1 Horse Boarding Contract and Waiver THIS AGREEMENT, dated, is made between The Range Arena and Boarding, hereinafter referred to as THE RANGE, and, OWNER of the below described horse(s), hereinafter referred to as OWNER. OWNER warrants that he / she owns (or leases) the horse(s) and will provide documentation that the horse is negative for Coggins and is free of disease, along with current records of deworming and vaccinations in writing, or to have horse immunized within 30 days of this agreement. Fees and Terms: Monthly Boarding Options: Circle one: Full Board: We feed our hay and clean stalls Self Care: You feed your feed, plus clean stalls Large Box In Arena $ $ Large Box Outside of Arena $ $ Open Stalls $ $75.00 Services included in all boarding rates, except self care: Daily feeding of horses (twice per day) Medicating of horses Blanketing and/or un-blanketing horse in winter (additional fee of $20.00 for self care board) Trailer parking for all boarders This is a month to month agreement at the following rate: $ per month paid by OWNER between the 1st and the 5th day of each month. A late fee of $25.00 will be accrued on the 6th of each month if payment has not been made. All board payments are to be paid up front. If for some reason you will be late on your payment please inform THE RANGE as soon as possible. This price will be locked in for a period of one year. Under no circumstances shall the horse be removed from THE RANGE until the bill is paid in full. (Going to horse shows or rodeos is ok). THE RANGE agrees to board the below described horse at 3025 Fort Sanders Road, Laramie, Wyoming

2 A security deposit of $ will be given to The Range Arena and Boarding to secure the performance of OWNER S obligations. Refund of security deposit is dependent upon OWNER fulfilling ALL of the following conditions: 1. OWNER has provided written thirty (30) day notice to The Range prior to date of termination or expiration. 2. OWNER has no other moneys due. 3. OWNER has thoroughly cleaned the premises. THE RANGE will deduct from the Security Deposit all reasonable charges to accomplish cleaning or repair from damage over normal wear and tear. 4. OWNER shall not have the right to apply the Security Deposit in payment of last month's boarding fees. THIRTY DAYS WRITTEN NOTICE IS REQUIRED FOR TERMINATION OF THIS LEASE Termination: Either party may terminate this agreement given thirty (30) days written notice to the other. In the event of a default, the wronged party has the right to recover reasonable attorneys fees and court costs resulting from this failure of either party to meet a material term of this Agreement. OWNER cannot assign this agreement unless THE RANGE agrees in writing. Your written notification of termination will not be valid unless your account is current including payment of the final month's board fee. B. Biting Kicking Other Is there anything else we should know to about your horse? Feeding Information: Board includes quality grass hay or grass/alfalfa mixture. THE RANGE will be happy to feed grain or other feeds and supplements in addition, but they must be provided by OWNER. Hay will be provided by THE RANGE as needed to maintain horse s weight and condition. THE RANGE determines horse s diet from their condition and will adjust feed accordingly. If a horse is a hard keeper then additional feed may need to be purchased to maintain your horse s body weight at OWNER S expense. Additional feeds or medications I want to be fed to my horse: Standard of Care: THE RANGE agrees to provide adequate feed and facilities for normal and reasonable care required to maintain the health and well being of your horse. THE RANGE will do all we can do to keep your horse at a good weight. If your horse is a hard keeper or worked extensively additional feed may need to be purchased by OWNER. (Initial) OWNER acknowledges they have inspected the facilities and finds them in safe and proper order. OWNER agrees to reimburse THE RANGE for repair of any damages caused by OWNERS horse to stalls, fences or equipment because of chewing, kicking, fighting, or otherwise unacceptable behavior. (Initial) OWNER agrees to take manure to designated disposal area, and not left in piles away from said area. (Initial) OWNER acknowledges THE RANGE has the right to step in and provide care to horse(s) if stalls are not being cleaned regularly or horses aren t being fed regularly. (Initial) OWNER will remain fully responsible for the health and safety of the horse, and THE RANGE specifically disclaims any liability for accidents, illness, acts of God, etc. Only in the event of gross negligence will THE RANGE be liable. Any item concerning the care and maintenance of OWNERS horse not specifically addressed in this agreement is OWNERS responsibility. If, in THE RANGE S opinion, OWNER doesn t maintain their animal (hoof trims, teeth floating, or yearly shots), they will be in breach of this agreement and will be asked to remove their animal from THE RANGE S property. Hours of Operation: The arena will be open from 5:00am until 11:00pm. During these hours ONLY will OWNER use arena, unless prior approval is given. Veterinary Information and Emergency Care:

4 If emergency treatment is needed, THE RANGE will attempt to contact OWNER with provided phone numbers but in the event OWNER is not reached, THE RANGE has the authority to secure emergency veterinary and or farrier care. OWNER is responsible to pay all costs relating to this care. THE RANGE is authorized as OWNERS agent to arrange billing to OWNER. Snowy Range Veterinary Clinic ( ), is THE RANGE S designated veterinary hospital for routine and emergency veterinary care. THE RANGE will follow all veterinarian recommendations for your horse. OWNER can administer medication or authorize THE RANGE to administer medications &/or treatments. OWNER agrees to have horse treated for the following at OWNERS expense: A. Coggins Test: Proof of a negative Coggins test performed on your horse at a minimum of every twelve months B. Deworming: THE RANGE agrees to deworm OWNERS horse every 6 months with a rotating paste wormer program C. Vaccinations: Proof of Eastern/Western Encephalitis, Tetanus, Rhinopneumonitis, Influenza vaccines (5-Way), West Nile, and Equine Rabies are required yearly. D. Teeth Floating: If OWNERS horse drops excessive grain or if veterinarian suggests horse needs to be done when they are here for yearly shots, then OWNER will have their horse s teeth floated. Additional comments: Risk of Loss: During the time that the horse is boarded at THE RANGE, THE RANGE shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the horse or any other cause of action whatsoever, arising out of or being connected in any way with the boarding of said horse. This includes, but is not limited to, any personal injury or disability the horse may receive while on THE RANGES premises. The OWNER fully understands that THE RANGE does not carry any insurance on any personal belongings not owned by it for boarding or for any other purposes, OWNER is strongly encouraged (but not required); to carry reasonable insurance for public liability, accidental injury, theft, mortality insurance not only for your horse but also for any personal property, tack etc. stored on property. (Initial) Hold Harmless: OWNER agrees to hold THE RANGE harmless from any claim resulting from damage or injury caused by said horse and agrees to pay legal fees incurred by THE RANGE in defense of a claim resulting from damage by said horse. Abandoned Livestock: Under Wyoming law, livestock owners who repeatedly refuse to take possession of their animals must pay for the costs of rounding them up, feeding them, providing veterinary service and transporting them back. These expenses also include any and all damages caused by the animal(s). Those who don t pay

5 all accrued expenses face up to six months in jail and a $750 fine for a first offense, and double those penalties for repeat offenses. If ownership is not reinstated, THE RANGE has full legal authority to sell horse(s) at market value to pay for accrued expenses. (Initial) Inherent Risks and Assumption of Risk: The undersigned acknowledges there are inherent risks associated with equine activities such as described below and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equine to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine's reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant's ability. (Initial) Rules and Regulations: The OWNER agrees to abide by all the rules and regulations of THE RANGE. In the event someone other than the OWNER shall call for the horse, such person shall have written authority signed by the OWNER to obtain said horse. The OWNER agrees there shall be no smoking on the premises. The OWNER agrees that OWNERS dogs are not allowed off-leash on the premises. The OWNER agrees that upon entering the premises, using the facilities, or using another person s horse, is at their own risk, and the OWNER holds THE RANGE harmless, and assumes full responsibility, in the event of any accident or injury to themselves and/or to their guests. The OWNER is responsible and liable for the conduct of all family members, visitors, minors, instructors, or trainers they bring or invite onto THE RANGE S property. Anyone not in this mentioned contract must sign a waiver before mounting OWNER S horse. Minors 12 years old and under who OWNER brings or invites onto THE RANGE S property will be under OWNERS direct supervision or under the direct supervision of an adult designated by OWNER. THE RANGE is not responsible for supervising minors. Wyoming Equine Liability Act The Wyoming equine liability provisions immunize equine professionals by declaring that those who engage in equine activities or any recreational activities assume the inherent risks in the sport or recreational opportunity. However, actions based upon negligence of the provider wherein the damage, injury or death is not the result of an inherent risk of the sport or recreational opportunity shall be preserved pursuant to W.S (a) Any person who takes part in any sport or recreational opportunity assumes the inherent risks in that sport or recreational opportunity, whether those risks are known or unknown, and is legally responsible for any and all damage, injury or death to himself or other persons or property that results from the inherent risks in that sport or recreational opportunity.

6 (b) A provider of any sport or recreational opportunity is not required to eliminate, alter or control the inherent risks within the particular sport or recreational opportunity. Entire Agreement: This constitutes the entire agreement between THE RANGE and OWNER. Any modifications or additions to this agreement must be in writing and signed by both parties.
