A. Purpose of RFP SECTION I: Program Design and Requirements The County of Humboldt, under the direction of the Youth Council (YC) of the Humboldt County Workforce Investment Board (HC-WIB) issues this Request for Proposals (RFP) to solicit program operators in the Southern Humboldt, Eel River Valley and Eureka regions for StepUP for Youth Jobs, Humboldt County s youth workforce development services program. The StepUP for Youth Jobs program (StepUP) is operated and funded under the provisions of the Workforce Innovation and Opportunity Act 1 (WIOA) and serves WIOA-eligible youth. (Additional WIOA and non-wioa funds may become available under the contracts that result from this RFP.) Successful bidders will demonstrate the effective use of WIOA resources along with non-wioa resources for delivery of a comprehensive program for all youth. While not all youth may be enrolled in the WIOA-funded program, the YC seeks to partner and connect all youth-serving programs, to breakdown program silos and build a system that serves all youth, regardless of specific barriers. The YC seeks contractors who have the capacity, experience and community networks necessary to deliver comprehensive youth services in Southern Humboldt, Eel River Valley and Eureka regions. Additional funding may become available as the HC-WIB secures discretionary grants. Selected youth program operators may be asked to participate in grant applications and may receive additional funds to implement discretionary grants. The contract of the youth program operators may be amended accordingly. Note: At the time of the issuance of this RFP, the U.S. Department of Labor and the CA Employment Development Department have not issued final regulatory guidance for WIOA implementation. 1 Page 1

StepUP for Youth Jobs Program Design WIOA Youth Services RFP#192 The YC has designed and funded the StepUP program to deliver services that prepare youth, particularly at-risk youth, for success in the work-place. The program is delivered through regional contractors, called Youth Program Operators (YPO s), in order to ensure that the enrollment and service delivery meets the needs of the at-risk youth in their home community, and engages the resources of that home community. WIOA is designed to deliver career exploration and guidance, continued support for educational attainment, opportunities for skills training in the Target industries and occupations, and culminating with a good job along a career pathway or enrollment in post-secondary education. Under WIOA, a strong emphasis has been placed on work experience (WEX) activities. All proposals need to include a job readiness and WEX placement design, and a partnership with businesses that are willing to provide youth with work experience opportunities, such as job shadowing, on-the-job training, internships, and hourly work. Along with developing an effective WEX portion of the program, the design will need to incorporate a pre-wex component, including job readiness, resume building, career counseling, and competency-based learning. For youth receiving either stipend payments for competency-based learning or actual wages for WEX activities, the contractor is required to become or provide an employer of record with worker s compensation insurance and process payroll for the youth. Letters of agreement need to be included if it is an agency other than yours who will act as employer of record. WIOA describes WEX activities to include: Paid and unpaid work experiences that have as a component academic and occupational education, which may include 1. Summer employment opportunities and other employment opportunities available throughout the school year; 2. Pre-apprenticeship programs; 3. Internships and job shadowing; and 4. On-the-job training opportunities. The YC seeks organizations that are embedded in the communities of Southern Humboldt, the Eel River Valley and Eureka to propose a youth program for their region that delivers the 14 program elements 2 of WIOA. YPO s representing each of the five regions will participate on a county-wide team of YPO s to deliver a consistent program. The HC-WIB staff will provide support to the YPO team in development of the program details. C. Career Pathways WIOA places emphasis on career pathway, which means a combination of rigorous and highquality education, training, and other services that (A) Aligns with the skill needs of industries in the economy of the State or regional economy involved; (B) Prepares an individual to be successful in any of a full range of secondary or postsecondary education options, including apprenticeships (C) Includes counseling to support an individual in achieving the individual s education and career goals; (D) Includes, as appropriate, education offered concurrently with and in the same context as workforce preparation activities and training for a specific occupation or occupational cluster; 2 Fourteen program elements defined on pages 7-8. 5 (E) Organizes education, training, and other services to meet the particular needs of an individual in a manner that accelerates the educational and career advancement of the individual to the extent practicable; (F) Enables an individual to attain a secondary school diploma or its recognized equivalent, and at least 1 recognized postsecondary credential; and (G) Helps an individual enter or advance within a specific occupation or occupational cluster. D. Current Enrollments and Participant Eligibility Current contracts in Southern Humboldt, Eel River Valley and Eureka regions have both inschool youth (ISY) and out-of-school youth (OSY) enrolled. All youth currently enrolled and in follow-up will continue under WIOA and be assigned to the new contractors that will provide services in that region. The caseload for each region will be transferred to the new contractor upon contract start date. Under WIA the program has been primarily an ISY program with some OSY enrolled. Under WIOA it will become a primarily OSY program with the option to serve some ISY or only OSY. Funds awarded through this RFP must serve a minimum of 75% OSY and can serve some ISY. WIOA defines ISY and OSY as follows: OUT-OF-SCHOOL YOUTH - 1. Not attending any school (as defined by State law); 2. Not younger than 16 or older than 24; and 3. One more of the following: a. A school dropout. b. A youth who is within the age of compulsory school attendance, but has not attended school for at least the most recent complete school year calendar quarter. c. A recipient of a secondary school diploma or its recognized equivalent who is a low-income individual and is i. basic skills deficient; or ii. an English language learner. d. An individual who is subject to the juvenile or adult justice system. e. A homeless individual, a homeless child or youth, a runaway, in foster care or has aged out of the foster care system, or in an out of-home placement. f. An individual who is pregnant or parenting. g. A youth who is an individual with a disability. h. A low-income individual who requires additional assistance to enter or complete an educational program or to secure or hold employment. IN-SCHOOL YOUTH - 1. Attending school (as defined by State law); 2. Not younger than age 14 or (unless an individual with a disability who is attending school under State law) older than age 21; 3. A low-income individual; and 4. One or more of the following: a. Basic skills deficient. b. An English language learner. c. An offender. d. A homeless individual, a homeless child or youth, a runaway, in foster care or has aged out of the foster care system, or in an out of-home placement. e. Pregnant or parenting. Page 3

6 E. Scope of Work WIOA Youth Services RFP#192 f. A youth who is an individual with a disability. g. An individual who requires additional assistance to complete an educational program or to secure or hold employment. Executing the WIOA contract is a multi-faceted operation. It requires program oversight, fiscal responsibilities, eligibility and case management, and providing WEX activities to the client. 1. Program oversight requires management of the program to ensure that operations expenses are consistent with and allowable under WIOA, CA EDD guidelines, HC- WIB policies, and the County contract requirements. It is important to have an understanding of WIOA and the contract with the County to ensure that the program is being run effectively and appropriately. 2. Fiscal requirements include ensuring that expenses are allowable, tracking the budget, proper backup documentation, processing invoices and submitting the invoices with appropriate backup documents to the County monthly for reimbursement. 3. Eligibility and case management is a significant part of the program. First, a client must be determined to be eligible. Eligibility must be documented. Once all the documentation is complete, the client is enrolled in CalJOBS. Next, an Individual Service Strategy is developed, the plan to determine how to best serve the client. Case management is an ongoing process from the time a client enrolls until they exit the program and then complete one year of follow up. Detailed notes and ongoing supporting documents must be organized and tracked well. Case management also includes providing supportive services, and aligning youth with academic and occupational opportunities. 4. Providing pre-wex and WEX activities will include development of a quality WEX program. This will need to meet the needs of each client where they are at when they enter the program. Some may be job ready and step directly into a job shadow, onthe-job training or WEX while others may require assistance with developing a resume, mock interviews, attending career panels, taking a course, completing competency based learning, etc. It will be important to develop partnerships with businesses who can supply WEX activities. The following contains a list of program components that must be provided, regardless of program model: All respondent programs MUST: 1. Conduct creative outreach and recruitment activities to identify participants for the program; 2. Complete a thorough intake interview and collect eligibility documentation for enrollment into the program; 3. Conduct individual assessments that are comprehensive in nature, and can accurately identify a plan to provide services that are necessary and appropriate for eligible youth to be successful in completing an academic program or entry into a career path; 4. Provide academic skills remediation for youth who test below 9th grade in reading and/or math; Page 4

Conduct career exploration activities with structured opportunities to explore a range of career options in a particular industry, thereby developing work-readiness and industry-relevant competencies; 6. Develop individual service strategies (ISS) that address the needs identified through the comprehensive assessment, in a manner that is appropriate to the individual, developmental needs of each youth, and follows clear timelines in which to be completed; 7. Provide supportive services as appropriate and identified in the youth ISS; 8. Define the terms of participant success for each service delivered; 9. Work with employers in the development and structure of work-experiences that match the skills and interests of youth participants, and address the specific needs of both the youth and employers; 10. Fulfill the role of Employer of Record and coordinate payroll for youth participating in paid work-experiences; 11. Develop effective community partnerships that will support the service delivery needs of youth as identified in the comprehensive assessment; 12. Maintain contact and active engagement with participants to ensure there are no gaps in service; 13. Maintain current progress of participant activities using the current CalJOBS customer tracking system; 14. Coordinate with vocational rehabilitation services and other local agencies for youth with disabilities; 15. Utilize resources made available by The Job Market; 16. Provide follow up services for a minimum of one year after exit; 17. Comply with the Uniform Administrative Requirements and the Cost Principles as delineated in Title 29 of the Code of Federal Regulations Part 95 or Part 97 as the applicable Office of Management Budget circulars. F. Regional Service Area The YC has designated five (5) sub-regions in Humboldt County for youth services, illustrated below in the map. Contracts are in place in the following regions; Northern Humboldt and Eastern Humboldt. We are seeking bidders to serve the Eel River Valley, Eureka, and Southern Humboldt region. Successful bidders will demonstrate strong, grass-roots ties to the community. A single provider can bid on more than one region. 1. Eastern Humboldt contract in place 2. 8 G. Program Budget All proposers are required to submit a sample budget summary, which includes WIOA funding and in-kind/match amounts and will be used for competitive cost analysis. A detailed budget will be required upon contract award. WIOA funding requires specific expenditure ratios in order to achieve policy objectives of service to OSY and engagement in WEX. Humboldt County is the local workforce investment area (LWIA) and the ratios will be monitored by the State for the total LWIA budget annually. There are two separate requirements: 1. A minimum of 75% of WIOA funds must be expended on out-of-school youth and a maximum of 25% expended on in-school youth; and 2. A minimum of 20% of program funds be spent on WEX activities. The YC of the HC-WIB determined that locally a minimum of 25% of program funds will be required for WEX activities and an additional 10% be required for supportive services. A minimum of 35% of program funds for each region will go directly to youth services. Note: there is no minimum requirement to serve ISY youth. The program can serve 100% OSY. EXAMPLE of OSY Spending Requirement Total amount awarded to contractor $100,000 75% minimum for OSY spending $75,000 25% maximum for ISY spending $25,000 EXAMPLE of WEX and Supportive Service Requirement Total amount awarded to contractor $100,000 25% WEX requirement $25,000 10% Supportive Service requirement $10,000 Bidders must demonstrate a minimum one-to-one (1:1) match of non-wioa cash and/or inkind funding (50% of the total budget) for the program in the region(s) they are proposing to serve. The goal of the YC is that youth programs will be built through leveraging multiple funding sources and community resources, not as a stand-alone WIOA-funded program. Examples of match funding might include salaries, overhead costs, supplies and equipment, WEX wages, mentoring, counseling, bookkeeping, internships, tuition and workshops/classes. The County of Humboldt retains the right to negotiate final budget and contract amounts with bidders selected to provide youth services. H. Partners Both WIOA and the YC encourage partnering and collaboration to deliver the most effective services to have the greatest possible community impact. With limited WIOA funding it will be essential to have other funding sources to leverage the program, this is not intended to be a standalone program. Letters of agreement need to be included with proposals. Letters should provide a general outline of the partnership, services and activities that will be delivered. In the cases where leveraged funds and/or in-kind match dollars are involved, this needs to be included in the letters. Examples of partners might include educational institutes/agencies, service clubs, other Page 6

9 youth service providers, school districts, non-profits, Cities and/or Counties, internship programs and private sector businesses. It is important to include partners that will assist with the pre-wex and WEX activities. The HC-WIB encourages bidders to identify specific collaborative efforts to serve youth with disabilities. With the passage of the WIOA, all local areas will now have vocational rehabilitation as a partner at the one-stop center for aligned application, enrollment and performance measures. The Job Market is Humboldt County s local one-stop. Selected contractors will be expected to coordinate with vocational rehabilitation services for youth with disabilities and be expected to coordinate with The Job Market to enhance referrals and services available through the one-stop. Note: The operations of the one-stop service center will go out for competitive bid in 2015, and a new operator or consortium of collaborating agencies will be operating the one-stop service center under WIOA by July 1, I. WIOA Required Program Parameters The HC-WIB requires all contractors to address certain programmatic aspects, per WIOA. These experts of the law are key to the youth program operations. Under WIOA, Sections 129 (a), (b) and (c), the purpose of youth programs is and all programs must provide: - An objective assessment of the academic levels, skill levels and service needs of each participant; - Service strategies for each participant that shall identify career pathways, that include education and employment goals; - Activities leading to the attainment of a secondary school diploma or its recognized equivalent; - Preparation for postsecondary educational and training opportunities; - Strong linkages between academic instruction and occupational education that lead to the attainment of postsecondary credentials; - Preparation for unsubsidized employment opportunities, in appropriate cases; and - Effective connections to employers, including small employers, in in-demand industry sectors and occupations of the local and regional market. Proposals must contain all the required program elements. If a provider does not directly provide the services listed, it must demonstrate the ability to make seamless referrals to appropriate providers of such services. The grantee will have primary responsibility for ensuring that each participant receives the full continuum of services. Per WIOA 129 (c)(2), required program elements include: 1) Tutoring, study skills training, and instruction leading to completion of secondary school, including dropout prevention strategies; 2) Alternative secondary school services, or drop-out recovery services as appropriate; 3) Paid and unpaid work experience that have as a component academic and occupational education, which may include: a. Summer employment opportunities and other opportunities throughout the year; b. Pre-apprenticeship programs; c. Internships and job shadowing, and; Page 7

10 d. On-job training opportunities; 4) Occupational skills training, as appropriate; WIOA Youth Services RFP#192 5) Education offered with and in the same context as workforce preparation activities and training for a specific occupation; 6) Leadership development opportunities, which may include community service and peercentered activities encouraging responsibility and other positive social behaviors during non-school hours as appropriate; 7) Supportive services; 8) Adult mentoring for the period of participation and a subsequent period, for a total of not less than 12 months; 9) Follow-up services for not less than 12 months after the completion of participation, as appropriate; 10) Comprehensive guidance and counseling, which may include drug and alcohol abuse counseling and referral, as appropriate; 11) Financial literacy education; 12) Entrepreneurial skills training; 13) Services that provide labor market and employment information about in-demand industry or occupations available in the local area, such as career awareness, career counseling, and career exploration services; and 14) Activities that help youth prepare for and transition to postsecondary education and training. J. WIOA Performance Measures Below are the WIOA Performance Outcomes for youth recently established by the U.S. Department of Labor/Employment and Training Administration (US-DOL/ETA). Performance levels for these outcomes are negotiated annually at the federal, state and local level. The percentage of program participants who are in education or training activities, or in unsubsidized employment, during the second quarter after exit from the program; The percentage of program participants who are in education or training activities, or in unsubsidized employment, during the fourth quarter after exit from the program; Median earnings of program participants who are in unsubsidized employment during the second quarter after exit from the program; The percentage of program participants who obtain a recognized postsecondary credential, or a secondary school diploma or its recognized equivalent during participation in or within one year after exit from the program; The percentage of program participants who, during a program year, are in an education or training program that leads to a recognized postsecondary credential or employment and who are achieving measurable skill gains toward such a credential or employment; and Effectiveness in serving employers. 11 K. Scoring WIOA Youth Services RFP#192 Applications will be evaluated by a team of reviewers, appointed by the YC of the HC-WIB. An entity s failure to submit a complete proposal or to respond in whole or in part to RFP requirements may cause the scoring committee to deem the proposal non-responsive and thus ineligible for review. It is not a requirement to contract with the entity receiving the highest average score as a result of the proposal review process. Term The contract term will be two years, projected to start in August 1, 2015 and expire on June 30, Note: Although the term of the agreement is for a 2-year period, performance will be evaluated annually. 12 B. Submittal Requirements: 1. Proposals must be received at the HC-WIB office by 5:00 p.m. Pacific Time on June 17, Proposals not received by this time will be automatically disqualified. Electronic copies may be ed, but faxed proposals will not be accepted. 2. Include all of the required attachments that pertain to your proposal. Failure to do so will disqualify your proposal from competition. 3. Print on only one side of the page. 4. Application to include a maximum 28 pages including tables, forms, statement of assurances and checklist, in Addendum 1, Sections I through VIII. Required attachments, such as match fund letters are additional to the 28-page limit, they will not be included in the 28 page count. Use 12-point font and at least 1-inch margins. 5. Appeals Process SECTION V: ADDITIONAL INFORMATION Funding decisions are the sole responsibility of, and are made at the sole discretion of the Humboldt County WIB. Any formal appeal to the WIB's final funding decisions must be based on one or both of the following conditions: 1. The action of the HC-WIB is at variance with the law; and/or Page 10

13 2. The action of the HC-WIB contravenes current WIB or County policy. WIOA Youth Services RFP#192 All appeal requests should initially be directed to Jacqueline Debets, WIB Executive Director. A meeting to discuss the issues will then be scheduled. Should resolution be unattainable, a hearing will be scheduled with legal counsel to hear the merits of the appeal, and make recommendations to the full HC-WIB for consideration. B. Contract Requirements In order to subcontract for WIOA funds, an organization must: (1) Be legally capable of entering into a contract, and be able to provide proof of the ability to administer WIOA programs (i.e., previous experience administering employment and training programs or other related service programs). (2) Provide documentation of current fiscal and compliance audits, as required by law. (3) Provide Articles of Incorporation and evidence of current corporate status, as filed with the Secretary of State, if necessary. (4) Be an Affirmative/Equal Opportunity Employer. If selected for funding, organizations will be required to meet EEO requirements. (5) Ensure that reports and/or documents contain correct information. (6) Comply with requirements for lobbying, debarment and drug-free workplace certification. Each organization selected will be under contract with the County of Humboldt to provide the services and activities indicated in RFP #192. The contract will include specific program specifications, program performance standards, along with a line-item budget and administrative assurances. C. General Requirements Funded service providers must comply with all federal, state and county regulations, directives, policies and procedures pursuant to the WIOA program. Funded service providers must also comply with all Humboldt County contract provisions. D. Type of Contract Contracts will be cost reimbursable with billing required. Contractors are required to provide detailed line item budgets on forms provided by County of Humboldt. All costs reported and final cost statements shall be supported by appropriate accounting documentation, and must be reported on an accrual basis. E. Contractor Responsibilities Agencies awarded contracts to provide services will be responsible for the following: (1) Providing and training qualified staff to plan and administer the program; (2) Providing specified services to eligible youth; (3) Coordinating and tracking management information systems and paperwork associated with WIOA; Page 11

14 (4) Coordinating with HC-WIB administrative staff to ensure that required performance reports and fiscal claims are submitted in entirety and on time; (5) Attend in-service training sessions and regularly scheduled operator meetings; (6) Implementing strategy for effective program evaluation and continuous improvement; (7) Coordinating collaborative partnerships and providing primary administrative oversight related to services offered to youth. F. Insurance Requirements (1) Comprehensive or Commercial General Liability Insurance at least as broad as Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001), in an amount of $1,000,000 per occurrence. If work involves explosive, underground or collapse risks, XCU must be included. If a general aggregate limit is used, either the general aggregate limit shall apply separately to this project or the general aggregate shall be twice the required occurrence limit. Said policy shall contain, or be endorsed with, the following provisions: a. The County, its officers, employees and agents, are covered as additional insured for liability arising out of the operations performed by or on behalf of Contractor. The coverage shall contain no special limitations on the scope of protection afforded to the County, its officers, agents, and employees. b. The policy shall not be canceled or materially reduced in coverage without thirty (30) days prior written notice (10 days for non-payment of the premium) to County by certified mail. c. The inclusion of more than one insured shall not operate to impair the rights of one insured against another insured, and the coverage afforded shall apply as though separate policies had been issued to each insured, but the inclusion of more than one insured shall not operate to increase the limits of the insurer s liability. d. For claims related to this project, the Contractor s insurance is primary coverage to the County, and any insurance or self-insurance programs maintained by the County are excess to Contractor s insurance and will not be called upon to contribute with it. e. Any failure to comply with reporting or other provisions of the parties, including breach of warranties, shall not affect coverage provided to County, its officers, employees, and agents. (2) Automobile liability insurance with coverage at least as broad as Insurance Services Office form CA , Code 1 (any auto), for vehicles used in the performance of this Agreement with minimum coverage of not less than $300,000 per accident combined single limit (CSL). Such policy shall contain or be endorsed with the provision that coverage shall not be cancelled or materially reduced in coverage without thirty (30) days prior written notice (10 days for non-payment of premium) to County by certified mail. (3) Workers Compensation insurance meeting statutory limits of the California Labor Code which policy shall contain or be endorsed to contain a waiver of subrogation against County, its officers, agents, and employees and provide for thirty (30) days Page 12

15 prior written notice in the event of cancellation. If Contractor has no employees, Contractor may sign and file the following certification in lieu of insurance: I am aware of the provisions of the California Labor Code Section 3700 which requires every employer to be insured against liability for workers compensation or to undertake selfinsurance in accordance with the provisions of that code, and I will comply with provisions of that code before commencing with and during the performance of the work of this contract. (4) Contractor shall furnish County with certificates and original endorsements affecting the required coverage prior to execution of this Agreement by County. The endorsements shall be on forms as approved by the County s Risk Manager or County Counsel. Any deductible or self-insured retention over $100,000 shall be disclosed to and approved by County. If Contractor does not keep all required policies in full force and effect, County may, in addition to other remedies under this Agreement, take out the necessary insurance, and Contractor agrees to pay the cost of said insurance. G. Indemnification Contractor agrees to indemnify, defend and save harmless County, its Board of Supervisors, its officers, agents, employees, and volunteers from any and all claims and losses, whatsoever, accruing or resulting from any and all contractors, subcontractors, material men, laborers and any other person, firm or corporation furnishing or supplying work, services, materials, or supplies in connection with the performance of this agreement, and from any and all claims and losses accruing or resulting to any person, firm or corporation who may be injured or damaged resulting from any wrongful acts, errors and omissions, or negligence of Contractor, its agents and employees, pertaining to the performance of this agreement. H. Assignment Any contract resulting from this bid and any amendments or supplements thereto shall not be assignable by the successful bidder either voluntarily or by operation of law, without the written approval of the County, and shall not become an asset in any bankruptcy, receivership or guardianship proceedings. I. Record Keeping Contractor(s) will be expected to maintain complete up-to-date and accurate records and management controls. Individual case files shall be maintained on each WIOA-funded youth which will include, but is not limited to, comprehensive assessment documentation, progress and participation in activities, goals and achievements, comprehensive case notes, referrals made, services received from other providers, outcomes and follow-up information. In addition to collecting data listed above, the Contractor(s) will collect data and documentation on each participant who is: (1) Basic skills deficient (scoring at or below grade level 8.9 in English reading, writing or computing); (2) Is one or more grade levels below the grade level appropriate to the individual s age; and Page 13

16 (3) Has one or more disabilities, including learning disabilities. WIOA Youth Services RFP#192 Contractor(s) will be expected to maintain complete fiscal and accounting records including, but not limited to, backup documentation to the contract budget, demonstration of acceptable accounting methods to disburse costs, and demonstration of the 40% minimum expenditure rate for out-of-school youth. J. Reporting Contractor(s) shall be responsible for submitting accurate management information reports and forms on time and in the manner prescribed by the State and HC-WIB, and will coordinate with the County of Humboldt. Contractor(s) will ensure that fiscal claims are submitted in entirety and the manner prescribed by the County Fiscal Officer. Contractors shall receive reimbursement for costs by submitting monthly cost statements together with a request for payment on a signed copy of the County s white claim form by the tenth day of the following month. Contractor(s) will be responsible for monthly breakout of costs expended on out-ofschool youth to ensure that the 40% minimum funding condition is being met. K. Monitoring The Contractor(s) selected for this program may be visited at any time by representatives of the HC-WIB, Youth Council, County of Humboldt staff, State of California, Department of Labor, or Contractors of these units of government, and others who have a direct concern in administration of WIOA projects. All organization records must be available for inspection. All areas of the project will be subject to examination and could include, but is not limited to, inspection of participants personnel files and applications, and the financial bookkeeping records. WIOA participants may be interviewed to verify eligibility, ensure proper personnel procedures required under the Act are being followed, and to ensure provision of adequate services as prescribed by contract. In addition, monitoring may include interviews with employers, supervisors, instructors, and staff of organizations partnering with the Contractor(s) to ensure provision of agreed upon services. L. Conflict of Interest Consultant warrants and covenants that no official or employee of the County, nor any business entity in which an official of the County has an interest, has been employed or retained to solicit or assist in the procuring of the resulting contract, nor that any such person will be employed in the performance of such contract without immediate divulgence of such fact to the County.
