1 Instructions to follow with respect to Import/ Export of Hazardous Wastes/ Other Wastes under Hazardous and other Wastes (Management, Handling and Trans-boundary Movement) Rules, 2016 (a) The application shall be addressed to Joint Director, Hazardous Substances Management Division, Jal Block, 2 nd Floor, Indira Paryavaran Bhawan, New Delhi. (b) All applications seeking import/ export permissions under Hazardous and other Wastes (Management, Handling and Trans-boundary Movement) Rules, 2016 may be submitted to Central Registry Section of the Ministry at 'Agni' Block, Ground Floor, Indira Paryavaran Bhawan. (el The application shall only be sent by registered post! speed post! ordinary post or in person submitted to the Central Registry Section of the Ministry. Any application not routed through Central Registry section of this Ministry will not be considered for the grant of permission by the Hazardous Substances Management division of this Ministry. (d) Applicants are requested to frequently visit the website of the Ministry for agenda, minutes, meeting notice and other such information ( /importexport). (e) Please ensure that the Mobile No. and address of the contact person is mentioned in the forwarding letter of the application. (0 For other queries/ clarification, the applicant may contact Ministry or call on between 4.30 PM to 5.30 PM only on working days.

2 (g) The applicants who are applying for the first time in the Ministry may invariably be present in the Expert Committee Meeting for a technical discussion. (h) The applicants called for presentation by the Expert Committee need to ensure their presence within two ensuing meetings of the Expert Committee. Subsequent to which, their application would be cancelled and they will have to submit a fresh application for consideration by the Ministry. (i) The 'check list' of the documents to be submitted to the Ministry along with the application may be referred below. 2

3 Checklist indicating the requirement for appraisal of the applications for import jexport of hazardous waste as listed in Schedule III A and III B of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 of the Ministry (i) Import of Lead Scrap/Batteries Scrap (c) Valid Consent to Operate under Water Act, 1974 and Air Act, 198!. (d) Valid Authorization under Hazardous and other Waste Rules, (e) Copy of lead analysis report in soil, air, water, stack and blood of the workers. (I) Process flow chart indicating adequate pollution control equipment including alkaline scrubber and battery breaking system for unit of more than 10,000 MTA of ISRI Code RAINS. (g) Photographs & Video CD of running plant. (h) Acknowledgement for receipt of copy of application from concerned State Pollution Control Soard (SPCS) / (i) Document depicting the status of employment (iii Import of waste tyres/rubber scrap* (c) Valid Consent to Operate under Water Act, 1974 and Air Act, 198!. (j) Valid authorization under Hazardous and other Waste Rules, (d) Process flow chart indicating adequate pollution control equipments.. (e) List of users (I) Photographs & Video CD of running plant. 4 * With respect to consideration of applications of import of waste tyres for production of tyre pyrolysis oil, along with above cited documents, the applicant need to submit certificate from the concerned State Pollution Control Board/Pollution Control Committee along with inspection report certifying that the unit is in compliance with Standard Operating Procedure issued by the Ministry. (iii) Import of EEAs for repair or renting in India and to be re-exported after one year" (c) Undertaking for re-export specifying the time period for re-export (d) Details of previous import, if there has been any and confirmation regarding their re- export (e) Acknowledgement for receipt of copy of application from concerned State Pollution Control Board (SPCB) / (D Certification from exporting company for accepting the re-export of repaired and un repaired EEAs and spares/part/ component/ consumables after the specified time (g) Document depicting the status of employment (h) Extended Producer Responsibility-Authorisation as producer under E-Waste (Management) Rules, 2016, if the EEAs to be imported are listed in Schedule I of the E-Waste (Management) Rules, 2016 ** "Used electrical and electronic assemblies imported for repair/ ' rental purpose and to be re-exported back after repair/use within one year of import are in Schedule III D of Hazardous and other waste Rules, 2016" and thus are exempted from the need of Ministry's permission, subject to the condition prescribed within the Rules. (iv) Import of used EEAs for Testing purpose/projects/r&d and to be re-exported after three years'" (c) If being imported on returnable basis than undertaking for re-export specifying the time period (d) Chartered Engineer Certificate from the exporting country indicating the functionality, manufacturing date, residual life and serial number. (e) Details of previous import, if there has been any and confirmation regarding their re- export, if applicable. (D Acknowledgement for receipt of copy of application from concerned State Pollution Control Board (SPCB) / 4

5 (g) Certification from exporting company for accepting the re-export of defective or second hand EEEs, and the spares/part/ component/ consumables after the specified time. (h) Document depicting the status of employment (i) Extended Producer Responsibility-Authorisation as producer under E-Waste (Management) Rules, 2016, if the EEAs to be imported are listed in Schedule I of the E-Waste (Management) Rules, 2016 "Used electrical and electronic assemblies imported for testing, research and development, project work purposes and to be reexported back within a period of three years from the date of import" are in Schedule III D of Hazardous and other waste Rules, 2016 and thus are exempted from the need of Ministry's permission, subject to the condition prescribed within the Rules. (v) Import of used EEAs including medical equipment for their re-use purpose **** (c) If being imported on returnable basis than undertaking for re-export then specifying the time period (d) Chartered Engineer Certificate from exporting country indicating the functionality, manufacturing date, residual life and serial number. (el Details of previous import, if there has been any and confirmation regarding their re- export. (fj In case of capital items particularly medical equipment the fact that the machine has been refurbished at the OEM factory and after sales service is provided by the supplier /importer. (g) Aclrnowledgement for receipt of copy of application from concerned State Pollution Control Soard (SPCS) / Pollution Control Committee (PCC) (h) Certification from exporting company for accepting the re-export of defective or second hand EEEs, after the specified time period. (i) Document depicting the status of employment generation indicating the no. of people benefitted U) Extended Producer Responsibility-Authorisation as producer under E-Waste (Management) Rules, 2016, if the EEAs to be imported are listed in Schedule I of the E-Waste (Management) Rules, 2016 (k) Extended Producer Responsibility-Authorisation as producer under E-Waste (Management) Rules, 2016, if the 5

6 EEAs to be imported are listed in Schedule I of the E-waste (Management) Rules, 2016 **** "Used critical care medical equipment for re-use" falls in Schedule VI of Hazardous and Other Waste Rules, 2016 and is prohibited for import purpose.
