9 PROPERTY - MISCELLANEOUS SEWER BACKUP SECTION SEWER BACKUP This endorsement provides coverage for loss or damage caused by the sudden and accidental backing up or escape of water or sewage from a sewer, sump pump or septic system provided there is no evidence that flood water or overland water has entered the building from an entry point other than the sewer backup itself. If evidence of flood water or overland water is found to have entered the building from another entry point, there is no coverage. Special Coverage Feature - $1,000 for Loss Prevention Device This endorsement also provides $1,000 coverage for the purchase of approved devices (following an insured sewer backup loss) that are proven to mitigate future sewer backup losses. These devices include a main line normally open back flow valve, backup power source for a sump pump, higher capacity sump pumps etc. Guaranteed Replacement Cost and Single Limit of Insurance do not apply to any loss covered by this endorsement. For the purpose of this endorsement: "Flood" means waves, tides, tidal waves, tsunamis or the rising or, the breaking out or the overflow of any body of salt water, whether natural or man-made. "Overland Water" means water that accumulates upon or submerges land which is usually dry resulting from: 1. The unusual and rapid accumulation or run off of surface waters from any source, including torrential rainfall. 2. The rising or, breaking out or the overflow of any body of fresh water. 10 PROPERTY - MISCELLANEOUS SEWER BACKUP SECTION HIGH RISK AREAS (Territories 13, 14, 15) LIMITS Maximum coverage - $100,000. Lower limits are also available - $5,000, $10,000, $15,000, $20,000, $25,000, $50,000, or $75,000. NEW BUSINESS A professionally installed backwater valve or sump pump or septic system is required to qualify for coverage over $25,000. A fully completed and signed sewer backup questionnaire must be obtained for risks on a municipal sewer system. Refer to company Any risk with 1 sewer backup loss in the previous 5 years. The company must review a copy of a fully completed and signed sewer back up questionnaire for risks on a municipal sewer system prior to coverage being bound. Coverage is not available if there have been 2 or more sewer backup losses in the previous 5 years. RENEWALS A professionally installed backwater valve or sump pump or septic system is required to qualify for coverage over $25,000. To continue coverage where there has been 1 sewer backup loss in the previous 12 months, a professionally installed backwater valve or sump pump or septic system is required and a fully completed and signed sewer back up questionnaire for risks on a municipal sewer system must be reviewed and approved by the company prior to offering the renewal. Coverage is not available if there have been 2 or more sewer backup losses in the previous 5 years. ALL OTHER AREAS (Territories 1 12) LIMITS Maximum coverage Policy Limits. Lower limits are also available - $5,000, $10,000, $15,000, $20,000, $25,000, $50,000, $75,000 or $100,000. NEW BUSINESS Refer to company Any risk with 1 sewer backup loss in the previous 5 years. RENEWALS To continue coverage over $25,000 where there has been 1 sewer backup loss in the previous 12 months, a professionally installed backwater valve or sump pump or septic tank system is required and a fully completed and signed sewer back up questionnaire for risks on a municipal sewer system must be reviewed and approved by the company prior to offering the renewal. Coverage is not available if there have been 2 or more sewer backup losses in the previous 5 years. 11 PROPERTY - MISCELLANEOUS SEWER BACKUP SECTION DEFINITIONS Backwater Valve: A type of check valve in a drainage pipe where the reversal of water flow causes the valve to close, thereby cutting off the water flow back up through the pipe, also known as backflow valve. Automatic Sump Pump: An automatic sump pump is a mechanical pump used to remove water that has accumulated in a sump pit. The water may enter the sump pit through drains funneling into the pit, or it may enter because of rain or because of natural ground water, if the basement is below the water table level. Electric Sump Pump: The sump pump s mechanical system is powered by the electrical system of the dwelling in which it has been installed. The disadvantage to this type system is the sump pump is rendered inoperable in the event of a power outage. Sump Pump with Battery Backup: The sump pump s mechanical system derives its primary source of power from the electrical system of the dwelling in which it has been installed. The battery backup provides a secondary power source for the sump pump to operate from in the event of a power outage. The limitations of this type of system are the battery life, ensuring the backup battery provides sufficient power to handle anticipated water loads and length of time the sump pump will operate off the battery pack in a power outage. Sump Pump with Generator Backup: The sump pump s mechanical system derives its primary source of power from the electrical system of the dwelling in which it has been installed. A gas powered generator provides a secondary source for the sump pump to operate from in the event of a power outage. The limitations of this type of system are ensuring the system is fully fueled, the generator provides sufficient power output to support the anticipated water loads and maintenance of the generator s mechanical components. Sump Pump with Water pressure Backup: The sump pump s mechanical system derives its primary source of power from the electrical system of the dwelling in which it has been installed. Pressurized municipal water pushes through the backup system creating a vacuum that draws water from the sump pit. There are no moving or mechanical parts to maintain within this type of system, however, the system should be designed to provide sufficient power to support anticipated water loads and there is a possibility the system could fail if there is loss of water pressure from within the supply line. Septic System An alternate wastewater treatment system used when a home is not connected to a municipal sanitary sewer system. The main components of a septic system are a septic tank and a leaching bed. Wastewater from a home drains directly into the septic tank, eventually draining into the leaching bed where it is further treated, filtered through natural processes, and ultimately drained back into the soil or ground water. Regular maintenance and pumping of the septic tank is imperative to ensure efficient operation and to prevent sewer backup losses. Ontario D 3 Aviva Insurance Company of Canada September 1, 2011

12 PROPERTY - MISCELLANEOUS OVERLAND WATER SECTION OVERLAND WATER COVERAGE This coverage is offered as a package including both the Sewer Backup Endorsement and the Overland Water Endorsement to provide broad water damage protection. The Overland Water Endorsement includes coverage for sewer backup when it is concurrent to overland water damage. A risk must therefore also be eligible for Sewer Backup to be eligible for the Overland Water Endorsement. SEWER BACKUP ENDORSEMENT The risk must meet all eligibility for the Sewer Backup Endorsement specified in this section of the manual. OVERLAND WATER ENDORSEMENT This endorsement provides coverage for the actual loss or damage caused by overland water including the sudden and accidental backing up or escape of water or sewage from a sewer, sump pump or septic system resulting from overland water provided there is evidence the overland water has also entered the building from an entry point other than the sewer backup itself. This endorsement does not provide coverage for loss or damage caused by flood or storm surge. There is also no coverage for loss or damage caused by the escape of water that results from the intentional breach of dams, dikes, levee s or any other similar man made structure. Guaranteed Replacement Cost and Single Limit of Insurance do not apply to any loss covered by this endorsement. For the purpose of this endorsement: "Flood" means waves, tides, tidal waves, tsunamis or the rising or, the breaking out or the overflow of any body of salt water, whether natural or man-made. "Overland Water" means water that accumulates upon or submerges land which is usually dry resulting from: 3. LIMITS Overland Water Maximum Coverage: Homeowners - The total sum of Coverage A, B, C and D. Tenants - The total sum of Coverage C and D. Condominium - The total sum of Coverage C, D, Unit Improvements and Betterments, Unit Additional Protection, and Loss Assessment Coverage. The detailed list is too lengthy to publish but is indicated by the Overland Water Zone. Zone 1 9 Overland water risk is normal. Zone Overland water risk is high. Zone Overland water risk is very high and coverage is not available. ELIGIBILITY The risk must not be located in a Very High Risk Overland Water Zone The risk is not in an area named in a government flood warning until 30 days after that warning has ended. The buildings must not be located within 100 meters (328 feet) of any river or other flowing water with a usual width of 5 meters (16.5 feet) or more. An exception will be allowed if the lowest level of the buildings has an elevation at least 10 meters (33 feet) above the usual water level. The buildings must not have a reverse slope driveway (sloping downward to the dwelling) and must not have a below-grade garage. The risk must meet all eligibility for the Sewer Backup Endorsement. A fully completed and signed Sewer Backup Questionnaire is required (including questions on reverse slope driveway and distance from a river) for High Risk Overland Water Zones (Zones 10-12). 14 PROPERTY - MISCELLANEOUS OVERLAND WATER SECTION ANNUAL COVERAGE REQUIREMENT The Overland Water Endorsement premium represents an average annual risk level and must not be removed and re-added on a seasonal basis. If the Overland Water Endorsement is removed, it must not added back for at least 12 months. POST CLAIM ALL TERRITORIES New Business If there has been one past loss or occurrence at the location we are insuring, the risk must be referred to confirm eligibility. Any risk with two or more losses at the same location we are currently insuring is not eligible for overland water coverage. Renewal If there has been one loss risk must be referred to the company to confirm continued eligibility. 15 PROPERTY - MISCELLANEOUS - PERSONAL LIABILITY SECTION PERSONAL LIABILITY Comprehensive Personal Liability coverage extends only to the Named Insured as defined in the policy wording however, the following additional interests may be considered: a. with an additional charge - other residents of the Insured's household; b. without an additional charge: i. Municipal Corporations, insofar as the existence of a receiving set television aerial is concerned, which require, as a condition precedent to the issuing of a permit for the erection of a receiving set television aerial, Bodily Injury and/or Property Damage Liability Insurance which provides indemnity in respect of the liability of the Municipal Corporation. ii. Municipal Corporations which engage in the care and removal of trees from the premises of individuals where such corporations require, as a condition precedent to the care and removal of such trees, Bodily Injury and/or Property Damage Liability Insurance which provides indemnity in respect of the liability of the Municipal Corporation arising from these operations. iii. Provided the coverage is restricted to the ownership, maintenance or use of the premises in which they have an insurable interest: A. Co-owners of the premises; B. Agents of the Insured, having care, custody or control of the premises described in the policy; C. Persons, firms or corporations financially controlling or controlled by the Insured; D. Estates or living trusts and the executors, administrators, trustees or beneficiaries thereof; E. Bankrupt estates and mortgagees, assignees or receivers thereof; F. Loan associations or similar institutions when an interest in the property is retained under a conditional sales agreement. NOTE: If the Insured s primary residence is located outside Canada, Comprehensive Personal Liability will be restricted to premises only coverage. Aviva Insurance offers the following Liability limits: $1,000,000 $2,000,000 $3,000,000 $4,000,000 $5,000,000 NOTE: Liability premiums vary by individual risk characteristics and will be determined when the policy is uploaded. The standard limit for package policies is $1,000,000. The standard limit for non-package policies is $500,000. An additional premium will be charged for Liability coverage or to extend Liability from existing coverage, subject to the following premiums: Additional family (or families) Additional residence (or residences) owned or occupied by the Insured Incidental Office in the Principal Residence Babysitting or Day Care by Insured Not more than 5 children at any one time (including Insured s children) Incidental school or music lessons by Insured Not more than 3 students at any one time Watercraft Solar Power Generation Wind Turbine Power Generation Ontario D 7 Aviva Insurance Company of Canada Nov. 1 / Dec. 1, 2010(R 1)

16 PROPERTY - MISCELLANEOUS - PERSONAL UMBRELLA SECTION PERSONAL UMBRELLA Personal Umbrella coverage applies worldwide and supplements the required $1,000,000 primary coverage on private passenger rated Automobile (including Family Protection Endorsement OPCF #44 if provided by the primary coverage), Comprehensive Personal and Watercraft Liability policies. The limits available are $1,000,000 to $5,000,000. The Personal Umbrella Policy also provides first dollar Liability coverage not normally provided by the primary policies (subject to a $250 deductible). For example: Personal Injury - libel, slander, false arrest, wrongful eviction and defamation of character, etc. Watercraft - coverage beyond that which is normally provided by the Comprehensive Personal Liability form, if primary insurance is in force and specified in the Declarations. Liability assumed under a personal contract - written or oral. Legal Defence costs are covered from the first dollar when coverage provided by the Personal Umbrella Policy is not insured by the primary policies. OTHER FEATURES Automatic coverage provided for additional exposures acquired by the Insured after the policy inception date. Extensions of coverage to officers or members of non-profit organizations (excluding condominium corporations or associations) Excess automobile coverage is provided outside Canada and the United States of America subject to a primary limit requirement. PRIMARY INSURANCE The failure of the Insured to maintain the proper primary coverages will not invalidate this policy, but the Insurer will only be liable to the same extent as if the proper primary coverages had been maintained. 17 PROPERTY - MISCELLANEOUS - PERSONAL UMBRELLA SECTION BROKER BINDING AUTHORITY Under the following conditions, Personal Umbrella coverage may be bound by the broker for a maximum of $5M in excess of $2M. It is submitted with a fully completed and signed application in the name of an individual. All underlying coverages are insured for a minimum of $1M Liability and in the name of the same applicant as listed on the Personal Umbrella application or their spouse. There is no home based business in any insured residence. There have been no liability claims in the past 5 years, whether payment was made or not. Principal driver of all vehicles must be licensed a minimum of 5 years, with no accidents in the past 5 years and maximum of 1 minor conviction by each driver. Occasional drivers must be licensed a minimum of 3 years, with no accidents in the past 3 years and maximum of 1 minor conviction by each driver. All underlying private passenger rated automobile policies include an OPCF 44 endorsement No person defined as an insured under the policy may be a professional entertainer, broadcaster, television personality, professional athlete, high profile politician, labour leader. No person defined as an insured under the policy has ever been sued for libel or slander. No more than 1 rental property with a maximum annual gross income of $20,000 per year. No one insured under this policy owns any aircraft whether powered or not. No property located outside Canada. No property in multiple names other than the Named Insured and spouse. All risks must meet eligibility criteria for Aviva Insurance to qualify for Personal Umbrella coverage. Application Only a fully completed and signed application will be considered. With the Automatic Coverage policy feature, the coverage should be reviewed annually, and a new application is required every three years. Coverage over $5 million must be referred to the Company and coverage is not in effect until approved by the Company. Automobile Liability for two private passenger rated automobiles owned, leased or regularly used by the Insured (including private passenger vehicles owned, leased or registered in a Company name when used by Insured for personal use).
