2 LETTER FROM THE CHAIRMAN Dear Fellow Conservative, The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the Kentucky General House. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property). Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress. The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for We the People. It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation s founding fathers envisioned. We selected bills that focus on Ronald Reagan s philosophy of the three-legged stool : 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Kentucky s elected leaders best defend the principles of a free society: Life, Liberty and Property. 6 KENTUCKY SENATE VOTE DESCRIPTIONS 1. 5 Abortion Restrictions. This bill prohibits an abortion after 20-weeks (5 months) of pregnancy and includes an exception for the life of the mother. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this bill. The Senate passed the bill on January 5, 2017 by a vote of Paycheck Protection. This bill empowers workers to decide whether or not they want to have union dues withheld from their paychecks and requires unions to separately solicit money for their political activities. ACU supports the right of workers to decide how their dues will be paid and where their money should go and supported this bill. The Senate passed the bill on January 5, 2017 by a vote of Right to Work. This bill prohibits requiring employee to join a labor organization or pay dues to a labor organization as a condition of employment. Families and the economy do better when people are employed, especially in private sector jobs, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports the right to work and supported this bill. The Senate passed the bill on January 7, 2017 by a vote of Abortion Education. This bill requires a physician or qualified technician to prepare for a patient an ultrasound of a fetus and provide audio of a fetal heartbeat before an abortion is performed, although the patient can refuse to look or listen to them. ACU believes abortion is a human tragedy, supports restrictions on the practice, and educating patients and supported this bill. The Senate passed the bill on January 7, 2017 by a vote of Prevailing Wage Repeal. This bill eliminates the state s prevailing wage law for state funded projects and prohibits localities from implementing their own prevailing wage law. These laws are based on the federal Davis-Bacon Act and force contractors to pay wages above the market level. ACU opposes the prevailing wage, which drives up the cost taxpayers must pay for construction projects, and supported this bill. The Senate passed the bill on January 7, 2017 by a vote of Religious Freedom and Political Speech. This bill allows students to express their political and religious views in class assignments, and permits religious symbols to be displayed on clothing. In addition, the bill allows for the distribution of religious literature and gives religious and political organization the right to decide their own membership. ACU supports the freedom and protection of religious and political expression and supported this bill. The Senate passed the bill on February 10, 2017 by a vote of Pension Regulations. This bill adds some provisions to a law designed to prevent the manipulation of salaries to increase pension payments. Under the bill, any increase in compensation for an annual year that exceeds 10 over the creditable compensation from a previous year shall not be included in calculating monthly pension benefits. ACU supports reasonable restrictions on pensions to avoid the manipulation of the system and supported this bill. The Senate passed the bill on February 15, 2017 by a vote of Franchise Employee Regulations. This bill establishes that, when applying labor law, neither a person that holds a franchise nor that person s employees are employees of the franchisor. ACU supports this common sense application of labor law in response to the National Labor Relations Board rule overturning decades of precedent in this area and supported this bill. The Senate passed the bill on February 16, 2017 by a vote of Right to Try. This bill allows terminally ill patients to access medicine that has passed Phase 1 safety tests of the Food and Drug Administration s approval process, but has not been approved for sale in the United States. ACU believes it is absurd for government to deny a terminally ill person access to a potentially life-saving drug and supported this bill. The Senate passed the bill on February 21, 2017 by a vote of Health Insurance Mandate. This bill requires all health benefit plans, including private health plans, to provide coverage for smoking cessation programs. Under the bill, a plan cannot place any limitations on the duration of treatment, charge any co-payments or deductibles, set counseling limitations, or establish any utilization management requirements. ACU opposes these mandates that interfere with the free market and drive up the cost of health care for everyone, and opposed this bill. The Senate passed the bill on February 22, 2017 by a vote of Telephone De-regulation. This bill entirely ends the Kentucky Public Service Commission s regulation of phone service in rural areas. Passage of the bill completes the de-regulation process that began in 2015 and has since left less than 15,000 homes under PSC regulation. ACU supports free competition in telephone service and supported this bill. The Senate passed the bill on February 24, 2017 by a vote of
7 Nuclear Power Plant Regulations. This bill repeals a law that effectively banned the construction of nuclear power plants by requiring that plants have a permanent disposal facility for radioactive waste. Under the bill, they are only required to have a plan to manage the waste. ACU supports all forms of energy, believes government should not favor one form of energy over another, and supported this bill. The Senate passed the bill on March 1, 2017 by a vote of Liability Reform for Food Donations. This bill establishes a protection from liability for individuals and non-profit organizations that donate food. Recipients who claim to have been harmed will have to show that the donating entity committed intentional misconduct. ACU supports these good Samaritan laws and supported this bill. The Senate passed the bill on March 3, 2017 by a vote of Expanding the Definition of Hate Crimes. This bill expands the list of hate crimes to include crimes committed against an individual because they are a local, state, or federal peace officer, a firefighter, or emergency medical services personnel. ACU believes this kind of legislation violates the double jeopardy clause of the U.S. Constitution and opposes attempts to determine people s thoughts when they commit a crime and opposed this bill. The Senate passed the bill on March 7, 2017 by a vote of Direct Primary Health Care Agreements. This bill allows direct primary care agreements ( concierge services ) between doctors and patients for a set monthly fee, while still exempting them from the extensive regulations governing health insurance plans. ACU supports a free market in health care and supported this bill. The Senate passed the bill on March 7, 2017 by a vote of Reforming Licensing Requirements. This bill reduces the licensing requirements for barbers and cosmetologists from 1,800 hours of education to 1,500. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU opposes the proliferation of licensing requirements, which are primarily designed to reduce competition, supports this bills effort to reduce exorbitant requirements, and supported this bill as a step in the right direction. The Senate passed the bill on March 8, 2017 by a vote of Alcohol Sale Regulations. This bill eases the regulations governing the sale of alcoholic beverages by establishing a maximum licensing fee for local governments, expanding the hours for sale, and allowing licensed caterers to deliver alcoholic beverages to homes, among other provisions. ACU supports reducing unnecessary regulations on all businesses and supported this bill. The Senate passed the bill on March 8, 2017 by a vote of Restaurant and Bar Regulations. This bill grants restaurants and bars the right to purchase unopened, privately owned bottles of rare liquor. The purpose is to allow rare vintage wines and antique bottles to be brought to the market. ACU believes in common sense regulatory reform and supported this bill. The Senate passed the bill on March 8, 2017 by a vote of Charter Schools. This bill allows local school boards and the mayors of Louisville and Lexington to authorize local public charter schools. The bill requires these schools to meet or exceed state performance standards and states that preference may be given to low-income students, but is not required. ACU supports the expansion of school choice and supported this bill. The Senate passed the bill on March 15, 2017 by a vote of Recreational Therapy Licenses. This bill creates a new bureaucracy to license recreational therapists, defined as those who help people with disabilities find ways to deal with depression through activities including arts and crafts, drama, music, and community outings. ACU opposes the proliferation of license requirements, which are primarily designed to restrict competition, and opposed this bill. The Senate passed the bill on March 30, 2017 by a vote of Golf Cart Deliveries. This bill allows package delivery companies to use golf carts or utility vehicles in residential areas to deliver express envelopes or packages. ACU supports common-sense regulatory reform of laws primarily used to restrict competition and supported this bill. The Senate passed the bill on March 30, 2017 by a vote of Taxpayer Funded Abortion. This bill prevents government funds from being used to pay for abortion services. It also directs government funds away from organizations that provide only family planning services, such as Planned Parenthood, and do not provide other basic health services. The bill gives the highest priority for federal funds to community health clinics and federally qualified health centers rather than clinics that perform abortions. This bill allows home school students to participate in extracurricular activities in public schools as long as they pay any required fee and adhere to the same standards as public school students. This bill eases the regulations governing the sale of alcoholic beverages by establishing a maximum licensing fee for local governments, expanding the hours for sale, and allowing licensed caterers to deliver alcoholic beverages to homes, among other provisions.
