIENT/AU PAIR Day Mamas offers a 30 day probation period on placement of an Au Pair. In order to validate this guarantee the Placement Fee must be paid to Day Mamas. If the Au Pair resigns within 30 days of commencement of employment, Day Mamas will attempt to arrange a suitable replacement free of charge. This also applies should the Au Pair cancel the contract prior to the commencement date. The Placement fee for the previous Au Pair will not be refunded, even in the unlikely event that Day Mamas is unable to arrange a replacement Au Pair for the Client. Should the Client no longer wish to hire an Au Pair after an offer of employment has been accepted, the Client shall be liable for the full Placement Fee, even if the contract of employment has not yet been signed by either of the parties. If the Placement Fee is not paid in full within the specified time, the Client s right to have a replacement Au Pair, if necessary, will be forfeited. Please note that Day Mamas guarantee specifically excludes: - Retrenchment - Unfair dismissal - Illness and death - Breach of employment contract by the employer GENERAL TERMS AND CONDITIONS Interviewing a candidate from Day Mamas will indicate acceptance of the fees and the terms & conditions. The client is advised to have a contract of employment with the candidate. Day Mamas can assist the client with a contract template. While Day Mamas takes care to ensure the suitability of the candidate, it is the Client s responsibility to judge the suitability of an Au Pair for their family and environment. The final decision to accept the candidate remains with the Client. The Client undertakes to inform the Agent if an Au Pair (placed in a temporary position) remains with the Client following the period of employment agreed with the Agent. In this case, the Client shall be liable for the outstanding full placement fee as per a permanent position. LIABILITY CLAUSE Day Mamas acts as an intermediary only and is not the employer. The client must be 100% sure of the suitability of the Au Pair before hiring them. Day Mamas is not responsible if the Au Pair proves to be unsuitable. The choice of an Au Pair is the Client s decision.
5 Day Mamas accepts no liability for any inconvenience, loss of or damage to property, or any loss or personal injury or death arising directly or indirectly from any act or omission of any applicant introduced by Day Mamas even if such an act or omission is negligent or fraudulent or dishonest. Day Mamas does not accept responsibility for any misrepresentation of information conveyed by the Au Pair. Day Mamas will only put forward candidates with a driver s license, but are unable to guarantee the standard of the Au Pairs driving. I, the undersigned, have read and understand and accept these terms and conditions. Upon signing of this agreement I agree to pay Day Mamas the placement fee due, upon the engagement of an Au Pair.
