HSE Fundamentals - Minimum Requirements 1.1 Principles The contracting entity s corporate principles on workplace and environmental protection place the highest priority on protecting the life and health of employees and are aimed at preventing physical and psychological injury to persons while at work. These principles seek to continuously improve job safety and health protection as well as environmental protection. The contractor will observe these principles when performing work. This relates to the safety of all employees of the contracting entity as well as employees of the contractor, including its sub-contractor chain located at the production facilities and construction sites of the contracting entity. Work performed at the customer (such as metre reading, consultations) is to be considered the same as activities performed at construction sites. In addition, environmental protection and the economical use of resources are also considered core objectives. When performing work, negative impacts on the environment and environs should be limited to the absolute minimum necessary. Each instance of non-compliance with the provisions of HSE minimum requirements will be penalized and can result in expulsion from the contracting entity s production and construction sites. These and the following rules are binding for all personnel that the contractor employs or contracts with in fulfilling its obligations to supply goods and render services, i.e., including for employees of its sub-contractors as well as their sub-contractor chain. These HSE minimum requirements do not release the contractor from its obligation to comply with the applicable statutory requirements and to ensure their implementation. 1.2 Scope The HSE minimum requirements apply to all work as well as transport services at the contracting entity s production facilities and on the contracting entity s construction sites. Supplementary to the provisions of the HSE minimum requirements, the requirements of the Construction Site Ordinance shall apply to construction sites, subject to the scope of work to be performed and the number of personnel involved. In addition, supplementary to these HSE minimum requirements, additional project/site-specific HSE requirements may also be applied upon awarding of a contract. 1.3 Mandatory implementation Compliance with the provisions stipulated in these HSE minimum requirements shall be monitored by both the contracting entity and the contractor. When performing work, the contractor agrees to comply with all statutory requirements, in particular workplace safety and health regulations. The contractor shall ensure compliance with accident prevention regulations and any rules made known to him by the contracting entity. Likewise, when utilizing equipment it shall be ensured that the proper type of equipment is used and that statutory regulations and technical rules are observed.

4 Instructions of the contracting entity shall be obeyed. Each contractor shall ensure that when work is being performed at least one German-speaking supervisor is present for each trade and shift. This person shall be identified by name to the contracting entity prior to commencing work. The contracting entity retains the right to issue specific instructions and notifications within the course of organizing larger projects as work progresses which the contractor shall ensure are announced to and observed by its employees. The same applies to the use of safety and technical forms customary for the contracting entity s production facilities and construction sites. Prior to commencing work, each contractor shall instruct his employees in the provisions of these HSE minimum requirements and applicable instructions material to his delivery of goods and services and is responsible for implementation and compliance with the same. This instruction and awareness of the relevant content shall be documented in writing by the contractor s employees. Proof of instruction shall be provided to the contracting entity s point-of-contact prior to commencing work. The instruction must be provided in a manner that is understandable to the employee and shall be conducted on a regular basis (how often instruction must be repeated will be specified on the basis of the contractor s risk assessment). Prior to commencing work, the contractor shall verify the receipt and acceptance without reservation of these HSE minimum regulations by signing the contract and shall submit all supporting documents requested by these HSE minimum requirements. In addition, the contractor agrees to comply with all workplace safety and accident prevention regulations as well as to assume responsibility for safety, orderliness, cleanliness and environmental protection in its work area. If the contractor declines to accept these HSE minimum requirements without reservation, the contracting entity retains the right to refuse to permit the contractor to commence work. Any costs incurred therefrom, e.g. standby periods / work stoppage / leasing costs for tools, cranes, etc., shall be borne by the contractor. 1.4 Reducing Risk Potential, Coordination, Work Scheduling with Safety Measures Risk Assessment Pursuant to the Workplace Safety Act (ArbSchG) as well as associated regulations, risk assessments shall be prepared for all work assignments (e.g. construction, assembly, operation, repair and demolition) and upon request submitted to the contracting entity. Following evaluation of the risks identified, a work schedule for each trade shall be defined and implemented with safety goals for the systematic reduction of potential hazards. The goal is to avoid accidents and near accidents as well as to prevent negative impacts on the environment and environs. Coordination The requirements of the German Statutory Accident Insurance Association (DGUV), Rule 1 (DGUV V1) and the Workplace Safety Act (ArbSchG) relating to coordination shall be clarified in coordination between the contracting entity and the contractor before commencing to work and, if needed, set down in writing. The designation and appointment of coordinators (one or more) for certain jobs must be in writing.

5 In selecting these persons, particular attention should be given to their professional and personal suitability as well as any knowledge of the production facility, construction site or local area that may be required. In exercising this coordination function, the respective freedom to issue instructions and coordination authority shall be guaranteed by the contractor. The work schedule with safety measures that is to be prepared by the contractor prior to commencing work shall meet the basic requirements of DGUV V1. The contractor shall enclose all relevant documents needed to evaluate the work schedule with safety measures. 1.5 Suspension of Work During Acutely Hazardous Situations Should an acutely hazardous situation arise while work is being performed, work shall be immediately suspended and the hazard promptly eliminated. Work may not recommence until all unsafe conditions have been eliminated. All costs arising from the suspension of work due to hazardous situations which the contractor is responsible for shall be borne by the contractor. 2. Provisions of the HSE Minimum Requirements 2.1 Requirements Affecting Contractor Employees Contractor employees must be professionally and personally suited for work at the production facilities and on the construction sites of the contracting entity. Responsibility for ensuring such suitability as well as for providing proof of such suitability resides with the contractor. The contractor agrees to ensure that communications with all parties involved is in the language appropriate to the project/construction site. Contractor personnel who are not yet 18 years of age may perform work only where such has been expressly agreed with the contracted entity and does not violate provisions of law. All training, directions and instructions relating to contractor duties and tasks shall be provided in a language intelligible to the employees and made available in written form. All management and supervisory personnel responsible for work to be performed within the scope of the contract as well as the contractor s security personnel shall be identified by name to the contracting entity. 2.2 Workplace Safety Requirements Affecting the Contractor Only those contractors will be retained that have been successfully pre-qualified by the contracting entity with respect to the work to be performed and the risks associated therewith. The contractor is encouraged to structure the occupational safety organisation in accordance with SCC or BS OHSAS 18001:2007 (prospectively ISO 45001).

6 The contracting entity may stipulate additional requirements relating to the project/construction site Commissioning of Sub-Contractors In awarding work to sub-contractors, the contractor shall comply with 8 ArbSchG [Workplace Safety Act] as well as 6(1) DGUV V1 Principles of Prevention". The HSE minimum requirements also apply completely to the whole sub-contractor chain. The contractor agrees to notify his subcontractors in writing of the standards set forth in these HSE minimum requirements and to monitor and implement them accordingly. The contractor must have the contracting entity approve subcontractors Temporary Employees A contractor that hires temporary staff on the basis of the Temporary Employee Act (AÜG) is fully responsible for workplace safety for these temporary employees for the term of their assignment. The contractor shall treat persons hired as temporary employees as if they were his own employees. Statutory/insurance-related reporting obligations are the responsibility of the contractor Accident and Damage Reporting All incidents (workplace accidents, near accidents, unsafe conditions and activities, property damage, environmental damage, etc.) shall be promptly reported to the contracting entity. Documentation shall be coordinated with the contracting entity s health and safety officer (SiFa). Certifications of First Aid treatments shall likewise be made available to the contracting entity. Property damage of any kind at the expense of the contracting entity that occurs in the contractor s work area or for which the contractor bears responsibility or which the contractor identifies shall be promptly reported. In accordance with the duty to minimise damage, immediate measures shall be coordinated with the contracting entity and faciliated. In order to avoid future personal injury and environmental damage, a careful analysis of occurred accidents and near accidents is required for the purpose of identifying potential improvements. The contractor therefore agrees to cooperate and assist the contracting entity with accident investigations or to provide the contracting entity with the findings of its own accident investigation. It should be emphasised that findings of accident investigations are not used to evaluate the contractor but instead serve solely to improve workplace health and safety as well as environmental protection Involvement in Environmental and Energy Management The contractor actively participates in avoiding negative environmental impacts and in increasing environmental performance and energy performance in accordance with the environmental and energy goals and policies announced by the contracting entity. The contractor shall endeavour to execute the assignment in a manner that makes efficient use of resources and energy. Avoidable energy consumption shall be prevented, e.g. by switching off unneeded consumers. Negative impacts on energy and resource use of the contracting entity shall be avoided.

7 The contractor shall report to the contracting entity observations of unanticipated environmental impacts or circumstances that result in energy loss, such as leaks or defects. Recommendations for improving energy efficiency or for avoiding environmental impacts shall be communicated in the same manner Instruction/Training Prior to commencing work, the contractor shall receive safety information relevant to the activity it is to perform. The training that the contractor is responsible for conducting shall also be monitored by the contractor for effectiveness. Monitoring effectiveness can be accomplished by the contractor on a random basis in the course of inspections and/or by posing questions Access Regulations Documents for identity control (identification by personal ID) as well as documentation required by social insurance law shall be kept on site by the contractor for all contractor employees so that it is available at all times. The contracting entity shall be allowed to inspect these records at any time. Unauthorised access to work areas and operation of switches and controls is forbidden. It shall in principle be refrained from driving vehicles on production facilities and construction sites of the contracting entity. Case-by-case exceptions under special circumstances (transportation of tools, measurement devices, materials, etc.) must be approved by the contracting entity Accommodations/Common Areas Daytime accommodations and other common areas must be made available and operated in accordance with workplace guidelines. The contractor shall provide accommodations for its employees. The contracting entity shall provide the required supply and disposal capacities, e.g. for locating daytime accommodations, washrooms, toilets and other facilities, provided needs are coordinated in a timely manner with the contractor. The contracting entity retains the right to set up the common areas itself. Food and drink may only be consumed in the break rooms/zones assigned for that purpose. It is forbidden to live or stay overnight at the contracting entity s production facilities or construction sites Safety, Orderliness and Cleanliness All contractors are required to keep their work sites, storage facilities, depots and accommodations in a clean and orderly condition. All contractors shall ensure that leftover materials, construction waste, rubbish, packaging, etc. is promptly removed from their areas, however no less than once daily. Work areas in buildings are to be kept in reasonably clean (broom-swept) condition and production facilities and construction sites of the contracting entity (which include storage areas, workspaces, access routes) are to be kept and turned over in clean condition. Non-compliance will result in cleaning being done at the expense of the party responsible. All contractors are responsible for seeing that no flammable materials are stored in their areas that could be ignited by hot work.

8 The use of cables, wires, hoses, etc. may not present an accident hazard or obstruct traffic. Escape and rescue routes and hydrants shall be kept clear. All tools and materials shall be put away and stored securely after use. All tools and equipment shall be turned off or otherwise rendered safe immediately at the end of the work day as well as during break periods. Unless otherwise agreed by contract, rules on waste logistics and disposal that apply to the specific production facility or construction site shall be applied Withdrawal / Expulsion of Personnel from the Production or Construction Site The contractor agrees to replace personnel at its own expense if the contracting entity requests it on serious grounds, which include for example: Lack of qualification and experience on the part of contractor employees Non-compliance with instructions given by the contracting entity Theft Alcohol and drug abuse Serious or repeated violation of HSE regulations. Through the withdrawal/expulsion of personnel, the contractor is not released from the obligation to perform the agreed services or to adhere to agreed deadlines Prohibition of intoxicating substances, Smoking Rules Contractor employees are prohibited from consuming alcoholic beverages, narcotics and medications that affect reaction and perception capacity. Employees who are under the influence of such substances shall be prohibited from entering production facilities and construction sites or expelled from production facilities and construction sites. A general ban on smoking shall be in effect in enclosed spaces. In coordination with the contracting entity, the contractor may use company defined smoking areas Organization of First Aid Contingent on the scope of work performed and existing risks, the contractor shall provide a sufficient number of First Aid providers and set up or maintain a sufficient number of First Aid facilities. In coordination with the contracting entity, the contractor may, if necessary, draw on the company s First Aid organisation (if available). Additional internal emergency response measures of the contractor shall be made known to the contracting entity prior to commencing work as part of the workflow plan (opportunity for joint coordination). 2.3 Contact at Production Facilities and on Construction Sites The contracting entity and contractor agree to provide prompt, full and coherent notification of work-related events. This applies in particular to hazardous situations or damage.

9 The following outlines the basic communication channels. These shall be deviated from only in the event of imminent danger or where necessary after prior consultation with the contracting entity. The contractor is obligated to identify all personnel he employs (at a minimum all those who hold key positions) by name in writing and to communicate this information to the contracting entity. The contracting entity and the contractor shall reach agreement as to the expediency of designating deputies. 2.4 Materials and Equipment Tools and Accessories Tools and accessories shall be provided by the contractor for specific tasks, unless otherwise agreed by contract. Only suitable, approved and periodically tested tools and accessories may be used. The loaning of tools and accessories as well as accessory components and consumables from the contracting entity s stocks to contractor employees is not provided for and must be handled on a case-by-case basis Radio Communications, Mobile Phones If radio communications are used, the number and type of devices as well as the frequency employed shall be reported to the contracting entity, and authorisation to use the devices shall be obtained by the contractor. The contractor shall comply with postal and telecommunications regulations. Wireless connections (for controlling machinery and lifting equipment) must be registered with the contracting entity. Before these connections can be employed at the production facilities and construction sites, proof of registration and problem-free operation (no interference with other devices and equipment) shall be provided to the contracting entity. The use of mobile phones is prohibited when performing certain types of work (e.g. transport and control operations, directing vehicles, etc.). It is prohibited to bring mobile phones or radio devices into areas subject to explosion hazards.

10 2.5 Personal Protective Equipment (PPE) The contractor shall provide his employees with sufficient protective equipment and clothing on the basis of the protective measures stipulated in the risk assessment. The contractor is required to instruct his employees in the proper use of the equipment. Persons who lack PPE that accords with the regulations applicable to the production facility or construction site (such as a safety helmet/safety shoes/safety goggles/etc.) may not access the contracting entity s production facilities and construction sites. If owing to the specific work situation additional protective gear is needed (e.g. eye or face protection, hearing protection, breathing protection, high-visibility clothing), the contractor shall see that it is provided and properly used. After being given one warning, persons who fail to comply will be expelled from the contracting entity s production facilities and construction sites. Helmets worn by contractor employees must be labelled with the company name and the name of the employee. The loaning or supplying of PPE to contractor personnel from the contracting entity s stocks is in principle not provided for and must be handled on a case-by-case basis. 2.6 Work Permitting and Approval Process The contractor is required to participate in the work permitting and approval process for production facilities and construction sites. Work may not commence without a work permit (WP). Changes to status or clearances shall be undertaken exclusively by the responsible specialist with the contracting entity or by a person authorised by the responsible specialist for this purpose. A written work permit involving special safety measures (hot work permit, driving permit, scaffolding, etc.) is generally required to perform hazardous work. The responsible party with the contracting party shall be notified of commencement, suspension and termination of work. 3. Special Provisions of the HSE Minimum Requirements Prior to performing work of evident higher risk, immediately before commencing work the contractor employee responsible for the work shall conduct and document a risk assessment. The contractor shall undertake and adhere to the safety measures identified thereby. Special safety measures that require the cooperation of the contracting entity to be implemented shall be identified by the contractor. The contractor shall notify the contracting entity in writing before commencing the activity which high-risk tasks are to be taken into account in executing the activity. 3.1 Work involving a Falling Hazard Prior to commencing work, appropriate safety measures shall be taken by the contractor based on the risk assessment so that work at height can be performed safely. In adverse weather conditions - such as thunderstorms, strong winds, frost or ice hazard - work at height may not be performed.

11 Work involving a falling hazard / Work at height: Persons working at the following heights must be secured against falling: From 0.00 m above water or other materials in which one can sink 1.00 m or higher Workplaces and routes in which the distance to edge is more than 2.0 m lie outside the hazard zone for falls. 3.2 Crane Operation, Hoisting and Pulling Tasks The regulations of the employer s liability insurance association, including implementing instructions, apply to crane operation, hoisting and pulling tasks. The following provides examples of some of the basic issues involved: Persons are not permitted to stand under suspended loads. Load-handling equipment may not be used for transporting persons It is not permissible to ride on loads being hoisted by crane. It is not permissible to use lifting tackle or load-bearing equipment that does not have a load-capacity notice and visible and valid inspection sticker. Persons in hoistable personnel lifting devices must be secured against falling by using PPE. Before using a mobile crane, the contractor must present the inspection certificate for the crane as well as proof of qualification to perform crane and backstop work (Anschlagarbeiten). Verification of structural safety for the installation site / planned load shall be verified / provided by the contractor. A permit is required to perform work with a mobile crane. For work performed in proximity to high-voltage lines, crane hoisting and rotating movements are to be set so as not to exceed safety clearances. If necessary, the contractor shall install a rotation governor. In addition, the contractor shall earth each crane using an earthing device he provides. The appropriate conductor cross-section as well as permissible earthing points shall be coordinated with the contracting entity s relevant specialist on site. The aforementioned regulations apply mutatis mutandis for hoisting and pulling tasks. 3.3 Use of Mobile Elevated Work Platforms Persons in mobile elevated work platforms shall, where technically provided for, secure themselves against falling by using PPE. Mobile elevated work platforms may only be operated by trained persons specifically commissioned to perform this work. 3.4 Scaffolding Work The contracting entity s standard form shall be used for scaffolding approval and acceptance. Any time scaffolding is not available for use -- in particular while being assembled, disassembled or modified - the scaffolding shall be labelled at all access points and stairs with No Entrance signs

12 and appropriately demarcated with barriers that prevent access to the hazard zone. When assembling and disassembling scaffolding, erectors must wear and make proper use of PPE that protects against falls. Approved industrial safety helmets with chin straps must also be worn. 3.5 Electro-technical Work Equipment and supplies brought in by the contractor must be safe and tested and comply with applicable statutory requirements. A permit is required prior to commencing work in order to perform work on electrical systems. A separate written approval process is required for live-line work. The electrician-in-charge or the contracting entity may stipulate additional requirements and has decision-making authority in all electro-technical matters. Instructions of the electrician-in-charge relating to electrical safety shall be adhered to by all employees. 3.6 Hot Work, Fire and Explosion Protection If hot work must be performed, a hot work certificate (supplement to work permit) must be obtained from the contracting entity s facility management and appropriate safety measures must be taken. When performing welding work over gratings or on open platforms, fire-resistant covers must be placed on the areas below where welding is being done. Flammable materials shall be removed or properly covered (e.g. fire-control tarp). Appropriate procedures (incl. equipment) shall be employed when working in areas subject to explosion hazards. 3.7 Working in Containers / Confined Spaces When performing work in containers or confined spaces, special attention should be given to the safety of personnel who are performing such work. Access authorization with gas analysis is required. When performing work in containers and confined spaces and when working with breathing apparatus, at least one security guard must be stationed outside the hazard zone. The particular safety features of tools and equipment used in containers and confined spaces shall be noted. 3.8 Work with Angle Sanders The contractor shall take special safety precautions when planning, monitoring and executing cutting or grinding work using electric angle sanders. In supplement to specific restrictions regarding the use of angle sanders as derived from a tradespecific risk analysis and work flow plan (see Chap. 1.4), the following general restrictions also apply: Only properly instructed personnel who meet the requirements of the applicable standard are allowed to use angle sanders with grinding and cutting disks. All angle sanders must be equipped with a handle(s) that comply with statutory

13 requirements. All angle sanders must be handled with both hands. If this is not possible, a different tool must be used. Pursuant to statutory regulations, all angle sanders must be equipped with a safety hood for the disk. Angle sanders must be equipped with a kick-back stop. Angle sanders must be equipped with a brake that automatically stops the disk any time the trigger is released. Angle sanders may not have a lock-on switch. In connection with work associated with a falling hazard and the use of PPE to protect against falls, it shall be ensured that the use of angle sanders does not present a risk of causing damage to PPE (e.g. damage to the safety line or tether). Angle sanders used for cutting must be equipped with a cutting disk suitable to this task. Angle sanders may not be used for work with hazardous materials, e.g. working with asbestos or in proximity to hazardous substances, such as flammable solutions. Negative impacts on humans and the environment posed by sander dust shall be taken into account and kept to a minimum. The use of pneumatic angle sanders shall be kept to a minimum and requires the written approval of the contracting entity. If no other options are available, the contractor employee responsible for the work and contracting entity executive management must sign a prior approval. Prescribed basic protection includes wearing safety glasses and a face shield to protect the eyes and face from flying particles, close-fitting clothing with long arms and legs and closely-fitting gloves to provide for better grip and to protect hands from metal fragments and sparks. Deviations from the above are only allowed on the basis of a trade-specific risk analysis. 3.9 Working with Hazardous Substances Prior to commencing work, the contractor shall submit to the contracting entity all EC Safety Data Sheets and planned uses of hazardous substances it requires in order to fulfil its scope of supply and services in a timely manner. The risk assessments, directives and instruction document prepared by the contractor shall be posted in proximity to the trade (Gewerk) and shown to the contracting entity upon request. The directives prepared by the contractor shall be posted in the production facilities and construction sites. The use of carcinogenic, mutagenic or reprotoxic substances is not permitted. Storage of hazardous substances brought in by the contractor shall be coordinated with the contracting entity prior to commencing an activity.

14 Dusts and Fibres (AMF): Special requirements apply to the use of artificial mineral fibres" (AMF). The contracting entity shall undertake together with the contractor to classify mineral wool products (thermal load and the year the mineral wool was installed) Asbestos The contracting entity shall be promptly notified if materials containing asbestos are discovered while work is being performed. It shall be coordinated between contracting entity and contractor as to how to proceed Dealing with Dust or Dust-Like Substances Machinery and equipment shall be selected and operated so as to generate the least amount of dust possible. Dust-generating devices, machinery and equipment must be equipped with an effective vacuum device or the release of dust must be prevented by other means. For activities that involve potential exposure to dust, the propagation of dust to unaffected work spaces shall be prevented, dust deposits shall be avoided and any deposits that have accumulated shall be removed by damp or wet methods. Cleaning work areas using dry brooming or blowers is not permitted Dealing with Substances Hazardous to Water The use and storage of substances hazardous to water shall be coordinated with the contracting entity prior to delivery. Protective measures required by the WHG [Water Management Act] of the VAwS [Regulation on Facilities Using Substances Hazardous to Water] as well as local requirements shall be met Radiation and Hazards Associated with Non-Destructive Testing Work using radiation sources shall be reported in writing to the contracting entity 48 hours in advance. Proof of compliance with the X-Ray and Radiation Act shall be provided to the contracting entity. The work shall be conducted at a time when no one is in proximity to the area where the work must be performed. For work involving a radiation hazard, the affected area, including access to pipes, canals or the like within this area, shall be demarcated by barriers and warning signage intended specifically for this purpose. No persons may be in this restricted area other than those assigned to perform this work Transports Delivery Traffic Transports shall be via the access routes normally used for such purposes. Drivers shall be instructed prior to accessing the production/construction site by vehicle. Drivers shall be given the name of a contact person, with whom they must check in and check out.

15 Special or heavy transports shall be reported to the contacting entity. Deliveries shall take place only during regular daytime work hours. Routes used within the contracting entity s production and construction sites shall be kept clear. This applies in particular to emergency routes and work areas near hydrants. Traffic regulations applicable under the StVO [Highway Act] shall apply. The contracting entity can deny access for failure to comply. Suppliers may remain on the production and construction sites solely for the express purpose of providing delivery Driving in Reverse Backing up shall be avoided where possible. If backing up is necessary for operational reasons, it must be performed in such manner so that it poses no hazard to people or things. Each vehicle operator is therefore obligated to eliminate such hazards before operating the vehicle. The driver shall, in any event, proceed at walking speed. If 360º visibility is not provided, additional safety measures must be taken, e.g.: direction. The person providing directions must remain within the driver s field-of-vision and may not perform any other activity simultaneously. Use of back-up video systems Requirements for Transports with Tipping Trailers / Dump Trucks In addition to items and , the contractor is also responsible for the following: Preparation of specific risk assessments for transports as well as loading and unloading activities prior to commencing work. Preparation of operating instructions in cooperation with the contact person / contracting entity site manager prior to commencing work. Training / instruction of drivers with reference to the aforementioned documents as well as maintenance of training documentation prior to commencing work Use of Materials Handling Vehicles The contractor shall see that materials handling vehicles used at the contracting entity s production/construction sites meet all applicable regulations and, where applicable, the Road Transport Certification Regulation [Straßenverkehrszulassungsverordnung]. Materials handling vehicles may only be operated by trained persons specifically commissioned to perform this work. 4.
