1 REQUEST FOR PROPOSAL Engineering Survey/Design Services Loecy Pond Dam Modification or Rehabilitation August 27, 2018 I. INTRODUCTION Chagrin River Watershed Partners, Inc. (CRWP), located at Glenn Avenue, Willoughby Ohio 44094, is soliciting cost proposals from Engineer teams to plan, survey, and design the modification or rehabilitation of the Loecy Pond Dam. The project is located at Latitude , Longitude on Industrial Parkway in the City of Chardon, Geauga County Ohio. CRWP is soliciting proposals on behalf of the Dam Owners, who are listed below: NOF Metal Coatings 275 Industrial Parkway Chardon, Ohio Littin Properties, LLC 121 Industrial Parkway Chardon, Ohio Geauga County Park District 9160 Robinson Road Chardon, Ohio Pentair Residential Filtration, LLC (as successor in interest to Fleck Controls, LLC) 220 Park Drive Chardon, Ohio The Cleveland Electric Illuminating Company 800 Cabin Hill Drive Greensburg, PA A. Pre-Qualification To be considered eligible to submit a Proposal, Bidder must be legally licensed under applicable laws in the State of Ohio. At least one key personnel must be a registered professional engineer in the State of Ohio. Engineering team(s) must demonstrate prior experience in designing and/or modifying dams in accordance with applicable codes, standards, rules and regulations. Proposal must meet minimum qualifications to be deemed complete and must be submitted on or by the deadline noted in Section IV, Part B.

2 Engineering teams will be required to coordinate with the Dam Owners, CRWP, the City of Chardon, and the Ohio Department of Natural Resources (ODNR) Division of Water Resources Dam Safety Program, as well as any other agencies or entities deemed necessary by the Dam Owners for the successful completion of this project. The successful bidder on this RFP will enter into contract with the Dam Owners for the services described below. II. PROJECT DESCRIPTION The Loecy Pond Dam is currently classified by ODNR as a Class I dam due to Potential Downstream Hazard. Construction of the dam is estimated to be between The dam was inventoried by ODNR in 1987 and subsequently reclassified to Class I status in The most recent report from ODNR on May 24, 2016 identified several repair, maintenance, and monitoring items that the Dam Owners must complete to rehabilitate the dam in accordance with Ohio Administrative Code (See attached Exhibit B) (the ODNR Inspection Report ). ODNR must approve any plans for modifications or repairs to the dam. The goal of this RFP is to balance long-term Dam cost from a functionality standpoint while minimizing risk such as those identified in the ODNR Inspection Report. The Dam Owners intent is to implement this project as outlined below. III. CONTRACTOR SCOPE OF SERVICES Prospective bidders must provide proposals with cost estimates for the following scope of work, broken out by each category (Initial Survey Work, Rehabilitation Alternative, Modification Alternative, Cost Benefit Analysis, and Final Design Plans): A. Initial Survey Work Prospective bidders must review auditor survey drawing provided in Exhibit A of this document and: Survey pond banks as needed, identify dam structures and roadways Provide drawing detailing total property owned in acres by parcels through reviewing meets/bounds Calculate percent of pond frontage property owned by companies identified in Exhibit A Estimate pond surface area including the two small ponds upstream of Loecy Pond Estimate percent of dam structures and embankment owned by each company identified in Exhibit A Include photos of applicable dam components and spillway locations Please note that the Dam Owners require that all survey documents meet minimum standards included as Exhibit C of this document. B. Rehabilitation Alternative Prospective bidders will need to review the ODNR Inspection Report. At a minimum, proposals should address the following: Addressing all Required Remedial Measures identified in the ODNR Inspection Report, including but not limited to: o Dam failure inundation study and map o Section IV of an Emergency Action Plan o Hydrologic and hydraulic study 2

3 o Plans/specifications to increase the discharge/storage capacity o Structural integrity investigation and report o Any necessary plans/specifications to repair or replace the spillway, emergency spillway, lake drain valve, or any other structural repairs or replacements needed to bring the dam into compliance with ODNR o Preparation of an Operation, Maintenance, and Inspection Manual for the dam (page 6 of the ODNR Inspection Report) o Preparation of an Emergency Action Plan for submittal to ODNR (page 7 of the ODNR Inspection Report) Address vegetation removal concerns Inventory of any required local, state, or federal permits to complete the rehabilitation, including but not limited to U.S. Army Corps of Engineers (USACE), ODNR, and Ohio Environmental Protection Agency (EPA) Inventory of any potential federal, state, and/or local grant funding to assist with Rehabilitation Provide quarterly inspections and reports as required Meetings, travel, and any public communications Forecast of maintenance costs post-rehabilitation for the next 10 years C. Modification Alternative Declassify the structure from ODNR s Dam Safety Program so that it meets the ODNR-defined conditions of a Roadway Embankment. This solution may require slowly dewatering the impoundment and modification of the dam structure and culvert. Proposals should address at a minimum the following: Structural integrity investigation of the concrete pipe through the dam and masonry culvert through the embankment Investigation, modeling, and report on the modification s effect on downstream hydrology, including the effects of the modification on the frequency and severity of downstream flooding Bathymetric and sediment depth surveys of Loecy Pond and upgradient ponds as needed, such as to cost out dredging, etc. Aesthetic landscaping improvements to newly drained/graded land, using native Ohio species suitable to the growing region Inventory of any required federal, state, or local permits, including but not limited to USACE, ODNR, and Ohio EPA Inventory of any potential federal, state and/or local grant funding to assist with Modification Meetings, travel, and any public communications D. Cost Benefit Analysis Produce cost benefit analysis report on Rehabilitation vs. Modification alternatives with conceptual construction estimates of the cost to implement each Alternative, including postconstruction maintenance requirements E. Final Design Plans The bidder should also provide cost estimates for the following scope of work. Final Design plans will be produced for the Alternative selected by the Dam Owners, based upon the Cost Benefit Analysis. 30/60/90% design meetings 3

4 Prepare seven (7) print sets and one (1) digital set of fully-engineered plans with detailed cost estimates, descriptions of potential utility conflicts, schematics, site maps, planting plan and any other necessary images for the Alternative selected by the Dam Owners. The plans must be approved by ODNR and suitable for bidding out for construction according to the specifications of the Dam Owners or representative that will contract out the construction IV. CONSULTANT SELECTION A. Proposal Preparation Proposals must be submitted as two (2) duplicate hardcopies, one (1) original hardcopy and one (1) digital (submitted in PDF format on a USB drive) proposal consisting at a minimum of the following information in the order indicated below: Cover letter stating interest in project with signature of duly authorized principal Description of Work to be Performed, including proposed start/end dates and milestones Cost of Services breakdown by each category (Initial Survey Work, Rehabilitation Alternative, Modification Alternative, Cost Benefit Analysis, and Final Design Plans) and include the following at a minimum: o Total hours available, hours per staff, and direct labor by labor category o Overhead and other direct costs o Anticipated overall project profit margin as a gross percentage Technical qualifications of Engineering team Experience with similar projects, including regulatory experience Experience of key staff personnel assigned to the project Three (3) References Proposal shall include one certificate of personal property tax affidavit, certificate of real property tax affidavit, and no collusion certificate Certificates of Insurance demonstrating the following coverage: (i) Commercial General Liability Insurance, written on an occurrence basis, on ISO form CG001 or its equivalent, providing coverage for bodily injury, broad form property damage, personal injury (including coverage for contractual and employee acts), contractual liability, incidental professional liability, the hazards, and products and completed operations, with a combined single limit of liability of not less than two million dollars ($2,000,000.00) for each occurrence applicable to the Work, and an annual aggregate limit of liability of not less than three million dollars ($3,000,000.00); (ii) Auto Liability Insurance, with minimum combined single limits of one million dollars ($1,000,000.00) per occurrence for bodily injury and property damage. The policy shall include a duty to defend and cover all owned, non-owned, leased, hired, assigned or borrowed vehicles; (iii) Workers' Compensation Insurance, meeting all applicable statutory requirements, and Employers' Liability, with limits of at least one million dollars ($1,000,000.00) per accident or disease per employee; and (iv) Blanket Professional Liability Insurance, providing for payment of the of the insured s liability for errors, omissions or negligent acts arising out of the performance of professional services. The policy shall have a limit of liability not less than $5,000,000. B. Proposal Submittal Envelopes containing Proposals shall be labeled and presented so that they may be easily identified as containing a proposal for this project. Envelopes at a minimum must include the following: Name and location of project 4

Proposal Review and Acceptance Process The Dam Owners reserve the right to reject any and/or all Proposals, in their sole and absolute discretion, including but not limited to Bidders who have not met the prerequisites of the bid proposal and Bidders who have previously failed to perform properly or complete on time contracts of a similar nature. The Dam Owners also reserve the right to waive any information and technicalities in bidding. Contract will be awarded on the basis of the following factors which are described below. Each factor will be rated and the contract will be awarded (unless all bids are rejected), under normal circumstances, to the bidder receiving the highest number of points. Points will be awarded for Bid Proposals exceeding the minimum standards as described in Bidder's Pre-Qualifications. The Dam Owners reserve the right, however, to award the contract to a Bidder who the Dam Owners believe to be in their best interest. The Dam Owners reserve the right to make awards by the individual categories of the work, by groups of categories or total bid, whichever it deems is in the best interest of the Dam Owners in their sole and absolute discretion. Price = 5 Points. The highest number of points in this category will be given to the lowest responsible bid price. General Dam Project Experience/Capacity/Project Schedule = 10 Points. Points will be awarded on the basis of prior experience in performing similar work produced in each of the previous three years, technical and financial resources in designing and/or modifying dams, record of the past job performance, and anticipated project schedule and milestones. Regulatory Experience = 3 Points. Points will be awarded on the basis of experience of the bidders in Ohio dam regulatory compliance, such as preparing Emergency Action Plans. Grant Writing Experience = 2 Points. Points will be awarded based upon experience and success in submission of grant proposals of similar projects over the past three years. 5

Bid Proposal Timeline Proposals must be received by CRWP using one of the addresses listed in Section IV, Part B by 5:00PM EST on September 27, Bid Proposals received after the time and date stated will not be accepted unless proposals are postmarked on or before September 27, Proposals received on time will be opened privately at CRWP offices. The Dam Owners shall hold the bids through October 11, 2018 for purposes of reviewing the bid Proposals. The Dam Owners shall announce the successful bidder on or before October 15, V. GENERAL TERMS AND CONDITIONS Successful bidder shall comply with all environmental, health and safety ordinances, by-laws, rules and regulations of all local, state and federal governmental bodies and agencies. In addition, all work must be done in accordance with any relevant requirements pursuant to Ohio Administrative Code. Successful bidder shall acquaint itself with project site and with all conditions pertaining to the performance of services requested. The Dam Owners and CRWP shall accept no responsibility for the failure of consultant and/or contractor to affect such acquaintance and shall not be liable for any increase in consideration due to consultant and/or contractor s failure to anticipate conditions or difficulties which may be encountered in the performance of services requested. Successful bidder will provide all plans, specifications, investigative reports, and other supporting documentation must be produced and delivered in sufficient quantity and format (hardcopy, digital) as needed for the Dam Owners to fulfill their obligations. Successful bidder should carefully review the pre-requisites for bidding which will be adhered to when completing the bid proposal package. Bids will be evaluated to determine the bidder that is responsive to the solicitation and is most advantageous to the Dam Owners, price, capacity, experience, and other factors considered. Transfer of Records. Data shall be collected and formatted in a manner consistent with common good engineering practices. All records (original tracings, maps, field sketches, lab reports, flow data, graphics originals, design calculations, electronic files including model input and output files, etc.) generated by the project shall be the property of the Dam Owners and shall be turned over to the Dam Owners upon completion or as directed. Successful bidder will be required to enter into a professional services agreement with the Dam Owners in such form as Dam Owners may present upon an Award to the Successful bidder. 43 SURVEY REQUIREMENTS For LOECY POND DAM MODIFICATION OR REHABILITATION NOTE These standards are based on the Minimum Standard Detail Requirements for ALTA/NSPS Land Title Surveys and are only to be used for the purposes of the Loecy Pond Dam Modification or Rehabilitation project. Table A Items requested by the client are provided below. The survey is not required to be an ALTA/NSPS Survey. Survey requirements for this project shall follow the above referenced ALTA/NSPS standards with respect to the following: Section 3. Surveying Standards and Standards of Care All Subsections Section 4. Records Research Per Ohio Administrative Code Section 5. Field Work All Subsections Section 6. Plat or Map Subsections: A., C., D. (excluding ii.(k) and iii.) Section 7. Certification Survey Certification Shall Read: This is to certify that this map or plat and the survey on which it is based were made in accordance with the 2016 Minimum Standard Detail Requirements for ALTA/NSPS Land Title Surveys (as modified by [client] for this project), and OAC , and includes Items of Table A of the referenced ALTA/NSPS Standards.
