3 COMMERCIAL AUTO PROGRAM Commercial auto insurance is provided under the ISO Commercial Auto policy, which provides bodily injury and property damage liability coverages for commercial auto risks, along with a variety of other coverages that are outlined in the following pages. Binding Authority You may bind coverage, subject to the ineligible risk characteristics found in this section, up to the limits shown below. Bodily Injury/Property Damage Liability Medical Payments (where applicable) $1,000,000 Combined Single Limit $5,000 per person Uninsured/Underinsured Motorist Liability $1,000,000 Single Limits Physical Damage $125,000 actual cash value - on any one vehicle Ineligible Risks - Risks with more than one minor moving violation per driver within the last 36 months - Any at fault accidents within the last 36 months prior loss history is required with application - Any driver with a suspended, cancelled or revoked drivers' license within the last 36 months - Ambulances, police, fire or other emergency vehicles - Amphibious equipment - Amusement devices, carnivals or circuses - Automobile garages - Anhydrous ammonia - Antique or obsolete vehicles - Auto driving schools - Automobile leasing or rental - Bulk oil dealers - Buses or livery conveyances - Courier services - Dump trucks over 20,000 GVW - Explosives, including chemicals & fertilizers - Garbage removal - Hauling for hire - Hazardous materials transport - House movers - Junk, metal or scrap iron dealers - Liquefied petroleum gas - Logging - Milk haulers bulk - Mining or quarry operations - Oil field all classes of operations - Pizza delivery - Public autos (taxis, limousines, etc.) - Radius of operations over 200 miles (no long haul or Zone Rated vehicles) - Sand or gravel hauling - Sewer contractors - Snow removal - Vehicles used in speed contests, races, exhibitions - Vehicles equipped with a cherry picker, boom or tree spade Submission Risks (Non-Binding) Agents may not bind coverage on the following classes, but individual consideration will be given if complete underwriting information is submitted to the Home Office (non-bound) so that an underwriting investigation can be completed. - Dump trucks under 20,000 GVW without supporting coverage - Extra-heavy trucks - Semi-trailers - Truck-tractors - Sports or high performance vehicles, as determined by the Company - Vehicles over 15 years old with physical damage Policy Term Policies are written for a term of twelve months. A renewal declarations will be mailed approximately 36 days in advance of the renewal date. TRUCKS, TRACTORS AND TRAILERS CLASSIFICATIONS Classify trucks, tractors and trailers for liability and physical damage coverages as follows: A. Fleet Non-Fleet Classifications 1. Classify as fleet the autos of any risk that has five or more self-propelled autos of any type that are under one ownership. Do not include autos owned by allied or subsidiary interests unless the insured holds a majority financial interest. 2. Do not include mobile equipment insured on a general liability policy in determining if the risk is a fleet. 3. Do not include trailers in determining if the risk is a fleet, but apply the fleet classification to the trailers if the risk otherwise qualifies as a fleet. 4. Classify the autos of any other risk as nonfleet. 5. Do not change the fleet or non-fleet classification because of mid-term changes in the number of owned autos. B. Primary Classifications 1. Vehicle Weight Gross vehicle weight (GVW) and gross combination weight (GCW) means: Sec. 15 CA-1 WA 01-08

4 a. Gross Vehicle Weight The maximum loaded weight for which a single auto is designed, as specified by the manufacturer. b. Gross Combination Weight The maximum loaded weight for a combination truck-tractor and semi-trailer or trailer for which the truck-tractor is designed, as specified by the manufacturer. 2. Size Class a. Light Trucks Trucks that have a gross vehicle weight (GVW) of 10,000 pounds or less. (2) An extra-heavy truck-tractor has a gross combination weight (GCW) over 45,000 pounds. f. Semi-trailers (Prior underwriting approval required) A semi-trailer is a trailer equipped with a fifth wheel coupling devise for use with a truck-tractor, with load capacity over 2,000 pounds. This includes bogies used to convert containers into semi-trailers. g. Trailers Any trailer with a load capacity over 2,000 pounds, other than a semi-trailer. b. Medium Trucks Trucks that have a gross vehicle weight (GVW) of 10,001 20,000 pounds. h. Service or Utility Trailer Any trailer or semi-trailer with load capacity of 2,000 pounds or less. 3. Business Use Class If a truck, tractor or trailer has more than one use, use the highest rated classification, unless 80% of the use is in a lower rated activity. In that case, use the lower rated classification. c. Heavy Trucks Trucks that have a gross vehicle weight (GVW) of 20,001 45,000 pounds. a. Service Use Autos used for transporting the insured's personnel, tools, equipment and incidental supplies to or from a job location. This classification is confined to autos principally parked at job locations for the majority of the working day or used to transport supervisory personnel between job locations. d. Extra-Heavy Trucks (Prior underwriting approval required) Trucks that have a gross vehicle weight (GVW) over 45,000 pounds. e. Truck-Tractors (Prior underwriting approval required) A truck-tractor is a motorized auto with or without body for carrying commodities or materials, equipped with fifth wheel coupling device for semi-trailers. (1) A heavy truck-tractor has a gross combination weight (GCW) of 45,000 pounds or less. b. Retail Use Autos used to pick up property from, or deliver property to individual households. c. Commercial Use Autos used for transporting property other than those autos defined as service or retail. 4. Radius Class Determine radius on a straight line from the street address of principal garaging. a. Local (Up To 50 Miles) The auto is not regularly operated beyond a radius of 50 miles from the street address where such auto is principally garaged. Sec. 15 CA-2 WA 01-08

Intermediate (51 miles To 200 Miles) The auto is operated beyond a radius of 50 miles but not regularly beyond a radius of 200 miles from the street address where such auto is principally garaged. PRIVATE PASSENGER TYPES A private passenger auto is a four-wheel auto of the private passenger or station wagon type. A pickup, panel truck or van not used for business is rated as a private passenger auto. This subsection applies to all private passenger autos, which are owned by corporations, partnerships, unincorporated associations, government agencies or rated as part of a fleet. FARMERS AUTOS (availability varies by state) This rule applies to private passenger autos, pickups, panel trucks, and vans rated as part of a fleet which meet all the following qualifications: 1. Principally garaged on a farm or ranch; 2. Owned by an individual or husband and wife resident in the same household, or by a farm family partnership or corporation; 3. Not used in any occupation other than farming or ranching; and 4. Not used in going to and from work other than farming or ranching. OPTIONAL COVERAGES A. Drive Other Car Coverage Drive other car coverage is provided at no additional charge for an individual named insured who owns a private passenger auto that is insured on the policy; refer to the following Individual As The Named Insured rule. For other risks, use Driver Other Car Coverage Broadened Coverage For Named Individuals Endorsement CA In all cases, drive other car coverage includes coverage for the spouse for no additional charge. B. Individual As The Named Insured Endorse a policy issued to an individual named insured with the appropriate individual named insured endorsement. Family drive other car coverage is provided at no additional charge if the policy covers: 1. A private passenger auto not used for public transportation or rented to others without a driver. 2. A pickup, panel truck or van that is not used in the business of the insured other than for farming or ranching. Use Individual Named Insured Endorsement CA C. Non-Ownership Liability Coverage may be extended to non-owned autos that are owned by employees but only while used in the insured's business. Use Employees As Insured Endorsement CA When the non-ownership liability coverage is afforded, the coverage form provides coverage to a partnership for the use of autos owned by individuals partners, which are used in the business of the partnership. D. Hired Auto 1. Autos Hired, Loaned, Leased Or Furnished a. If an insured, lessee or renter is providing the primary insurance covering the auto and the term of the lease or agreement is: (1) For 6 months or more: (a) Rate as though owned by the insured, lessee or renter; and (b) If the policy is extended to cover the owner of the auto as an additional insured, the applicable liability rate will be multiplied by a factor of Use Lessor Additional Insured and Loss Payee CA or Hired Autos Specified As Covered Autos You Own Endorsement CA (2) For less than 6 months: Rate according to the provisions in Paragraphs 2. and 3. except as follows: (a) For liability coverage, separately estimate the cost of hire for those autos for which the insured is providing the primary insurance. (b) Multiply the hired car premium by a factor of (c) The rate in preceding paragraph will be multiplied by each $100 cost of hire. (d) For contractual liability coverage the following procedures apply: (i) The insured is covered on a primary basis for liability assumed by contract for the rental or lease of any auto by the insured or Sec. 15 CA-3 WA 01-08

6 by any of his or her employees except for: Any auto rented with a driver; or Any truckers' hold harmless agreements. (ii) Make a charge for contractually assumed liability for these autos when the total number of auto rental days exceeds an aggregate of 30 days for all auto rental agreements. (iii) The following is an example of the preceding paragraph: Insured rents a private passenger auto for 25 days and a pickup truck for 15 days. Make a charge for 10 days (40 days 30 days). b. If the owner of the auto is providing the primary insurance, rate according to Paragraph 2. c. If a lessor is an employee of the insured, use Employee As Lessor Endorsement CA d. If an employee rents or hires an auto in his or her own name for the purposes of performing duties related to the insured's business, use Employee Hired Autos Endorsement CA Cost Of Hire Basis Liability Coverages Estimate the total cost for the hire of autos for each state where the insured does business. Do not include charges for services performed by common or contract motor carriers subject to the insurance requirement of any public authority regulating motor carriers. 3. Hired Auto Physical Damage Physical damage coverage may be provided for autos which are leased, hired, rented or borrowed while being operated by or in the custody of the insured, but does not apply to autos which are lease, hired, rented or borrowed with drivers. Use Employee Hired Autos Endorsement CA for coverage if an employee rents or hires a vehicle in his or her own name for the purposes of performing duties related to the insured's business. E. Rental Reimbursement Coverage may be added for rental reimbursement expenses incurred by the insured for the rental of an auto because of loss to a covered auto. Indicate maximum amount of rental reimbursement for each day (minimum amount $15.00) and maximum number of days (minimum 30 days). Use Rental Reimbursement Coverage Endorsement CA F. Audio, Visual and Data Electronic Equipment 1. Audio, Visual and Data Electronic Equipment Coverage Due to regulatory ruling this coverage and associated form CA are not currently available for use in the state of Washington. 2. Radar Equipment Coverage is not available for equipment designed or used for the detection or location of radar. Note: Electronic equipment, which is specifically designed solely for the reproduction of sound and permanently installed in the covered auto at the time of loss, along with accessories used with such equipment, other than tapes, records or discs, is automatically covered under the Coverage Form without an additional premium charge. G. Tapes, Records and Discs Coverage To provide comprehensive coverage for tapes, discs and other similar devices used with permanently installed audio, visual or data electronic equipment, use Tapes, Records And Discs Coverage Endorsement CA H. Limited Mexico Coverage (Availability varies by state) Coverage for accidents or losses occurring in Mexico within twenty-five miles of the United States border on trips of ten days or less may be provided by attaching Limited Mexico Coverage Endorsement CA I. Auto Loan/Lease Gap Coverage (not available in Washington) This rule applies to autos that are loaned or leased for a period of six months or longer and which have been provided Physical Damage Coverage. A policy providing Physical Damage Coverage may be extended to provide coverage for the difference between the outstanding indebtedness on a loan/lease agreement on a vehicle and the actual cash value of the vehicle. Use Auto Loan/Lease GAP Coverage Endorsement CA Sec. 15 CA-4 WA 11-11

7 J. Towing And Labor Costs Optional towing and labor costs coverage may be added for private passenger autos with a limit of $50 for each disablement. K. Loss of Use Expenses Rental Vehicles Optional Limits Coverage for expenses for which an insured becomes legally responsible to pay for loss of use of a vehicle rented or hired without a driver, under a written rental contract or agreement is provided at no additional charge at limits of $20 per day/$600 maximum. For higher limits of coverage use Endorsement CA Optional Limits Loss Of Use Expenses. L. Waiver of Transfer of Rights of Recovery Against Others to Us (Waiver of Subrogation) Upon request, a policy can be endorsed to waive the subrogation clause in the policy. The waiver will apply to all contracts entered into by the Named Insured. The ability to waive only named or specific contracts is not available and the waiver is subject to the form conditions. There is no premium impact from the addition of this form. Endorsement CA will be attached. Sec. 15 CA-5 WA 12-14

8 WASHINGTON STATE EXCEPTION PAGE 1. LOSS PAYABLE CLAUSE In accordance with WAC , use Washington Loss Payable Form REG-335 CA to provide a long-form loss payable clause. 2. ACCIDENT PREVENTION COURSE DISCOUNT FOR OPERATORS 55 OR OVER A. An accident prevention course discount applies to all coverages except Underinsured Motorists Coverage if: 1. There is a regularly assigned principal operator of a specific motor vehicle; and 2. The principal operator is 55 years of age or older and has a completion certificate stating that he or she has completed: a. A motor vehicle accident prevention course meeting the requirements of the Department of Licensing with a minimum of eight hours, or b. An eight-hour program-learning self instruction course conducted by an agency approved by the Department of Licensing to conduct classroom courses. B. If the policy insures two or more motor vehicles, the discount applies to that motor vehicle principally operated by a person who has completed the course. C. The discount applies for 24 months after successful completion of the course. D. Multiply the rates by a 0.95 factor. 3. AUTO LOAN COVERAGE PRIVATE PASSENGER AUTOS Auto Loan Coverage is designed to reimburse insureds in the amount of the "outstanding indebtedness" with respect to the loan balance of an auto finance agreement, but only in excess of the ACV of the auto. A. This coverage is applicable only to private passenger autos, as defined in Wash. Rev. Code Ann. Section auto designated or described in the endorsement schedule by a 0.10 factor. 4. NO-FAULT COVERAGES Personal Injury Protection A. Personal Injury Protection Coverage must be offered to individual named insureds on every new policy or renewal policy insuring a motor vehicle, except motorcycles. Use Washington Personal Injury Protection Named Individuals Endorsement CA B. The requirement to offer this coverage does not apply to policies insuring a: 1. Farm type tractor or other self-propelled equipment designed for use principally off public roads, while not on public roads; 2. Vehicle operated on rails or crawler-treads; 3. Vehicle located for use as a residence; 4. Motor home as defined in Wash. Rev. Code Sec ; 5. Moped as defined in Wash. Rev. Code Sec ; or 6. Motorcycle. C. A named insured has the right to reject this coverage in writing. The rejection is valid and binding to all levels of coverage and on all persons who might have otherwise been insured under such coverage. D. If a named insured fails to reject in writing basic limits Personal Injury Protection Coverage and does not request increased limits Personal Injury Protection Coverage, then only basic limits Personal Injury Protection Coverage shall be provided. E. If requested by a named insured, increased limits for Personal Injury Protection Coverage must be offered for each insured at the limits specified in Wash. Rev. Code Sec F. Unless a named insured subsequently requests such coverage in writing, the insurer does not have to provide Personal Injury Protection Coverage on any supplemental, renewal or replacement policy. 5. UNDERINSURED MOTORISTS INSURANCE B. Private Passenger Autos must be made available for each new owned auto. Use Washington Auto Loan Coverage Private Passenger Autos Endorsement CA The insured must request this coverage within 30 days of purchase of a new auto. A new auto is one that has not been previously titled by the state and is a private passenger auto. C. Determine the premium for Auto Loan Coverage Private Passenger autos by multiplying the comprehensive and/or collision premium for each owned A. Application 1. Underinsured Motorists Insurance (including Uninsured Motorists Insurance) must be provided for either bodily injury liability or bodily injury and property damage liability. This coverage must be provided at limits equal to the policy's liability limit but not higher than that limit. Use Washington Underinsured Motorists Coverage Endorsement CA The named insured or spouse has the right to reject, in writing, underinsured motorists bodily Sec. 15 CA-6 WA 01-08

9 injury and property damage coverages or reject the property damage portion only. 3. The named insured or spouse also has the right to reject, in writing, underinsured bodily injury limits equal to the policy's liability limit and select limits lower than the policy's liability limits, but not less than the minimum financial responsibility limits. If lower limits for property damage coverage are selected, such rejection and selection need not be in writing. 4. Unless a named insured or spouse requests such coverage in writing, the insurer does not have to provide Underinsured Motorists Insurance on renewal policies when a named insured or spouse has rejected the coverage on the policy previously issued by the insurer. B. Modification Do not modify the premium under any rating plan or other manual rule provisions. C. Trailers Do not charge an underinsured motorists premium for trailers when power units designed to tow such trailers are insured for Underinsured Motorists Insurance on the same policy. 6. ISO Rule 95 Audio, Visual and Data Electronic Equipment Coverage form CA is not currently available for use in Washington due to regulatory ruling. Sec. 15 CA-7 WA 11-11

10 TERRITORY Territory Code ABERDEEN territory comprises all territory within the city limits of Aberdeen ADAMS COUNTY ASOTIN COUNTY BELLINGHAM territory comprises the entire city of Bellingham and all territory and places lying within the area enclosed by the outside boundaries of the following townships and ranges in Whatcom County Townships 37N and 38N; Ranges 2E and 3E BENTON COUNTY (BALANCE) - That portion of Benton County not included in Kennewick-Pasco-Richland territory BREMERTON territory comprises the entire city of Bremerton and all territory in Kitsap County bounded on the north by the north line of Township 24N, including Erland Point; on the east by Port Orchard Bay, Sinclair Inlet and the east line of Range 1E; on the south by the south line of Township 24N; and on the west by the west line of Sections 5, 8, 17, 20, 29 and CENTRALIA territory comprises all territory within the city limits of Centralia CHEHALIS territory comprises all territory within the city limits of Chehalis CHELAN COUNTY (BALANCE) - That portion of Chelan County not included in Wenatchee territory CLALLAM COUNTY CLARK COUNTY (BALANCE) - That portion of Clark County not included in the Vancouver territory COLUMBIA COUNTY COWLITZ COUNTY - see Kelso, Longview and Remainder of State... Townships 8N, 9N and 10N; Ranges 27E, 28E, 29E 30E and 31E KING COUNTY - see Seattle Metropolitan, Seattle Suburban East, Seattle Suburban South and Remainder of State.
