1 Page1 Terms and Conditions 2017 Johnstone, Eduarda & Jesus Lda (JES) is the PROPERTY AND RENTAL MANAGEMENT COMPANY operating from Portugal, renting properties for holiday purposes and acting for the Owner. The OWNER means the Owner of the property being rented, who provides the Property Management and Rental Company (JES) with the authorisation to rent under the Alojamento Local regime. JES means the representative in Portugal to administer residential properties and provide all the necessary private services to the guest. The RENTAL GUEST (Guest) means the interested party in renting the property for a short period of occupation. This contract is made between the Guest and JES, with JES acting as the Administrator and the Representative, providing all the necessary services. Rental contracts are governed by Portuguese Law. DESCRIPTION Both the Owner and JES have inspected this privately owned property, making every effort to ensure that the accommodation is accurately described and fully equipped. All representations and descriptions made by the Owner or JES or their respective employees in advertising, letters or by word of mouth are made in good faith, but will not create any subsequent liability on them. The photos of the rental properties are accurate to the best of our knowledge and every effort is made to constantly update the information. Occasionally changes (i.e. furnishings) may change or vary for reasons beyond our control and for which JES cannot accept responsibility. PAYMENTS A 25% DEPOSIT of the total cost quoted, must be paid, within 7 days of booking, before a PROVISIONAL booking can be taken (until this deposit is in place, the booking remains an enquiry only and therefore it can be booked by another Guest). If for any reason the Booking Deposit has still not been made by the due date then JES has the right to cancel the booking. Payments are to be made by bank transfer; cheques and credit card payments are not accepted. The Owner will be contacted and asked for authorisation to proceed with the provisional booking. The Owner has fourteen (14), days to cancel this provisional booking for whatever reason. In the event of the booking being rejected by the Owner, JES will return the deposit paid. Additional rental will be charged per person for the use of an extra folding bed, sofa bed (single or double) or cots. Therefore, please ask for more details before making your booking, as we may need to contact the owner of the property concerned to ensure the property meets with your personal requirements. The Deposit will be deducted from the total cost quoted to the Guest and the BALANCE must be paid

2 Page2 eight (8) weeks prior to the commencement of the rental period for which the booking has been made. Once the balance has been paid the booking is CONFIRMED. If for any reason full payment has not been made by the due date then JES has the right to cancel the booking and retain any money previously paid. For bookings made less than 8 weeks prior to occupancy, payment in full is required for confirmation of booking. JES will contact you once fully confirmed and all monies have been received. Prices are subject to change and can increase or decrease over time due to variations in the exchange rate and special offers. Once a booking has been made however, the price is fixed and cannot be changed. All prices include VAT. Please note that in-line with Portuguese Legislation, all rental properties have been AL registered and a copy of all visitors Passports or Identity Cards will be required for all Guests and kept at Reception. Your accommodation is reserved for a maximum of two (2) people per bedroom unless alternative arrangements have been made and authorised by JES. Please ensure that the Lead Booker is over the age of 21. The rental property is reserved exclusively for the people named on the reservation confirmation (for which JES must have prior name details and passport/id information) and must not be exceeded. No other person(s) is permitted to stay at the accommodation. Any additional person(s) staying at the apartment for which JES does not have prior information of will be asked to leave the property immediately. It is the Guest s responsibility to check any special passport or visa requirements. JES is unable to accept responsibility for failure to carry valid passports, visas or driving licences. DAMAGE DEPOSIT Guests are asked for a Deposit against damages to be paid with the balance payment (i.e. T1 (1 Bedroom) = 250; T2 (2 Bedroom) = 250). Our main concern is to ensure that the property remains in good condition. The damage deposit will be returned within one month of departure, if there are no damages. Occasionally, if there is something broken or damaged, the deposit will be held until such time that the item has been replaced or the problem has been resolved. Payment for damage exceeding the damage deposit amount has to be paid to Reception in cash in Pounds Sterling or Euros. UTILITY USAGE Electricity units are included in the rental price per week (Studio/1 Bedroom = 200 units; 2 Bedroom = 400 units). Guests using more than their allocated units of electricity will be asked to pay 0,20/unit (20 cents). HOUSEKEEPING Maid service is provided as follows: Maid service is provided as follows:- LOW one day per week, MID - one day per week, HIGH one day per week and PEAK one day per week, for all apartments. There is no maid service during weekends (Saturday and Sunday) or on Public Holidays. Maid Service includes

3 Page3 bedrooms, bathrooms, living room and floors and once these basic daily duties are completed the maid will vacate the property. The washing of personal laundry, kitchen pots/pans/dishes and the cleaning of the BBQ are not part of the daily maid service, however if there is time, attention will be given to the kitchen. Regrettably should the maids be turned away when they make their daily routine visit, they will not be permitted to return that day due to their scheduled and busy seasonal work load. On departure if the apartment is not left in a reasonably clean and tidy condition and additional cleaning is necessary, a charge will be deducted from your damage deposit. CLEANING PRODUCTS As this property is self-catering, a starter pack of cleaning products will be provided which should be sufficient to last a few days. Further supplies (including toilet rolls) must be purchased by the guest as and when the products are required. REFUSE It is the Guests responsibility to take their rubbish to the local bins both during their holiday and at the end of their stay. BEHAVIOUR At all times Guests are expected to have consideration for others. If guests appear to be behaving in a way as to cause danger, distress, annoyance or damage to others or the property, JES may terminate your holiday arrangements. In this case JES will have no further liability and will not be responsible for meeting any expenses incurred as a result, making any refund or paying compensation. Take care with fireplaces inside the property and be vigilant with children around fires and fireplaces. JES or the owner will not be liable for injury caused by negligence around fires and fireplaces. During your stay you are responsible for ensuring you lock up the property when you go out and that you have your keys with you to get back in. 2 keys will be issued for your use. Lost keys will have a fee deducted from the damage deposit. May we remind you to park your vehicles properly, inside the parking areas defined. SWIMMING POOL The swimming pool is unguarded and therefore guests using it must do so at their own risk. Diving is not permitted. Children must be supervised by an adult at all times. Only plastic drinking glasses may be used besides the pool. Guests must never take glassware to the poolside.

4 Page4 Guests should refrain from entering the pool with copious amounts of sun cream/tanning oil on their skin, as this will cause damage to the filtration system. JES will immediately act upon the report of a malfunction of the swimming pool however, neither JES nor the owner can be held responsible for any malfunction. SMOKING Smoking is not permitted at any of the properties. If we find that smoking has occurred at the property we reserve the right to withhold the damage deposit. PETS AND ANIMALS No pets or animals are permitted on the premises. CANCELLATION In the event of a cancellation, notification must be made in writing by the person who made the booking. Deposits in respect of rentals are non-refundable and the following charges (% of total) will be made. The charge is dependent on the date of cancellation in relation to the commencement of the rental period: a. More than 6 weeks 50% b. Between 6 & 4 weeks 65% c. Between 4 & 2 weeks 80% d. Two weeks and less 100% (including no-show) These percentages are proportions of the total cost quoted. However, JES will make every effort to rebook the accommodation and if successful only the booking deposit will be forfeited. Failure to occupy the accommodation booked or decline the property prepared upon arrival (by the Guest), will be deemed as cancellation by the Guest and the Owner reserves the right to resell all or part of the booking without prejudice to the right to collect the cancellation charges in full. INSURANCE Holiday Travel Insurance is not included in your booking, therefore you may want to take this option through your usual family broker or travel agent when booking your flights. We firmly recommend that you consider insurance cover for cancellation, personal accident & liability, medical expenses, loss of luggage, cash, documents, legal and theft etc. If you do bring valuables, please insure them individually for all eventualities, lock them away or keep them on your person at all times. Always lock away your

5 Page5 cash or keep it on your person. Management accepts no responsibility for any personal loss, as most of the apartments are fitted with a safe. The Owner and JES are NOT responsible and accept no responsibility for any loss. SECURITY Security in Condominium Golf II is to a very high standard. The complex itself is only accessible via security gates operated by remote control or video intercom, to ensure everything is under control and all visitors have a restful and relaxing holiday. Inside the apartment you will find a Rental Information Guide which contains useful information and important telephone numbers (24 hour call-out, doctors, dentists, security etc). All apartments have security locks on the front doors, secondary locks on sliding doors and windows, and a safe for valuables and documents. Please set the security alarms when they are installed (always ask at Reception for demonstration on how to use). LIABILITY The Owner and JES are not responsible in any way for the loss or damage of any goods or personal belongings of the Guest. The Owner and JES will be under no liability whatsoever in the event of cancellation, withdrawal or alteration of any arrangements or any losses or accidental expenses caused by reasons of war, civil strife, strikes, sickness, quarantine, bad weather conditions, natural disaster, technical problems of any description, terrorist activities, closure of airports, or any other circumstances beyond their reasonable control. The Owner and JES: i. Will not be liable for any injury, sickness, loss, damage or additional expenses or inconvenience directly or indirectly arising out of the design, structure, use or condition of any building or premises, their approaches or contents or mechanical and/or electrical services belonging thereto or out of any defect therein. ii. Will not in any circumstances whatsoever accept responsibility for loss of life, personal injury, illness, or loss or damage to luggage or personal effects or consequential loss other than for the negligence of their respective employees acting in the course of their employment. iii. Cannot be held liable for any actions of any persons (other than for the negligence of an employee acting in the course of his employment) or the failure of any public service or supplies of a technical nature connected with the holiday arrangements over which they have no direct control. In any case liability is limited to the value of the accommodation booked. In the unlikely event, due to extraordinary circumstances that the accommodation should become unavailable after confirmation to you (and payment made in full), we will immediately advise you thereof. In the event of the property being sold, every effort will be made to relocate and/or upgrade before refunding in full. Our aim will be to provide you with suitable alternative accommodation similar to the

6 Page6 property initially chosen and within a 20Km radius. If an alternative is not found, or if you are not happy with the alternative, you will be entitled to a full refund of accommodation payments having been received by us. In the unlikely event of failure of electrically supplied apparatus, the Owner or JES cannot be held responsible, but will endeavour to assist you when possible and will ensure that any extra payment made for this service is refunded. Any fault with any Air Conditioning unit will be given priority and every effort will be made to rectify quickly. By leaving all doors open the remaining units inside the property should sufficiently cool the property. We will make every effort to repair or find a portable unit if available. However, if a problem persists then we will credit your account with 100 per week for each Air Conditioning unit that does not function. EMERGENCIES In the case of an emergency and you are unable to stay at your booked property we can allocate up to a fixed amount per person. This is based on the rate paid per person for your rental accommodation with JES. We can also recommend the Magnolia Golf and Wellness Hotel, Quinta do Lago, which is subject to their availability. Our emergency numbers are as follows: JES Reception Office (+351) Susie Roque (JES Representative for Admin & Guests) (+351) Ana Kellner (JES Representative for Admin & Technical) (+351) BUILDING WORKS JES will take steps to monitor and advise you if any building work is likely to affect your apartment during your stay. Should we consider that a neighbouring building plot would seriously affect your property with either noise and/or dust pollution, then we will use our reasonable endeavours to offer you an alternative property. Where road works or public works occur at short notice or without notice, and which are outside of the control of the Owner or JES, we cannot be held liable for any inconvenience to you. COMPLAINTS In the unlikely event that you should have a complaint whilst on holiday, please immediately inform Reception, who will do their best to resolve any problem without delay. Any claim against the Owner, or JES must be submitted in writing within seven (7) days of the completion of the rental period. UNFAIR TERMS & CONDITIONS

7 Page7 If any of these Terms & Conditions are deemed by a court of competent jurisdiction to be illegal, unlawful or in any way unenforceable then the court shall have the power to reduce the scope and extent of that clause to such an extent as makes the clause legal and enforceable. ARRIVAL & DEPARTURE There are no definite changeover days (due to flights being available on most days). The apartment will be ready for arrivals by 16:00 and the departure time is 10:00. Please help us to ensure your apartment is ready for occupancy by informing us of the approximate time of arrival. Should your arrival be outside of normal operating hours, then you must inform Reception to ensure the keys are left in a specially designed safety locking box on the apartment door. The minimum period of stay is 7 nights. Occasionally, it is possible for the Guest to vacate the apartment later and occupy earlier, please check with Reception for more details. JES reserves the right to charge and issue an invoice for additional occupancy on a daily basis if the property is not vacated by 10am on the day of departure without written consent. For those Guests arriving at the airport we will arrange your transport requirements as requested; a taxi, car hire, limousine or personalised collection to assist you with all of your luggage safely to Condominium Golf II.
