If an item, service or other expectation is not on your invoice please address immediately before paying. Also keep in mind that additionl foods, service, equipment, etc. may result in increased balance if applicable.

2 Services 1.1 Caterer agrees to provide services to the Client for Event: known as the Event, taking place on Date:. 1.2 For this Event, Caterer agrees to provide the following: (detailed description of what caterer will provide, such as food, decorations, cutlery, equipment, furniture, personnel, etc. is notated on your invoice). Client MUST review invoice for accuracy or otherwise is not our fault for missing products, services or incorrect items and no refund shall be permitted. 1.3 Client agrees to provide the following: (See Final Quote/Invoice for list) 1.4 Client agrees to pay Caterer the amount of $ (50% of the final price) to lock said date of event down. See section 6 for outline of refund 1.5 If you select the Buffet style service, the definition of this service is having the catering company serve your guests in a buffet line set up for proper portion controls. All buffet style services are designed to allow guests to one (1) plate of portioned size of entrée and sides. If you wish to have more than one serving per guest, please advise us so we can increase the head count and charge accordingly. 1.6 If you select the Plated style service, the definition of this service is having the catering company serve your guests individually at their tables all plating is designed to allow guests to one (1) plate of portioned size of entrée and sides. If you wish to have more than one serving per guest please advise us so we can increase the head count and charge accordingly. Additional servers are charged so we can service tables accordingly. 1.7 If you select the Family style service, the definition of this service is having the catering company serve your guests at their tables were all portions are delivered on platers or serving bowls all plating is designed to allow guests to a portioned size of entrée and all they can eat sides. If you wish to have more than one serving of the entrée per guest, please advise us so we can increase the head count and charge accordingly. There is a 40% increase on this due to all you can eat feature. 1.8 Buffet service Our staff will set up the buffet, service each guess a proper portion of foods. Afterwards they will clean up after the meal referring to our dinnerware and glassware only. Our dinnerware or any items that Taterings rent is our responsibility to manage and clean up. Clean up of other items and 3 rd party rentals, décor and linens we did not coordinate will result in additional charges but exempts us from any damages that occur. 1.9 Cake Cutting This is a FREE service but is only limited to the following. First we are not responsible for anything that happens to the cake(s) or desserts since we do not make them. Cake(s) will be cut by a member of our staff and placed on either plates you purchased or rented OR we will provide plastic plates with forks for your dessert when applicable. This is NOT a passed service meaning your guests must come get their cake from the table. If you wish to have it passed or this service modified, then additional fees will apply Service Time You have us for a maximum of 4 hours. Time starts once your guests arrive. It is the client s responsibility to respect your timeline you present to Tatering. Any additional labor caused by delays in your schedule will result in a $25 per hour per staff member having to stay beyond the allotted time. This will result in additional billing after the event. We strongly suggest a wedding or day planner to help prevent this from occurring. Payment 2.1 For the above services, Client will pay Tatering a total of $, and its basis. This is a set price for a certain menu, assuming a certain number of guests, or it can be a price per guest attending the event, or any other deal Client and Tatering agree to. Be specific, including the deposit outlined in Section Client may request additional services, with the knowledge that these services will add to the total cost agreed upon by this contract, and must be agreed to in writing, either as an addendum to this Agreement, or in a separate document.

3 2.3 The balance on the total cost is due in full 30 days prior to said event, or else Client will be subjected to late charges and/or cancellation with a total forfeiture of all monies paid to Tatering and cancellation of contract. Contact us immediately to avoid cancellation, however late charges will apply Due date of final payment is defined as the date 30 days prior to the event. Payment has to be received on this date of and not after. If you mail the final payment then it needs to arrive on or before said date of, or else it is considered late and will result in a total forfeiture of all monies paid to Tatering and cancellation of contract All late payments are subject a $100 per day fine and must be paid in full with the balance or this contract is voided and total forfeiture of all monies paid will apply. 2.4 Any equipment deposits are refundable once property has been returned to Tatering, within 2 days of the Event, in original condition and cleaned. Guests 3.1 Client agrees to provide Tatering with the total number of guests no later than 30 days before Event. Final amount of contract can change if number of guest s increases. Failure to provide information before will result in a total forfeiture of all monies paid to Tatering All headcount changes after day 30 will be handled in the following way a Day 29 to day 16: Increases are subject to the following increase per person of 1 ½ (one and a half) times the original quoted price per person (food/services/equipment/etc.) 3.1.1b Day 15 to day 1: Increases are subject to the following increase per person of TWO (2) times the original quoted price per person (food/services/equipment/etc.) 3.1.1c Day 29 to day 1: Decreases are not permitted to be reduced after day 30. No refund will be allowed. 3.2 Client agrees to break down the guest list into adults and children, and include any food allergies or special dietary requests, if applicable. We are not responsible for any issues if information is not provided. Menu 4.1 Client will choose from Caterer s available options. 4.2 Menu must be confirmed by 30 days before the Event, or else Client will be subjected to cancellation and non-refund of deposit. 4.3 Menu will be fixed, and no changes may be made, 30 Days before Event. Cancellation Policy 6.1 Client may cancel this Agreement 30 days prior for partial amount after administrative fee has been deducted. A FIFTY PERCENT (50%) administrative fee will be applied for all cancellations greater than 30 days prior to the event stated. 6.2 Cancellation occurring 29 days or less before Event will result in a total forfeiture of all monies paid to Caterer. 6.3 All refunds will be issued within 30 days of cancelling if a refund is defined from above. Refunds will be mailed to customer in the form of a check and to the address specified by the client.

4 Inclement weather 7.1 We understand Texas weather can be unpredictable. We are always concerned with safety of our guests as well as our staffing. If weather conditions are present that pose danger to our staff and as well to your guest s services will have to be postponed until a safe work environment is present If a situation is present will be handled in the following way a Decisions are made typically the day of the event 7.1.1b We will look at moving our contract date to a new date that both Tatering and client are both available c The client is 100% responsible to pay for all labor, foods, rentals and equipment costs for the new date. This is at COST to Tatering, no upcharge will occur. Code of Conduct Policy 8.1 We expect you and your guests to maintain an appropriate level of conduct with Tatering. Please read below code of conduct and sign you have read and received this. If not signed this contract is void with no refund. Date / / Any violation of this policy will result in immediate cancellation and termination of contract between our catering company and client stated on our contract. This will be effective immediately when unappropriated conduct has been displayed. Regardless if this is prior or even during an event we are conducting. Because of these violations, there will be 100% total forfeiture of all monies paid to Tatering. It is also a violation to our contract to post any negative comments, reviews or verbally advertising when you violate such policy. We strictly prohibit any negative or inaccurate reviews, media, social, blog and all online negative behavior of our company. Any violation may be addressed in a legal manner and damages caused by this the client will be held accountable. Engage in disruptive, disturbing behavior including: o Inappropriate physical contact to our employees o Profane, obscene or abusive language; racial, ethnic, or sexual orientation epithets Taking any property, inventory or unauthorized materials owned by Tatering Vandalize our property by writing, marking, scribbling, defacing or causing destruction to the property in any manner Possess, use or sell any controlled substance while on our property or in our presence. Complaints o All complaints from both customer and your guests must be done OFFLINE and given Tatering the opportunity to conduct a proper review of the issue. o Please notify us the day of or immediately after the event if an issue arises o Please state facts o All negative reviews posted without above communication to us will void any type of refund and we reserve the right to pursue any legal damages caused by said reviews. Communication failure o We expect to keep an open line of communication and information. If a change is needed, then we need to know immediately and if possible not the day of. o Failure to respond to s, text or phone calls in regards to your event and contract.

5 Arbitration 9.1 Should either party failure to provide or breach this Agreement in any way, the offending party will be liable for any damages. 9.2 Both parties agree to seek a third-party mediator or arbitrator for any disputes that arise as a result of this Agreement. Jurisdiction This Agreement falls under the jurisdiction of the state of Texas, and is therefore subject to all of Texas laws and regulations.
