3 GUIDE TO ELECTRONIC SOLICITATION SUBMISSIONS I. INTRODUCTION TO BIZNET It is now a requirement of the Department of Administrative Services (DAS) Procurement Services that all Companies create a Business Network (BizNet) Account and add your company profile in the BizNet system. Companies are responsible for maintaining company information as updates occur. Please Note: If you are certified through the Supplier Diversity or the Pre-Qualification Program, you have already created a BizNet account. The BizNet login is: New Companies: Create an account by clicking the BizNet login link above and then the button on the right labeled Create New Account. Login and select CT Procurement and Company Information. Please be sure to complete information in all tabs (Company Information, Accounts, Address, etc ). Existing Companies Needing to Update Their Information: Login to BizNet and select CT Procurement and Company Information. Note: If you are having difficulty connecting to your account or downloading/uploading forms, please call DAS/Procurement Services at II. BUSINESS FRIENDLY LEGISLATION As a result of Public Act , DAS/Procurement Services goal is to make doing business with the State of Connecticut more business friendly. To eliminate redundancy, forms that were repetitively filled out with each solicitation are being automated in BizNet. DAS/Procurement Services began the transition to on-line solicitation submittal by automating the submission of Affidavits and Non-Discrimination forms on October 1, Companies can submit forms electronically to their BizNet account if they haven t already done so. These forms must be updated on an annual basis, no later than 30 days after the effective date of any material change rather than completing them with each solicitation submittal. Companies that have already filed these forms have the ability to view, verify and update their information prior to submitting a solicitation response. 6 Request for Proposals SECURITY PERSONNEL SERVICES Overview The State of Connecticut, Department of Labor announced on February 8, 2013 that Guard I and Guard II Security Personnel positions would be incorporated into Connecticut Standard Wage Laws and subject to the provisions of Connecticut General Statutes (CGS) 31-57f effective July 1, Wage and benefit requirements under Standard Wage will impact the current budget environment. The Department of Administrative Services (DAS) is seeking to revisit solutions for Uniformed Security Personnel Services that will incorporate the Standard Wage requirements, provide the most cost effective solution(s) and provide effectively trained security personnel and services. It is the intention of DAS to streamline contractor participation to that/those contractor(s) that provide the most cost effective solution, that can harmonize services with effectively trained security personnel, and demonstrate solid solution(s) and experience with worker organizations and labor synergies. The results of this contract will replace the existing contract #09PSX0321 Scope of Services I. Scope of Services A. All work performed under this Contract shall be in compliance with Public Act No , Connecticut (CT) General Statutes g, y, z and aa, and any other applicable Statutes or Regulations regarding Security Officer and Security Service 1. Contractor must conform to all current Connecticut laws pertaining to Private Detective, Security Officer Services and Security Personnel according to CGS Contractor will provide to DAS and maintain a current and valid copy of their Company License. This license is obtained through the Department of Emergency Services and Public Protection (DESPP), Division of State Police, Special Licenses and Firearms Unit, 111 Country Club Road, PO Box 2794, Middletown, CT , Tel.: Failure to provide a current copy of the license on an annual basis constitutes grounds for removal of your company from the Contract award. 2. Pursuant to CGS q,a security officer must be registered and have a valid Connecticut Security Officer Identification Card (Guard Card) from the DESPP, Special Licensing and Firearms Unit. The security officer must carry their valid Security Officer Identification Card at all times while performing their duties. During the course of performing their duties, a registered security officer must present their guard card for inspection when requested by the Client Agency, DAS Statewide Security Unit or any law enforcement officer. Pursuant to CGS z and CGS 29-28, an armed security officer must be registered and have a valid Connecticut Security Officer Identification Card (Guard Card) with the DESPP, Special Licensing and Firearms Unit. The security officer must carry their valid Security Officer Identification Card with firearms permit (Blue Card) at all times while performing their duties. During the course of performing their duties, a registered security officer must present their blue card for inspection when requested by the Client Agency or DAS Statewide Security Division or any law enforcement officer. 4. All security officers performing any services under this Contract must be registered (under the Contractor license) with DESPP division of State Police, Special Licenses and Firearms Unit. Any security officer that is not registered with DESPP shall not engage in any security officer services until the Contractor has applied to register the security officer with DESPP. Security Officers shall hold a valid Connecticut Security Officer Identification Card (Guard Card) prior to registering the security officer. B. Services will be primarily for unarmed security personnel for the protection of various buildings, grounds and appurtenances. C. It is anticipated that the majority of requirements for uniformed security personnel will be longterm, however, duration may be as short as one or two days as the need warrants. D. The Contractor shall ensure continuity of the security personnel initially assigned to a Client Agency post unless that use is objected to by the Client Agency, or a mutually acceptable alternative schedule is agreed upon with the Client Agency. E. Armed security personnel may also be required and shall be identified by the requesting Client Agency. F. Client Agency Site specifications, rules, regulations, and clearances shall be established prior to assignment and maintained throughout the term of the contract. Contractor must adhere to established security and/or property entrance policies and procedures established for each requesting Client Agency. It is the responsibility of each Contractor to understand and adhere to those policies and procedures prior to any attempt to enter the premises. RFP Template RFP-22 Rev. 12/4/12 Prev. Communications & Questions During the period from your organization s receipt of this Request for Proposals, and until a contract is awarded, your organization shall not contact any employee of the State of Connecticut for additional information, except in writing via , directed to Cindy Milardo, Contract Team Leder at cindy.milardo@ct.gov. 9 Product and/or Service Specifications I. Guard Levels A. Guard I - Standard Wage Position 1. Carries out detailed instructions and procedures primarily oriented to insure that emergencies and security violations are readily discovered and reported to appropriate authority. The primary duty is to observe and report security and emergency situations. Intervenes directly only in situations which require minimal action to safeguard property or persons. B. Guard II Standard Wage Position 1. Enforces regulations and procedures designed to prevent breaches of security, exercises judgment and uses discretion in responding to incidents and emergencies, determining whether to intervene directly, ask for assistance as time permits, keep situation under control or surveillance, or to report incident or situation to the appropriate authority for handling. Commonly required to demonstrate proficiency with firearms and other special weapons and to meet rigorous physical fitness standards. C. Supervisory / Shift Supervisory / Field Supervisory 1. Serves as a liaison between the Contractor and the Client Agency. Investigates all matters concerning security and safety at state properties and reports findings to the Client Agency. Monitors and supervises activity and performance of all security personnel levels at site location(s). Makes recommendations to Client Agency for improvements in safety and service. II. Guard Qualifications and Requirements A. Describe your firm s hiring and selection requirements and qualifications for each guard level. A job description shall be provided for each guard level being proposed. B. Describe your certification process and specific requirements for each guard level C. Provide specific background checks and screenings done for each guard level D. Copy(s) of the Firm s DESPP License(s), and verification that security personnel have appropriate registration cards, permits, and/or licenses as required must be submitted with proposal responses. 10 III. Guard Training Contractor(s) shall perform all necessary training, refresher training, and continuation training at the Contractor s expense: A. Describe the firm s training program for each guard level. A copy of the firm s Training manual may be requested for evaluation purposes. B. Describe the specific curriculum for each security guard level. C. Describe the firm s training certifications at hiring, refresher training, and continuation training programs. Identify the frequency of training and refresher training and how the firm will administer and manage the training and refresher training requirements and results to DAS. IV. Worker Organizations and Labor Synergies A. Describe any employee incentive, recognition and/or retention programs. B. Describe the firm s strategy and experience with a collective bargaining workforce. Provide detail that outlines the nature of the firm s existing workforce and locations of the firm s employees that participate in collective bargaining assignments. C. Provide specific detail pertaining to past and/or present grievances, litigation, violations and the solutions reached. D. Describe the firm s problem resolution protocol. E. Describe the firm s specific experience with Standard Wage regulations. Provide specific details on the firm s experience transitioning to a Standard Wage environment. Responses should indicate how the firm incorporated salary and benefits into their transition. V. Services A. Describe how the firm will match security personnel with services required. B. Describe the firm s uniform allocations for each guard level. C. Describe the firm s equipment that includes, but is not limited to: 1. Radios and/or other communication devices. 2. Vehicles (Radio equipped) 3. Bicycles D. Describe the firm s reporting capabilities in relation to services required including, but not limited to, certified payroll, incident reports, training reports, and security service personnel activity reports. 11 VI. Contract Administration A. Describe the firm s approach and structure to managing the uniformed security personnel contract for the State of Connecticut. Responses must indicate a client service plan, a problem escalation plan, an annual certification, training/refresher notification plan, and communication plan. B. Detail the proposers solution to providing availability 24/7, 365 days per year. C. Describe how the firm will monitor the performance and activity of its security personnel at various Client Agency sites. D. Describe the firm s transition plan to incorporate Standard Wages into their workforce. E. Describe the firm s transition plan for implementing security personnel at a new location. The transition plan should list specific tasks and estimated timeframes. VII. Work Hours A. Standard Work Day 1. A standard workday consists of an eight hour shift plus a one-half hour lunch period. 2. Work shifts will vary per location. B. Holidays 1. The holiday rate of pay will be one and one half times the chargeable hourly rate. 2. Holiday rates shall only be paid for security officers authorized to work by the client agency on a State observed holiday. 3. Overtime 1. Overtime is the amount of hours worked in excess of the standard 40-hour workweek. 2. Overtime is not allowed unless approved by the requesting Client Agency. 3. Client Agency shall not be responsible to pay overtime for a replacement security officer when the regularly scheduled security officer is not available. RFP Template RFP-22 Rev. 12/4/12 Prev. 12 Proposal Requirements I. Contract Period The State intends that this contract shall be in effect beginning July 1, 2013 through June 30, The parties may extend this Contract, prior to Termination or expiration, one or more times for a combined total period not to exceed the complete length of the original term, but only in accordance with the section in this Contract concerning Contract Amendments. II. Mandatory Extension to State Entities Proposers are required to offer and extend this contract (including pricing, terms and conditions) to Political Sub-Divisions of the State (Towns and Municipalities), Schools, and Not-For-Profit Organizations. When a Political Sub-Division, School, and/or Not-For-Profit Organization utilizes this contract all references to the State are hereby replaced with the Name of the Using Sub-Division, School, or the name of the Not-For-Profit Organization. III. Standard Wage Rates A. Contractors must comply with all provisions of Connecticut General Statues 31-57f, Standard Wage Rates for Certain Service Workers and must pay wages in accordance with the current wage rates provided by the Department of Labor. Information regarding this Statute and how and when it applies can be obtained from DOL s web site at B. Questions concerning the provisions and implementation of this act should be referred to the Connecticut Department of Labor, Wage and Workplace Standards Division, 200 Folly Brook Blvd., Wethersfield, Ct (860) or his designated representative. C. Standard Wage rates for Guard I and Guard II positions are provided in Attachment II. IV. Pricing A. Pricing submitted shall reflect net pricing at an hourly rate. B. Partial hours shall be paid in 15-minute increments. C. Proposals may be submitted for each county the firm is proposing. V. Insurance Before commencing Performance, the Contractor shall obtain and maintain at its own cost and expense for the duration of the Contract, the following insurance as described in (a) through (h) below. Contractor shall assume any and all deductibles in the described insurance policies. The Contractor s insurers shall have no right of recovery or subrogation against the State and the described Contractor s insurance shall be primary coverage. Any failure to comply with the claim reporting provisions of the policy shall not affect coverage provided to the State. RFP Template RFP-22 Rev. 12/4/12 Prev. Rev. 9/21/12 Page 12 of 20

13 The Contractor shall carry and maintain at all times during the term of the Contract, and during the time that any provisions survive the term of the Contract, sufficient general liability insurance to satisfy its obligations under this Contract. The Contractor shall name the State as an additional insured on the policy and shall provide a copy of the certificate to DAS prior to the effective date of the Contract. The Contractor shall not begin Performance until the delivery of the certificate to DAS. The Client Agency shall be entitled to recover under the insurance policy even if a body of competent jurisdiction determines that the Client Agency or the State is contributorily negligent. (a) (b) (c) (d) (e) (f) (g) (h) Reserved Commercial General Liability: $1,000,000 combined single limit per occurrence for bodily injury, personal injury and property damage. Coverage shall include, Premises and Operations, Independent Contractors, Products and Completed Operations, Contractual Liability and Broad Form Property Damage coverage. If a general aggregate is used, the general aggregate limit shall apply separately to the project or the general aggregate limit shall be twice the occurrence limit. Automobile Liability: $1,000,000 combined single limit per accident for bodily injury. Coverage extends to owned, hired and non-owned automobiles. If the vendor/contractor does not own an automobile, but one is used in the execution of the contract, then only hired and non-owned coverage is required. If a vehicle is not used in the execution of the contract then automobile coverage is not required. Workers Compensation and Employers Liability: Statutory coverage in compliance with the Compensation laws of the State of Connecticut. Coverage shall include Employer s Liability with minimum limits of $100,000 each accident, $500,000 Disease Policy limit, $100,000 each employee. Reserved Umbrella Liability: Excess/umbrella liability insurance may be included to meet minimum requirements. Umbrella coverage must indicate the existing underlying insurance coverage. Claims Made: Not acceptable with the exception of Professional Liability when specified. Reserved VI. Emergency Standby for Goods and/or Services In the event of a declared emergency or natural disaster within the State of Connecticut, not resulting from inadequate inventory or contract expiration, but which are expected to be temporary in nature, DAS and/or the Client Agency reserves the right to request the goods and/or services called for in this contract from the Contractor. The Contractor shall make best effort to provide goods and/or services at the time and in the manner specified by DAS and/or the Client Agency. From the time a request for goods and/or services is made the contractor shall acknowledge the request within two (2) hours. If the Contractor is unable to respond or provide the goods and/or services requested, DAS and/or the Client Agency reserves the right to procure said good and/or services from another source. Contractors called upon to perform under emergency circumstances shall supply goods and/or services in a timely manner such that time is of the essence. Contractors shall offer the DAS and/or Client Agency first priority for goods and/or services, which are unknown at this time, but which may be required during an actual emergency, from its regular sources of supply at the rates set forth in Exhibit B of this Contract. 14 VII. P-Card (Purchasing Credit Card) Purchases for all state agencies that are less than $1,000 shall be made using the State of Connecticut Purchasing Card (MasterCard) in accordance with Memorandum No issued by the Office of the State Comptroller. Contractor shall be equipped to receive orders issued from this Contract using the purchasing card. The Contractor shall be responsible for the credit card user-handling fee associated with credit card purchases. The Contractor shall only charge to the State s MasterCard upon delivery of goods or rendering of services. The Contractor shall capture and provide to their Merchant Bank, Level 3 reporting at the line item level for all orders placed by State purchasing cards. Contract Award The State reserves the right to award this Contract in a manner deemed to be in the best interest of the State and may include, but not be limited to: A. by item, group of items, or in it s entirety B. geographic location to adequately service the entire State of Connecticut in the best possible manner C. Multiple Vendor Award IX. Bonds: A. Performance Bond Prior to issuance of a contract award, the awarded contractor shall submit a performance bond or irrevocable letter of credit in the amount of $500, X. Stability of Proposed Prices Any price offerings from proposers shall be valid for a period of 180 days from the due date of the proposals. XI. Amendment or Cancellation of the RFP DAS reserves the right to cancel, amend, modify or otherwise change this RFP at any time if it deems it to be in the best interest of the State to do so. XII. Proposal Modifications No additions or changes to any proposal will be allowed after the proposal due date, unless such modification is specifically requested by DAS. DAS, at its option, may seek proposer retraction and/or clarification of any discrepancy or contradiction found during its review of proposals. XIII. Proposer Presentation of Supporting Evidence Proposers must be prepared to provide any evidence of experience, performance, ability, and/or financial surety that DAS deems to be necessary or appropriate to fully establish the performance capabilities represented in their proposals. 15 XIV. Proposer Demonstration of Proposed Services and or Products At the discretion of DAS, proposers must be able to confirm their ability to provide all proposed services. Any required confirmation must be provided at a site approved by DAS and without cost to the State. XV. Erroneous Awards DAS reserves the right to correct inaccurate awards. This may include, in extreme circumstances, revoking the awarding of a contract already made to a proposer and subsequently awarding the contract to another proposer. Such action on the part of DAS shall not constitute a breach of contract on the part of DAS since the contract with the initial proposer is deemed to be void and of no effect as if no contract ever existed between DAS and such proposer. XVI. Proposal Expenses Proposers are responsible for all costs and expenses incurred in the preparation of proposals and for any subsequent work on the proposal that is required by DAS. XVII. Ownership of Proposals All proposals shall become the sole property of the State and will not be returned. XVIII. Ownership of Subsequent Products Any product, whether acceptable or unacceptable, developed under a contract awarded as a result of this RFP shall be the sole property of the State unless otherwise stated in the contract. XIX. Oral Agreement or Arrangements Any alleged oral agreements or arrangements made by proposers with any State agency or employee will be disregarded in any State proposal evaluation or associated award. 18 ATTACHMENT 1 - CONTRACT This RFP is not a contract and, alone, shall not be interpreted as such. Rather, this RFP only serves as the instrument through which proposals are solicited. The state will pursue negotiations with the highest scoring proposal. If, for some reason, DAS and the initial proposer fail to reach consensus on the issues relative to a contract, then DAS may commence contract negotiations with other proposers. DAS may decide at any time to start the RFP process again. Thereafter, Proposers will be required to sign a formal contract as identified in Contract.
