1 NOTICE OF REQUEST FOR PROPOSALS (RFP) COMMUNICATIONS HILL LANDSCAPE MAINTENANCE FEBRUARY 26, 2010

2 COMMUNICATIONS HILL LANDSCAPE MAINTENANCE INSTRUCTIONS: The purpose of this Addendum is to; 1. Answer question submitted by participating company. 2. Amend Attachment A titled Scope of Services to include additional area for landscape maintenance. 3. Amend Attachment B titled Compensation to include additional area for landscape maintenance. QUESTION 1: Can the City provide proposers with the current landscape maintenance costs for the areas described in this RFP? ANSWER Q1: The District 8 Communications & Dairy Hill locations are new areas of responsibility that the City s Department of Transportation has been assigned. Currently they are being managed under a temporary service order on a Time & Material basis. We cannot provide an exact weekly or monthly charge at this time. 4. Attachment A titled Scope of Services is amended by adding the following items: a. Section 1.2 titled Landscape s is amended adding Section titled Detention Basin. b. Section is amended to read, Litter and debris removal, including graffiti removal (to include Detention Basin). c. Section is amended to read, Irrigation system maintenance (to include Detention Basin). d. Section is amended by adding the following sections; i. Section Detention Basin 1. Section Mow once per week or once per very 2 weeks per seasonal needs and upon approval of project manager. 2. Section Mow play field and surrounding non-mow grass, walking path and tree/shrub plantings. 5. Attachment B titled Compensation is amended per the attached Revised Attachment B. Participating companies are to complete this form and submit as their Proposal per the instructions outlined in the RFP, Section 11.2.

A fully burdened cost is defined and includes wages paid employee, general & administrative costs, workers compensation, liability insurance, FICA, SUDA/FUDA, employee benefits, vacation & holiday, and all tools and vehicles to be used on work assignments. The City has estimated the annual square footage for each classification in Sections 1 5, estimated hours for Section 6a & 6b, and estimated usages for Section 6c. Proposers are to multiply their cost per each lines estimated usage to arrive at an estimated. 1.2 PROPOSAL COSTS: 1. PAYMENTS/INVOICES All Payments are based upon City s acceptance of Contractor s performance of Landscaping Services as documented in Attachment A, Scope of Services, and as evidenced by successful completion of the deliverables per specifications. City shall have no obligation to pay unless Contractor has successfully completed and City has approved the services for which payment is due. City shall pay Contractor s services on a monthly basis thirty days (Net 30) after receipt of an acceptable invoice for work approved by City s Director. Contractor is to submit invoices once per month for specified services. Supplemental work may be billed on a semi-monthly (twice per month) basis. 3. OPTION RENEWAL RATE INCREASE (CPI) Any increases in rates/prices shall be reviewed on the anniversary date of the agreement and will be governed by the Consumer Price Index (CPI) for the San Francisco, Oakland, San Jose area, published by the U.S. Department of Labor, Bureau of Statistics. The City in its sole discretion must approve all increases. NOTE: Increases shall not exceed 5% of the previous years pricing. All increases must be approved by the City. The City reserves the right to not grant increases. 3.1 CPI Adjustment :The Contractor s compensation rates may be subject to adjustment on each anniversary of the performance period. The City in it s sole discretion may or may not approve an increase in compensation rates. The adjustment shall be calculated as follows: A. The base for computing the adjustment shall be the percentage of increase from the Consumer Price Index for Urban Wage Earners and Clerical Workers (with a base year of =) for the San Francisco-Oakland-San Jose area, published by the United States Department of Labor Statistics ( Index ), which is published most immediately preceding the commencement of the applicable extension term ( Extension Index ), shall be compared with the Index published most immediately preceding the commencement date of the then expiring term ( Beginning Index ). If the Extension Index published has increased over or decreased under the Beginning Index, the monthly compensation rates for the extension term shall be set by multiplying the then expiring term s monthly compensation rate by a fraction, the numerator of which is the Extension Index and the denominator of which is the Beginning Index. Upon adjustment of the monthly compensation rates, the parties shall immediately execute a written amendment to the Agreement setting forth the new monthly compensation rates, and attach the same as a revised exhibit to the Agreement. B. If the Index is changed so that the base year differs from that used as of the month immediately preceding the Agreement s commencement date, the Index shall be converted in accordance with the conversion factor published by the United States Department of Labor, Bureau of Labor Statistics. If the Index is discontinued or

7 REVISED ATTACHMENT B COMPENSATION revised during the term of the Agreement such other government index or computation with which it is replaced shall be used in order to obtain substantially the same result as would be obtained if the Index had not been discontinued of revised. C. The preceding provision of this Section notwithstanding, the adjustment of any monthly compensation rate for any extension term shall not exceed 5% of the previous term s monthly compensation rate. D. For the purpose of illustration only, if a Beginning Index is 115 and the Extension Index is 124, the monthly compensation rate to be paid during the extension term shall $ X (the then expiring term s monthly compensation rate) multiplied by 124/115.
