2 Variances (a) Variances from the standards may be granted (b) To obtain a variance, a specific request must be made to OSHA Inspections Right of Entry (a) Authorized OSHA representatives shall have a right of entry to any site of contract performance for the following purposes: (1) to inspect or investigate for compliance with the OSHA standards

4 Scope (a) The regulations apply to the construction, alteration, and/or repair, including painting and decorating, that no contractor or subcontractor contracting for any part of the contract work shall require any worker to work in surroundings that are unsanitary, hazardous, or dangerous

5 Interpretation of Statutory Terms (b) no contractor or subcontractor shall require any worker to work in surroundings which are unsanitary, hazardous, or dangerous to health or safety (c) Subcontractor is any person or firm that agrees to perform any part of the labor or material requirements of a contract for construction, alteration or repair.

(c) A firm is a subcontractor if the contract involves furnishing of supplies or materials if the work involves the performance of construction work and satisfies the following conditions: 1. Work is performed directly on or near the construction site 2. A supplier is a subcontractor if the material supplied is of a customized basis specifically for a project (e.g., shop fabricated ventilation ducts) not supplying nails, structural steel, or precast concrete.

7 Rules of Construction (a) Prime contractor and the subcontractors can make their own arrangements about their obligations on the jobsite, e.g. toilets, drinking water, first aid stations, etc. But in no case is the prime contractor relieved of overall responsibility for compliance with the OSHA requirements (b) The prime contractor, who contracts for full performance, assumes all obligations of the employer under the standards, whether or not any work is subcontracted (c) Subcontractors assume responsibility for complying with the standards which pertain to their work. The prime contractor and the subcontractor have joint responsibility under OSHA (d) Under joint responsibility, both the prime and the sub are subject to the OSHA regulations.

9 Accident Prevention Policies (b) (1) It shall be the responsibility of the employer to initiate and maintain accident prevention programs as may be necessary to comply with this part. (2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment. (3) The use of any machinery, tool, material, or equipment which is not in compliance shall be rendered inoperable or removed from the jobsite. (4) The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.

10 Safety Training and Education Employer Responsibility (b)(1) The employer shall avail himself of the safety and health training programs the Secretary (Department of Labor) provides. (2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate any hazards (3) Employees required to handle or use poisons, caustics, and other harmful substances shall be instructed regarding the safe handling and use (5) Employees required to handle or use flammable liquids, gases, or toxic materials shall be instructed in the safe handling and use of these materials (6) (i) Employees required to enter into confined or enclosed spaces shall be instructed as to the nature of the hazards involved, the necessary precautions to be taken, and the use of protective and emergency equipment required

11 Safety Training and Education (6) (ii) Confined Space Limited means of egress Subject to accumulation of toxic or flammable contaminants May be oxygen deficient Storage tanks, vaults, vessels, boilers, and any open top spaces more than four feet deep

12 First Aid and Medical Attention First aid services and provisions for medical care shall be made available by the employer for every employee covered by these regulations Fire Protection and Prevention The employer shall be responsible for the development and maintenance of an effective fire protection and prevention program at the job site throughout all phases of the construction, repair, alteration, or demolition work.

13 Housekeeping (a) During construction, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures (b) Combustible scrap and debris shall be removed at regular intervals (c) Containers shall be provided for the collection and separation of waste, trash, oily and used rags, and other refuse. Containers for garbage, flammables, and hazardous materials need to have covers. Waste to be disposed of regularly.

14 Personnel Protection Equipment (PPE) The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.

15 Definitions Authorized Person - a person approved or assigned by the employer to perform a specific type of duty or duties or to be at a specific location or locations at the jobsite Same as Designated Person Competent Person - one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them Qualified person - one with recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems related to a particular subject or issue

16 Definitions (continued) Construction work includes construction, alteration, and/or repair, including painting and decorating Employer means contractor or subcontractor (the engineer as owner s rep?) Hazardous substance substance which, by reason of being explosive, flammable, poisonous, corrosive, oxidizing, irritating, or otherwise harmful, is likely to cause death or injury

17 Means of Egress (a) Every facility shall have free and unobstructed egress from all parts of the building or structure at all time when it is occupied. No locked doors to prevent escape. (b) Exits shall be marked by readily visible signs. (c) Means of egress shall be continuously maintained free of all obstructions.

18 Employee Emergency Action Plans (a) Emergency action plans shall be in writing and shall cover those designated actions employers and employees must take to ensure employee safety from fire and other emergencies (b) Emergency plans include: (1) escape procedures and escape route (2) procedures for those remaining to operate critical plant operations (3) how to account for workers after evacuation (4) rescue and medical duties for those assigned (5) means to report fires and emergencies (6) who to contact for plan details

(c) Alarm system (1) Establish employee alarm system (2) A distinctive alarm to be used to alert specific personnel, e.g., fire brigade (e) Training (emergency plans) (1) before implementing the plans, the employer shall designate and train a sufficient number of persons to assist in the safe and orderly evacuation of employees (2) Each employee must receive information: (i) when the plan is initially developed (ii) when employee responsibilities change (iii) when the plan is changed

20 Employee Emergency Action Plans (cont.) (e)(3) The written emergency plan shall be kept at the workplace and made available for employee review. Firms with 10 employees or less can communicate the plan orally and the plan need not be a written plan.
