1 Dear Parents & Campers Thank you for joining us this summer for Mountain Bike camp. We are looking forward to taking advantage of all the amazing terrain in Carrabassett Valley and its surrounding areas. In this packet, you will find medical release forms, waivers, and other forms which need to be filled out and sent back to us at your earliest convenience. , mail, or fax the pages back to me at your earliest convenience. On registration day (first day of camp), campers will check into the CVA dormitory between 12-3pm. The dormitory (Murfey Hall) is located on Begin Way, which is off the Sugarloaf access road across from The Rack. Campers will be picked up by 12pm on August 8 th at the same location. All campers will need the following equipment/gear for the camp: Functional mountain bike that has been recently tuned up, bike helmet, 2-3 pairs of padded riding shorts (baggy or lycra versions), sports sunglasses, bike tool pouch, bike multi-tool, mini pump, spare tube, 2 water bottles/hydration pack, long sleeve synthetic or wool shirt, windbreaker. Besides cycling gear your child will also need the following items: swim suit, casual clothes, towel, toiletries, sun screen, bug spray, sleeping bag, water sandals, sneakers, and a rain coat. 8 Carrabassett Valley Academy Camp Consents and Releases Declaration of Fitness to Participate We declare that the camp participant is capable of and qualified to participate in all athletic, training and sports activities while enrolled at a CVA camp and that there are no known or undisclosed conditions that would make the student unfit or incapable of participating in any athletic, training, or sports activities while enrolled at CVA camp. Where the student has a medical condition, the student is responsible for acting within his/her capabilities and alerting staff as needed. Medical/Accident Insurance We hereby agree to provide and maintain medical/accident insurance for the student for the duration of the term of enrollment. We understand that Carrabassett Valley Academy does not provide and is not responsible for providing medical/accident insurance. We understand and accept that the camp participant and his/her family are solely responsible for all medical expenses incurred in connection with any CVA event or activity. Promotional Image Release We hereby give permission to CVA or its designee(s) to use photographs, likenesses, video images, audio recordings, quotations and identifying information of the student and parents/guardian in any educational, documentary or promotional materials utilized, released, or published by CVA, and we give permission for CVA or its designee(s) to choose the venues for such utilization, release or publication. We understand that such educational, documentary or promotional materials may include, but are not limited to, radio production, television production, filming, and the CVA website on the internet. We authorize the release to the media of the student's photographs and general information, both during and after the student's enrollment at CVA. Release and Agreement Not to Sue We hereby give permission for the student to participate in all camp activities, including field trips, social events, athletic events, and all other camp activities, both on campus and away from campus. We acknowledge that CVA attempts to provide a caring, quality educational and athletic program for its campers. We acknowledge that there are certain inherent risks of injury associated with many activities whether on campus or off campus and at locations such as ski slopes, running trails and bike trails and that such risks affect all campers regardless of ability, athletic conditioning or medical condition. We also recognize that absent an appropriate release, CVA could run the risk of being sued for alleged negligence every time an injury occurred. We acknowledge that in return for providing programming to its campers, CVA has a legitimate interest in being free from defending claims of alleged negligence arising from such injuries.falls and other injuries are a common occurrence requiring deliberate and conscious control of the camper's body. Safety is directly affected by the camper's judgment, often in a rapidly moving environment. It is the camper's responsibility to stay within the limits of his/her own ability and good judgment. We agree to assume full responsibility for any risk of personal injuries, disease, or other damages which could arise, whether directly or indirectly, no matter how indirectly, from the camper's participation in any activities while enrolled at a CVA camp. We further agree to purchase insurance or similar protection at our own expense if we wish to provide for financial recovery with regard to such damages. We further agree not to sue CVA or its employees or agents, or to bring any claim against them for alleged negligence or other fault in causing or in treatment of any such injuries, death, or damages, and agree to release and indemnify CVA and its trustees, officers, employees and agents from any such claims. It is the intent of this contract to protect CVA against all such suits, whether alleging negligence or otherwise. It is agreed that this section of the contract is enforceable only to the extent permitted by Maine law. Applicable Law It is agreed that this contract for higher education and any disputes that may arise, directly or indirectly from it, will be governed by the law of Maine. We further agree that any dispute arising directly or indirectly under this contract or any other dispute between the undersigned and CVA, to the extent it may be brought to court at all, shall be submitted to courts in the State of Maine only, and not those in any other state or jurisdiction. It is agreed that the terms of this contract are severable and that should any portion be found not to be enforceable, the remaining portions of the contract will not be affected. IMMEDIATE DISMISSAL FROM PARTICIPATING WITH CVA WILL RESULT FROM ANY INVOLVMENT WITH, POSSESSION, USE OR DISTRIBUTION OF ALCOHOL, DRUGS OR TOBACCO, OR ANY RELATED PARAPHERNALIA If student/athletes choose to remain in a room or situation where alcohol and/or drugs are being used; they will be considered to be involved and will be dismissed. Terms of dismissal are as follows; 1) parent/guardian is notified of incident; 2) parent/guardian is responsible for making arrangements for athlete s return home immediately; 3) no refund for loss of service. The undersigned agree to the terms of this contract in its entirety. The camp participant and both parents must sign below unless CVA otherwise agrees in writing. 9 This release must be signed prior to participation in any activities in the Anti-Gravity and Recreation Complex. 1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and, 2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, 3. I willingly agree to comply with the stated and customary terms and conditions for participation, and if I cannot comply, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, 4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE TOWN OF CARRABASSETT VALLEY AND CARRABASSETT VALLEY ACADEMY, their officers, officials, agents and or employees, other participants, sponsoring agencies, sponsors, advertisers, insurers, owners and lessors of the premises (herein, the Releases ) WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS OR DAMAGE TO PERSONAL PROPERTY, whether arising from the negligence of the releases or otherwise, to the fullest extent permitted by law: such indemnification shall include any reasonable attorneys fees and costs incurred by The Town of Carrabassett Valley and or Carrabassett Valley Academy in connection with such claims or causes of action. The Town of Carrabassett Valley and Carrabassett Valley Academy retains any defense, immunity, or limitation of liability available to The Town and the Academy by law, including the Maine Tort Claims Act; and, 5. I specifically agree that I shall indemnify and hold harmless The Town of Carrabassett Valley and Carrabassett Valley Academy, its officials, municipal officers, employees, agents, their heirs, successors and assigns, from any such claims, demands, causes of action, judgments, or liabilities by a third party, including claims by my child named below. My indemnification for the Town of Carrabassett Valley and Carrabassett Valley Academy, set forth above, shall be binding on me and legally effective even in the event that a minor s signature, set forth below, is not considered to be legally valid. Authorization I hereby give my consent to any emergency medical procedures deemed advisable for my child by the Town of Carrabassett Valley or Carrabassett Valley Academy, and / or its employees and staff in the event that I cannot reasonably be contacted in sufficient time, given the circumstances of my child s injury, and my child has sustained an injury which reasonably requires treatment. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INCIDENT. This is to certify that I, as parents/guardian with legal responsibility for this participant, do consent and agree to this release as provided above, of all releases; and for my heirs and assigns, I release and agree to indemnify and hold harmless the releasees from any and all liability incident to my minor child s involvement or participation in any activity at the Carrabassett Valley Antigravity and Recreational Complex as provided above, even if such liability arises from the negligence of the releases, to the fullest extent provided by law. I also agree to be fully bound by the indemnification provisions set forth in (4) and (5) above. The student and both parents must sign below unless CVA otherwise agrees in writing.
