2 The Manufactured Housing Improvement Act of 2000, Model Manufactured Home Installation Standards were implemented in The program for HUD-Administered states is being rolled out now as part of this implementation. The purpose of the program is to implement regulations 24 CFR Part 3285 and 24 CFR Part Purpose 2
3 Requirements States must either operate their own qualifying installation program or participate in the federal program. State programs must meet or exceed the minimum requirements outlined in 24 CFR (b). Regulating and improving the installation and performance of manufactured homes within HUD-Administered States to improve the protection of their residents. questions to 3
4 HUD-Administered States At present the following states fall under the HUD-Administered Installation Program: 1. Alaska 9. New Jersey 2. Connecticut 10. Rhode Island 3. Hawaii 11. South Dakota 4. Illinois 12. Vermont 5. Maryland 13. Wyoming 6. Massachusetts 7. Montana 8. Nebraska questions to 4
5 Implementation HUD will implement the regulations by: Evaluating and certifying installer trainers and training programs to become federally approved per requirements outlined in 3286 Subpart D Training of Installers in HUD-Administered States. Requiring that all installers in HUD-Administered states receive a HUD Manufactured Home Installer License in accordance with Requiring that all manufactured home inspectors meet requirements per Tracking the sale, installation and inspection of homes in HUD-Administered 5 states.
6 Applicability Any new homes that are set in a HUD-Administered installation state or territory must follow these regulations for sale, installation and inspection. These regulations only apply to new manufactured homes on their first set. 6
7 The installation program is being implemented in 4 phases throughout the country. Phases 1 and 2 involved implementing pilot programs in two (2) states: Maryland (July 14 Nov. 1) and Nebraska (Sept. 1 Dec. 1). Phase 3: Eastern States Phase 4: Western States Program Roll-out 7
8 State Installation Program Program Rollout- East Phase 3 includes five (5) states in the east. Eastern States Include: Connecticut, Massachusetts, New Jersey, Rhode Island, Vermont Dates Program launches on December 1, 2015 Program kick-off call on December 1, 2015 All installers must be licensed by May 1, questions to hudinfo@sebapro.com 8
9 State Installation Program Program Rollout- West Phase 4 includes six (6) states in the west. Western States Include: Alaska, Hawaii, Illinois, Montana, South Dakota, Wyoming Dates Program launches on January 1, 2016 Kick-off on January 12, 2016 All installers must be licensed by June 1, questions to hudinfo@sebapro.com 9
10 Installer Requirements for Licensing Meet experience or education requirements Take and pass an approved training program 12 hours, must score a 70% minimum Proper bond and/or insurance Complete HUD 307 Installer Application 10
11 Experience Requirement for Installers Experience Must have 1 of the following: 1,800 hours of experience in installing manufactured homes 3,600 hours as a supervisor in the building construction industry 1,800 hours as an active manufactured home installation inspector 1 year of a college educational program in a construction-related field, or A combination of experience and education that equals 3,600 hours of the above questions to hudinfo@sebapro.com 11

14 Bond & Insurance Bond and Insurance All installers must hold at least one of the following: 1. Combination of Surety Bond and Insurance minimum $10,000 bond and $250,000 general liability insurance. 2. Surety Bond Only minimum $100, Insurance Only minimum $250,000 with no deductible 4. Irrevocable Letter of Credit Only minimum $100, Combination of Irrevocable Letter of Credit and Insurance minimum $250,000 insurance and $10,000 letter of credit questions to 14
15 Recommendation Recommendation for maximum coverage at lowest cost: Combination of Surety Bond and Insurance $10,000 bond and $250,000 general liability insurance. General liability policy must list HUD, Office of Manufactured Housing Programs, as an additional insured. HUD, Administrator, Office of Manufactured Housing Programs 451 7th Street SW, Room 9168, Washington, DC Bond form template and list of bond providers available on installation site. Must hold all coverage for 1 year past license expiration. 15
16 Installers HUD 307 An installer who installs homes in HUD-Administered states must submit a HUD 307 to SEBA to apply for an initial or renewed installation license. HUD 309 Installers must submit the HUD 309 Manufactured Home Inspection Form after having it signed by a qualified inspector. 17 HUD Installers License License Notification & Expiration Applicants are notified by mail and . Will receive a wallet-size and large certificate. The license is good for 3 years. Must take 8 hours of continuing education for renewal. questions to hudinfo@sebapro.com 17
18 Inspections Obtaining Inspections It is the responsibility of the installer or retailer to arrange for an inspection at least 10 days prior to the completion of the installation. HUD 309 All inspectors must sign off on the HUD 309 Manufactured Home Inspection Form. Inspection Training MHEI has created an online inspection training course. 18
19 Inspections Who May Perform Inspections A manufactured home or residential building inspector employed by the local authority having jurisdiction over the site of the home, provided that the jurisdiction has a residential code enforcement program A professional engineer A registered architect A HUD-accepted Production Inspection Primary Inspection Agency (IPIA) or a Design Approval Primary Inspection Agency (DAPIA) An International Code Council certified inspector questions to hudinfo@sebapro.com 19
20 Permits Permits After May 1, 2016 in the eastern states, permitting offices and inspectors cannot issue occupancy permits for homes that have not been installed by a licensed manufactured home installer. This is regardless of when the permit for the home was issued and when the installation started. Pursuant to HUD s regulations, the issuance of the certificate of occupancy by a local jurisdiction is to occur in connection with the installation of the manufactured home by a licensed installer. See 24 CFR The issuance of a certificate of occupancy on a manufactured home purporting to be installed by an unlicensed installer would be inconsistent with Federal Regulations. 20
21 Retailer Responsibilities All retailers/park owners who sell manufactured homes to be set in a HUD- Administered state must follow requirements in providing information to consumers, and HUD through SEBA. Providing installation instructions & Use of a licensed installer and qualified inspector if arranging for installation or inspection of a home and Retailer responsibilities before and after sale 3286 Subpart G Must provide a consumer disclosure per Unit and installation tracking using the HUD 305 and 306 as found in
22 Consumer Disclosure Statement Required statements about the manufactured home per That the home will be required to comply with federal requirements as stated in The home may be required to comply with additional state and local requirements for its installation. Additional information about the requirements are available from the retailer and is available in part 24 CFR 3286 and from HUD. Compliance with any additional federal, state, and local requirements may involve additional costs to the purchaser or lessee. Dispute resolution statement per
23 (a) Information Provided by Retailer Retailers of manufactured homes must provide tracking information on all homes for installation in HUD-Administered states. This information is to be provided using the HUD 305 form and must be submitted within 30 days from the time a purchaser or lessee enters into a contract. The HUD 305 collects the following information; consistent with : The home's serial number and manufacturer's certification label number. The name and address of the retailer or distributor that is selling or leasing the home. The state and address where the home is to be sited, and, if known, the name of the local jurisdiction. The name of the purchaser or lessee. 23
24 (b) Information Provided by Retailer Retailers must also submit installation information. This is to be provided using the HUD 306 form and must be submitted within 30 days of the date of installation. The HUD 306 collects the following information; consistent with : The name, address, telephone number, and license number of the licensed installer The date of installer certification of completion of the installation The date a qualified inspector verified the installation as being in compliance with the requirements. The name, address, and telephone number of the qualified inspector who performed the inspection of the installation as required by
