3 1) DESCRIPTION AND LOCATION OF WORK The work shall consist of roadside mowing throughout the County of Haliburton. The bidder shall supply all labour, materials and equipment required to complete the roadside mowing. A county map of roads to be cut will be provided as part of this quotation document. The mower shall be equipped with four-way flashers as well as a 360 o flashing/rotating amber beacon. The equipment used is subject to inspection by the Operations Manager (or designate) to ensure suitability for the work. The minimum cutting swath accepted shall be 1.5 m (5 ft). A boom mount, rear swing mount or side mount mowers either rotary or flail type may be used as long as the cutting swath stated above is adhered to. 3 of 6
4 3) BID PRICE The bidder will provide a rate per lane kilometer and is advised that total lane kilometers are estimated and are not guaranteed. 4) RIGHT TO ACCEPT AND REJECT QUOTATIONS Lowest or any Quotation may not necessarily be accepted. 5) BIDDERS TO INVESTIGATE Bidders must satisfy themselves by personal examination of the geographic area and by such other means as they may prefer as to the actual conditions and requirements of the work. 6) SCHEDULING OF WORK Work shall commence the first day of the second full week of June 2015/2016 and must be completed no later than the last day of the third full week in July of same year. Daily schedules of work will be coordinated with the Operations Manager or his designate. 7) TRAFFIC CONTROL The Contractor s bid price shall include all costs for labour, materials and equipment to provide traffic control for the Contract. Traffic control will be in accordance with the requirements outlined in the Ontario Traffic Manual Book 7 (Temporary Conditions). 8) INSURANCE REQUIREMENTS The Contractor covenants and agrees to indemnify and save harmless the Owner from and against any and all claims for loss, costs, damages and/or compensation and legal expenses the Owner may incur as the direct or indirect result of the work operation described herein being carried out by the Contractor. The Contractor shall secure and maintain at his/her expense during the currency of this Contract, general comprehensive liability insurance in an amount not less than two million dollars ($2,000,000.00), naming The Owner and its Agents as an additional named insured. The Contractor shall submit proof of such insurance in the form of a certificate from his/her insurance company prior to commencing work on the Contract. The Contractor shall upon the award of this Contract and prior to commencement of the work, furnish evidence of coverage under the Workplace Safety and Insurance Board. 9) PAYMENT AND WARRANTY Payment will be made in response to the Contractor s invoice at the completion of the Contract. This payment will be made when all work has been completed to the satisfaction of the Operations Manager. Payment to the Contractor shall be verified from measurements and/or records taken by the Operations Manager or his designate. 4 of 6
5 The Contractor shall be responsible for the proper performance of the Work only to the extent that the design and specifications permit such performance. The Contractor agrees to correct promptly, at his own expense, any defects or deficiencies in the work. The Operations Manager shall promptly provide the Contractor with written notice of observed defects and deficiencies. 10) COMPLIANCE WITH THE OCCUPATION HEALTH AND SAFETY ACT Clause GC of the O.P.S. General Conditions of Contract is deleted and replaced by the following: The Contractor shall execute the terms of the Contract in strict compliance with the requirements of the Occupational Health and Safety Act and Regulations for Construction Project, RSO 2000, c.0.1 (the Act) and Ontario Regulation 527/00 (Construction Projects) and any other regulations under the Act (the Regulations) which may affect the performance of the Work, as the Contractor or Employer, as the case may be. The Contractor shall ensure that: a) worker safety is given first priority in planning, pricing and performing the work; b) its officers and supervisory employees have a working knowledge of the duties of a Constructor and Employer under the Act and the provisions of the Regulations applicable to the Work, and a personal commitment to comply with them; c) workers employed to carry out the Work possess the knowledge, skills and protective devices required by law or recommended for use by a recognized industry association to allow them to work in safety; d) its supervisory employees carry out their duties in a diligent and responsible manner with due consideration for the health and safety of the workers; and e) all subcontractors employed by the Contractor to perform part of the Work and their employees are properly protected from injury while carrying out their associated duties. The Contractor shall cooperate with representatives of the Owner and inspectors appointed to enforce the Act and the Regulations in any investigations of worker health and safety in the performance of the Work. The Contractor shall indemnify and save the Owner harmless from any additional expense which the Owner may incur to have the Work performed as a result of the Contractor s failure to comply with the requirements of the Act and the Regulations. 5 of 6
