2 LETTER FROM THE CHAIRMAN Dear Fellow Conservative, The American Conservative Union Foundation is proud to present our ratings of the 2018 meeting of the Arizona State Legislature. Like our Ratings of Congress, which date back 47 years, our state ratings are meant to reflect how elected officials view the role of government in an individual s life. We begin with our philosophy i.e., conservatism is the political philosophy that sovereignty resides in the person, and then apply our understanding of government (its essential role is to defend Life, Liberty and Property). Because our ratings are designed to educate the public about how consistently elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. ACUF state ratings launched in 2011 with ratings for five states have become a nationally recognized resource for evaluating over 8,000 elected officials comprising each of America s 99 state legislative chambers. Each election cycle, citizens choose leaders whose vision for the state most closely matches their own, hoping that candidates promises will be kept. ACUF s ratings measure whether those promises were fulfilled or forsaken. With nearly a decade of data on state legislators voting records and average scores for every legislative chamber, citizens in every state can assess how effectively their lawmakers have applied conservative philosophy to the role of government. We at ACUF believe, as Ronald Reagan once said, that freedom is never more than one generation away from extinction. We hope that by providing this unique tool, these ratings will empower Americans to exercise their right to protect our unique American democracy from tyranny. We selected bills that focus on Ronald Reagan s philosophy of the three-legged stool : 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Arizona s elected leaders best defend the principles of a free society: Life, Liberty and Property. 6 ARIZONA SENATE VOTE DESCRIPTIONS 1. SB 1247 Banning Municipal Mandates on Employer-Provided Health Benefits. This bill prohibits local governments from mandating that private employers provide health insurance benefits and makes clear state health care laws preempt local governments. ACU believes employers and employees should be free to negotiate their own wages and benefits without government interference and supported this bill. The Senate passed the bill on February 5, 2018 by a vote of SB 1467 Expanding School Choice by Reforming Tax Credits and Education Savings Accounts. This bill is designed to expand school choice by modifying the current law governing Student Tuition Organizations (STOs) and Educational Savings Accounts (ESAs). Some key provisions include expanding scholarship eligibility to include homeschool children, expanding scholarships for students with disabilities, and easing the process for families to utilize both ESAs and scholarships provided by STOs. ACU supports expanding school choice and supported this bill. The Senate passed the bill on February 28, 2018 by a vote of SB 1245 Enriching Farmers by Doubling Food Stamps for Locally Grown Products. This bill establishes a new program in which recipients of the Supplemental Nutrition Assistance Program (SNAP) receive a dollar-fordollar match (up to $20 per visit) on locally-grown products purchased from select outlets, including local farmers markets. ACU opposes this expansion of food stamps that is primarily designed to enrich farmers at the expense of taxpayers and opposed this bill. The Senate passed the bill on February 28, 2018 by a vote of HB 2356 Expanding Juvenile Courts Jurisdiction over Juvenile Crimes. This bill allows juvenile courts and correctional facilities to retain jurisdiction over teenagers who committed crimes as juveniles until they turn age 19 (as opposed to age 18). The ACU Foundation s Center for Criminal Justice Reform is a leading voice on this issue and works to reduce the pipeline to prison by ensuring troubled youth are provided necessary treatment and secluded from violent adult criminals and their practices. ACU supports this measure designed to reduce recidivism and improve public safety by providing greater flexibility to the judicial system and supported this bill. The Senate passed the bill on April by a vote of HB 2484 Ensuring Equal Taxation of Food Products and Preventing Taxation of Bags. This bill requires municipalities that impose taxes on food products to do so uniformly, as opposed to targeting select items, such as sugary drinks. In addition, the bill prevents municipalities from placing additional taxes on food manufactures, or on items used to transport food products, such as plastic bags. ACU believes taxes should be imposed as minimally as possible, but believes that when they are they are imposed, they are done so as broadly as possible and without government favoritism, in order to ensure low rates for everyone and supported this bill. The Senate passed the bill on March 14, 2018 by a vote of HB 2460 Preventing State Discrimination against Charter Schools. This bill ensures charter and private schools have an equal chance to purchase vacant and unused buildings from a public school district by preventing the school district from selling a property for an amount less than what is offered by a charter or private school. ACU supports expanding school choice and believes taxpayer-owned property should be sold to the highest bidder and supported this bill. The Senate passed the bill on March 20, 2018 by a vote of HB 2005 Placing Limits on Fines for Violations of the Renewable Energy Standard. This bill limits to $5,000 the maximum fine that can be placed on a utility company for non-compliance with the state s renewable energy standard. The bill is in response to a ballot referendum effort pushed for by California billionaire Tom Steyer s NextGEN America to amend the state constitution to require half of all electricity to come from renewable sources by the year ACU supports all forms of energy, believes government should not favor one form of energy over another, and supported this bill as a protection against the passage of the renewable energy referendum. The Senate passed the bill on March 21, 2018 by a vote of HB 2536 Providing Equal Opportunities to Homeschoolers to Obtain College Coursework Credit. This bill ensures that homeschooled students have the same opportunity as public school students to enroll in dual enrollment programs at community colleges. These programs allow any coursework completed to count as credit toward both high school and college graduation requirements. ACU supports providing equal opportunities to homeschool students and supported this bill. The Senate passed the bill on March 27, 2018 by a vote of
7 9. HB 2153 Protecting Free Speech by Ensuring Nonprofit Donor Privacy. This bill prevents local governments from forcing nonprofit organizations with tax-exempt status to disclose their donors or register as political action committees. ACU supports this measure to prevent donor intimidation and maintain an environment of free speech as protected under the First Amendment and supported this bill. The Senate passed the bill on March 29, 2018 by a vote of HB 2238 Limiting Regulatory Authority of Government Agencies. This bill is designed to limit the regulatory authority of state agencies by overturning the Chevron deference, a legal doctrine that requires a court to defer to an agency s interpretations of the law when an individual or business challenges an administration decision. ACU believes the Supreme Court s Chevron deference decision, one of the all-time worst made by the Supreme Court, is a travesty because it destroys the very protections the Founders established to prevent unelected bureaucrats from encroaching on courts ability to fairly interpret the law. The Senate passed the bill on April 5, 2018 by a vote of HB 2602 Protecting the Right to Mine Cryptocurrencies at Home. This bill prevents municipalities from restricting the ability of an individual to mine cryptocurrencies, such as bitcoin, in a private residence. Mining is a process by which individuals use high-powered computers to solve algorithms that execute cryptocurrency transactions and are rewarded with small fractions of a cryptocurrency. ACU supports the free competition of currency, especially at a time when the Federal Reserve is engaging in dangerous and unprecedented monetary policy and supports the right of individual to freely engage in cryptocurrency mining and supported this bill. The Senate passed the bill on April 5, 2018 by a vote of SB 1394 Strengthening Abortion Reporting Requirements to Help Victims Sexual Assault. This bill is designed to assist abortion patients who are victims of domestic violence, sexual assault or sex trafficking by requiring abortion providers to ask patients if they were victims of any of these forms of coercion, and report the answers to the Department of Health Services, without revealing any patient s name. Patients may to refuse to answer, in which case abortion providers are required to provide victims with contact information for law enforcement and how to access support services. ACU believes abortion is a human tragedy, supports restrictions on the practice and informing patients and supported this bill. The bill passed the Senate on April 11, 2018 by a vote of HB 2563 Protecting Free Speech on College Campuses. This bill directs all public institutions of higher education to adopt free expression policies that protect all student and faculty freedoms to assemble and speak, so long as the activity is lawful and does not substantially disrupt the operation of the institution. The bill also declares that it is not the proper role of an institution to shield anyone from speech protected by the First Amendment and requires disciplinary actions against those who infringe on the rights of others to assemble or speak. ACU supports the freedom of speech and assembly as protected under the First Amendment and supported this bill. The Senate passed the bill on April 19, 2018 by a vote of HB 2235 Reducing Dental Costs by Expanding License Eligibility for Professionals. This bill is designed to reduce costs and expand access to dental care by creating a new license for dental therapists (similar to a nurse practitioner who assists a medical doctor). With the license, dental therapists are able to provide routine dental services including preventative examinations and common dental extractions. ACU supports expanding access to affordable dental care and supported this bill. The Senate passed the bill on April 19, 2018 by a vote of HB 2166 Hiking Motor Vehicle Fees and Circumventing No New Tax Pledges. This bill imposes a fee of $18 on all new motor vehicles which is supposed to be used to fund the Arizona Highway Patrol at 110 percent, but in reality is just a way to channel funds to other unrelated initiatives such as teacher pay increases. Furthermore, the bill is designed to circumvent the no new tax pledge taken by the governor and others by classifying the increase as a fee instead of a tax. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU opposes this violation of the no new tax pledge and budgetary gimmick which is designed to bypass spending cuts and opposed this bill. The Senate passed the bill on April 23, 2018 by a vote of SB 1399 Reducing Licensure Burdens on Aspiring Barbers. This bill permits individuals to become licensed barbers by taking part in apprentice programs approved by the state. Under previous law, an individual could only become a licensed barber if they completed 1,500 hours of education at a licensed school of cosmetology. ACU opposes the proliferation of licensing requirements which are primarily designed to restrict competition and supported this bill as a step in the right direction. The Senate passed the bill on April 26, 2018 by a vote of
8 17. SB 1273 Granting Individuals the Ability to Challenge Overreaching Government Regulations. This bill allows individuals to petition the Governor s Regulatory Review Council (GRRC) if they believe an agency rule or regulation is unduly burdensome or is not necessary to fulfill a public health, safety, or welfare concern. The bill then provides the GRRC the authority to revise or void any unnecessary or unduly burdensome regulation which governs an occupation with an average wage rate of under 200 percent of the federal poverty level. ACU supports this measure to increase oversight and reduce regulatory burdens and supported this bill. The Senate passed the bill on May 2, 2018 by a vote of SB 1398 Reforming Unemployment Insurance to Encourage Employment. This bill helps encourage people to reenter the workforce more quickly by requiring individuals who have received unemployment benefits for four weeks or more to relinquish that benefit unless they accept job offers that pay at least 120 percent of their unemployment benefit. Furthermore, the bill establishes a workforce training program for those receiving benefits to help quicken their return to the workforce. Families and the economy do better when people are employed, benefiting from the dignity of work, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports reasonable reforms of unemployment insurance that promote employment and supported this bill. The Senate passed the bill on May 2, 2018 by a vote of HB 2212 Expanding the List of Peace Officers Allowed to Carry a Weapon at All Times. This bill expands the list of peace officers that cannot be restricted from carrying a firearm at any time to include those employed by local governments, Indian tribes, or are federally certified officers. ACU supports the founders belief in the Second Amendment and supported this bill. The Senate passed the bill on May 2, 2018 by a vote of HB 2532 Placing Restrictions on the Occupational Licensing Practices of Local Governments. This bill requires any local government that imposes an occupational licensing on an occupation to first to hold a public hearing where residents can voice their opinions and prevents any occupational license from being established unless it is necessary to protect the health, safety or welfare of the public. Furthermore, the bill requires that any occupational license that is implemented to terminate after five years, unless it is re-adopted. ACU opposes the proliferation of occupational licenses which are primarily designed to restrict competition and supported this bill. The Senate passed the bill on May 3, 2018 by a vote of HB 2478 Extending the Ability of Pima County to Levy Taxes for Sports Facilities and Events. This bill extends, until the year 2028, the ability of Pima County to establish a district that levies taxes and issue debt accumulating bonds for purposes of funding youth or professional sporting events or facilities. The bill continues the requirement that voters approve the creation of a district, but eliminates a provision preventing the creation of future districts upon voter rejection. ACU does not believe it is the proper role of government to subsidize sport franchises and enrich franchise owners and opposed this bill. The Senate passed the bill on May 3, 2018 by a vote of HB 2371 Protecting Food Truck Operators from Overregulation. This bill protects food truck operators from local governments that impose overly burdensome or anti-competitive regulations on mobile food units. Under the bill, a reasonable framework is established which allows municipalities to regulate issues such as parking and traffic but ensures operators do not need to obtain special permits, insurance, or submit to fingerprinting to operate. ACU supports this effort to expand entrepreneurship by eliminating a patchwork of local ordinances that oftentimes restricted competition and supported this bill. The Senate passed the bill on May 3, 2018 by a vote of

12 ARIZONA HOUSE VOTE DESCRIPTIONS 1. HB 2208 Prohibiting Red Light and Speed Cameras. This bill bans automated cameras for use as traffic enforcement by state and local authorities. ACU opposes these devices that are used primarily to produce revenue and has serious concerns about the ability of these systems to invade privacy by tracking people s movements and supported this bill. The House passed the bill on February 8, 2018 by a vote of HB 2153 Protecting Free Speech by Ensuring Nonprofit Donor Privacy. This bill prevents local governments from forcing nonprofit organizations with tax-exempt status to disclose their donors or register as political action committees. ACU supports this measure to prevent donor intimidation and maintain an environment of free speech as protected under the First Amendment and supported this bill. 13 8. HB 2478 Extending the Ability of Pima County to Levy Taxes for Sports Facilities and Events. This bill extends, until the year 2028, the ability of Pima County to establish a district that levies taxes and issue debtaccumulating bonds for purposes of funding professional or youth sporting events or facilities. The bill continues the requirement that voters approve the creation of a district, but gives lawmakers the new ability to continue proposing new districts, even after voters reject via referendum. ACU is very dubious that taxpayer dollars should ever be used to enrich sports franchises by subsidizing stadiums and opposes this measure that weakens the will of the people by disregarding the results of public referendums and opposed this bill. The House passed the bill on February 21, 2018 by a vote of but it was vetoed by the governor. 9. HB 2484 Ensuring Equal Taxation of Food Products and Preventing Taxation of Bags. This resolution initiates a ballot referendum to overturn a portion of the state s employment law that automatically presumes an employer took a retaliatory action against an employee if any adverse action was taken against an employee within 90 days of that employee using paid sick leave. ACU believes the intent of an employer should be proven, not presumed, and supports this effort to reduce frivolous litigation and supported this resolution. This bill is designed to assist abortion patients who are victims of domestic violence, sexual assault or sex trafficking by requiring abortion providers to ask patients if they were victims of any of these forms of coercion, and report the answers to the state Department of Health Services, without revealing the patient s name. Patients may refuse to answer, in which case abortion providers are required to provide victims with contact information for law enforcement and support services. ACU believes abortion is a human tragedy, supports restrictions on the practice and informing patients and supported this bill. The House passed the bill on April 9, 2018 by a vote of SB 1398 Reforming Unemployment Insurance to Encourage Employment. This bill helps encourage people to reenter the workforce more quickly by requiring individuals who have received unemployment benefits for four weeks or more to relinquish that benefit unless they accept job offers that pay at least 120 percent of their unemployment benefit. Furthermore, the bill establishes a workforce training program for those receiving benefits to help quicken their return to the workforce. Families and the economy do better when people are employed, benefiting from the dignity of work, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports reasonable reforms of unemployment insurance that promote employment and supported this bill. The House passed the bill on April 11, 2018 by a vote of
14 16. SB 1387 Protecting Home Businesses from Overreaching Regulations. This bill prevents local municipalities from imposing overreaching regulations, such as permitting, licensing or rezoning requirements, on businesses operating out of residences. However, the bill does not infringe on the rights of HOAs to restrict homebased businesses. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports eliminating unreasonable regulations to expand entrepreneurship and business growth and supported this bill. The House passed the bill on April 16, 2018 by a vote of HB 2563 Protecting Free Speech on College Campuses. This bill directs all public institutions of higher education to adopt free expression policies that protect the freedom of all students and faculty to assemble and speak, as protected by the First Amendment, so long as the activity does not substantially disrupt the operation of the institution. The bill also declares that it is not the proper role of an institution to shield anyone from lawful speech and requires disciplinary actions against those who infringe on the rights of others to assemble or speak. ACU supports the freedom of speech and assembly and supported this bill. The House passed the bill on April 16, 2018 by a vote of SB 1273 Granting Individuals the Ability to Challenge Overreaching Government Regulations. This bill allows individuals to petition the Governor s Regulatory Review Council (GRRC) if they believe an agency rule or regulation is unduly burdensome or is not necessary to fulfill a public health, safety, or welfare concern. The bill then provides the GRRC the authority to revise or void any unnecessary or unduly burdensome regulation which governs an occupation with an average wage rate of under 200 percent of the federal poverty level. ACU supports this measure to increase oversight and reduce regulatory burdens and supported this bill. The House passed the bill on April 18, 2018 by a vote of SB 1399 Reducing Licensure Burdens on Aspiring Barbers. This bill permits individuals to become licensed barbers by taking part in apprentice programs approved by the state. Under previous law, an individual could only become a licensed barber if they completed 1,500 hours of education at a licensed school of cosmetology. ACU opposes the proliferation of licensing requirements which are primarily designed to restrict competition and supported this bill as a step in the right direction. The House passed the bill on April 19, 2018 by a vote of HB 2532 Placing Restrictions on the Occupational Licensing Practices of Local Governments. This bill requires any local government that imposes an occupational licensing on an occupation to first to hold a public hearing where residents can voice their opinions and prevents any occupational license from being established unless it is necessary to protect the health, safety or welfare of the public. Furthermore, the bill requires that any occupational license that is implemented to terminate after five years, unless it is re-adopted. ACU opposes the proliferation of occupational licenses which are primarily designed to restrict competition and supported this bill. The House passed the bill on April 30, 2018 by a vote of HB 2356 Expanding Juvenile Courts Jurisdiction over Juvenile Crimes. This bill allows juvenile courts and correctional facilities to retain jurisdiction over teenagers who committed crimes as juveniles until they turn age 19 (as opposed to age 18). The ACU Foundation s Center for Criminal Justice Reform is a leading voice on this issue and works to reduce the pipeline to prison by ensuring troubled youth are provided necessary treatment and secluded from violent adult criminals and their practices. ACU supports this measure designed to reduce recidivism and improve public safety by providing greater flexibility to the judicial system and supported this bill. The House passed the bill on April 30, 2018 by a vote of
15 22. HB 2371 Protecting Food Truck Operators from Overregulation. This bill protects food truck operators from local governments that impose overly burdensome or anti-competitive regulations on mobile food units. Under the bill, a reasonable framework is established which allows municipalities to regulate issues such as parking and traffic but ensures operators do not need to obtain special permits, insurance, or submit to fingerprinting to operate. ACU supports this effort to expand entrepreneurship by eliminating a patchwork of local ordinances that oftentimes restricted competition and supported this bill. The House passed the bill on April 30, 2018 by a vote of HB 2235 Reducing Dental Costs by Expanding License Eligibility for Professionals. This bill is designed to weaken the current licensing regime controlling dental care professionals by creating a new license for dental therapists (similar to a nurse practitioner who assists a medical doctor). With the license, dental therapists are able to provide routine dental services including preventative examinations and common dental extractions. ACU supports efforts that to create job opportunities, reduce costs, and expand access to affordable dental care and supported this bill. The House passed the bill on May 3, 2018 by a vote of SB 1245 Enriching Farmers by Doubling Food Stamps for Locally Grown Products. This bill establishes a new program in which recipients of the Supplemental Nutrition Assistance Program (SNAP) receive a dollar-fordollar match (up to $20 per visit) on locally-grown products purchased from select outlets, including local farmers markets. ACU opposes this expansion of food stamps that is primarily designed to enrich farmers at the expense of taxpayers and opposed this bill. The House passed the bill on May 3, 2018 by a vote of
