5 Risk Management, Relationship, and Legal Duty of Care Relationship of Student Organization will most likely determine the legal duty of care as determined by the courts. Relationship should be used to determine the Institution s level of administrative oversight, including policies and procedures. When the relationship is clearly defined between the Institution with student organizations, it sets clear expectations. I.E. Academic organization functioning under academic department, fully supported by the department

6 Legal Duty of Care Failure to protect or supervise students is a common allegation Key issue in litigation is whether the institution has a legal duty to use reasonable care A court must determine that a relationship exists recognized under the law that precipitates a duty of care. This is based on case precedent and can vary from state to state. The more that an institution supervises, regulates, controls, and supports student activities, the more likely it is that a court will decide that a duty of care exists. 12 Risk Management Simulation You are the advisor to a student organization that is attending a summer conference in Dallas. You ve been asked by to identify and analyze potential risks based on the limited information included below: Conference includes students who are minors Your Student Organization received University funds to pay for registration Conference includes males/females/gender non-conforming students Overnight accommodations are paid for by the organization Food and beverages are not covered by the organization or university funding, each student is on their own Conference sessions end at 5pm each day and there is a bar located in the hotel you are staying at Your organization members are using an Enterprise vehicle that was reserved by you as the advisor

13 Use the sample risk control matrix to list potential risks you identify based on the above information. Identify at least 3 risks. Use the risk assessment matrix to identify the risk impact/severity and the risk likelihood for each of the risks. Determine the corresponding risk rating for each risk. For each risk you identified, list any controls you would suggest be implemented to mitigate the identified risk. For each risk that you identified, on the sample risk control matrix, list the owner(s) of the risk. Think about if anything on your risk control matrix would change based on the relationship the organization has with the institution.

14 Plot twist The conference proceeds as scheduled with the controls in place. You get to the conference and find out from a parent of a student attending that they received a message that their female student was coerced into sexual relations with another male student attending the conference. Furthermore, the student reported that another female student walked in on the two. The parent is demanding the student be returned back to the university immediately. What do you do? What are your reporting obligations?
