2 BACKGROUND In 2002 the City of Cape May turned over responsibility for local fire inspections to the State of New Jersey. Fire prevention had been one of the ancillary functions of the Cape May Fire Department. In practice, however, adequate personnel resources were not available to cover the routine needs of the fire department and conduct fire prevention inspections. Responding to fire and emergency calls was the obvious priority and, at any given time during the day, a fire or emergency call could interrupt a fire inspection activity. In order to avoid such continuing conflict, the fire inspection responsibility was returned to the State. After more than a decade of experience of State oversight of fire inspections in Cape May City, there was increasing interest in returning this function to local authority. Such interest was based largely on the random nature of State inspections and the absence of routine on-site inspections. While understandable, given the State workload and travel distance between Trenton and Cape May, the State operation was increasingly less than satisfactory. The City began exploring its options in April 2017.
3 BACKGROUND The City Council revisited the matter of a local Fire Prevention Bureau and the City Manager contacted the State to advise there was interest in returning the fire inspection function to City auspices. Given the City s prior experience of the competing roles and responsibilities between responding to fire and emergency calls and conducting fire prevention inspections, a separate fire prevention bureau was determined to be in the City s best interests. Fire prevention protocols in near-by jurisdictions were reviewed to gain a more informed understanding of operations and costs. Based on these reviews, an outline of the purpose, rationale, mission, scope, costs and fees was developed and studied. As a consequence, the benefits of establishing a fire prevention bureau in Cape May were clear and included: Greater confidence in the provision of services for the health, safety and welfare of Cape May residents, visitors and business; Increased capability to serve all the citizens and businesses of Cape May City more effectively; Greater assurance that fire safety inspections would be all-inclusive and consistent rather than random and periodic; Increased assurance that dedicated fire prevention personnel would focus on fire prevention and safety through inspections, compliance and follow-up and not be delayed or disrupted by other fire or emergency priorities; Greater certainty that more comprehensive and thorough fire inspections would be accomplished rather than random, perfunctory ones; Well-founded confidence that the fire prevention bureau would be financially feasible and would result in a net neutral or net profit
4 DECISIONS & ACTIONS Ordinance was adopted by City Council and Cape May City Fire Prevention Bureau was established on August 15 th Enforcement will take effect January 1 st 2018
5 SALE & RENTAL PROPERTIES For the year 2018, all 1 & 2 family dwellings shall be inspected upon the sale of property. Rental properties shall be inspected prior to tenant occupancy. The seasonal rental period shall be from April 15 th September 30 th of any given year.
6 SALE & RENTAL PROPERTIES FEES For the sale of property or rental property inspections, the fee shall be one hundred ten ($110)dollars. This fee shall include only the sale of property or rental property inspection application received in the Fire Bureau office more that ten (10) working days from the settlement or tenant occupancy date. For all sale of property or rental property inspection applications received in the Fire Bureau office within less than ten (10) business days to settlement or tenant occupancy, the fee shall be two hundred twenty ($220) dollars. Certificates of smoke detector and carbon monoxide compliance, issued by the Bureau of Fire Prevention, are NON TRANSFERRABLE.
7 SALE & RENTAL PROPERTIES REQUIREMENTS Smoke Detectors & Carbon Monoxide Alarms Fire Extinguisher Size shall be no smaller than a 2A:10BC, and can weigh no more than 10lbs. Fossil Fuel/Solid Fuel Heating Appliances (For rentals only) Range Hood (For rentals only)

11 SALE & RENTAL PROPERTIES ACCESS Lock boxes are strongly encouraged to expedite and simplify the inspection process. Bureau of Fire Prevention will pick up keys from Cape May City Real Estate Offices Only. Utilize Property Management Company Schedule with property owner, if not utilizing the first three options
