1 These are the terms and conditions, which apply to your trip. Payment indicates that you are bound by, and acknowledge that you have read, understood and will comply with all booking requirements and conditions. It is agreed by and between the passenger(s) and HEE Travel that all disputes and matters whatever arising under, in connection with or incident to this agreement shall be litigated, if at all, in and before a court located in the County of Monmouth, State of New Jersey, USA to the exclusion of courts of any other city, state or country. Booking / Acceptance By making a reservation, you have agreed to accept the Terms & Conditions herein. HEE Travel accepts a booking with the understanding that full payment has been collected and held by HEE Travel. On confirmation of your booking, HEE Travel will reserve your place on your selected tours. It is your responsibility as the customer to check the accuracy of your booking and travel dates on receipt of your travel documents. Deposit and final payment Deposit: 50% deposit of LAND price or minimum $200 per person (whichever is higher) is required when making your reservation.. If air ticket is required on itinerary, 100% of AIR ticket payment must be received upon reservation. In the event that the deposit does not reach us within 10 days after the booking is made, we assume that you no longer wish to travel with us, and we will release any arrangements reserved for you. The booking becomes a contract at the time you make your deposit. Final Payment: Final payment must be received no later than 45 days prior to your departure. Final payment will be charged directly to the credit card we have on file. If HEE Travel doesn't receive your final payment 45 days before departure, we reserve the right to cancel your reservation and charge cancellation fees accordingly. A $100 per person late payment fee will be applied to your invoice if final payment is not received 45 days prior to the departure day. If the booking is made less than 45 days before departure, the full amount must be paid when booking the tour. 1 / 6

2 Air Ticket: Full payment per person is required, if your requested air tickets are to be issued by the airlines before the due date of the final payment. Terms and conditions vary by airline, please refer to airline s website for details. Cancellation Policy Notification of all cancellations must be made in writing and sent to HEE Travel. If a written cancellation is received by HEE Travel more than 60 days prior to departure, half of the deposit or $100 (whichever is higher) will be forfeited. For cancellations received less than 60 days prior to departure, 75% of the deposit or $200 (whichever is higher) will be forfeited. Full payment must be received 45 days prior to departure and it is 100% non-refundable for cancellation or no-show. Air tickets are 100% non-refundable. Traveler is advice to buy Travel Insurance which includes cancellation for any reason. Please consult one of our representatives for such Travel Insurance. If you must cancel for a reason that is covered by your travel insurance, please contact your travel issuer. HEE Travel holds no responsibility for any travel insurance claims. Amendment fees A fee of $50 per transaction may apply for any alteration or amendment to a confirmed reservation that you request. Airline penalties may also apply. A name change for a traveler requested after air tickets have been issued will be treated as a cancellation, and cancellation fees will apply. Insurance Travel Insurance is highly recommended. There is no medical insurance or cancellation insurance coverage included in the tour price. We strongly recommend that you take out comprehensive insurance to cover trip cancellation, medical expenses, personal accidents, personal baggage loss, money loss, and public liability before you travel. Please consult our agents to learn about and purchase additional insurance. Baggage is carried at the owner s risk, and baggage insurance is recommended. HEE Travel accepts no responsibility for costs that may occur as the result of a participant failing to secure adequate insurance coverage, which coverage is highly recommended. 3 The cost of passports, visas, unscheduled meals and interstate travel from any place to your departure city are not covered in the price of your tour. Tips, including those to your tour manager (national guide), tour driver, or local city guides and gratuities on cruise ships are not included. In addition, the cost of laundry, beverages, travel insurance, excess baggage fees, and all other items of a personal nature are not covered in the price of the tour. Domestic Air ticket price is subject to change until ticket has been issued and tour prices based on current exchange rate and subject to currency fluctuations. Special/Independent Tour Arrangement If you, or your agent, have made independent travel arrangements, you accept responsibility for joining our tour or arrangements independently and on time. We are not able to refund monies paid to us, or any third party acting on our or your behalf, or make compensation or other payments where, for whatever reason, you fail to join our tour or any arrangements made by us. When you book arrangements with us, you accept responsibility for the proper conduct of yourself and your party. If your actions or omissions cause damage to any property in the provision of the contracted arrangements, or cause delay or diversion to any fight or other means of transportation, you agree to pay any charges incurred. Travel Documents & Visas A Passport with a minimum of seven months validity from the intended date of travel is required for travel for all countries in our program. Should your visa application be refused for any reason, you may be liable for the full loss of the booking deposit. HEE Travel is not responsible for the rejection of a traveler s entry by immigration and custom officials, even if the tour participant holds a valid passport and proper visas. Tour costs cannot be refund or forwarded in these circumstances. For the most up-to-date requirements please check with the website of China Embassy. Baggage 3 / 6

4 Free allowances, limits, and additional charges for checked and carry-on baggage may apply and vary by airline, frequent flyer status, booking class, destination (e.g., baggage allowance differs for the transpacific and China/Inter-Asia sections of your tour), bag size and weight. Refer to the airline's website for details on their checked and carry-on baggage rules. Baggage allowances and charges are subject to change. We strongly recommend baggage insurance as HEE Travel does not assume any responsibility for loss or damage to baggage or passenger's belongings. It is at passenger's risk throughout. For the most up-to-date requirements please check with your air carrier prior to your flight. Baggage is carried at the owner s risk, and baggage insurance is recommended. Responsibility HEE Travel, as tour operator, acts only as an agent. All travel arrangements included in a trip are made on behalf of the participants with the express condition that neither HEE Travel nor its agents shall be held liable or responsible in the absence of negligence for any direct or indirect consequence, or irregularity of any kind, which may be accessional by reason of any act or omission of any person or entity, including without limitation, any act of negligence or breach of contract of any third party such as an airline, train, motor coach, private car, cruise vessel, boat, or any other conveyance, hotel, sightseeing provider, local ground handler, etc., which is to or does supply any goods or services for this trip. Participant understands that HEE Travel neither owns nor operates such third party suppliers and accordingly agrees to seek remedies directly from and only with those suppliers and not hold HEE Travel responsible for their acts, omission or commission. If the services included in the tour cannot be supplied or there are changes in an itinerary for reasons beyond the control of HEE Travel, HEE Travel is not responsible for payment of any expense caused thereby; expenses will be payable by tour participants. Without their limiting the foregoing, HEE Travel and its agents are not responsible for any losses or expenses due to delay or changes of schedule, overbooking of accommodations, default of any third parties, sickness, weather, strike, acts of God, acts of terrorism, force majeure, acts of governmental civil disturbances, natural disasters, fires, governmental and local authority's orders, a political change, war, quarantine, customs regulations, epidemics, criminal activity or for any other cause beyond its control. All losses or expenses attributable to such occurrences must be paid for by the participant. HEE Travel is not responsible for personal injury, property damage or other loss a passenger incurs on any tour arising from acts or omissions by any air carrier, public transport company, 4 / 6

5 hotel, car rental company, subcontractor or other person or organization, whether or not such company is rendering any services supplied on the tour. All tickets and vouchers are issued and supplied subject to the foregoing and to all terms and conditions under which transportation and services are provided. HEE Travel is not responsible for the rejection of a traveler s entry by immigration and custom officials, even if the tour participant holds a valid passport and proper visas. Tour costs cannot be refund or forwarded in these circumstances. Although HEE Travel will be happy to assist you with any shopping needs, HEE Travel accepts no responsibility for value, reliability, quality, authenticity of any goods purchased, or services contracted for during the tour while on tour or for any mailing, freight or shipping arrangements. HEE Travel reserves the right to accept or reject any person as a tour participant, to expel any tour participant from the tour, to make changes in the itinerary whenever HEE Travel deems it necessary for the interest, the comfort, convenience, or safety of the tour participants, or to cancel a tour at any time. All tour participants must be physically and mentally for traveling. Each participant is responsible for their own health. In the event that a tour participant has a serious illness, is not suggested for travel to China. HEE Travel will not undertake any legal obligation related to participants' health conditions. In general, tours in China are quite active and require a good deal of walking, frequently including stairs. Tibet & Shangri-la in Yunnan requires travel into areas of high altitude and with extreme temperature fluctuation. We strongly recommend that you discuss any health concerns regarding these points with your personal physician. Additional Assistance: In order to ensure the smooth operation of the tour for all group members, any traveler requiring special assistance must be accompanied by an adult who is responsible for providing all such assistance. HEE Travel is under no obligation whatsoever to provide any special assistance. You are required to notify HEE Travel, in writing, prior to the time of booking of any physical disability or medical condition which may require any special assistance during the tour. Please note that for the physically challenged, access to some facilities may not be available at the same standard as in the U.S. HEE's tour directors and their designees reserve the right to exclude passengers from participating in tours if, in their sole discretion, they believe that the tour may be challenging to the passenger or could detract from the full enjoyment of the other tour participants. HEE Travel reserves the right to decline to accept, or retain any person as tour participant, should such person's health, mental condition, physical infirmity or general deportment impede the operation of the tour or the rights, welfare, or enjoyment of other tour participants. Currently, vaccinations are not required. As health requirements change without notice, please check with your personal physician or public health 5 / 6

6 service for current required or recommended inoculations. The carriers, hotels and other suppliers providing tour services are independent contractors and are not agents, employees, or servants of HEE Travel or its affiliates. Nor are any of them considered to be involved in joint ventures with HEE Travel. All certificates and travel documents for tour services issued by HEE Travel are subject to the terms and conditions specified by the suppliers and to the laws of the countries in which the services are supplied. HEE Travel reserves the right to substitute hotels and alter the itinerary, withdraw any tour and make any desirable alteration for the convenience of the operation of tours. The HEE Travel ground operator has sole and exclusive control over the operation of all tours in China. Neither HEE Travel nor any subsidiary or affiliate of HEE Travel shall be responsible for any such alterations made by HEE Travel the ground operator. HEE Travel is not responsible for typographical or printing errors or omissions on the website, in this brochure or any of HEE Travel s marketing materials, including virtual and printing materials. The general conditions under which you agree to utilize the services of HEE Travel may not be amended in any way, except in writing, by an authorized officer of HEE Travel. By utilizing the services of HEE Travel you agree that the exclusive venue for all claims shall be the County of Monmouth, State of New Jersey, and such claims shall be determined according to the laws and jurisdiction of the state of New Jersey.
