1 ADOPT-A-PARK AGREEMENT The City of Perth Amboy Adopt-A-Park program is designed to increase community involvement in preserving our City parks. The program is voluntary and is designed for organizations, businesses and individuals. Each volunteer adopting group assumes responsibility for an assigned park or section of a park and agrees to participate in park improvements a minimum of two (2) times a year for a one year, renewable period. The City of Perth Amboy will work with the adopting group to select a park and provide guidelines to complete work assigned. The adopting group or participant agrees and is expected to: a) Request an application b) Meet with Parks & Recreation Representatives to discuss the park project and identify the park needs. c) Be instructed on the safety requirements and operate in accordance to the safety regulations of the program. d) Sign the Adopt-A-Park Agreement. e) All participants will sign the Liability Agreement. f) Recruit and schedule volunteers from your organization to implement the program. g) Obtain permission from the Parks & Recreation Divisions before proceeding with any conditions. h) Notify the Parks and Recreation Divisions of any unusual or suspicious activities or conditions. i) Return all equipment, materials and supplies when project is completed. The City of Perth Amboy shall: a) Provide the adopting group with necessary tools and materials to help with their project. b) Identify park needs and a list of parks available to adopt. c) Provide instruction and coordination for assigned work projects with adopting group. d) Dispose of trash and debris from adopted park site. e) Provide standard sign to recognize the volunteer group for their contribution and commitment. 2 Waiver Release of Liability and Volunteer Service Agreement I, of sound mind and body am fully aware of and understand the conditions of my voluntary work that will be performed for the City of Perth Amboy. In consideration of the opportunity afforded to me to participate voluntarily in the City of Perth Amboy activities, and in recognition of the possible injury or liability to which I may voluntarily subject myself, I and my heirs, executors, administrators and successors and assigns hereby knowingly, freely and voluntarily waive any right or cause of action, whatsoever, arising as a result of such activities from which any liability or injury may or could accrue to the City of Perth Amboy or their agent or employees individually, except for actual medical expenses that might be incurred as a result of personal injury caused by negligent or intentional acts of City employees as provided by New Jersey Law. I understand and agree that my voluntary participation in City of Perth Amboy activities does not entitle me to any compensation or other employee benefits. I further understand that I am NOT an agent or employee of the City of Perth Amboy and that will not so represent myself to any person, government unit or corporate entity. I further understand and agree that I will be solely responsible for my actions while participating in volunteer activities. I further understand and agree that my voluntary participation in the aforementioned activities is subject to termination at any time by the City of Perth Amboy for any reason or no reason at all without notice, and that I am entitled to no recourse, nor will I seek any recourse in the event of such termination. This waiver shall be determined to be and shall be a complete bar to any action which might otherwise be brought either by law or under any state or federal statute for the property injuries arising as a result of voluntary participation in the activities contemplated herein except for those benefits afforded volunteers in accordance with New Jersey s Workers Compensation Law. 3 City of Perth Amboy Office of Recreation ADOPT-A-PARK PROGRAM VOLUNTARY MAINTENANCE AUTHORIZATION PERMIT FORM The permission granted to pursuant to this permit form is subject to the following terms and conditions: 1. agrees to participate in the City of Perth Amboy Adopt-A-Park program and to perform maintenance related duties as required. 2. The City of Perth Amboy agrees to: a) Install a standard sign at the park location to recognize the adopting group. b) Remove all trash and debris from the clean-up work location(s); and c) Provide materials and supplies for use by the clean-up entity. 3. The Superintendent of Recreation shall decide all questions, difficulties and disputes of any nature whatsoever relating to the maintenance of the clean-up park location(s) that may arise under or by reason of this permit, the prosecution or fulfillment of the services hereunder, and the character, quality, amount and value thereof; and his/her decision upon all such claims, questions and disputes relating to maintenance and monitoring shall be final and conclusive upon the parties hereto. Claims of third parties shall not be subject to this paragraph. 4. In consideration of the mutual covenants expressed herein, the adopting group agrees to and shall indemnify and save harmless the City of Perth Amboy and all its departments, districts, officials, employees and agents of and from any action, demand, cause of action, suit, claim, loss, damage, costs, charge, debt, obligation, expense and attorney s fees arising out of or related to, either directly or indirectly, and any or all work performed by or on behalf of the adopting group at or on the park locations(s).
