4 3 3.0 APPLICATION 3.1 This Agreement shall apply t emplyees defined in this agreement and engaged under the TAFE Teachers Award - State 2012 and the Senir Cllege Teachers Award - State 2012 and emplyees engaged in educatinal assessment and delivery under the Public Service Award State 2012as per appendix 4 f this agreement. 4.0 DATE OF OPERATION 4.1 The Agreement perates frm 1 July 2013 until the nminal expiry date f 30 June POSTING OF AGREEMENT 5.1 A cpy f this Agreement must be displayed in a cnspicuus place at the wrkplace, where it can be easily read by emplyees in the wrkplace. 6.0 RELATIONSHIP TO AWARDS AND INDUSTRIAL INSTRUMENTS 6.1 Where there is any incnsistency between this Agreement and the abve Awards, this Agreement will prevail t the extent f any incnsistency. It is the intentin f the parties t this agreement that this agreement shall prvide the full terms and cnditins f emplyment in lieu f all r any f the terms and cnditins in the relevant award clause/s including, but nt limited t: (a) The fllwing clauses f the TAFE Teachers Award State 2012 d nt apply: i. Schedules 1, 2 and 5 f the award will n lnger apply. 7.0 REPLACEMENT OF PREVIOUS CERTIFIED AGREEMENT 7.1 This Agreement replaces the Department f Educatin and Training TAFE Educatinal Emplyees Certified Agreement 2012 and The State Gvernment Departments Certified Agreement 2009 in as much as it relates t educatinal assessment and delivery staff. 8.0 DEFINITIONS 8.1 "Casual Emplyee" means an emplyee wh is engaged by the hur t wrk n an irregular basis. 8.2 "Chief Executive" means the Chief Executive f the Department f Educatin, Training and Emplyment 8.3 "Cmmissin" means the Queensland Industrial Relatins Cmmissin. 8.4 Delivery time means time spent delivering training such as Timetabled teaching, curse delivery, cntact time r nline delivery f up t hurs. 8.5 Duble Time and a half means, where the rate f salary is a frtnightly rate, ne and ne-half days' salary in additin t the prescribed frtnightly rate, r pr rata if there is mre r less than a day. 8.6 Fulltime Emplyee means an emplyee wh is engaged by the week t wrk the rdinary hurs f wrk f hurs per week. Temprary r tenured emplyees may wrk fulltime.

6 8.7 "IR Act" means the IndustrialRelatinsAct1999 as amended r replaced frm time t time "Institute" means any technical and further educatin Institute perated by the State prviding vcatinal educatin and training cntinued r established pursuant t the Vcatinal Educatin Training and Emplyment Act 2000 r any Act in substitutin r amendment theref. 8.9 "Institute Directr" means the persn in charge f an Institute Nn-delivery time is the time difference between timetabled delivery hurs and hurs per week. All nn-delivery time shuld be timetabled including leave. Examples f nn-delivery time include preparatin and crrectin time, planned staff prfessinal develpment, Release t Industry bligatins, general ffice time and student access time (duty time), negtiated prject wrk r curriculum and resurce develpment and leave such as Recreatin Leave, Lng Service Leave, Public Hlidays and any ther frm f planned leave and will frm part f listed Nn-Delivery time n the timetable Other Duty Time is a subset f nn-delivery time and includes planned staff prfessinal develpment, Release t Industry bligatins, ffice duty time, preparatin and crrectin time, any negtiated prject wrk r curriculum and resurce develpment. Nn-delivery time may be timetabled in lieu f all delivery time Part-Time Emplyee means an emplyee wh is engaged t wrk a regular pattern f rdinary hurs each frtnight. Such rdinary hurs in any ne week shall be less than the prescribed weekly hurs f a full-time emplyee. Temprary r tenured emplyees may wrk part-time Permanent Emplyee A permanent emplyee is an emplyee engaged n a permanent basis and may be engaged full-time r part-time PS Act means the Public Service Act 2008 as amended r replaced frm time t time "Release t industry" means release frm Institute attendance fr bservatinal, research r hands-n experience in an external rganisatin within industry, cmmerce r ther apprpriate setting fr the specific purpse f acquiring skills, knwledge and experience necessary fr staff members t imprve the currency and quality f technical and further educatin "Temprary Emplyee" means an emplyee engaged t meet temprary circumstances fr a specified perid r a specified task TOIL mean time ff in lieu n a time fr time basis "Unin" means the Tgether Queensland, Industrial Unin f Emplyees and/r the Queensland Teachers Unin f Emplyees VETE Act means the TAFE Queensland Act. 9.0 EMPLOYMENT CATEGORIES 9.1 Emplyees cvered by this Agreement shall be advised in writing f their emplyment categry upn appintment. 9.2 The emplyment may be (a) permanent and either n a full-time r part-time basis; r (b) temprary and either n a full-time r part-time basis; r (c) n a casual basis. 9.3 Temprary emplyees are entitled t the same allwances and hurs arrangements as permanent emplyees. 10. CASUAL EMPLOYMENT Nte - The casual emplyment prvisins cntained in the TAFE Teachers Award State 2012, the Senir Cllege Teachers Award State 2012 and the Public Service Award State 2012 shall n lnger apply (see clause 6.1 abve) A casual emplyee is paid 23% in additin t the rdinary hurly Award rates f pay fr the class f wrk upn which such emplyee is engaged. Each engagement stands alne, with a minimum payment as fr 2 hurs wrk

7 6 made in respect t each engagement. Where applicable, a casual emplyee is further entitled t the prvisins f vertime, weekend penalty rates and payment fr wrk perfrmed n public hlidays Subject t the prvisins f clause 10.1, a casual emplyee is further entitled t payment f any applicable Award allwances, (excluding bth lcality allwance and higher duties allwance), based pr rata n the number f hurs wrked in relatin t the rdinary hurs f the Award classificatin A casual emplyee is nt entitled t annual leave, sick leave r paid public hlidays. Casuals are cmpensated fr the lss f these entitlements by way f an extra lading f 23% added t their rdinary rate f pay The spread f rdinary hurs f wrk fr casual emplyees shall be in accrdance with the hurs f wrk prvisins in this agreement PART-TIME EMPLOYMENT Nte - The part-time emplyment prvisins cntained in the TAFE Teachers Award State 2012, the Senir Cllege Teachers Award State 2012and the Public Service Award State 2012shall n lnger apply (see clause 6.1 abve). The fllwing cnditins apply t part-time emplyees: (a) The Chief Executive r delegate shall, in cnsultatin with the emplyee and as part f the teaching prgram, determine a regular pattern fr the hurs t be wrked. The rdinary hurs f wrk and the nrmal wrk pattern are t be recrded in writing and can be amended and recrded in writing by agreement between the Chief Executive r delegate and the emplyee. (b) Within the specified regular wrk pattern, the minimum daily rdinary hurs n any ne day when wrk is perfrmed shall be 2 hurs. (c) Subject t the prvisins cntained in clause 11, all prvisins f this Agreement applicable t full-time emplyees apply t part-time emplyees n a pr rata basis. (d) The hurly rate f pay fr a part-time emplyee is the same as that fr a full-time emplyee appinted t, r directed t assume duty, at the same classificatin level. (e) A part-time emplyee is entitled t any applicable allwances n a pr rata basis. (f) A part-time emplyee wh wrks n a public hliday shall be paid in accrdance with clause (g) A part-time emplyee wh usually wrks n a day n which a public hliday falls and wh is nt required t wrk n that day shall be paid fr the rdinary hurs the emplyee wuld nrmally have wrked if that day had nt been a hliday. (h) Fr rdinary hurs perfrmed within the spread f rdinary hurs as prescribed in this Agreement, and in additin t the number f hurs specified t be wrked in the wrk cycle, a part-time emplyee is entitled t payment at the rdinary hurly rate. The additinal hurs s wrked shall be taken int accunt in the pr rata calculatin f all entitlements. (i) When a part-time emplyee is authrised t wrk additinal hurs utside the spread f hurs prescribed by clause 15 the part-time emplyee is eligible fr payment f vertime in accrdance with the prvisins f clause 15. (j) A part-time emplyee may be appinted t mre than ne psitin in the public sectr prvided that the maximum number f rdinary hurs fr which they are emplyed shall nt exceed the hurs per frtnight fr a full-time emplyee in equivalent psitins (i.e hurs) SALARY MATTERS (a) With the exceptin f thse emplyees cvered by transitinal arrangements (see clause 13), and in accrdance with Gvernment Wages Plicy (see appendix 3 transitinal arrangements), the fllwing salary increases shall be available t emplyees cvered by this Agreement:

8 i. 2.2 % n 1 July 2014 and ii. 2.2% n 1 July (b) Salaries will be in accrdance with Appendix 1. (c) Additinal Remuneratin Payments (see clause 14) will be a fixed rate fr the life f the agreement in accrdance with Appendix 2and are nt subject t the increases listed in 12 (a) TRANSITIONAL SALARY ARRANGEMENTS Fr the life f this agreement, emplyees whse rates f pay (inclusive f ARP payments) upn transitin t the new salary structure are less than their salary immediately prir t expiry f their current agreement will be preserved. N wage increases will be available t these fficers until their classificatin s base salary (inclusive f ARP) exceeds their pre-transitin base salary (see Appendix 3) ADDITIONAL REMUNERATION PAYMENT (ARP) 14.1 Additinal Remuneratin Payments (ARP) are all-purpse payments that may be paid fr the utilisatin f high level skills and/r experience beynd the scpe f the relevant Rle Descriptin that are deemed relevant by the Institute Directr r delegate. the undertaking f high level additinal respnsibilities beynd the scpe f the relevant Rle Descriptin that are deemed relevant by the Institute Directr r delegate Payment f an ARP is discretinary, reviewable and subject t the apprval f the Institute Directr r delegate Payment f any r all f the individual ARP payments will cease at such time that the fficer is n lnger undertaking the additinal duties and/r required t utilise the skills and experience fr which the payment was apprved Payment f the ARP may be reviewed as required but must ccur at least nce per year as part an annual prgramming prcess Officers may receive ne r mre payments in any cmbinatin as deemed suitable by the Institute Directr r delegate Each payment cunts as salary fr superannuatin purpses and is included in salary fr vertime ARP payments are cntinued during perids f paid leave. (Where leave is n reduced pay r withut pay the payment is prprtinally reduced r withdrawn.) 14.8 Further infrmatin n qualifying skills/tasks fr individual ARP classificatin grupings are at Appendix HOURS OF WORK, MEAL BREAKS, OVERTIME & TOIL Nte - The hurs f wrk prvisins cntained in the TAFE Teachers Award State 2012, the Senir Cllege Teachers Award State 2012and the Public Service Award State 2012shall n lnger apply (see clause 6.1 abve) HOURS OF WORK The rdinary hurs f duty fr emplyees under this Agreement are hurs per week The rdinary hurs per week may be brken dwn int the fllwing cmpnents: (a) Delivery time can be up t a maximum f per week; (b) Timetabled nn-delivery time will be allcated by the Institute Directr accrding t the needs f the curse and wrk circumstances assciated with the curse.

9 8 (c) A timetable will utline required delivery time and nn-delivery time. Examples f nn-delivery time include Recreatin Leave, Lng Service Leave, Public Hlidays. (d) Other Duty Time is a sub-set f nn-delivery time and will als be timetabled. Examples f ther duty time include planned staff prfessinal develpment, Release t Industry bligatins, preparatin time, ffice duty time and prject wrk. Activities r duties and arrangements will be as agreed with the Institute Directr. Where there is n agreement, the Institute Directr will determine the duties and arrangements t apply including the lcatin in which the activity is t ccur, prvided reasnable ntice is given t the emplyee. T avid any cnfusin this clause is intended t perate t the exclusin f clause , clause 6.3 and Schedule 1 f the TAFE Teachers Award State-2012,clause , clause 6.3 and Schedule 1 f the Senir Cllege Teachers Award State-2012and Clause 21 f the Department f Educatin, Training and Emplyment TAFE Educatinal Emplyees Certified Agreement The rdinary spread f hurs shall be 6.00am t 10.00pm Mnday t Saturday, wrked n n mre than 5 days, subject t agreed arrangements in accrdance with clause 17(Natinal service delivery alternative remuneratin and ther expenses arrangement) and clause 18(Internatinal service delivery alternative remuneratin and ther expenses arrangement). Clauses 17 and 18 prevail ver the prvisins f Part 14 f this agreement (HOURS OF WORK, MEAL BREAKS, OVERTIME & TOIL) where there is a cnflict These hurs are t be wrked in accrdance with a prgram and timetable develped under the directin f the Institute Directr. The timetable may be adjusted with minimal ntice t meet client needs, hwever 24 hurs ntice shuld be given, where pssible Time is t be recrded n the timesheet t the nearest quarter hur OVERTIME All emplyees shall be cmpensated fr vertime by TOIL arrangements unless therwise apprved by the Institute Directr r delegate. TOIL r paid vertime is at the discretin f the Institute Directr r delegate, nt the emplyee Where paid vertime is authrised, wrk perfrmed in excess f hurs per week r utside the rdinary spread f hurs shall be paid fr at the rate f time and a-half fr the first 3 hurs in any ne day and duble time fr all time wrked thereafter except where the prvisins f clause 15 (Natinal service delivery alternative remuneratin and ther expenses arrangement) and clause 16(Internatinal service delivery alternative remuneratin and ther expenses arrangement) apply Where paid vertime is authrised, wrk perfrmed n Sunday is t be paid at the rate f duble time with a minimum payment f 2 hurs except where the prvisins f clause 15 (Natinal service delivery alternative remuneratin and ther expenses arrangement) and clause 16 (Internatinal service delivery alternative remuneratin and ther expenses arrangement) apply All vertime will be calculated t the nearest quarter hur TIME OFF IN LIEU (TOIL) All emplyees shall be cmpensated fr vertime by TOIL arrangements in lieu f receiving paid vertime fr wrk perfrmed utside f rdinary hurs unless, therwise determined by the Institute Directr r delegate, with the fllwing cnsideratins: Tutr - at the discretin f the Institute Directr Assessr Overtime payment may be made in exceptinal circumstances. Unused TOIL will be paid ut after 12 mnths, prvided reasnable requests have been made t take TOIL and these requests have been refused. Trainer - Overtime payment will nly be made in exceptinal circumstances Fr trainers, unused TOIL will nt be paid ut after 12 mnths except in exceptinal circumstances where unused TOIL in excess f hurs exists and at least 3 reasnable requests have been made t take the TOIL ver a 12 mnth perid and these requests have been refused. Only that amunt in excess f is t be cnsidered fr payment Educatinal staff can be directed t avail themselves f accumulated TOIL when teaching cmmitments are lw/r are directed with 48 hurs ntice by the Institute Directr.

10 15.4 REST PAUSES Rest pauses are paid breaks and taken during wrking time and paid fr at the rate being paid at the time the rest pause is taken Emplyees are entitled t a rest pause(s) at such times as will nt interfere with the cntinuity f wrk, where such cntinuity is necessary, in accrdance with the fllwing: (a) a ttal f 10 minutes fr an emplyee wh wrks fr mre than 3 hurs but less than 6 rdinary hurs in any day; r (b) a ttal f 20 minutes fr an emplyee wh wrks fr at least 6 rdinary hurs in any day by either a rest pause f 10 minutes duratin in the first and secnd half f the wrking day; r ne rest pause f 20 minutes duratin in the first part f the wrking day; r emplyees wh are required t leave their wrk places t partake f rest pauses in crib huts r lunch rms and thse wh are n site in lieu f mrning and afternn rest pauses shall, at the emplyer s discretin, have ne rest pause f 20 minutes duratin in the first part f the wrking day 15.5 MEAL BREAKS All Emplyees wh wrk in excess f 5 hurs n any day shall be allwed nt less than 30 minutes fr an unpaid meal break between the 3 rd and 6 th hurs f duty PUBLIC HOLIDAYS All hurs wrked by an emplyee n a public hliday shall be cmpensated in accrdance with the Industrial Relatins Act 1999 r successr legislatin TRAVEL FOR DUTY 16.1 Emplyees may be required t travel t mre than ne TAFE site n any day t perfrm duties NATIONAL SERVICE DELIVERY ALTERNATIVE REMUNERATION AND OTHER EXPENSES ARRANGEMENT 17.1 In lieu f the abve vertime, penalties and allwance prvisins as specified in Part 15 abve, the Chief Executive r their nminee may enter int an alternative remuneratin and ther expenses arrangement with an emplyee t cmpensate the emplyee fr the perfrmance f duties under nn-standard circumstances (e.g. nn-standard wrking hurs/rsters, service delivery in rural/remte areas within Australia ) whilst undertaking curse delivery, special prjects r prgrams fr a fixed perid f time This alternative arrangement will take the frm f additinal peridic payments up t a maximum f $150 per wrk day payable fr the duratin f the delivery perid, prject r prgram. This payment will nt be superannuable The alternative arrangement is t be recrded in a written agreement and signed by the Chief Executive r their nminee and the emplyee prir t the cmmencement f the arrangement. The written agreement must: Clearly specify the perid f the agreement. Cver all aspects and mdes f delivery including hurs, penalty rates, TOIL, and where necessary cmpensatin fr travel within Australia which are cvered by payments under this clause. Where apprpriate, specify the emplyee s status at the cnclusin f the written agreement/arrangement. In particular, designate the return t wrk arrangements fr a persn wh was a tenured public service fficer prir t accepting an alternate arrangement under clause Shuld the additinal payment fr wrk perfrmed as required and directed by the Chief Executive r their nminee nt adequately cmpensate the emplyee fr any vertime, penalties and allwances fregne, the emplyee will discuss the matter with their supervisr fr the purpse f seeking a review, in the first instance, and, if necessary, access the Dispute Reslutin Prcedure detailed in clause INTERNATIONAL SERVICE DELIVERY ALTERNATIVE REMUNERATION AND OTHER EXPENSES ARRANGEMENT 18.1 In lieu f the abve vertime, penalties and allwances prvisins as specified in Part 14, the Institute Directr r their nminee may enter int an alternative remuneratin and ther expenses arrangement with an emplyee t cmpensate the emplyee fr the perfrmance f duties under nn-standard circumstances n prjects r

12 21.2 This agreement cvers all matters r claims that culd therwise be subject t prtected industrial actin It is agreed that the fllwing changes may be made t emplyee s rights and entitlements during the life f this agreement: (a) General Rulings and Statements f Plicy issued by the Queensland Industrial Relatins Cmmissin that prvide cnditins that are nt less favurable than current cnditins; (b) Any imprvements in cnditins that are determined n a whle-f-gvernment basis; (c) Reclassificatins Unless incnsistent with the terms f this agreement, the entitlement f emplyees cvered by this agreement as cntained in awards, agreements, Ministerial Directives r determinatins made under the Public Service Act 2008 effective at the date this agreement was made shall nt be reduced fr the life f this agreement AWARD MAINTENANCE 22.1 Subject t clause 12, the Queensland Industrial Relatins Cmmissin State Wage increases awarded up t, and including, the nminal expiry date f this Agreement shall be absrbed int the wage increases prvided by this Agreement It is a term f this Agreement that n persn cvered by this Agreement will receive a rate f pay, which is less than the crrespnding rate f pay in the relevant parent Award The emplyer will cnsent t applicatins made after the nminal expiry date f this Agreement t amend the parent Awards t incrprate wage adjustments based n this Agreement AWARD REVIEW 23.1 The Department cmmits t cnduct an Award review f the TAFE Teachers Award - State 2012 and the repeal f the Senir Cllege Teachers Award - State 2012in cnsultatin with the unins within 18 mnths f certificatin f the agreement PROGRAMMING Nte - The prgramming prvisins cntained in the TAFE Teachers Award State 2012 and the Senir Cllege Teachers Award State 2012 shall n lnger apply (see clause 6.1 abve) Prgramming will be undertaken in accrdance with the relevant rganisatinal plicy CLASS SIZES 25.1 Class sizes will be determined in accrdance with the relevant rganisatinal plicy ANNUAL LEAVE PAYMENTS AND LOADING 26.1 Wages payable fr perids f annual leave will nt be paid in advance except in circumstances cnsidered exceptinal including, but nt limited t, travel t internatinal r remte lcatins causing hardship; and 26.2 In the case f emplyees wh are entitled t the 17.5% annual leave lading, fur weeks annual leave lading will be paid during December f each year PARENTAL LEAVE 27.1 Paid and unpaid parental leave will be granted in accrdance with relevant legislative prvisins LONG SERVICE LEAVE 28.1 Lng service leave will be granted in accrdance with relevant legislative prvisins SICK LEAVE 29.1 Sick leave will be granted in accrdance with relevant legislative prvisins.

13 30.0 BEREAVEMENT LEAVE Bereavement leave will be granted in accrdance with relevant legislative prvisins SALARY PACKAGING 31.1 Salary packaging is available fr emplyees in departments and agencies cvered by this agreement Departments and agencies are t apply the fllwing principles fr emplyees that avail themselves f salary packaging: (a) as part f the salary package arrangements, the csts fr administering the package, including fringe benefits tax, are met by the participating emplyee; (b) there will be n additinal increase in superannuatin csts r t fringe benefits payments made by the emplyer; (c) increases r variatins in taxatin are t be passed t emplyees as part f their salary package; (d) where mandated by relevant gvernment plicies, emplyees must btain independent financial advice prir t taking up a salary package. Where n mandatry requirement exists, it is strngly recmmended t all emplyees t seek independent financial advice when entering int a salary packaging arrangement fr the first time, r adding new item/items t an already agreed packaging arrangement; (e) the Emplyer will pass n t the emplyee any Input Tax Credits (ITCs) it receives as part f salary packaging; (f) there will be n significant additinal administrative wrklad r ther nging csts t the emplyer; (g) any additinal administrative and fringe benefit tax csts are t be met by the emplyee; (h) any increases r variatins t taxatin, excluding payrll tax that result in additinal csts are t be passed n t the emplyee as part f the salary package The emplyee's salary fr superannuatin purpses and severance and terminatin payments will be the grss salary, which the emplyee wuld receive if nt taking part in flexible remuneratin packaging Subject t federal legislatin, emplyees may elect t adjust their current salary sacrifice arrangements t sacrifice up t 100% f salary t superannuatin CONSULTATIVE COMMITTEES 32.1 TAFE Queensland Cnsultative Cmmittee (TQCC) There will be a jint cnsultative cmmittee made up f emplyee and emplyer representatives knwn as the TAFE Queensland Cnsultative Cmmittee (TQCC). The purpse f TQCC is t perate as the peak cnsultative bdy fr TAFE Queensland Lcal Cnsultative Cmmittees (LCC) Each Institute will als have a lcal level cnsultative cmmittee made up f emplyee and Institute representatives knwn as the Lcal Cnsultative Cmmittees (LCC) The LCC may, by agreement, subsume the rle/s f any ther cnsultative frums already in place The purpse f the LCC will be t cnsult n a brad range f lcal issues and is nt cnfined t the discussin f matters arising frm this agreement Matters nt reslved at the LCC may be referred t the TQCC fr reslutin if the matter has brader TAFE QLD implicatins The cmpsitin f the LCC will ensure representatin by management and unin nminees frm amngst the institute staff DISPUTE AND GRIEVANCE RESOLUTION PROCEDURES 33.1 In the event f any disagreement between the parties as t the interpretatin r implementatin f this Agreement, the fllwing prcedures shall apply:

14 13 (a) In the first instance, the matter is t be discussed by the emplyee(s) cncerned (where apprpriate) and their immediate supervisr. The discussin shuld take place within 24 hurs and the prcedure shuld nt extend beynd 2 days; (b) If the matter remains unreslved as per (a) abve, it shall be referred t the delegated fficer r nminee and t the relevant unin fficer/delegate/representative wh shall arrange a cnference f the parties t discuss the matter. This prcess shuld nt extend beynd a further 5 days; (c) If the matter remains unreslved, it shall be referred t the Institute Directr r their nminee and the secretary f the unin r nminee fr discussin and apprpriate actin. This prcess shuld nt exceed a further 7 days; and (d) If the matter is nt reslved then it may be referred by either party t the Queensland Industrial Relatins Cmmissin. In terms f s. 230 f the Industrial Relatins Act 1999, the Cmmissin is empwered t d all things necessary t prevent and/r settle the dispute and determine any matter in dispute All timelines utlined abve may be altered by mutual agreement between the parties Sexual harassment and the grievance and dispute settling prcedure Where the grievance invlves allegatins f sexual harassment, an emplyee may cmmence the prcedure at Stage (c) Subject t legislatin, while the dispute prcedure is being fllwed, wrk is t cntinue cnsistent with the determined change, except where a genuine safety issue is identified N party shall be prejudiced as t the final settlement by the cntinuatin f wrk.
