2 RAFFLE GENERAL TERMS AND CONDITIONS INTRODUCTION BBC Children in Need is a company limited by guarantee (company number ) and a charity registered in England and Wales (number ) and Scotland (number SC039557). The registered charity address is. The following terms and conditions apply to The BBC Children In Need Raffle at Countryfile Live (referred to as the raffle ). These general raffle terms and conditions should be read alongside, and are in addition to any special terms that will also apply, meaning: (i) (ii) any specific terms and conditions or instructions of entry from BBC Children in Need, which may be mentioned at point of interaction, in any promotion of or messages about the raffle on any platform; ( Interaction Information ); and special prize terms and conditions as attached here or set out on the Countryfile Live website (which may apply to a particular prize and which will be provided with the Interaction Information or will be available on request) ( Special Prize Terms ). Reference to Raffle Terms means these general raffle terms and conditions and any Interaction Information and/or Special Prize Terms. If there is any inconsistency between these general raffle terms and conditions and any special terms under (i) or (ii) above, the Special Prize Terms shall apply. By entering the raffle, you agree to be bound by the Raffle Terms so please read them carefully. Your attention is drawn in particular to sections 3, 4.5 and 5. If you do not agree to these Raffle Terms, you should not enter the raffle. 1. ELIGIBILITY TO ENTER 1.1 To enter the raffle and to be eligible to win a prize you must: (A) be resident in the United Kingdom, the Channel Islands or the Isle of Man; (B) be 18 years of age or over (note: to win certain prizes you may be required to be over a certain age specified in the Special Prize Terms for such prize);, (C) not be an employee of BBC Children in Need or SME Limited, BBC or BBC Studios Limited (the organisers of Countryfile Live) or any of their related companies or any Studios Limited provider (or employee or agent thereof) to BBC Children in Need, BBC, BBC Studios Limited or SME Limited or a member of the family of any of the above; and (D) agree and comply with these Raffle Terms.

3 2 ENTRY 2.1 By entering the raffle and/or accepting a prize from BBC Children in Need you confirm that you have complied, and shall continue to comply, with these Raffle Terms. 2.2 BBC Children in Need may ask for evidence to verify the age, identity and/or eligibility of an entrant at any time. BBC Children in Need may withhold delivery of a prize until it has received such evidence from the winner and failure to provide such evidence in a timely manner may result in forfeiture of the prize. 2.3 By entering the raffle, you agree that BBC Children in Need, BBC, BBC Studios Limited, SME Limited and the BBC may publicise your name and town of residence if you are a winner. BBC Children in Need, BBC Studios Limited or the BBC may also ask you to take part in additional publicity but you can choose whether or not you want to. 2.4 The opening and closing date and time for entries is as indicated below. All entries must be made in the entrant's own full name and must be received by BBC Children in Need by the closing date and time. Entrants may be required to provide their full contact telephone number, address and any other information as specified at the time of entering the raffle. It is the entrant s responsibility to notify BBC Children in Need if their contact details change. BBC Children in Need cannot be responsible for any failure or delay in contacting or delivering prizes to entrants if incorrect details are provided. 2.5 Each entrant will be i. charged the cost of entry as indicated whether their entry into the raffle is successful or not; and ii. liable for any cost as indicated in the Special Prize Terms. 2.6 The price of each ticket is 10 and payment for participation in the raffle may made by cash or credit/debit card. Each ticket will be entered into the draw only upon receipt of full payment. There is no limit on how many tickets an entrant may purchase. 3 PRIZES AND SPECIAL PRIZE TERMS AND CONDITIONS 3.1 The prizes are as specified in the Interaction Information and any applicable Special Prize Terms. 3.2 The Special Prize terms may also set out extra conditions, costs and/or requirements for you to win or receive your prize, so you are reminded that you must also comply with them. For example, (not by way of limitation and you must check for each prize) you may be required to be of a certain age or to provide proof of your age; some prizes are special by nature so that, for example, if you win a tour around a distillery, as a condition of being able to receive your prize and attend the distillery tour, you may first have to provide proof of age, and all attendees on a tour may be required to sign additional wavers such as Health and Safety and insurance wavers, provided by the prize organisers or venue,

4 and may be required to sign such special T&C or agreements with BBC Children in Need and/or a third party and such other documentation as is reasonable and/or required by law. 3.3 The Special Prize Terms may also set out costs for delivery of the prize to certain areas in the UK, Channel Islands and Isle of Man or set out that some prizes cannot be delivered there at all (for example to Scottish Highlands and Islands, and Northern Ireland). You should check the Special Prize Terms carefully for these costs and any other special terms related to delivery. Travel and Accommodation 3.4 Where the prize relates to travel and/or accommodation, the prize will be subject to availability and certain dates may be excluded. All elements relating to such prize must be taken up during one period, and on consecutive dates. The winner (and their companion(s) if applicable) may be required to hold a valid passport and/or other necessary travel documentation, authorisation and visas. Where the prize relates to travel for more than one person, the winner and their companion(s) must travel together, departing from and returning to the same location at the same time and on the same itinerary but the prize provider and/or their agents cannot guarantee that any seats that may be part of a prize will be adjacent to each other. 3.5 Winners must obtain all necessary travel insurance, obtain any necessary medical advice for their trip and confirm all necessary travel documents, including a passport, prior to any travel. 3.6 Where the prize involves travel or accommodation to a destination to be chosen by the winner, the dates and/or destination chosen is subject to availability. Events 3.7 Where the prize necessitates travel and/or attending an event on a specific date, the winner must be available on the date(s) specified by BBC Children in Need in the Interaction Information and no alternative dates will be available. Any travel and accommodation offered in connection with the Event as part of the prize must be used at the same time as the Event. Third Party Terms and Instructions please read this section carefully 3.8 Where any element of the prize and/or information relating to the prize is to be provided to the winner by a third party, the winner (and where applicable, their companion(s)) must comply with all instructions and necessary requirements as may be specified by the third party to receive and/or take up the prize, including but not limited to contacting such third party within specified time frames, adhering to the itinerary as specified, paying any required charges and/or costs which are not included in the prize, completing any required forms including but not limited to booking forms and delivering any required documentation to that third party, including but not limited to proof of identification.

5 3.9 The prize is subject to the terms and conditions of the prize providers, their agents, and where applicable to the terms of the venue and/or the manufacturer and/or item or product provider The winner (and where applicable, their companion(s)) may be required to provide their signature as proof of their agreement to relevant waivers, releases and/or consents and/or liability for any costs not included in the prize when taking up the prize. Failure to sign any relevant documentation may result in forfeiture of the prize BBC Children in Need shall not be liable where the winner fails to comply with the requirements or instructions of any third party providers and such failure may result in forfeiture of the prize. Winner s Costs and Liability please read this section carefully 3.12 Your special attention is drawn to any costs you may be liable for if you are a winner of a prize, by way of example only, if you are a winner of a garden cabin or child s play shed you would be required to meet the costs of any necessary ground works or building if required. Such terms will be set out in the Special Prize Terms and Conditions and the details terms and conditions for such prizes that are a part of the Raffle Terms The prize excludes all other costs and arrangements not expressly included in the prize. The winner (and where applicable their companion(s) is/are solely responsible for all other additional charges and expenses incurred in connection with the prize that are not set out in the prize description. BBC Children in Need will not be held liable where such charges and/or expenses are incurred, and no refund or reimbursement will be made. BBC Children in Need will accept no responsibility where the winner is unable to pay in full, any such charges and/or expenses as incurred. General 3.14 Each prize is subject to availability and to winner confirmation, i.e. BBC Children in Need has managed to contact the winner and received confirmation of eligibility For delivery of the prize, you may be required to be available at a specified time and place All arrangements for fulfilment of the prize shall be in accordance with the restrictions specified by BBC Children in Need and, unless stated otherwise in writing, shall take place within 12 months of the relevant closing date Where applicable, BBC Children in Need will only issue prize cheques made payable in the winner's name as given to BBC Children in Need at the time of entry The information provided as a description of the prize has been published in good faith and we will do our best to ensure that it is accurate. However, occasionally, it may be incorrect or incomplete due to human error or circumstances beyond our control.

6 3.19 Money paid for prizes is non-refundable and non-exchangeable. Prizes are non-transferrable and must not be transferred, resold, re-auctioned or otherwise made available to another party in any way. BBC Children in Need may substitute prizes of a similar description and standard if for any reason the relevant items are not available or for any other substantial reason BBC Children in Need will have sole and absolute discretion as to whether to accept any entry and BBC Children in Need may rely upon its own records and information in determining whether contestants are eligible to receive a prize A winner will generally be notified either by , telephone or post within 14 days of the relevant closing date Subject to confirmation by BBC Children in Need of the winner s address as may be requested, the winner will generally receive the prize within eight to ten weeks from the closing date or as set out in any Interaction Information or Special Prize Terms for the respective prize. 4 OPENING AND CLOSING DATE AND THE DRAW 4.1 The BBC Children in Need Raffle at Countryfile Live raffle will be held at the Countryfile Live event, Blenheim Palace, Woodstock, Oxfordshire, OX20 1PP, and will be open at on Thursday 2 nd August 2018 and will close at on Sunday 5 th August Winners will be determined by random draws of all eligible entrants for the number of prizes in the raffle. The BBC Children in Need Raffle at Countryfile Live, raffle draw will be held at the Countryfile Live event on Sunday the 5 th August 2018 after the closure of the raffle. 4.3 A list of winners for the raffle may be obtained by sending a stamped addressed envelope marked clearly with the name of the raffle to BBC Children in Need within 30 days from the date of the closing date of the raffle. 4.4 BBC Children in Need reserves the right to select an alternative winner, award the prize to another entrant or withdraw a prize entirely if: i. it has reasonable grounds for believing that an entrant who has been drawn as a winner has contravened the Raffle Terms or is fraudulent or dishonest (and therefore despite being drawn, is not eligible to be a Winner); ii. a winner has changed address to one outside of United Kingdom, the Channel Islands or the Isle of Man after the closing date; iii. it is unable to contact the winner within one month of selecting the winner; iv. the winner declines the prize; or

7 v. it does not receive confirmation of the winner s address or other contact details at the time and/or in the form as may be required by BBC Children in Need (at its sole discretion). 5 LIABILITY 5.1 BBC Children in Need is not responsible for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. 5.2 BBC Children in Need shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner(s) under these Raffle Terms if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes arising without limitation out of or in connection with the activities of any third party and/or any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars). 5.3 BBC Children in Need is not responsible for the acts and omissions of any third party providers of the prizes and accepts no responsibility or liability to the winner or any other persons for such third parties acts or omissions. 5.4 To the extent permitted in law, BBC Children in Need shall not be liable to the winner(s) or their companions (whether in contract, tort (including negligence) or otherwise) for any loss or damage arising out of or in connection with the raffle, prize and/or these Raffle Terms that is not foreseeable. Loss is foreseeable if it was an obvious consequence of BBC Children in Need s breach or if it was contemplated by the winner and BBC Children in Need when the winner entered the raffle. 5.5 Without prejudice to any of the above, you agree that, if BBC Children in Need is held to have any legal liability, BBC Children in Need will only be liable for direct loss up to a maximum total of the amount of the entry fee paid by the affected entrant plus any foreseeable losses incurred as a direct result of BBC Children in Need s breach. 5.6 Nothing in these Raffle Terms shall exclude or limit BBC Children in Need s liability for death or personal injury caused by its, or its staff s, negligence, for fraud, or to any extent not permitted by law. 6 PERSONAL DATA 6.1 BBC Children in Need will use the personal information you provide to administer the raffle, to fulfil the prizes and to maintain records for audit purposes in connection with the raffle. BBC Children in Need will only keep your information for as long as necessary to fulfil these purposes and will retain it in accordance with our retention policy (a summary of which is available on request). BBC Children in Need may share your personal information with the following people to process on our behalf:

8 an independent third party who carries out the draw; The BBC, BBC Studios Limited or, or SME Limited (the organisers of Countryfile Live) to announce the name and location of the winner or if you agree to take part in any additional publicity; and relevant third party providers of the prizes to fulfil the prize, the relevant party will be set out in any Special Prize Terms For more information on how BBC Children in Need will use your data, please see its Privacy Policy at or which is available on request. 6.2 Where any third party provides any element of the prize, your personal information will also be shared with such third parties for them to use for their own purposes of fulfilling the prize. Where this happens, the relevant third party will be the data controller under the General Data Protection Regulation 2016 and the Data Protection Act 2018 and will be responsible for their use of your data. BBC Children in Need will not be responsible for how they use or process your data in these circumstances. 6.3 If necessary, BBC Children in Need will cooperate with any investigation by any governmental body, regulatory authority, court or tribunal legitimately exercising rights and such cooperation may be without notice to you. 7 MISCELLANEOUS 7.1 BBC Children in Need may make minor changes to these Raffle Terms without notice. If BBC Children in Need makes any material changes, it will post a notice of such changes on the Countryfile Live website and will make such changes available at the Countryfile Live event. 7.2 These Raffle Terms shall be governed by and construed in accordance with the laws of England and in relation to any disputes arising therefrom, shall be subject to the exclusive jurisdiction of the courts of England. 7.3 In any matters concerning any part of the raffle, BBC Children in Need decision will be final and no correspondence or discussion shall be entered into with you or with any other person acting on your behalf regarding the decision If you have any queries or complaints please contact BBC Children in Need at Countryfile Live event, BBC Children in Need, Bridge House, Media City UK, Salford, M50 2BH or
