1 A Message from the Chairman Dave Lanspeary, AAM is the owner of Dave s Auto Repair in Youngtown. He can be reached at: or via at djls58@qwestoffice.net As I hope you are all aware, we begin the New Year with the announcement that your ASA national dues have increased. There is no increase in your state dues. As with any business, which includes yours and mine, operating expenses do change and we must make decisions in order to remain viable, profitable and to continue providing services to our customers. The same holds true for associations. Here in Arizona your state board, working with our executive director Luz Rubio, will do our best to help mitigate the effect this national dues increase will have on your membership. Although many services ASA national provides are well worth the investment, I think we can all agree the primary benefits of membership remain at the local and state level via chapter meetings, training events, our annual Sunrise Convention, and the value of networking with other members. The agenda for our next Sunrise Convention in July is coming along well. Our vendor and supplier support continues to remain strong and we will be offering a broader range of management and technical subjects that will be of interest to our members and their key personnel. The overwhelmingly positive responses we received from those who attended Maylan Newton's ESI seminar during Sunrise 2011 led us to bring him back again for Also, you will have received information on the ESI "Service Writers School Of America" program ASA will be bringing here in November this year. Attendance for this seminar is limited and we've received firm commitments from several members already. Thank you. A recent bill, HB2394, was introduced in the State Legislature that will negatively affect the way in which our collision members interact with consumers and insurers. We do not need this type of ill conceived, poorly written regulatory interference into our businesses. ASA-Arizona will stay on top of the way this bill moves forward and keep our membership informed. In Houston Texas, a bill has been moving through the legislative process there that again will have negative consequences for mechanical and collision shops in that community. You may ask what this has to do with Arizona? The answer of course is that our industry remains a target of "feel good" legislators as well as the growing number of consumer protection groups who continue to vilify the automotive service industry at every opportunity. This is where a strong effective association built and funded from the local to the national level can and should make the effort to stand up and be recognized. Getting back to the ASA national dues increase, I encourage each of you to take this in stride and continue to financially support your association through the coming year. If at the end of 2012 we have not lived up to your (and our) expectations in providing value that exceeds your investment, I'll hold no grudge toward anyone who chooses to cancel their membership. 3 Meet the 2012 Tucson Chapter Board The Tucson Chapter has kicked off 2012 with lots of exciting activities for the chapter members. Members of ASA of AZ receive a discount on Individual Health Policies offered by Blue Cross and Blue Shield of Arizona, to find out more information, Call or Ext. 105 or 106 Insurance Legislation Held Over Due to Efforts of The Automotive Service Association of Arizona (ASA AZ) A proposed law that would have changed the way collision repair shops in Arizona do business has been held over to the next legislative session. HB2384, introduced by Representative Nancy McLain in the Arizona House of Representatives, would have had negative effects on body shops throughout the state. Without the representation of ASA of Arizona at the State Capitol, this bill would have likely passed with little or no opposition. The Collision division members of ASA of AZ met to discuss the impact of this legislation, and Luz Rubio, Executive Director quickly scheduled a meeting with the sponsor, Representative McLain to express our opposition and the opportunity to explain how our industry works. Our association was also included at the one stakeholder meeting that was held to discuss the bill. In its original form, the bill would have: Limited a shops ability to charge storage on a total loss if a tear down was also performed. Storage, in this situation, could only be billed to an insurer from the day the vehicle had been declared a total loss. Circumvented that part of Arizona insurance policies, when tear down and storage were necessary, that require insurers to fully indemnify the policy holder. Required that the insurer provide authorization to a collision repair shop before repairs could be started. Forced shops, in many situations, to absorb the costs associated with vehicle storage or bill it to the vehicle owner. Through the efforts of ASA AZ and working with The National Federation of Independent Businesses (NFIB), Representative McLain has agreed to put the bill on hold and has asked that stakeholder meetings are held during the off session. This is an indication that this bill will be introduced again next session. Protect Your Business, Take Part in the Process! 4 Horne Announces Alleged Non-Consumer Fraud-Related Contempt Action Against Tempe Transmission Shop Attorney General Tom Horne announced that he has asked for a court order requiring Tempe-based Transplant Plus and its principals to show cause why they should not be held in Contempt for multiple violations of their July 8, 2011 Consumer Fraud Consent Judgment with the State. Garo Enterprises, Inc. is a Tempe transmission shop run by Robert Brady, which conducts business under the name Transplant Transmissions. The company sells and installs remanufactured transmissions at 1750 E. Elliot Road, Tempe, Arizona. This is the third strike for Transplant Plus, Horne said, noting that this company has been sued twice by the State for consumer fraud violations, once in 2005 and again My office takes these kinds of allegations very seriously, and we will vigorously pursue this matter in court. The State alleges that Transplant Plus violated the Judgment against it by: Failing to register their trade name with the Arizona Secretary of State; Claiming that Transplant Transmissions could elect whether to perform repairs or refunds when the Judgment required full refunds for defective transmissions. Claiming the right to repossess customer s vehicles if the payment did not go through or was reversed; Claiming to have the sole discretion regarding whether to provide an exchange or refund, when the Judgment required full refunds for defective transmissions; Claiming that transmissions were nonreturnable after 30 days when the Judgment required full refunds for defective transmissions within 60 days; Claiming that all returns were subject to a 20% restocking fee when the Judgment required full refunds for defective transmissions; Claiming that there were no refunds only merchandise credit, when the Judgment required full refunds for defective transmissions; and Failing to respond to customer complaints filed against it with the Better Business Bureau; If found in contempt, Transplant Plus and its principals can each be ordered to pay civil penalties of up to $25,000 per violation. 5 Something Stink in Your Business? Perhaps It's You ETE REMAN s founder, Sam Loshak, is known for his many insightful and pithy statements. In fact, we ve come to dub his statements Samisms. One of Sam s most frequent reminders to ETE s leadership is fish stink from the head. What Sam means is that the worst smelling part of a dead fish is its head. But what Sam really means is that most problems within a company can be traced back to its leadership. Since you re reading this, odds are that you re a leader within your company. Odds are, I m talking about (and to) YOU. When you re evaluating a problem within your business, it s easy to blame everyone around you. It s easy to point your finger at your builder, at your manager, at your assistant pretty much at anyone. The hardest thing is to ask (and answer) why the problem truly exists. Often, your employees actions are a symptom of a greater problem. And, often, that greater problem is, well, you. I ll clarify: Your people are a reflection of you. Your people are a reflection of your work ethic. Your people are a reflection of your attitude. Your people are a reflection of your encouragement (or discouragement). Your people are a reflection of your example. You may not realize it, but you re being watched. Your employees look at you, they look to you, and (sometimes) they look up to you. No matter how they feel about you, however, they emulate you. You set the standard. Don t tell them what to do, show them how it s done. Ask yourself: How s my attitude? How do I react to stressful situations? How do I treat customers? Do I always get to work on time? Do I follow my own rules and policies? How often do I praise my employees for doing things right? Do I always deliver on my promises? How well do I listen to my employees? Have I provided my employees with adequate training both in technical skills and personal development skills? Am I living (and leading) by example? Those are tough questions. Well, actually they re easy questions that result in tough answers and tough work should you need to make changes in yourself. But the results are worth it. The bottom line: Be who and what you want your employees to be. Bonus questions: If you were your own employee, how would you stack up? Would you hire you? 6 Pain in the Back? Pay attention to lifting, weight, posture By SCF Arizona Back pain can affect anyone, and it is a common complaint among workers. In fact, MyOptumHealth.com reports that four out of five adults will experience lower back pain at some point in their lives, and it is one of the most common reasons for visiting a doctor. As strong as the back is, it often seems fragile because the spine comprises so many separate bones (vertebrae), a conglomeration of associated tendons and ligaments, and of course the vital nerves running through the vertebrae. Lifting an item incorrectly, reaching past your limits, sitting or standing too long in the same position can all cause back pain; so can being overweight. Pain from a muscle strain occurs most frequently from lifting a heavy object, lifting while twisting, or a sudden movement or fall. The pain is usually localized, and there may be muscle spasms or soreness. You can avoid back injuries by using proper lifting techniques, said Carl Hamilton SCF Arizona loss control consultant. He offered these tips when lifting: Keep the load close to your body Keep the load directly in front of you Know your personal limitations and seek help if the object is too heavy Visualize and communicate a simple plan of action prior to lifting Keep your back as straight as possible Bend at the knees Raise up using your legs in a smooth, controlled manner Avoid twisting or jerking the load as you lift Hamilton said other ways to avoid back pain at work include: Change or shift positions frequently Take periodic breaks away from your desk Stretch periodically throughout the day Adjust working heights to prevent slumping or excess reaching When sitting, keep knees level with hips and support the lower back with firm cushioning Being overweight is another reason people suffer back pain. The extra pounds increase the load on the spine raising the risk of disk degeneration and other structural causes of lower back pain. According to MyOptumHealth.com, people who are obese may have an increased lumbar curvature in the spine, which is caused by abdominal fat pulling the lumbar spine forward and downward. Being overweight or obese can also contribute to symptoms associated with osteoporosis, osteoarthritis (OA), rheumatoid arthritis (RA), degenerative disc disease (DDD) and other spinal conditions. And according to the American Obesity Association, back pain is prevalent among the nearly one-third of Americans who are classified as obese. Maintaining correct posture at a work station, whether standing or sitting, is important to keep the back from aching, Hamilton said. Good posture comes from conscious effort, he said. Your mother was right when she told you to Sit up straight. Any type of prolonged poor posture can increase the risk of developing back pain overtime, Hamilton said. That is why he recommends following mother s advice. He said that by developing a holistic approach and by engaging a company wellness program, a company can focus on building better, healthier employees based on realistic exposures. Exercise can help to strengthen and stretch the back. When the abdominals and other muscles that provide protection to the spine are out of shape, the back suffers. 8 Joint Statement Regarding the Collection and Reporting of Repairer Business Data The issue of data ownership is of ever-increasing importance to both consumers and businesses as technology expands the landscape of digital trade, and the collision repair industry is not immune to concerns relative to ulterior use of business generated data. During the past several decades, the estimating and management system companies have increased their product offerings beyond core estimating and management functions for repair facilities. Their scope of services presently includes the collection, generalized aggregation, analysis, and sale or provision of repairer data to third parties. Collision repairers contend that: - The collection of data is unilaterally demanded as a point of sale requirement for every estimating system option offered in the market, barring repairers that wish to provide electronically generated estimates from having the option of keeping their business data from being utilized for unauthorized purposes. - The information that is harvested from the collision repairer's system is being used for purposes other than those that the subscriber had intended when contracting to use the estimating system software. When this issue was first broached several years ago, one primary response on the part of the estimating system providers was that the only data being captured was that obtained via the upload of Direct Repair (DRP) estimates, and those end-users had implicitly waived any data ownership rights by agreeing to upload estimates as a condition of their participation in the (DRP) program. They also claim that no privacy rights have been violated since the information is all collected in a depersonalized manner, and presented as an overall aggregation of data collected. While we continue to contest the validity of both positions, the advent of cloud based platforms has expanded the data collection potential to include any businesses utilizing the server-based programs. It has also expanded the potential of data mining from only estimating programs to the possible inclusion of information generated from business management programs or other technology based service platforms. The Information Providers may seek to reassure the collision industry that they have taken all necessary steps to safeguard repairer/consumer information from data privacy breaches. While the data may remain safeguarded from threats in the traditional sense of electronic security, the members of the collision industry remain concerned that the information is not necessarily safeguarded from the technology firms themselves who have built in contractual permissions to force the industry to permit utilization of the data in ways that were not intended or expressly approved by their customer base. We believe it is long overdue for our industry to have the express option to either "Opt In" or "Opt out" of allowing technology firms to have access to ancillary uses of our data as a point of sale requirement to utilize the necessary tools once intended to aid the industry in running our businesses. This statement serves as a public request from the collision repair industry to Audatex, CCC, Mitchell and other technology firms who collect data. The industry seeks removal of contractual clauses within End User License Agreements which require permissive access to aggregate and collect end-user data as a point-of-sale requirement to purchase those programs. Further, we believe that if a business is to permit their data to be mined, they should be entitled access to an annual report specifically indicating where that data was used, and a list of parties that received reports utilizing data from the user's system. We believe the ability for businesses to choose participation in the data collection process is a reasonable solution, and we look forward to your response.
