TENDER; a) Sealed tenders superscribed Tender for purchase of scrap obsolete materials from Kanyakumari Electricity Distribution Circle are Invited by the Chief Engineer, Distribution/Tirunelveli from all intending purchasers for purchase of the following materials available at Central Stores/Parvathipuram/Nagercoil duly remitting the Earnest Money Deposit noted against each lot along with the Tender. Description of materials Ferrous and non Ferrous scraps such as M.S./ Aluminium /ACSR/ G.I/T.W and D.W/Grill scrap Emptys Cond. Dist. Transformer available in Kanyakumari E.D.C, Central stores Parvathipuram /Nagercoil E.M.D. 5% of the offered total value for each LOT b) Sealed Tenders will be received by the Superintending Engineer/ Kanyakumari Elecy.Distn.Circle, Nagercoil on 03 / 03 /2015 up to Hrs.. c) If the Tenderer has any doubt about the meaning of any portion of this Tender, he should at once submit particulars thereof to the Superintending Engineer, Kanyakumari E.D.C., Nagercoil in writing in order that the Doubt may be cleared before the submission of the tender. d) The tenders will be opened by the Chief Engineer, Distribution/Tirunelveli or authorized 0fficer of the TANGEDCO on 03 / 03 /2015 (i.e.) on the same day of the receipt of the tender in the presence of such of those tenderer or the persons who have represented on behalf of them with an authorization letter to be present at that time at Hours. e) If the due date of receipt of the tender and opening is not kept up due to unforeseen circumstances of declared any holiday, the receipt of the Tender and opening will be done on the next working day at Hours. f) The tenderers are requested to furnish full and clear postal address. If the tapal is returned due to non availability of the correct address or vogue address the TANGEDCO will not be responsible for it and it will be assumed that the tenderer has backed out and uninterested in the purchase of the items covered by this Specification. So the tenderers are requested to make proper arrangements for it and the TANGEDCO will not be responsible for any loss or delay in transit of the tender documents and other relevent correspondence. g) Attested Certificate of TNGST Registration and copy of PAN card should be furnished along with DD /receipt for EMD in the outer cover. Unless the offer will be rejected,

INSPECTION OF MATERIALS: a) The materials given under clause 1 (a) above can be inspected at the Central Stores of this Distribution Circle, Parvathipuram, Nagercoil on any Working day from 8.00 AM to Noon and from 1.30 PM to 4.00 PM with the prior permission of the Stores Officer / Central Stores/Parvathipuram/Nagercoil-3. b) The inspection of the materials will be permitted only on production of the receipt for having purchased tender specification or on production of specification copy to the Stores Officer. Selection or disturbance of the lots during inspection of the lots will not be permitted. Permission for inspection of the materials after noon on the final day of submission of tender will not be granted 4. PRICES; a) The tenderers should quote firm prices both in FIGURES and in WORDS separately as indicated in the tender form enclosed and any correction in the rates Shall be attested by persons signing in the tender offer. If there is any discrepancies (or) difference in value between the FIGURES and WORDS for the highest rates quoted either in WORDS or in FIGURES whichever is advantages to the TANGEDCO will be taken into account while deciding sale order. All the taxes leviable on these materials by the Tamil Nadu (or) Central Government, or other Local Bodies will have to be paid by the purchaser. The prices quoted in the tender shall be valid for at least 120 (one hundred and twenty) days from the date of opening of tender. The prices quoted for each lot covering the entire items of the lot alone will be Considered and not part of the lot quoted. b) No tenderers shall be allowed to withdraw the offer within the validity Of 120 days specified. If the tender is withdrawn by the tenderers before the expiry Of the validity period, the E.M.D. paid will be forfeited. The tenderers cannot quote His own validity period and if so, the tender will not be considered and will be totally rejected. c) The sale will be on TANGEDCO. Stores basis and hence no Central Sales Tax will be collected and that if any of the dealers taking part in the sale wish to take The materials outside the State, they should pay in addition to the sale price payable to the TANGEDCO, the purchase tax applicable to the transaction to the Government of Tamil Nadu before taking the materials outside the state. d) Only after submission of proof to TANGEDCO, by the dealer if clearing the Purchase tax liability in respect of the transaction to the Government of Tamil Nadu, The E.M.D. collected will be refunded to the dealers. e) Central Sales Tax will be collected only if interstate sale is involved, namely despatch to outside Tamil Nadu. 5. EARNEST MONEY DEPOSIT; Page5 a) Each tenderer should pay the E.M.D. noted under Para 1 (a) above by Demand draft, pay order drawn in favour of the Superintending Engineer, Kanyakumari Electricity Distribution circle, TANGEDCO, Parvathipuram, Nagercoil payable at Any of the Nationalised / scheduled Banks at Nagercoil and to be enclosed alongwith the tender Form. kkedc scrap tender [Type text]

6 6 b) Tender should be sent in DOUBLE COVER Tender offer receipt for Having paid the Earnest Money Deposit/Drafts etc., as prescribed in the tender Condition and the tender cover should be out in an outer cover. If on opening the outer cover, it is found that the DD/.Cash receipt towards the EMD at 5 % on the offered value by the Tenderer for each lot should be available then only the rate will be readout. Otherwise the rate will not be readout and the offer will be summarily rejected. The outer Cover should have a superscription as mentioned in para 1(a). c) There will be no exemption to SSI and NSI units from payment of EMD and therefore the Tender received without the EMD for the each lot will not be opened and summarily rejected d) Cash, Cheques and Bank Guarantees enclosed to the tender are not Acceptable and tender will be summarily rejected. e) Tenders should be submitted only in the prescribed forms supplied by the TANGEDCO alongwith the tender specification, otherwise the tenders will be summarily Rejected. f) The case of the Earnest Money Deposit paid through Demand Draft, The same will be returned to the unsuccessful tenderer within a reasonable time, From the date of receipt of requisition from the unsuccessful tenderers. g) The E.M.D. paid by the successful tenderer of Tamil Nadu State will be Adjusted in the sale proceeds of such successful tenderers. h) The E.M.D. will not carry any interest. i) In case of successful tenderers from outside the state of Tamil Nadu, E.M.D. will be refunded to them only after successful completion of sale and removal Of sold goods from Stores premises satisfactorily and after submission of proof to the TANGEDCO by the tenderer of clearing the purchase tax liability in respect of the transaction to the Government of Tamil Nadu. 5 (1) The Chief Engineer/Tirunelveli Region/Tirunelveli 11 reserves the right to reject the Tenders, due to the following Reasons. (i) Tender received from the Tenders who have not purchased the Tender specification from this office except down loading from TNEB website & TNGOV website. (ii) Tenders received with out EMD for each lot and Tenders received with part Earnest money Deposit. (iii) Telegraphic/Fax/Telex Quotations. (iv) Tenders received other than the Tender forms enclosed with the specification. (v) Tenders received without quoting firm rate both in figures and words separately for each lot to the Tender schedule, (vi) Tender received without the signature of the Tenderer in the Tender form concerned. (vii) Tenderers should not stipulate their own terms and conditions and their own validity period for the rates quoted by them either in the department Tender from or in separate letter along with the Tender.

7 7 (viii) (ix) The Tender from purchased Tenderer from the outside of Tamil Nadu should not be submitted on the Name of their branch office situated in the State of Tamil Nadu such tenders will be summarily rejected. Tender received without the required documents will be summarily rejected. 6. PAYMENT OF COST; a) (i)the successful tenderer or tenderers should pay the cost of materials at The rates offered by them in the tender within 21 days (Twenty One) from the date of Receipt of sale confirmation orders from the Chief Engineer/Distribution /Tirunelveli Region for the acceptance of the tender. No extension of time shall be granted under any circumstances and failure to comply with the requirement will entail to make good the loss sustained by the TANGEDCO if any in the subsequent sales. The cash receipt should be produced to the Stores Officer/Central Stores/Parvathipuram/Nagercoil who will arrange to issue release orders. It may be noted that the release order will be issued only on remittance of entire sale amount due to TANGEDCO. (ii) In unavoidable circumstances, Superintending Engineer grant extension of time up to 30 days from the due date of payment of sale price subject to collection of penal interest of 22%.After making collection of penal interest, Chief Engineer may grant further extension of time up to 30 days subject to collection of penal interest of 22%. b) He should remove the entire quantity of materials offered to the purchaser within 15 (Fifteen) days from the date of remittance of the amount. Failure to complete the removal of the materials within the time specified above is likely to result in forfeiture of all his claims for all or the balance of materials remaining at site and also forfeiture of the deposited amount. However, the Superintending Engineer/ Kanyakumari Electricity Distribution Circle/Nagercoil considers that the delay in removal of the materials is beyond the control of the purchaser a nominal rent not less than Rs. 100/- (Rupees One hundred only) per M.T. per day (or) Rs. 50/- per lot per day if the unit of lot is not in weight Whichever is higher will be collected after the stipulated period is over and this amount should be paid to the Stores Officer/Central Stores/Parvathipuram, Nagercoil in cash before the removal of the materials. c) The sale order and release order will be issued only to the successful Tenderer who has submitted the quotations. No change in the name (or) address (or) Transfer of sale will be permitted. d) INCOME TAX i) Income tax collection at source in terms of section 206 C towards sale is 1 % of scrap and circular Lr.no.CFC/GL/FC/ACCTS/DFC/BS/IT/F.208/D.24/2010(Accounts branch) dt: ii) Surcharge on income tax and additional surcharge on IT and SC is not collectable from buyer, who is a domestic company or any person who is resident in India. (Vide section 2(8)and provision to section 2(11),2(12) of the finance act 2010) 7. RELEASE OF MATERIALS; a) The successful tenderer will not be permitted to bring any dealers or merchant for inspection of materials for further examination of materials in the stores premises when once the tenders are finalized. 8 8 c) The materials are offered for delivery at departmental Stores at Parvathipuram on AS.IS WHERE IS CONDITION. They should be removed from the place where the purchaser at his own cost from the stores during working hours only and also they should abide by the TENGEDCO rules and regulations. All weighment will be as per the TENGEDCO weighing machine. d) The employees of the purchaser engaged in the removal of materials shall be subject to departmental rules and discipline. The purchaser is responsible for all the acts of his employees and any damage to the building or properties of this TANGEDCO or any other persons or he should make public body in the case of movement of his vehicles as good. In case of accident to any of this TANGEDCO or any persons in the cause of removal or transport of materials, the purchaser should pay necessary Compensation that may be awarded to the person or persons involved in the accident According to workers compensation act, besides arranging immediate medical aid. e) The successful tenderers / bidders should produce certificate from pollution Control Board prior to taking delivery of Acid Battery and waste Transformer Oil etc., failing which, the Earnest Money Deposit will be forfeited. f) The weight of the materials is inclusive of the binding materials used. Tenderers are therefore advised to satisfy themselves regarding the quality condition Of the materials before tendering. The TANGEDCO is not responsible for any Detoriation or loss in the materials from the date of tendering to date of removal from the site and no representation about the quality and the conditions of the materials during the tender period or at the time of taking delivery of the materials. g) The materials, which are accounted on weight basis, shall be weighed in the presence 0f one or two TANGEDCO Officers in the departmental Weighing machine or lorry weigh bridge available at the stores and the weights Recorded by the weighing machine will be final and shall be accepted by the successful Tenderers. The weighing machine are periodically maintained and certified by the Competent authority. h) The successful tenderers shall remove the weighed quantity then and There. No part of the weighed quantity will be allowed to be kept in the departmental Premises after the weighments are done. i) Materials removed from the Stores should not be dumped outside the Stores or in the outside of stores up to a radius of one Kilometer. j) The materials will be released only during the working hours of the Stores. The successful tenderers should remove the materials from the stores Premises within the working hours of stores. The successful tenderers should also contact the Officer in charge of Stores in advance about the availability of the Officers, who are nominated to witness the release of materials for releasing the Materials and then only arrange for the vehicle and men for taking delivery of the Materials. k) The TANGEDCO and competent authority is the sale and final authority for deciding on any points of any clarifications or dispute rising during the sale of Materials.

No suit any proceedings on regards to any matter arising in any respect under this tender shall be instituted in any court of law save in High court Chennai branch at Madurai, and city Civil Court of Nagercoil or on the Court of small causes of Nagercoil. It is agreed that no other court shall have jurisdiction to entertain any suit or proceedings even though Part of causes of action might arise within their jurisdiction. In case of any part of the cause of action arise within their jurisdiction of any of the court in Tamil Nadu and Not in the courts of Nagercoil. Then, it is agreed to between the parties that such Suits (or) Proceedings shall be instituted in a court within Tamil Nadu and no other Court outside Tamil Nadu shall have jurisdiction even though any part of the cause of auction might arise within the jurisdiction of such courts. 9. GENERAL CONDITIONS; a). The Chief Engineer, Distribution/Tirunelveli reserves the rights to reject any Or all the tenders to sell any or all the tenders to sell any or all the materials to one or More tenderers and to retain any or all the items included in this tender for the own use Of the Board without assigning any reason. b). Nonferrous metal scrap of Lead, Copper, Zincnulybdirum and Nickel Used Batteries will be disposed only to genuine reprocessors. 10. The Tenderers those who have Registered with Ministry of Environment and Forests, New Delhi shall be allowed to participate in the Auction. The tenders should enclose a copy of Registration Certificate with the tender schedule form, such tenderers shall be allowed to participate in contract regarding waste oil, Old/Used lead acid batteries and other non ferrous metal waste. 11.TENDER REGULATIONS TO APPLY; The Tamil Nadu Electricity Board s Tender regulations 1991 with latest Modifications shall MUTATIS MUTANDIS apply to this tender.
