2 LETTER FROM THE CHAIRMAN Dear Fellow Conservative, The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the Nevada Legislature. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property). Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress. The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for We the People. It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation s founding fathers envisioned. We selected bills that focus on Ronald Reagan s philosophy of the three-legged stool : 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Nevada s elected leaders best defend the principles of a free society: Life, Liberty and Property. 6 NEVADA SENATE VOTE DESCRIPTIONS 1. SB 1 (Special Session) Providing Taxpayer Funding for a Football Stadium. This bill provides $750 million in taxpayer funding for a new football stadium in Las Vegas through bonds backed by a 1.4% increase in the hotel lodging tax. ACU believes issues such as this should go before taxpayers via a ballot referendum and opposes needless government subsidies that put taxpayer money at risk for projects that can be funded through private enterprise and opposed this bill. The Senate passed the bill on October 11, 2016 by a vote of IP 1 Establishing Automatic Voter Registration. This initiative that will be on the ballot in 2018 automatically registers to vote everyone who conducts business at the Department of Motor Vehicles unless they specifically ask not to be registered. ACU opposes measures that weaken ballot integrity and make it easier to commit vote fraud and opposed this initiative. The Senate voted for the initiative on March 13, 2017 by a vote of Although it was vetoed by the governor, under Nevada law it is automatically placed on the ballot. 3. SB 115 Banning Firearms at Public Libraries. This bill bans firearms from being carried on public library property. ACU supports the founders belief in the Second Amendment and opposed this bill. The Senate passed the bill on March 21, 2017 by a vote of SB 173 Mandating Wages for Charter Schools. This bill requires prevailing wage laws to be applied to Achievement School Districts that put poorly performing schools under the management of a charter school. ACU opposes these artificial wage requirements, above the market rate, that increase the cost of construction for taxpayers and opposed this bill. The Senate passed the bill on March 22, 2017 by a vote of 12-8 but it was vetoed by the governor. 5. SB 196 Mandating Employer-Provided Sick Leave. This bill goes against the long standing tradition of private employers setting their own benefits and instead mandates every employer to provide paid sick leave of one hour for every 30 hours worked with any unused time carried over to future years. Employers are allowed to cap the total leave time at 6 days. ACU supports employers freely negotiating these kinds of benefits and opposes employment mandates which lead to increased business costs and reduced hiring and opposed this bill. The Senate passed the bill on April 18, 2017 by a vote of 12-9 but it was vetoed by the governor. 6. SB 140 Reducing Prison Costs and Reforming Sentencing. This bill reduces prison costs by expanding the state s compassionate release program. Under the bill, offenders who are convicted of non-violent crimes, served the majority of their term, and are 65 years or older could be sent to home confinement. Offenders convicted of sex crimes, crimes against children and vehicular homicide would not be eligible for compassionate release. ACU Foundation s Center for Criminal Justice Reform engages heavily on efforts that reduce taxpayer costs by decreasing incarceration rates for non-violent offenders. ACU supports this measure that allows corrections officials to utilize a portion of the savings to more effectively address violent crime and recidivism, thereby improving public safety for everyone, and supported this bill. The Senate passed the bill on April 18, 2017 by a vote of 13-8 but it was vetoed by the governor. 7. SB 384 Reducing Government Pension Transparency. This bill prevents the public from obtaining basic information regarding government employee pensions, including the number of years of service credit and retirement dates. ACU supports more government transparency concerning taxpayer funded pensions, not less, and opposed this bill. The Senate passed the bill on April 21, 2017 by a vote of but it was vetoed by the governor. 8. SB 464 Forcing the Hiring of Union Workers. This bill authorizes the Las Vegas Convention and Visitors Authority to require contractors for the renovation and expansion of the convention center to hire union labor. ACU opposes these government mandates that drive up the cost of projects to the taxpayer and opposed this bill. The Senate passed the bill on April 24, 2017 by a vote of but it was vetoed by the governor. 9. SB 122 Subsidizing Family Planning. This bill provides grants to local governments and abortion providers such as Planned Parenthood to provide family planning services and free contraception products and devices. ACU believes abortion is a human tragedy and opposes subsidies for abortion providers and opposed this bill. The Senate passed the bill on April 25, 2017 by a vote of AB 118 Granting Concealed Carry for Military Members. The current age requirement for the right to carry is age 21. This bill allows members of the military and those who receive an honorable discharge to obtain a concealed carry weapon permit at the age of 18 or older. ACU believes those who are old enough to fight for our country should be given Second Amendment rights and supported this bill. The Senate passed the bill on May 11, 2017 by a vote of
7 11. SB 160 Increasing State Agency Transparency. This bill requires state agencies to post hearing notices on a website three days in advance and requires the publication of the same notice if a second hearing is scheduled. ACU supports increased government transparency and supported this bill. The Senate passed the bill on May 17, 2017 by a vote of AB 271 Mandating Collective Bargaining. This bill mandates allowing employees leave time in order to conduct union activities and stifles the review of decisions made by fact-finders who help decide collective bargaining disputes. ACU opposes government meddling in collective bargaining disputes that give an advantage to union negotiators and opposed this bill. The Senate passed the bill on May 17, 2017 by a vote of 12-9 but it was vetoed by the governor. 13. AB 408 Preserving Obamacare. This bill creates a state health law that includes all the elements of Obamacare even if it is repealed at the federal level, including mandates for hospital stays and other requirements for insurance policies. ACU opposes copying a program that has led to dramatically higher insurance premiums and deductibles and the loss of their doctor for millions of people and opposed this bill. The Senate passed the bill on May 17, 2017 by a vote of 12-9 but it was vetoed by the governor. 14. SB 261 Authorizing Physician Assisted Suicide. This bill authorizes a physician to prescribe a drug that will end the patient s life at the request of an adult patient who has been diagnosed with a terminal condition. ACU opposes assisted suicide laws as they create a class of citizens no longer protected from coercion from medical professionals, insurance companies and heirs and opposed the bill. The Senate passed the bill on May 23, 2017 by a vote of AB 374 Establishing Universal Health Care. This bill in effect expands Medicaid by setting up a new health care option on the state health care exchange in 2019 that copies Medicaid benefits but will have no income requirements. ACU opposes imitating and expanding a program rife with waste and fraud that would impose even more government control over a health care system that has produced skyrocketing costs for taxpayers and opposed this bill. The Senate passed the bill on May 30, 2017 by a vote of 12-9 but it was vetoed by the governor. 16. SJR 6 Hiking the Minimum Wage Via a Constitutional Amendment. This resolution places a constitutional amendment on the ballot in 2020 that almost doubles the minimum wage to $14 an hour over a period of years. Under Nevada law, the bill must be repassed in 2019 to appear on the ballot. An increase in the minimum wage results in higher unemployment. High rates of unemployment hinder family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU believes it is better to bring issues before voters but opposes these artificial wages that hurt those who need help with employment the most, such as students and inexperienced workers and opposed this resolution. The Senate passed the resolution on May 31, 2017 by a vote of SB 392 Expanding Solar Energy Subsidies to Multifamily Dwellings. This bill expands the net metering program to multi-family units, such as apartments and townhomes. Under the bill, utilities will be forced to buy excess energy from community solar gardens, and issue above market rate energy credits to these groups while other ratepayers face higher rates to make up for the utilities loss. ACU opposes this program that results in one set of ratepayers subsidizing others, opposes government favoring one form of energy over another and opposed this bill. The Senate passed the bill on May 31, 2017 by a vote of 17-4 but it was vetoed by the governor. 18. AB 303 Banning Private Prisons. This bill bans the use of privately-run prisons and gives the Department of Corrections five years to place all prisons under government control. This bill ignores the need to relieve overcrowding in state prisons and violates ACU Foundation s Seven Principles of Privatization. ACU opposes this irresponsible mandate, as it would not only put ideology over public safety needs, it would deprive executive branch officials of options that offer flexibility and cost-effectiveness, and opposed this bill. The Senate passed the bill on June 1, 2017 by a vote of 12-8 but it was vetoed by the governor. 19. AB 175 Mandating Employer-Provided Health Benefits. This bill mandates that in order to qualify for the lower minimum wage allowed by the state, employers who offer health benefits must provide employees with a list of specific health benefits. ACU opposes these artificial wages that hurt those who need help with employment the most, such as students and inexperienced workers, and opposes mandated health benefits the employee may or may not need and so opposed this bill. The Senate passed the bill on June 3, 2017 by a vote of 12-9 but it was vetoed by the governor. 7
8 20. SB 555 Expanding School Choice. This bill gives additional funds to the Opportunity Scholarship Program which gives tax credits for donations that help pay private school tuition for low and middle income students. Educational attainment is an important value that yields substantial economic returns for families and for states, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports the expansion of school choice and supported this bill. The Senate passed the bill on June 4, 2017 by a vote of AB 405 Re-Authorizing Solar Energy Subsidies. This bill reverses a 2015 decision by the state Public Utilities Commission to phase out net metering, a harmful subsidy program for solar energy users. Through the program, customers who use renewable sources force utility companies to buy their excess, unused energy, resulting in other customers paying higher rates. ACU opposes this program that results in one set of ratepayers subsidizing others, opposes government favoring one form of energy over another and opposed this bill. The Senate passed the bill on June 4, 2017 by a vote of AB 431 Reducing Craft Beer Regulations. This bill eases restrictions on craft beer brewers, removing the limit of two locations and raising the amount of beer they can produce from 15,000 to 40,000 barrels per year and the amount of retail sales they can make from 2,000 to 5,000 barrels per year. ACU supports a free market in beer sales and supported this bill as a step in the right direction. The Senate passed the bill on June 4, 2017 by a vote of AB 206 Increasing the Renewable Energy Mandate. This bill increases the government mandate, known as the Renewable Portfolio Standard (RPS), to require that 40 percent of the state s electricity be produced from renewable sources by 2030, up from the current standard of 25 percent by ACU supports all forms of energy, believes government should not support one form of energy over another and opposed this bill. The Senate passed the bill on June 5, 2017 by a vote of 12-9 but it was vetoed by the governor. 22. AB 69 Authorizing Testing and Use of Driverless Cars. This bill authorizes the use of autonomous vehicles, known as driverless cars, for commercial use and sets up standards for testing and operating the vehicles. ACU supports the commercialization of new technologies and supported this bill. The Senate passed the bill on June 4, 2017 by a vote of

This resolution places a constitutional amendment on the ballot in 2020 that almost doubles the minimum wage to $14 an hour over a period of years. Under Nevada law, the bill must be repassed in 2019 to appear on the ballot. An increase in the minimum wage results in higher unemployment. High rates of unemployment hinder family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU believes it is better to bring issues before voters but opposes these artificial wages that hurt those who need help with employment the most, such as students and inexperienced workers and opposed this resolution. The resolution passed the Assembly on June 5, 2017 by a vote of SB 555 Expanding School Choice. This bill gives additional funds to the Opportunity Scholarship Program which gives tax credits for donations that help pay private school tuition for low and middle income students. Educational attainment is an important value that yields substantial economic returns for families and for states, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports the expansion of school choice and supported this bill. The Assembly supported the bill on June 5, 2017 by a vote of
13 21. SB 464 Forcing the Hiring of Union Workers. This bill authorizes the Las Vegas Convention and Visitors Authority to require contractors for the renovation and expansion of the convention center to hire union labor. ACU opposes these government mandates that drive up the cost of projects to the taxpayer and opposed this bill. The bill passed the Assembly by a vote of on June 5, 2017 but it was vetoed by the governor. 22. SB 392 Expanding Solar Energy Subsidies to Multifamily Dwellings. This bill expands the net metering program to multi-family units, such as apartments and townhomes. Under the bill, utilities will be forced to buy excess energy from community solar gardens, and issue above market rate energy credits to these groups while other ratepayers face higher rates to make up for the utilities loss. ACU opposes this program that results in one set of ratepayers subsidizing others, opposes government favoring one form of energy over another and opposed this bill. The Assembly passed the bill on June 5, 2017 by a vote of but it was vetoed by the governor. 13
