Jumping and non-jumping options. All riders and horses will be expected to walk-trot-canter-gallop in the open, in a group, on varied terrain. Those jumping should be comfortable jumping 3 + in height. Riders may also be assessed to be invited to race in SSCF flat races. Member Meeting & Cocktail Party, Cherry Blossom Farm, 6:30-8:30 pm All 2018 SSCF members are invited to attend. This is your opportunity to meet other members, the SSCF Board and Committee chairs, provide input and learn about changes for 2018, and enjoy drinks and dinner. Sat, Jan. 27 th : Hunting with Middleburg Hunt. The MFHs have graciously offered all 2018 SSCF members hunting aside to be their guests ($150 savings!). Jumping and non-jumping fields. Drinks and light nibbles to follow. Hunting with Middleburg Hunt Saturday, Fixture and Time TBA All riders are required to sign a MH waiver, have a negative Coggins test for their horse, and have a valid Virginia hunting license. All 2018 SSCF members hunting aside will be guests of the Masters. Those hunting astride, or guests of SSCF members, must pay the regular MH cap fee ($150). Formal Hunting attire. Helmets are strongly encouraged. Jumping and non-jumping fields. This is a mix of open galloping country and wooded trappy areas. Jumps are mostly coops and stone walls in height, with varied approaches and landings. Additional tickets may be purchased for $25/pp. The Side Saddle Café of Middleburg is catering the event, and water, soda, tea, and coffee will be served. 5 SIDE SADDLE CHASE FOUNDATION REPRESENTATION, ASSUMPTION OF RISK, AND RELEASE AGREEMENT FORM 1 ADULTS AND MINORS (Under 18 - Parents or Legal Guardian must sign FORM 2) Proper execution of the following release by the undersigned is a prerequisite to the undersigned being able to take part in any and all racing, foxhunting, clinics and related activities ("SSCF activities") sponsored by the Side Saddle Chase Foundation ("SSCF"). In consideration of the undersigned electing to participate in S S C F activities and the SSCF s participation in such activities, the undersigned and on behalf of participant and his or her heirs next of kin, dependents, representatives, executors, administrators, successors or assigns hereby does release, indemnify (including costs and attorney fees) and hold harmless the SSCF and all its officers, directors members, lessors and employees from any cause of action claims or demands of any nature whatsoever, which said participant, his or her representatives, heirs, next of kin, dependents, executors or administrators, may now have, or have in the future against said SSCF, its officers, directors, members, lessors, and employees, on account of personal injury, property damage or accident of any kind, including death arising out of the undersigned's participation in bunting activities including without limitation participation in or observation of SSCF activities. I, the undersigned participant, hereby sign the following representation and release, in consideration of being permitted to participate in SSCF activities, including but not limited to clinics, flat races, jump races, or foxhunts, conducted by the SSCF, Maggie Johnson, Devon Zebrovious, Warrenton Point to Point, Mr. Stewart s Cheshire Foxhounds, Loudoun Fairfax Hunt, Loudoun Hunt, Potomac Hunt, Willowdale Steeplechase, Pennsylvania Hunt Cup, High Hope Steeplechase, Morven Park, and others (hereinafter called the Race Meets ). Participant understands that by signing this Release, he/she covenants and agrees that he/she, as well as his/her heirs, next of kin, representatives, dependents, executors, administrators, successors and assigns, will never institute any suit or action of law or otherwise against the SSCF, or in any way aid in the institution or prosecution of any claim, demand, action or cause of action for damages, costs, loss of services, expenses or compensation for or on account of any damage, loss or injury either to his/her person, property or both, which may result from the undersigned's attendance at and/or participation in SSCF activities. Participant is hereby given notice of the risk inherent in equine activities, including activities, including (i) the propensity of an equine to behave in dangerous ways which may result in injury to the participant: (ii) the inability to predict an equine's reaction to sound, movements, objects, persons, or animals: (iii) hazards of surface or subsurface conditions: (iv) field conditions and side and rear area conditions: and (v) officiating and conduct of other players -- and specifically, assumes this risk and the risk of acts or omissions that constitute negligence for the safety of the participant by the SSCF, whether or not related to the preceding enumerated inherent risks. I hereby certify that I fully understand that riding horses, riding in races, or participating in SSCF activities, is inherently dangerous to the participants and that there is serious possibility that I will suffer injury or death as a result of participation. and fully u nderstands, accepts and assumes that risk. Participant verifies that he/she is in good health and that he/she has no physical limitations which would preclude his/her safe participation in SSCF activities. The participant agrees that prior to participating he/she will be satisfied with the ground conditions and if not satisfied, he/she will not participate. I hereby state that I have given notice of the risks of riding in and otherwise participating in horse races and steeplechasing pursuant to Section , , and of the Code of Virginia, 1950 as amended (a copy of which is attached hereto) including, but not limited to, (i) the propensity of an equine to behave in dangerous ways, which may result in injury to the participant, (ii) the inability to predict the equine s reaction to sound, movements, objects, persons, or animals; and (iii) hazards of surface or subsurface conditions. I expressly agree to assume all of the described risks and all other risks of riding in or otherwise participating in the races. I hereby certify that I am years of age. In order to induce the above described Race Meets and SSCF to allow me to participate in races or SSCF activities, I represent to the Race Meets and SSCF that I am properly trained and competent to ride in such races or such SSCF activities without endangering myself or other participants. I further represent that the horses I will ride are properly trained for the endeavor and will provide a safe conveyance without unduly jeopardizing my safety and that of others. Participant understands that the SSCF does not provide medical or hospitalization insurance for participants. Participant certifies that he/she will be covered by his/her own insurance while participating. Participant acknowledges that NO medical or veterinary emergency services are provided by SSCF at SSCF activities.
6 Participant hereby consents, directs and authorizes the SSCF to engage any emergency medical or veterinary care including transportation in the event of injury as the SSCF or others deem appropriate and hereby releases and indemnifies the SSCF as set forth herein and assu mes all associated risk and agrees to pay all associated costs. Participant assumes responsibility for his/her own physical fitness, ability and capability to participate. Participant specifically assumes the risk of his/her own negligence and others (participants, officials) in any SSCF activity and any negligence of the SSCF. Participant states that he/she is aware of all of the inherent dangers of SSCF activities and observing hunting or racing; that he/she is of lawful age and legally competent to sign this release which he/she has fully read and completely understands; he/she understands the terms are contractual and not a mere recital, and that he/she has signed this documents as his/her own free act. I further certify that I am currently covered by health insurance policy no. written by the following insurance company: OR I am currently covered by the Worker s Compensation policy no., issued in the name of the following owner/farm policy holder: by the following insurance company:. (Workman s Compensation Insurance may only be used if rider is employed by and is riding for the owner of the horse that is providing said Workman s Compensation Insurance Coverage). I further warrant that such insurance will remain in effect at all times that I am participating in the above described races. I WILL PROVIDE PROOF OF SUCH INSURANCE PRIOR TO BEING ALLOWED TO RIDE in SSCF activities or Race Meets. As further inducement to the Race Meets and SSCF to allow me to ride and otherwise participate in such races or SSCF activities, I agree to release, hold harmless and fully indemnify the SSCF, Race Meets, their committees, committee members, Masters and staffs, officers, directors, employees, agents, officials, and other persons acting on behalf of the Race Meets from any and all liability, claims, actions, causes of actions or demands, including attorney s fees and costs, that I might otherwise have or assert for any injury or other claim or other matter arising out of or related to my riding in or otherwise participating in these races, and I further agree to release, hold harmless and indemnify all landowners on whose land the above described Race Meets are conducted from any and all liability, claims, actions, causes for action or demands, including attorney s fees and costs, that might otherwise have or assert for any injury or other claim or other matter arising out of or related to my riding in or otherwise participating in these races. And I further waiver any and all claims, actions, causes of actions, or demands that I may now have or which may arise in the future, and further covenant not to sue the above named organizations or persons, including landowners, for any injury or damages resulting from my participation in such races. 7 Code of Virginia Definitions As used in this chapter, unless the context requires a different meaning: "Engages in an equine activity" means: (i) any person, whether mounted or unmounted, who rides, handles, trains, drives, assists in providing medical or therapeutic treatment of, or is a passenger upon an equine; (ii) any person who participates in an equine activity but does not necessarily ride, handle, train, drive, or ride as a passenger upon an equine; (iii) any person visiting, touring or utilizing an equine facility as part of an event or activity; or (iv) any person who assists a participant or equine activity sponsor or management in an equine activity. The term "engages in an equine activity" does not include being a spectator at an equine activity, except in cases where the spectator places himself in an unauthorized area and in immediate proximity to an equine or equine activity. "Equine" means a horse, pony, mule, donkey, or hinny. "Equine activity" means: (i) equine shows, fairs, competitions, performances, or parades that involve any or all breeds of equines and any of the equine disciplines, including dressage, hunter and jumper horse shows, grand prix jumping, three-day events, combined training, rodeos, driving, pulling, cutting, polo, steeple chasing, endurance trail riding and western games, and hunting; (ii) equine training or teaching activities; (iii) boarding equines; (iv) riding, inspecting, or evaluating an equine belonging to another whether or not the owner has received some monetary consideration or other thing of value for the use of the equine or is permitting a prospective purchaser of the equine to ride, inspect, or evaluate the equine; (v) rides, trips, hunts, or other equine activities of any type however informal or impromptu that are sponsored by an equine activity sponsor; (vi) conducting general hoofcare, including placing or replacing horseshoes or hoof trimming of an equine; and (vii) providing or assisting in breeding or therapeutic veterinary treatment. "Equine activity sponsor" means any person or his agent who, for profit or not for profit, sponsors, organizes, or provides the facilities for an equine activity, including pony clubs, 4-H clubs, hunt clubs, riding clubs, school- and college-sponsored classes and programs, therapeutic riding programs, and operators, instructors, and promoters of equine facilities, including stables, clubhouses, ponyride strings, fairs, and arenas where the activity is held. "Equine professional" means a person or his agent engaged for compensation in: (i) instructing a participant or renting to a participant an equine for the purpose of riding, driving, or being a passenger upon an equine; or (ii) renting equipment or tack to a participant. "Intrinsic dangers of equine activities" means those dangers or conditions that are an integral part of equine activities, including: (i) the propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them; (ii) the unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals; (iii) certain hazards such as surface and subsurface conditions; (iv) collisions with other animals or objects; and (v) the potential of a participant acting in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the equine or not acting within the participant's ability. "Participant" means any person, whether amateur or professional, who engages in an equine activity, whether or not a fee is paid to participate in the equine activity Liability limited; liability actions prohibited. A. Except as provided in , an equine activity sponsor, an equine professional, or any other person, which shall include a corporation, partnership, or limited liability company, shall not be liable for an injury to or death of a participant resulting from the intrinsic dangers of equine activities and, except as provided in , no participant nor any participant's parent, guardian, or representative shall have or make any claim against or recover from any equine activity sponsor, equine professional, or any other person for injury, loss, damage, or death of the participant resulting from any of the intrinsic dangers of equine activities. B. Except as provided in , no participant or parent or guardian of a participant who has knowingly executed a waiver of his rights to sue or agrees to assume all risks specifically enumerated under this subsection may maintain an action against or recover from an equine activity sponsor or an equine professional for an injury to or the death of a participant engaged in an equine activity. The waiver shall give notice to the participant of the intrinsic dangers of equine activities. The waiver shall remain valid unless expressly revoked in writing by the participant or parent or guardian of a minor Liability of equine activity sponsors, equine professionals. No provision of this chapter shall prevent or limit the liability of an equine activity sponsor or equine professional or any other person who: 1. Intentionally injures the participant; 2. Commits an act or omission that constitutes negligence for the safety of the participant and such act or omission caused the injury, unless such participant, parent or guardian has expressly assumed the risk causing the injury in accordance with subsection B of ; or 3. Knowingly provides faulty equipment or tack and such equipment or tack was faulty to the extent that it did cause the injury or death of the participant.

In consideration of the undersigned electing to participate in S S C F activities and the SSCF s participation in such activities, the undersigned and on behalf of minor participant and his or her heirs next of kin, dependents, representatives, executors, administrators, successors or assigns hereby does release, indemnify (including costs and attorney fees) and hold harmless the SSCF and all its officers, directors members, lessors and employees from any cause of action claims or demands of any nature whatsoever, which said participant, his or her representatives, heirs, next of kin, dependents, executors or administrators, may now have, or have in the future against said SSCF, its officers, directors, members, lessors, and employees, on account of personal injury, property damage or accident of any kind, including death arising out of the undersigned's participation in bunting activities including without limitation participation in or observation of SSCF activities. I/We, as parents or legal guardian(s), of, for whom I/We give our permission to ride in one or more SSCF activities or Race Meets, hereby sign the following representation and release, in consideration of being permitted to participate in SSCF activities, including but not limited to clinics, flat races, jump races, or foxhunts, conducted by the SSCF, Maggie Johnson, Devon Zebrovious, Warrenton Point to Point, Mr. Stewart s Cheshire Foxhounds, Loudoun Fairfax Hunt, Loudoun Hunt, Potomac Hunt, Willowdale Steeplechase, Pennsylvania Hunt Cup, High Hope Steeplechase, Morven Park, and others (hereinafter called the Race Meets ). 10 Definitions As used in this chapter, unless the context requires a different meaning: Code of Virginia "Engages in an equine activity" means: (i) any person, whether mounted or unmounted, who rides, handles, trains, drives, assists in providing medical or therapeutic treatment of, or is a passenger upon an equine; (ii) any person who participates in an equine activity but does not necessarily ride, handle, train, drive, or ride as a passenger upon an equine; (iii) any person visiting, touring or utilizing an equine facility as part of an event or activity; or (iv) any person who assists a participant or equine activity sponsor or management in an equine activity. The term "engages in an equine activity" does not include being a spectator at an equine activity, except in cases where the spectator places himself in an unauthorized area and in immediate proximity to an equine or equine activity. "Equine" means a horse, pony, mule, donkey, or hinny. "Equine activity" means: (i) equine shows, fairs, competitions, performances, or parades that involve any or all breeds of equines and any of the equine disciplines, including dressage, hunter and jumper horse shows, grand prix jumping, three-day events, combined training, rodeos, driving, pulling, cutting, polo, steeple chasing, endurance trail riding and western games, and hunting; (ii) equine training or teaching activities; (iii) boarding equines; (iv) riding, inspecting, or evaluating an equine belonging to another whether or not the owner has received some monetary consideration or other thing of value for the use of the equine or is permitting a prospective purchaser of the equine to ride, inspect, or evaluate the equine; (v) rides, trips, hunts, or other equine activities of any type however informal or impromptu that are sponsored by an equine activity sponsor; (vi) conducting general hoofcare, including placing or replacing horseshoes or hoof trimming of an equine; and (vii) providing or assisting in breeding or therapeutic veterinary treatment. "Equine activity sponsor" means any person or his agent who, for profit or not for profit, sponsors, organizes, or provides the facilities for an equine activity, including pony clubs, 4-H clubs, hunt clubs, riding clubs, school- and college-sponsored classes and programs, therapeutic riding programs, and operators, instructors, and promoters of equine facilities, including stables, clubhouses, ponyride strings, fairs, and arenas where the activity is held. "Equine professional" means a person or his agent engaged for compensation in: (i) instructing a participant or renting to a participant an equine for the purpose of riding, driving, or being a passenger upon an equine; or (ii) renting equipment or tack to a participant. "Intrinsic dangers of equine activities" means those dangers or conditions that are an integral part of equine activities, including: (i) the propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them; (ii) the unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals; (iii) certain hazards such as surface and subsurface conditions; (iv) collisions with other animals or objects; and (v) the potential of a participant acting in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the equine or not acting within the participant's ability. "Participant" means any person, whether amateur or professional, who engages in an equine activity, whether or not a fee is paid to participate in the equine activity Liability limited; liability actions prohibited. A. Except as provided in , an equine activity sponsor, an equine professional, or any other person, which shall include a corporation, partnership, or limited liability company, shall not be liable for an injury to or death of a participant resulting from the intrinsic dangers of equine activities and, except as provided in , no participant nor any participant's parent, guardian, or representative shall have or make any claim against or recover from any equine activity sponsor, equine professional, or any other person for injury, loss, damage, or death of the participant resulting from any of the intrinsic dangers of equine activities. B. Except as provided in , no participant or parent or guardian of a participant who has knowingly executed a waiver of his rights to sue or agrees to assume all risks specifically enumerated under this subsection may maintain an action against or recover from an equine activity sponsor or an equine professional for an injury to or the death of a participant engaged in an equine activity. The waiver shall give notice to the participant of the intrinsic dangers of equine activities. The waiver shall remain valid unless expressly revoked in writing by the participant or parent or guardian of a minor Liability of equine activity sponsors, equine professionals. No provision of this chapter shall prevent or limit the liability of an equine activity sponsor or equine professional or any other person who: 1. Intentionally injures the participant; 2. Commits an act or omission that constitutes negligence for the safety of the participant and such act or omission caused the injury, unless such participant, parent or guardian has expressly assumed the risk causing the injury in accordance with subsection B of ; or 3. Knowingly provides faulty equipment or tack and such equipment or tack was faulty to the extent that it did cause the injury or death of the participant.
